Abstract

Post the first amendment of Religious Courts Bill that provides wider authority toward Religious Courts in investigate and decide Islamic economics disputes has responses, whether support or pessimistic, especially among Religious Court judges themselves. This paper examines the Gorontalo Religious Courts judges response about their authority in resolve Shariah economy disputes. This paper is a qualitative descriptive research and the data was collected using observation, interviews and document reviews. The finding of this study revealed that the Gorontalo Religious Courts judges response well to trust laws in handling disputes Shariah economy. In other words, in principle, they are ready to handle disputes Islamic economics. Readiness, such as: the handling disputes Shariah economy is Religious Courts judges authorities and it is a professional responsibility as a judge; Religious Courts formed a special judge to handle falling out or cases of Shariah economy, and Religious Courts judges provides knowledge of Shariah economy without trainings or workshops.

Abstract

Jama’ati Muslim group of Luwoo and Tenggela villages in Gorontalo regency is one of the groups that routinely remembrance activities in their environment. By using psychological, this paper will attempt to explore the existence and the implementation of remembrance "Jama'ati" performed occasionally in which the congregation can help in reducing symptoms of anxiety psychosis, so the remembrance that there has been a therapeutic means for the congregation whom face depressive problem . Recitation (zikir) is done routinely will greatly assist in the process of forming the character of their souls. Recitation is one way to obtain spiritual concentration. For those who follow this zikir routinely can implement it in a variety of methods.

Abstract

This article aims to describe the Abu Hamid Muhammad Al-Ghazali’s Logic that includes: (1) to describe objectively the Abu Hamid Muhammad Al-Ghazali’s Logic of science essense, science classification, and urgency of logic in science development; (2) to describe the Abu Hamid Muhammad Al-Ghazali’s logic as a tool to get valid knowledge. (3) to describe philosophical thingking af Al-Ghazali in logical aspect. It includes many forms of thingking such as deduction, induction and analogy. It is also in connection with inference process (the final process in logic); (4) to study critically and heuristically relevance of Al-Ghazali’s logic to science development especially in Islamic science.

Abstract

This paper describes why Indonesian Muslims are polarized in a different understanding of the shari'a law. Recently, brotherhood and unity among Muslims considered still hazardous and agonizing. Despite the fact that the difference among the Muslims is about the matters of furu'iah; yet, its implication becomes widening and reaching other significant aspects such as determination of various legal provisions concerning the dimensions of faith, worship, and social life. In order to increase awareness and development of Muslim brotherhood, there have to be concern on maintaining condition ukhuwah cultures, patience, inclusiveness, and acknowledgement of the truth. Muslims also are supposed to not impose a uniformity that does not or has not received by other parties, and endorse similarities that exist of any differences.

Abstract

“Nur Muhammad” is a popular concept in the discourse of Sufism falsafati. In Gorontalo, texts of Muhammad Nur iw widely known. The texts, as the author of the findings gathered in a collection of manuscripts under the theme "Isra’ Mi’raj". Because it is a manuscript on Nur Muhammad is a commonly red each month of Rajab, exactly 27 Rajab regarding event-Isra Mi'raj. This paper shows that the manuscript Gorontalo Nur Muhammad is not the original work of local scholars Gorontalo, but it is a re-adaptation and copy the text of Nur Muhammad Classical Malay. This assumption is based on text analysis, and comparison with historical texts (manuscripts) others, as well as socio-cultural analysis of the Muslim community that mentradisikan Gorontalo reading the manuscripts on Islamic day events.

Abstract

Cultural diversity that exists in Indonesia is one potential that must be developed and preserved throughout the cultures as long as they not incompatible with the moral values of Islam. In fact, this diversity provides vibrant colors varying as a tradition that characterizes respective tribes and ethnics. In the culture of the Bugis, one of the cultural or ritual that is routinely performed each year in agricultural activities (harvest) is mappadendang, attended by all farmers. This ritual is performed as a form of joy and gratitude on the Creator, for abundant agricultural crops. In addition to the form of joy, the mappadendang ritual also intended to preserve the cultural heritage of their ancestors. Mappadendang in Pinrang itself coins philosophical and religious values which are very high and are a means to strengthening the unity and integrity. The importance of cooperation within the traditional mappadendang ritual includes carrying values of the Islamic economic system, such as, to work earnestly for seeking halal earnings, to form solid society with solid social order, justice, income distribution, eradicating the monopoly, individual freedom in order to obtain social welfare.

Abstract

This article intends to analyse the impacts of direct elections to the community life. The impacts, in this study, are particularly on political, social, and economic sectors. This research conducted in Palu, Donggala Regency, and Parigi Mautong Regency. The findings of this study were obtained from qualitative research, which the data obtained through qualitative enquiries such as Focus Group Discussion (FGD) which involved some parties who understood, comprehended, and organised the election; in-depth interview to informants, distribute a questionnaire to 162 respondents; do a literature study, and documentary reports. The result of this study shows that the processes of election impact positively to the social and political life of the community but not the economical. Equally important finding is that there are several negative impacts throughout the implementation process of the local elections.

Abstract

This paper aims to find out the impact and implications of power in the implementation of local autonomy in Indonesia. This study analyzes the constitutional and electoral changes as a form of good governance principle. The results of the study show that the implications and impacts of direct election in direct elections give the nuances of violating the constitution frequently. Similarly, the tendency to interpret the rules according to the will of the regional authorities. So that impact on the emergence of horizontal conflict society. Similarly, a growing number of interest conflicts arise, also giving extra work of the Constitutional Court (MK) to confirm to the constitution. This is exacerbated by the political elite who make politics as a means to seize power so often the political substance deviated from its true value. And this study shows that the election results are not optimal and make local leaders show behavior that is not pro-society with the growth of corruption. This article suggests a serious effort to address it by providing character education for local leaders with a nuanced sense of religious value and local wisdom.

Abstract

This study aims at analyzing the relationship between Riau provincial governments and Riau Malay Customary Law (LAM Riau) using Jaspers’ theory of existence. The data of this study are qualitative ones using the sociological law as the approach. Riau Malay customary law is the norm regulates the manner of behavior of the Malay people. Riau Malay customary law is a law-based-community. It means, the law is conserved and raised its existence jointly. The local governments have a very important role in maintaining its existence. Local governments (executive and legislative) and customary institution are defined as state organizers.

Abstract

In Indonesia, decentralisation has emerged in the name of democratisation over the last decades. Decentralisation, politically, has significantly shaped the relationship between the central and local governments. Therefore, many have believed that the decentralisation is equivalent to the democratisation process. In this article, we attempt to answer these questions: (1) is the decentralisation compatible with consolidated democratisation in Indonesia? (2) How is “the rule by people” implemented for the sake of democracy; in other words, how local people fill these spaces? In this article, we argue that there has been a connection between democratisation process and decentralisation. However, the relationship seems to be superficial.
