Abstract

The Covid-19 pandemic has a serious impact on many countries in the world, one is Indonesia. The misuse and distribution of narcotics in Indonesia has become a serious and worrying problem. Narcotics are a real threat and the eradication still requires serious handling, especially during the current Covid-19 pandemic. The implementation of massive remissions during a pandemic era like today has a lot of controversy. The legal issues that will be discussed in this paper are the controversy over granting remissions during the Covid-19 pandemic and how is the implementation of remissions to narcotics criminals during the pandemic? The research method used normative juridical research method which related to the provisions of normative law that apply in society. The results of this study show that the provision of large-scale remissions during the COVID-19 pandemic as today is controversy. This is because remission has an impact on perpetrators of abusing narcotics again. However, if remissions are not given to the prisoners, the inhabited prison will be overcapacity. This overcapacity will have an impact on ineffective services and empowerment in its implementation. This is part of a form of community-based punishment or social reintegration, namely the return of prisoners to the community, because for prisoners who get remission, it does not mean that they get a reduced sentence, but they serve the rest of their sentence outside prison. Abstract

Improper criminal imposition can ignore child protection arrangements, because child punishment should be the last resort or the last resort principle and imposed only for a short time. The method used in this research is empirical legal research. Empirical legal research is legal research conducted by examining primary data, namely data obtained directly from the community. As for the results of the Guidance Program for Correctional Students at the Class II Maros Special Child Guidance Institute, there are still some shortcomings such as the absence of a legal awareness program and the provision of formal education which indirectly affects the non-fulfillment of the rights of correctional students, especially because there are still adult prisoners who should be separated from children. The actual role of the officers of the Child Special Guidance Institution in its implementation is still not optimal due to the lack of quality and human resources, and there is no special coach for children. Abstract

The conflict that occurred in Wadas Village shows that the government uses a power approach and repressive measures. This is in line with the perspective of legal positivism. Therefore, legal positivism has been judged to be incompatible with legal developments in Indonesia, giving rise to new perspectives, one of which is prophetic law. The purpose of the reaserch was to determine the extent of the transformation of professional law contained in Pancasila and to find out in the development of law in Indonesia by looking at the cases that occurred in Wadas Village. This research used narrative qualitative type, in the form of stories, events, written and unwritten documents. The results of the study show that the essence of prophetic law is to make religious values an important part in building civilization. Prophetic law refers to the will of Allah SWT which was revealed through the Prophets and Rasul, the Mualim and Aulia who are always istiqomah and hold fast to the ilahiyah line or sunnatullah. The prophetic legal foundation in Pancasila, Pancasila is the objectification of Islam in Indonesia. This means that Islam is its objective form in the crystallization of Pancasila thought. In the context of the Wadas Village conflict, the government uses a professional paradigm that prioritizes the interests of the community and uses a persuasive approach that leads to common interests, in order to know the will of the residents with the aim of making joint decisions without the interests of the Wadas Village residents.

Abstract

This article examines the phenomenon of re-voting and recounting of ballots. Re-voting and recounting ballots is likened to an unpredictable stage of the electoral process because on particular districts, besides that with the devotees not all doing this. Re-voting and recounting ballots will add or even repeat either part or possibly all of the work that has been done by the Electoral Commission. Re-voting and recounting ballots could be due to constitutional court rulings, recommendation of bawaslu, and the state of force majeure. This will have an impact on budget addition, logistical willingness, voter attendance, longer conflicts and the integrity and professionalism of the Electoral Commission at stake. If the re-vote and the recount of the ballots are included in the stages of the election process and determined the date will result if the Constitutional Court decides outside the schedule of the process stages then it is feared that the date is not in accordance with the stages, Meanwhile, if the re-vote and recount of ballots do not become mandatory stages in the election, it is feared that with the simultaneous elections in 2024 the impact that occurs cannot be anticipated properly by the Election Commission. Abstract

This article aims to examine the urgency and the probability of regulating the Ombudsman in the constitution, as an effort to strengthen the supervision of public services in Indonesia. This article finds that the existence of an Ombudsman is important to oversee excellent public services, as this is part of Human Rights. However, the supervision of the Ombudsman in Indonesia is not strong enough to guarantee a truly complete public service. By using the doctrinal normative juridical research method in collaboration with the Reform Oriented Research method, the statutory, conceptual, and case approach, this article finds that in addition to the executive, judicial, and legislative institutions, there is a fourth branch of power that accommodates the existence of independent state institutions such as the Ombudsman. After trying to compare the Ombudsman regulations in South Africa and Thailand, this article offers to legitimize the Ombudsman philosophically and politically in the constitution, as a form of guarantee for the implementation of excellent public services. Abstract

Pengesahan Undang-Undang Tindak Pidana Kekerasan seksual (UU TPKS) merupakan momentum bagi negara untuk hadir sebagai garda terdepan dalam melindungi korban kejahatan kekerasan seksual. Pengesahan undang-undang ini adalah tonggak dimulainya peradaban baru untuk mencegah berbagai macam bentuk kekerasan seksual yang sudah darurat. Penelitian ini bertujuan untuk mengetahui penerapan perlindungan hukum terhadap korban kekerasan seksual dan melihat sejauh mana efektivitas penegakan hukum pasca pengesahan undang-undang kekerasan seksual terbaru. Penelitian yang digunakan adalah penelitian lapangan (field research) dengan jenis penelitian kualitatif (qualitative method) yang menggunakan pendekatan interdisipliner, yaitu pendekatan yuridis dan sosioligis terhadap data primer dan data sekunder. Hasil penelitian menunjukkan bahwa Kekerasan seksual terhadap perempuan dan anak masih menjadi masalah utama di masyarakat. Kasus kekerasan seksual khususnya yang terjadi pada anak di Kota Makassar cukup besar sepanjang 2021. Dinas Pemberdayaan Perempuan dan Perlindungan Anak (DPPPA) Kota Makassar mencatat ada sebanyak 302 kasus. Jumlah kasus tersebut mengalami peningkatan dibandingkan tahun sebelumnya pada tahun 2020, yakni 52 kasus. Meski pada tahun 2019, jumlah kasus pernah mencapai 127 kasus. Olehnya itu, salah satu upaya yang dapat dilakukan untuk menekan kasus tersebut yaitu dengan melakukan pengawasan ekstra dan melibatkan peran serta seluruh lapisan masyarakat. Selain itu, Untuk mengoptimalkan pencegahan dan penanganan kasus kekerasan seksual, UU TPKS yang disahkan DPR mengatur sembilan jenis TPKS yang diatur secara rinci dalam Pasal 4 ayat 1 UU TPKS, yakni : Pelecehan seksual nonfisik, Pelecehan seksual fisik, Pemaksaan kontrasepsi, Pemaksaan sterilisasi, Pemaksaan perkawinan, Penyiksaan seksual, Eksploitasi seksual, Perbudakan seksual, dan kekerasan seksual berbasis elektronik . Diharapkan dengan adanya pengaturan ini, penegakan tindak pidana kekerasan seksual akan semakin efektif dan aparat penegak hukum semakin profesional dalam memperhatikan korban.
