Abstract

Astronomy is a science which deals with the subject of at least four aspects related to worship i.e. the qibla, prayer time, the beginning of the months of Qamariah, and eclipses, both sun and moon. Each of the four subjects has legal foundations that have been discussed by the scholars. This article will discuss about qibla in the perspective madzhab. What is qibla has been debated among madzhab’s expert, which raises two major opinions. The opinions are whether the qibla is the physical building of the Kaaba or whether it is the direction of the Kaaba building. This is because there are two Hadith which in dzahir looks different which cause such differences.Keywords: qibla, madzhab, different, opinion.

Abstract

Among people stands prayer schedule. This prayer schedule used as a guide in the implementation of praying five times a day. The prayer schedule among astronomers is usually referred to eternal prayer schedule, or prayer schedule of all time. On the schedule there are usually local corrections. This paper will study further on issues of local corrections. Prayer schedule is accurate if it is the result of calculation based on local corrections.Keywords: prayer schedule, local corrections

Abstract

This study discusses the question of determining the Islamic calendar that has become dilemma among Muslims and causes endless disputes. In response to this, the practitioners of astronomy attempt to unify the dispute by trying to make the world dating guidelines. This step is one of Muslims’ efforts to respond the never ending disagreement. So the author felt it is important to examine the International Islamic calendar as a concrete step in achieving similarity and equality of International Islamic calendar.In this study, the author uses library research by using secondary and descriptive data. Data analysis technique is historical normative qualitative analysis. This has the reason that the observation of astronomical theories, especially the Islamic calendar needs to be observed through history since classical Islamic era until modern Islamic era, the era of classical Islam is observed through texts while modern Islamic era is observed by experiment so it can be found astronomically accurate research results.Keywords: Islamic calendar, classical Islam, modern Islam.

Abstract

Fiqh has always been an important aspect in the live of Muslims. In the beginning of Islam, Muslim did not face problems as experienced by the later generations of Muslims therefore Muslims need to develop fiqh in accordance with  the  current  situation. In this case, philosophy may provide a new perspective in the development of fiqh. Abstract

Fiqh compiled by Imam Abu Hanifa is clear and genuine about social equality. Imam Abu Hanifa was known as a Ra’yi scholar. Although he stayed in Mecca and learned hadiths, as well as other sciences from the characters he encountered, but the experience he gained from around Kufa enriching his collection of Hadith, and his methodology of fiqh reflects the school of Ahli Ra’yi that he learned. If he did not find explicit provision of legal issues from the Qur’an and Sunnah, he explored it from the words of the Companions in the form of ijma ‘or fatwa. If all three did not stated explicitly about the issues, then he searched through qiyas and istihsan, or looked at the traditions that developed in the community. He used ijtihad and reason, as well as how to use reason to compare opinions and to choose the most powerful opinion.Keywords: Fiqih, Ijtihad, Ahli Ra’yi, Madzhab

Abstract

Fazlur Rahman’s thought of constitutional law emphasises on certain issues:  First,  Islamic  countries  should  form  a  democratic  Islamic state. Head of State is directly elected by the people. Head of State is responsible to the people through parliament whose members are also elected by people directly. Second, relationship between Islam and the state is very close, because the foundation of the state and the system of law should come from the sources of Islam, namely the Qur’an and the Hadith. If government is violating Islamic value it is no longer credible and should be dismissed. Third, the concept of the Islamic state is debatable therefore Fazlur Rahman choses the concept of an Islamic democratic state. The head of state is elected directly by the people and the president as head of state responsible to the people through parliament. Fourth, there are many problems in the establishment of an Islamic state. According to Rahman, the establishment of an Islamic state is accomplished through a long struggle, such as the establishment of the Islamic state of Pakistan. It is started with the commitment of Muslims to carry out God’s command. The establishment of an Islamic state aims for safety and sovereignty of the country. Fifth, concerning the issue of the duty and authority of the head of state, according to Fazlur Rahman the head of state in charge of leading the government, in carrying out its duties and powers shall be in accordance with the interests of all the people.Key words: Thought, Law and State.

Abstract

In essence, marriage is a religious order that is governed by Islamic law and is the only authoritative sexual relations in Islam. As rahmatan lil ‘alamin, Islam has determined that the only way to meet the biological needs of individuals living just by marriage, marriage is one thing that is very interesting if we look more closely at the content of the meaning of this marriage problem. The Qur’an has explained that among the purpose of marriage is to find peace in one’s life both for men and women (litaskunu ilaiha). Islam ordained marriage as a vehicle of family to achieve happiness in life. Therefore, in this article, the author explores the notion of marriage, the legal basis, as well as the terms and harmonious marriage’s wisdom that prescribed.Keywords: marriage, Saqinah, law and Islam

Abstract

Interest of become civil servants (PNS) are always great, especially for young scholars living in the village. This is caused by the embarrassment of living in the village due to limited access to economic resources. Thus becoming civil servant comes across their mind and they are competing for the seats. For those who are not able to compete, they are willing to become a temporary employee in the office. The numbers of temporary employee endanger national stability because the process of recruitment neglects the ability of local cash or units of work in salary. This was addressed by the government with the enactment of Law No. 5 of 2014 on Civil Administrative State (ASN). The bill states that the appointment of civil servants should be rely on future service work.Keywords: servant, temporary employee, and dynamics

Abstract

Usually,  in  determining  the  beginning  of  the  Ramadan  and  Shawwal in every year in Indonesia there are always differences that arise due to differences in understanding the fundamental principles that cause by differences understanding of dzahir nash, there is a reference to the opinion on the basis of estimating wujudul Hilal (the moon is exactly on ufuq) and there is also a reference to the opinion of rukyatul hilal (moon is above ufuq with the provisions of Imkanu ar-rukyah), both of the methods in determining the beginning of Ramadan and Shawwal are applied every year in Indonesia. When the results of ijtihad fall on the same day, it does not cause problems in the community, but when the results fall on different days, recognized or not, it certainly can cause problems among the people, especially the ordinary people, at least a little bit of confusion, so they have to wait for government’s decision, in this case the Ministry of Religious Affairs.Keywords: Wujudul Hilal, Ru’yatul Hilal and determination of the beginning of Qamariyah month
