Abstract

Berbicara soal budaya, memang sangat unik dan menarik; unik karena membahas satu kesatuan yang integral dalam suatu masyarakat, akan tetapi selalu ada kekhasan didalamnya, yang itu membedakan antara lokus yang satu dengan yang lain. Menarik karena bahasan budaya selalu memantik para ilmuwan untuk selalu mendalami budaya secara detail yang terkait dengan cita rasa dan kompleksitas masyarakat. Ada hal yang menarik terkait dengan Budaya buka meja yang dilakukan secara kontinyu di masyarakat Desa Cikeusal, Ketanggungan, Brebes. Pemilihan Desa Cikeusal, karena tradisi di Desa ini unik, berbeda dengan Desa-Desa pada umumnya di Kecamata Ketanggungan, Desa Cikeusal mengunakan bahasa sunda, padahal sekitarnya berbahasa Jawa, juga dengan tradisi perbatasan Sunda-Jawa. Ada relasi yang tidak imbang antara perempuan dan laki-laki dalam tradisi buka meja. Laki-laki menjadi subjek "yang berkuasa" atas perempuan

Abstract

Fiqh has always been an important aspect in the live of Muslims. In the beginning of Islam, Muslim did not face problems as experienced by the later generations of Muslims therefore Muslims need to develop fiqh in accordance with  the  current  situation. In this case, philosophy may provide a new perspective in the development of fiqh. This article discusses about historical development of fiqh and how philosophy contributes to it.Keywords: fiqh, philosophy, development

Abstract

Indonesia has a diversity of religions and cultures, so far many people are still discriminated against because they are different from the state's recognized religion. In Kudus Regency, the Sedulur Sikep community as adherents of Adam's religion could not register their marriage, thus facing population administration problems. This service-based research explains how to strive for them to gain access to public services, social acceptance, and policy changes so that they are not discriminated against again. By connecting perspectives on civil and political rights as well as economic, social and cultural. The results show that the root of the problem which afflicts the victim can be spelled out in this column, namely the administrative system of population causes humiliation on the basis of the belief in participation that impacts on exclusion and other exclusions. To overcome this problem, efforts and strategies that are commonly made are changes at the internal level, empowerment, recognition and acceptance.

Abstract

El Fadl parse some CRLO fatwa that is considered controversial and not oriented to benefit. Among the controversial fatwa is considered Case On Bra, high heeled shoes and Marriage Covenant, slander arising from Bury Pilgrimage Practices for Women, Devil In Cars and Danger Woman Traveling Without Mahram on prostration husband and wife as a submission to the husband.At least , to find out the methodological framework of thought El Fadl can be observed from some analysis tehadap contemporary theme of Islamic world. El Fadl, tried to analyze the sociological aspects of women’s lives in Saudi and the things that cause them to have less decent position in society . Sociological and political aspects in Arabic which causes them to have less decent position in society .Here then it can be stated that, El Fadl seeks to reposition religion critically, rationally and liberal, reconstruct Islamic heritage by giving new interpretations. For indeed, Muslims have the culture and traditions ( Turath ) nice and steady.

Abstract

Abstrak Evolusi konsep fiqh yang masih sering dipermasalahkan adalah tentang “fiqh perempuan”. Selama ini, product fiqh dianggap diskriminatif, tidak menghargai hak-hak perempuan bahkan terkesan melecehkan perempuan, ayat-ayat tentang waris, kesaksian dan wali banyak disinyalir hanya mengunggulkan kaum laki-laki. Dari segala lini kehidupan, proses metamorfosis fiqh mulai terasa, terlebih di abad modern sekarang ini. Dengan pesatnya ilmu pengetahuan dan teknologi maka isu-isu persamaan hak, kebebasan, keadilan gender dan lain-lain terus menggejala di berbagai belahan dunia. Pemikiran Khaled Abou el Fadl telah melihat mekanisme perumusan dan pengambilan keputusan fatwa-fatwa yang dikeluarkan baik oleh pribadi-pribadi, tokoh-tokoh masyarakat dan lebih-lebih lembaga-lembagaa dan organisasi keagamaan pada umumnya. Salah satu kritik Khaled Abou el Fadl tentang fiqh perempuan adalah kritik dari fatwa yang dikeluarkan oleh CRLO yang cenderung mendiskriminasikan perempuan dalam berbagai aktivitas kehidupannya. Dalam konteks tersebut, pada dasarnya hal yang terpenting untuk dipahami dalam hermeneutik adalah bagaimana sesungguhnya hubungang teks (text) atau nash, penulis atau pengarang (author) dan pembaca (reader) dalam dinamika pergumulan pemikiran hukum Islam. Dengan demikian hal yang diperlukan adalah fiqh yang humanis dan tidak diskriminatif terhadap perempuan.Kata kunci: Hermeneutika, fiqh, perempuan  AbstractThe evolution of fiqh concept which still questionable is about “women fiqh”. During this time, fiqh product is considered discriminative, not respect to the women rights and even impressed harassed the women, verses about inheritance, testimony and trustee many allegedly only favor the men. By from all life aspects, the process of fiqh metamorphosis begin to feel, especially in modern century. By the rapid development of science and technology, issues of equality, freedom, justice, gender and etc keeps implicated in various parts of the world. Khaled Abou el Fadl’s thought has seen the formulation mechanism and decision making of the (fatwa2) issued by personal, public figures, and even religius foundation and institutions in general. One of  Khaled Abou el Fadls critics about the women fiqh is a critic from (fatwa) issued by CRLO that tend to discriminate the women in their various life activities. In that context, basically the most important thing to understand in hermeneutics is how the written text (text) or script, the writer or authors and the readers in dynamics of the struggle of Islamic legal thought. Abstract

This study basically discusses the narration map of Islamism, pattern of its dissemination, acceptance of its narration, and the facilitating factors of the growth of Islamism in Central Java. It is the fact that in the last few years the understanding of Islamism tends to the extremism, radicalism and terrorism. This is an ethnographic study in which it tries to understand the life of individual as part of the community in the wider context. Subjects of this research are; (1) youth; and (2) public figures. Findings of this research are; firstly, although Central Java is well-known as the home ground of radical-terrorism movement, people in this province are actively involved in countering narration of Islamism. Secondly, pesantren (Islamic boarding school), mosques, and religious scholars are elements that play as the front guard of anti-radicalism, extremism and terrorism in Central Java. Thirdly, the youth plays as an important element in articulating of Islamism. This social group is the most vulnerable group who might be influenced by Islamism specifically related to radicalism and extremism

Abstract

This study aims to reveal the legal excavations that allow abortion of a fetus with defects with mursalah maslahah. Basically, fetal abortion is forbidden, but because the times have brought us to a condition where we can see the condition of the fetus in the womb, under certain conditions, abortion is permissible. This research is a qualitative research study of literature using descriptive analysis of content analysis (content analysis). In this study, it was shown that the permissible abortion of a fetus with defects in the perspective of maslahah mursalah had fulfilled three conditions, namely; are in accordance with the objectives of the Shari'ah, are rational and definite, for the public interest. As well as in the use of maslahah mursalah as an istimbat al-ahkam method, it can be used when problems are not found or resolved in the texts, the opinion of the Medina experts, ijma' friends, Qiyas, istihsan then after that maslahah mursalah is used which in the case of abortion of a deformed fetus has fulfilled all aspects and produce a law that allows abortion of a defective fetus if the spirit has not yet been breathed into the fetus.

Abstract

Ijabah savings is one of the term savings products at KSPPS Tamzis Bina Utama Purbalingga Branch. Many people around Purbalingga who conduct ijabah savings transactions without knowing the details of the contract used in it, people only know the extent of saving money for some time and getting benefits from these deposits. The purpose of this study is to describe the management practice of ijabah savings at KSPPS Tamzis Bina Utama Purbalingga Branch and to know the Islamic law review of ijabah savings at KSPPS Tamzis Bina Utama Purbalingga Branch. The data collection process is carried out by: Observation, Interview, Documentation. This research uses field research (Field Research) with a qualitative approach. The results of this study indicate that the Ijabah Saving Management Practice by KSPPS Tamzis Bina Utama Purbalingga Branch must first become a member at KSPPS, open a Pearl account then a new Ijabah Saving account with a mudharabah muthlaqah contract. In the management process between KSPPS and members are mutually beneficial. In Islamic law, the contract used in ijabah savings is mudharabah muthlaqah, this contract is permitted and is in accordance with the verses of the Qur'an, hadith, the views of the scholars and also DSN fatwa Number 03/DSN-MUI/IV/2000 concerning deposits and Number 115/DSN-MUI/IX/2017 concerning mudharabah contracts.
