Abstract

This paper focus on the Culture-Led Development (CLD) role on the exploration of industrial and personal heritage management that encourages the development of SMEs as it has been implemented in Indonesia and Brunei Darussalam. This qualitative research with an antrophology approach was conducted with semi-structured interviews beside the observation and documentation involving 13 SMEs entrepreneurs, who have produced traditional or handicraft items, in 2018. The empirical data was used to illustrate the implementation of culture in business development. The term heritage has been identical with the sustainability of SMEs. The CLD helps change the entrepreneurs' way of thinking as it promotes innovative products that are environmentally friendly and are able to elevate cultural values and tradition. Abstract

This article aims to explain the perceptions and behavior of Moslem scholars (ulama/kiai) on the coast of Central Java toward Islamic banks. It is unassailable that finding out the kiai’s perception and behavior toward Islamic banks becomes unavoidable because the kiai occupies a very important position in the social structure as an agent of social change. In order to have an approriate understanding toward the perception and behavior, this study used qualitative-phenomenological approach. The main source of primary data were obtained from the kiai in Pekalongan region by using purposive sampling technique. Indepth-interview as the prominent method in gaining data was reinforced by observation method. To get validity of data, internal and external validity were performed. The former was taken through four stages, namely triangulation, emic process, member checking and prolonged time; and the latter through transferability. Data were analyzed inductively through three cronological steps, e.i. data reduction, display and conclusion drawing. Based on the perceptions and behavior of scholars toward Islamic banks, this study concludes that there are three categories of kiai. The first is an idealist compromise (kompromis-idealis) which argues that Islamic banks do not fully comply with sharia compliance yet, the use of Islamic banks is compulsory and conventional banks are not substitutes for Islamic banks. The second is a realistic compromise (kompromis realistis) which infers that Islamic banks are not fully accordance with sharia commpliance, the use of Islamic banks is not mandatory, but conventional banks are not substitutes for Islamic banks. The third is resistance (resisten) which argues that Islamic banks are not much different from conventional banks, so making use of Islamic bank is not obligation, and conventional banks substitute Islamic banks.

Abstract

This research was aimed to explore the economic freedom vis a vis government intervention according to Ibn Khaldun. To answer this question, researcher studied al-Muqaddimah of Ibn Khaldun. The ideas of Ibn Khaldun in his al-Muqaddimah were analized by using content analysis. Beside that, I also used Karl Mannheim’s sociology of knowledge approach to analyze his ideas. The result revealed that Ibn Khaldun emphasized the economic activities had to be free from the restrictive power of the government. The economic freedom, however, had not to be free from rule of game. It had to be under the control of the rule of game, and to do that the role of government was very necessary. Based on Karl Mannheim’s sociology of knowledge, Ibn Khaldun ideas were influenced by social knowledge determination in his life and he also used his perspective as Moslem to explore his ideas. It could be said that there was so strong relation between Ibn Khaldun ideas and the social reality in his life. Thus, his knowledge type was ideological, not utopian.

Abstract

This study aims to describe the empowerment of MSMEs in the digital era based on the utilization of social funds by Islamic banks through financial technology platforms. This research is qualitative research with a type of literature research. This study uses secondary data sourced from books, scientific journals, mass media news, as well as sources from the internet which are considered credible and of both national and international standards and are relevant to the matter being studied. Apart from that, to support this research, primary data sources were also used which came from the results of interviews which were studied further through focus group discussion (FGD) activities. The results of the study show that Indonesia is a country with a large potential for MSMEs. The main problem faced in empowering MSMEs is limited access to financing because many MSMEs are not yet bankable. On the other hand, Indonesia also has alternative potential for MSME financing through the utilization of Islamic bank social funds consisting of zakat companies and corporate social responsibility (CSR). In the digital era, this financing can be channeled through financial technology platforms. To be more competitive, the benefits of MSME beneficiaries are not only access to financing but also business empowerment outside of financing aspects such as training and so on provided by the MSME Center which is owned/formed by the financial technology platform.

Abstract

This study aims to analyze the effectiveness of the implementation of DSN-MUI Fatwa No. 17/DSN-MUI/IX/2000 concerning sanctions for capable customers who delay payments on BSI OTO financing at BSI Kajen Pekalongan. And analyze the factors that influence its effectiveness. This research method uses empirical juridical with a case study approach and legislation. The resulting data are analyzed using descriptive analysis techniques. The results of the study indicate that the late payment fine policy for financing, implemented by BSI Kajen Pekalongan on BSI OTO products, has proven effective in improving customer discipline and managing financing risks. The fine is only imposed on customers who are capable but deliberately delay (mumatil) payment of financing installments. The fine may be imposed as a form of ta'zīr (social/financial punishment). The main factors that support this effectiveness include strict compliance with sharia principles, where fine funds are not a source of bank income, but are allocated for social and charitable activities. This research contributes to the development of Islamic economic law studies and the evaluation of the application of the DSN-MUI Fatwa on financing products in Islamic Financial Institutions.
