Abstract

A review of the provisions of the minimum age limit for marriage contained in Article 7 paragraph 1 of Act 1 of 1974 is important, given the Qur’an as a source of law does not provide clear information in this regard. Almost all jurists’ four schools allows marriage under the age standard set forth in the provisions of Article 7 paragraph 1 of Law No. 1 of 1974, even Syafi’iyah schools, the majority of schools in Indonesia, allowing the marriage of women at the age of 9 years. While the minimum age to marry provisions contained in the Act, in the perspective of psychology including adolescent age category immature physically and psychologically. Abstract

When the law establishment of political parties is controversial, this article tries to analyze based in the early history of Islam by identifying groups (hizb) who demand the leadership for the their articulation rights are encompassed, including the Khawarij, Mu'tazilah and Shi'ite groups are identified as a reflection of classical political Islam. The reflection of modern political Islam is marked by an aggregation of contemporary needs that cannot be denied the necessity for the establishment of political parties by looking issues in Egypt and Indonesia in the early era of independence. The difference of views among scholars and ijma 'ulama is an interesting discussion in determining istimbath about the law of establishing an Islamic perspective party. AbstrakKetika hukum pendirian partai politik menjadi kontroversi, artikel ini mencoba menganalisis berdasarkan peristiwa sejarah diawal Islam dengan mengidentifikasi kelompok (hizb) yang menuntut estafet kepemimpinan sebagai bentuk artikulasi agar hak-hak mereka terwadahi, termasuk munculnya golongan Khawarij, Mu'tazilah dan Syi'ah yang diidentifikasi sebagai refleksi Islam politik klasik. Adapun refleksi Islam politik modern ditandai dengan agregasi kebutuhan kontemporer yang tidak bisa dipungkuri terhadap keharusan pendirian partai politik dengan melihat isu-isu di Mesir dan Indonesia di era awal kemerdekaan. Perbedaan pandangan dikalangan cendekiawan serta ijma' ulama menjadi diskusi menarik dalam menentukan istimbath tentang hukum mendirikan partai perspektif Islam.

Abstract

Working relationship is the relations between employers and workers/ laborers under working contracts, which has elements of jobs, wages, and commands. However, working relations is not always fine, sometimes there is dispute between employers and workers. The disputes may cause termination of employment or layoff. The termination may be initiated by employers, workers, law and the decision of dispute resolution institution.When layoff occurs, there is compensation in the form of severance pay, gratuity and compensation. The layoff dispute can be resolved through two paths: the first way is through bipartite, mediation and consolidation; and the second is through the industrial relation court.Keywords: layoff, compensation, dispute resolution

Abstract

Imam Maliki is one of the Imam of the Four Schools who has great influence in some areas of Islam. The characteristic that became one of Imam Malik's privileges was that he was a figure in fiqh and hadith. With this mastery of science and method of ijtihad, Imam Malik became a famous scholar in the hemisphere, people from every corner came to him and they jostled in his majlis and gathered to study. He gave fatwas and taught people about 70 years old. The scholars agree on his character, glory, religion, wara ', and grip against the sunnah. There are several characteristics in the jurisprudence of the Maliki School of Islam that make the method special, which influences the development of the Maliki School and makes it different amongst him and other scholars: First, the Maliki School of Medina holds the Meditative deed because Medina is the place of the Messenger of Allah. Secondly, he made mashalih al-mursalah as a source of law. Mashalih al-mursalah are things that aim for human benefit, but not specified by the shari'ah in particular. Third, Imam Malik clings to the fatwas of the sahabah (qaul sahabi) because they are the forerunner of the hijrah with the Prophet or the aid class (Ansor). Fourthly, Imam Maliki uses Istihsan in various problems, such as employee guarantees, helping the owner of the bread kitchen and the mill, the pay of the bathroom for everyone is the same and the implementation of qisas which should present some witnesses and oaths. Fifth, a special sunnah position before Imam Malik.

Abstract

The land issue in Madura is a very complicated issue, especially regarding private interests, the general public, and legal entities. This research explains the mechanism for resolving land disputes in the Madura region through mediation by the National Land Agency, and the mediator's method of resolving land disputes. This study uses an empirical juridical research method, which in this study examines the applicable legal provisions and what happens in reality in society. The results showed that the mediation mechanism carried out by the National Land Agency included first receiving a letter of complaint from one of the parties, secondly reviewing the complaint letter, thirdly calling the Camat, Village Head, Village Apparatus, and Community Leaders for questioning regarding land disputes. The mediator's way of resolving land cases in the Madura region through mediation is, First Calling the two disputing parties, second Mediation efforts are carried out on both parties to the dispute, third If the mediation is successful then a mediation report and a letter of peace agreement are made and if it is not successful then the mediator directs to resolve through the path of legitimacy.Masalah tanah di Madura merupakan masalah yang sangat rumit, terutama mengenai kepentingan pribadi, masyarakat umum, maupun badan hukum. Peneletian ini bertujuan menjelaskan mekanisme penyelesaian sengketa pertanahan di wilayah Madura secara mediasi oleh Badan Pertanahan Nasional, dan cara mediator dalam menyelesaikan sengketa pertanahan. Penelitian ini menggunakan metode penelitian yuridis empiris, dimana dalam penelitian ini mengkaji ketentuan hukum yang berlaku serta apa yang terjadi dalam kenyataannya di masyarakat. Hasil penelitian menunjukkan bahwa mekanisme mediasi yang dilakukan oleh Badan Pertanahan Nasional diantaranya adalah pertama menerima surat pengaduan dari salah satu pihak, kedua Menelaah surat pengaduan, ketiga Memanggil Camat, Kepala Desa, Perangkat Desa, dan Tokoh Masyarakat untuk dimintai keterangannya mengenai sengketa pertanahan. Adapun cara mediator dalam menyelesaikan kasus pertanahan di wilayah Madura secara mediasi adalah, pertama Memanggil kedua belah pihak yang bersengketa, kedua upaya mediasi dilakukan terhadap kedua belah pihak yang bersengketa, ketigaapabila mediasi berhasil maka dibuatlah berita acara mediasi dan surat perjanjian perdamaian dan apabila tidak berhasil maka mediator mengarahkan untuk menyelesaikan di lewat jalur letigasi.

Abstract

The Law No 6/2014 on Village Government is the legal basis for the development of village community. There are six areas coordinated by the Ministry of Rural, Rural Development and Transmigration: village movement, village officials’ institutional capacity, establishment of five thousand BUMDes, revitalization of rural markets, rural infrastructure development, and online network connections in the village. A wise step to do all elements of the nation are participating and evaluating to realize the construction of a prosperous village.

Abstract

Islamic law in the context of its position and strategy towards national law into positive law has sparked controversial sustainability since independence until now. The various strategies and explanations about them give a special pattern to the specificity of Islamic legal thinking in Indonesia. This paper focuses on how the position and strategy of Islamic law in legal positivity in Indonesia. With the legal normative and sociological approach of jurisprudence, this paper confirms a conclusion that the position of Islamic law becomes part of the raw material of national law that can be managed in a pluralist manner in conjunction with other laws that grow in Indonesia. Plurality of Indonesian law which is a necessity to be a positive partner for Islamic law towards positivation of legal law nationally. The strategy carried out is by uniting perceptions which are the substance of the teachings of Islamic teachings in the meaning of Shari'a and fiqh in the form of values of universality that exist in Islam such as the substance of justice, honesty, equality of balance and the like. With such a position and strategy of Islamic law can provide a solution as well as a great opportunity for Indonesian Islamic law to move in to color the development of national law into positive law through the process of positivist Islamic law in Indonesia.

Abstract

Ideas and or motions to formulate Indonesian fiqh or Islamic law has been initiated along with the renewal of Islamic thought as a whole. However, so far a relatively thorough attention and partial toward the trend of thought of law reform mostly is approached in partial. While the review of the renewal of Islamic thought that have been done by a lot of scholars, both Indonesian and foreigners, relatively flourish. There are many thinkers and observers who are concerned about this issue, ideas that they developed at first did not get a response, after a long struggle and cultivation by scholars and ulama, finally got attention. Islamic law however does not congruent with Shari'ah. The phrase al-Syarai 'wa al-waqai mutahaddidah' mutajaddidah (Shari'ah is limited and events will always be new), suggests that if Islamic law is expected to respond with all the impact of modernization, the reinterpretation and reformulation are unavoidable.Keyword : Fiqh, Islamic Law

Abstract

The challenge in the implementation of Islamic laws that moslems in Indonesia face does not have to do with the struggle for recognition by national laws. Instead, it has to do with trying to clarify their position among various  social groups. It also examine how much Islamic laws contribute values that stimulate development, order, peace and welfare for the nation and country. Historically, Qur’anic legal verses were revealed mostly after the Messenger migrated to Medina, while Meccan verses are identified as to consolidate the ummah so that they were ready to bear the burden imposed by the Islamic laws (taklif).The regulations reflecting syari’ah laws issued by the local governments and their implementation tend to be euphoric taking the chance given by the reform. They have not reflected different social groups on which the regulations will be imposed. Islamic laws as the basic consideration in formulating the local government regulations seem not to have accommodated religious elements comprehensively, i.e. integrating aqidah, akhlaq and syari’ah guiding people’s behavior conceptually as well as in practice. Therefore, partial implementation of Islamic syari’ah only will  result in pseudo-religiosity, and tend to become a problem for the ummah themselves.
