Abstract

Pencucian uang (“meney laundering”)  adalah perbuatan menyembunyikan asal usul dana yang tidak sah karena diperoleh dari suatu tindak pidana menjadi seolah sah, merupakan suatu tindak pidana sejak di undangkan Undang Undang Nomor 15 tahun 2002 jo Undang Undang Nomor 25 tahun 2003, yang kemudian diperbaharui dengan Undang Undang Nomor  8 tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang.  Tahapan pencucian uang yang terdiri atas konversi (“placement”), pelapisan (“layering”), dan pengintegrasian (“integration”)  pada perkembangannya dilakukan dengan memanfaatkan dunia maya (“cyber”), sehingga merupakan “cyber crime”,  yang penanganannya menjadi semakin sulit dan kompleks, karena kejahatan ini bisa merupakan kejahatan lintas Negara, padahal aparat penegak hukum dalam melaksanakan kewenanagannya dibatasi yurisdiksi.Disamping itu juga dibutuhkan kompetensi dan keahlian khusus di bidang “cyber”.“Cyber money laundering” merupakan keniscayaan yang harus dihadapi  sebagai salah satu bentuk “white collar crime” pada era abad ke 21, sehinnga upaya untuk pencegahan dan pemberantasan tindak pidana pencucian uang dapat diaksakan secara optimal.

Abstract

هذا البحث تحت موضوع "معالجة فيروس كورونا بإندونيسيا في ضوء مقاصد الشريعة". قد كتب لتصوير معالجة فيروس كورونا في إندونيسياعلى شكل عام و ضوء مقاصد الشريعة عنها. استطلع الباحث الأدلة و المعلومات عنها بالقراءة و تتبع النسخة و قام على منهج الاستنباط التحليلي في تقدير إجراءات إدارة فيروس كورونا بإندونيسيا من نظرية مقاصد الشريعة. ترتب من هذا البحث أن الإدارة قد جرت وفق الإرشادات من منظمة الصحة العالمية إلا في بعض القضايا التي مالت إلى تقديم الأهمية الاقتصادية و السياسية ما يخالف نظرية مقاصد الشريعة التي تضع حفظ النفس أولى منهما في التريب. سيرا بهذه النتيجة، فمن اللازم أن تكون المعالجة تقدم حفظ النفس على غيره في سائر القرارات القادمة؛ لأنه يحقق درء المفاسد الكبرى و جلب المصالح الآجلة.Abstract This research is under the topic of "Managing Coronavirus in Indonesia perspective of Maqāsid Al-Sharīa". It has been written to depict the management of Coronavirus in Indonesia generally and the view of the purposes of Sharīa on it. The researcher explored the evidence and information about it by reading and tracing the transcript and based on the analytical deduction approach in estimating the procedures for managing Coronavirus in Indonesia from the theory of the purposes of Sharīa. It follows from this research that the administration was conducted according to the guidelines from the World Health Organization, except in some cases that tended to present economic and political importance, contrary to the theory of the purposes of Sharia, which puts self-preservation first in the order. Following this result, the administration must take precedence over others in all future decisions; because it is achieved to ward off major evils and bring future interests.AbstrakPenelitian ini mengambil topik “Penanganan wabah virus Corona di Indonesia dalam perspektif Maqāsid Al-Sharīa” dengan tujuan menggambarkan pengelolaan penanganan virus Corona di Indonesia secara umum beserta pandangan Maqāsid Al-Sharīa terhadapnya. Peneliti menggali bukti dan informasi dengan cara membaca dan menelusuri transkrip-transkip berdasarkan metode pendekatan deduksi analitis dalam meninjau prosedur penanganan wabah virus Corona di Indonesia dari sudut pandang Maqāsid Al-Sharīa. Berdasarkan penelitian ini dapat disimpulkan bahwa penanganan wabah virus Corona dilakukan sesuai dengan pedoman dari World Health Organization, kecuali pada beberapa hal yang cenderung mengutamakan kepentingan ekonomi dan politik, dimana bertentangan dengan teori tujuan syariah yang mengedepankan pelestarian diri. Maka dari itu, penelitian ini berharap agar penanganan wabah virus Corona kedepannya mengedepankan pelestarian diri dalam setiap keputusan yang akan diambil; karena hal tersebut terbukti berhasil mencegah kerusakan yang besar dan membawa kemaslahatan bagi umum.

Abstract

Fazlur Rahman’s thought of constitutional law emphasises on certain issues:  First,  Islamic  countries  should  form  a  democratic  Islamic state. Head of State is directly elected by the people. Head of State is responsible to the people through parliament whose members are also elected by people directly. Second, relationship between Islam and the state is very close, because the foundation of the state and the system of law should come from the sources of Islam, namely the Qur’an and the Hadith. If government is violating Islamic value it is no longer credible and should be dismissed. Third, the concept of the Islamic state is debatable therefore Fazlur Rahman choses the concept of an Islamic democratic state. The head of state is elected directly by the people and the president as head of state responsible to the people through parliament. Fourth, there are many problems in the establishment of an Islamic state. According to Rahman, the establishment of an Islamic state is accomplished through a long struggle, such as the establishment of the Islamic state of Pakistan. It is started with the commitment of Muslims to carry out God’s command. The establishment of an Islamic state aims for safety and sovereignty of the country. Fifth, concerning the issue of the duty and authority of the head of state, according to Fazlur Rahman the head of state in charge of leading the government, in carrying out its duties and powers shall be in accordance with the interests of all the people.Key words: Thought, Law and State.

Abstract

Sexual crime of chlidren in Indonesia increased every year.  So thatgovernment  take out Perppu Number 1 year 2016 and determined tobe Law Number 17 Year 2016 that applied punishment for a sexualoffender by imposing chemically castrated. While in Islam the practiceof castration are forbidden. So it takes about religious views as on formof enlightenment and consideration to decide and formulate thingsespecially in national criminal law. Based on the description,formulation problem to deduce and know in this research is: whychemicall castrartion choose as a sanction again pedophile actor?How does review Islamic law to be  chemical castrartion againpedophile actor? Research methods used is deskriptif. The techniquesused to collec data is librarianship study. Based on the results of thestudy: first, reason the government choose chemical castrartion againpedophile actor because chemical castrartion can reduce sexual driveperson. Process crastation can do when the sexual offender in prison,so that sexual offender take out in prison will return to normal. Second,castration in Islam with cutting procedure, indicated not tio marry andnot as apenalty. The practice oe chemical crastation or punishment forpedophile actors is allowed.

Abstract

Legality is one basic of penal law beside culpability in deciding the punishment. Legality is often perceived similar to law enforcement. According to Article 1 (1) of the Penal Law (KUHP), the law refers to written law. In fact, there is also living law mentioned in the Constitution. This kind of situation often causes the judge decision fails to meet social justice since the decision is merely based on formal law and neglected material law, such as in the case of Minah in Banyumas Court. Thus, progressive approach is necessitated in order to understand legality both in formal and material law in accordance with national legal ideals, Pancasila.

Abstract

Regular cycle of day and night due to the rotation of the earth creates a difference time regions. The earlier area facing the sun has earlier time than the western side (M.Syahudi Islami , 48). For example, when Semarang is in the time of maghrib, in Lampung maghrib has not yet come since it is in the western side. Likewise, by the times of sunrise in Lampung, the sun has already high in Semarang. The time difference is about 1 hour every 15 degrees of longitude, or 4 minutes for every 1 degree of longitude. The calculation is drawn from required time for one rotation (360 degrees) for 24 hours. This paper will explain about equation of time, mean time, universal time/Greenwich Mean Time, ad local mean time which are vital aspects for religious prayers, especially for calculating prayer schedule.Keywords: rotation,time, prayer

Abstract

This article discusses about jurisprudence of the High Courtconcerning the case of inheritance among Muslim society inIndonesia. There three main issues examined: (1) law finding bySupreme Court Justice concerning the case of inheritance, (2) thedecision of the Supreme Court in the case of inheritance from theperspective of Istinbath al-hukm, and (3) the degree of progressivityof the Judge’s decision toward the issue of justice in Indonesia. Thisis a library research in which data are collected from documentsand other available resources. The method of analysis is normativequalitative.

Abstract

Reflection of philosophy of law for legal development by reflecting back to the central questions in the philosophy of law which are based on the aspects epistimologi, ontology, and axiology. The epistemological aspect inquire/study the origin, nature, operational limits of the law. The ontology aspect inquire / learn where the law. The axiology aspect learn the purpose of the law. The relevance of philosophy of law for the development of law by finding links between schools or schools of law with legal developments. Which schools/school of law it plays an important role and influence on legal developments since centuries ago to the present.

Abstract

This paper raises the issue of whether the enactment of Islamic Sharia in Indonesia should be a form of law and/or local regulation that binds the community (formalization of Islamic law) or is sufficiently enforced persuasively. This research takes the object of surakarta people who have enacted Regional Regulation No. 3 of 2006 on Tackling Commercial Sexual Exploitation. Formil the regulation of this area does not mention the word sharia but the substance of the material stipulated in the regulation is entirely sharia material or fiqh. The existence of this government is acceptable to all elements of Surakarta people who have a background and a hiterogen religion. With grounded research and participatory observational data collection techniques, researchers found evidence that Surakarta people fail to cope with the rise of prostitution and commercial sexual exploitation persuasively, they require government involvement (formalization of Islamic law). By looking at the religious characteristics of Surakarta people whose religion is not so strong, the formalization of Islamic law into local regulations finds its significance. For areas where religion is strong enough, the enactment of Islamic Sharia is sufficient with a persuasive pattern based on the religious awareness of the community.AbstrakPaper ini mengangkat permasalahan apakah pemberlakuan Syari’ah Islam di Indonesia perlu menjadi suatu bentuk undang-undangdan/atau peraturan daerah yang mengikat masyarakat (formalisasi hukum Islam) atau cukup diberlakukan secara persuasif. Penelitian ini mengambil obyek masyarakat Kota Surakarta yang telah memberlakukan Peraturan Daerah Nomor 3 Tahun 2006 tentang Penanggulangan Eksploitasi Seksual Komersial. Secara formil peraturan daerah ini tidak menyebut kata syari’ah tetapi substansi materi yang diatur dalam perda tersebut sepenuhnya materi syari’ah atau fiqh. Keberadaan perda ini dapat diterima oleh seluruh elemen masyarakat Kota Surakarta yang memiliki latarbelakang dan pemeluk agama yang hiterogen. Dengan grounded research dan teknik pengumpulan data observasi partisipatoris, peneliti menemukan bukti bahwa masyarakat Kota Surakarta gagal menanggulangi maraknya prostitusi dan eksploitasi seks komersial secara persuasif, mereka membutuhkan keterlibatan pemerintah (formalisasi hukum Islam). Dengan mencermati karakteristik keberagamaan masyarakat Kota Surakarta yang  keberagamaannya tidak begitu kuat, formalisasi hukum Islam menjadi peraturan daerah menemukan signifikansinya. Untuk wilayah-wilayah yang keberagamaannya cukup kuat, pemberlakuan syari’ah Islam pada cukup dengan pola persuasif yang didasarkan atas kesadaran beragama masyarakat.
