Abstract

The involvement of a third party in a debt agreement as the owner of the mortgage object is a legal action that often occurs in people's lives. Not a few third parties feel disadvantaged due to debt agreements between debtors and creditors because there are still no regulations that clearly regulate legal protection, one of the cases is Decision No.9/Pdt.G/2020/PN.Tbn. This research aims to investigate issues relating to legal protection for third parties as the owner of the guaranteed rights under applicable legal regulations.This research method uses a normative legal approach by conducting an approach to the law applicable in Indonesia and then conduct a normative analysis using the data sources of the rules of the laws of court decisions. opinions of the legal experts, with the existing legal concept. This research will later focus on legal protection for third parties as collateral owners based on applicable regulations and legal settlements if third parties feel aggrieved over the object of collateral owned. From the results of this study it can be concluded that there is no prohibition on the involvement of third parties as guarantors of land rights in the process of debt agreements, but the legal regulations regarding the role of third parties are only implicitly explained in Law No.4/1996 so that third parties are vulnerable to being harmed. As a form of legal protection for third parties, it can be carried out through a preventive process by issuing APHT and SKMHT by authorized officials. In addition, if a third party's rights have been impaired, this can be done through litigation and non-litigation. Keywords: agreement; guarantee; third party Abstrak Terlibatnya pihak ketiga dalam perjanjian utang piutang sebagai pemilik objek jaminan hak tanggungan merupakan perbuatan hukum yang sering terjadi dalam kehidupan masyarakat. Tidak sedikit pihak ketiga merasa dirugikan akibat adanya perjanjian utang piutang antara debitur dengan kreditur sebab masih belum adanya peraturan yang mengatur secara jelas mengenai perlindungan hukumnya, salah satu kasusnya adalah Putusan No.9/Pdt.G/2020/PN.Tbn. Penelitian ini bertujuan untuk mengkaji permasalahan berkaitan dengan perlindungan hukum bagi pihak ketiga sebagai pemilik jaminan hak tanggungan menurut peraturan undang-undang yang berlaku. Metode penelitian ini menggunakan pendekatan yuridis normatif dengan melakukan pendekatan terhadap hukum yang berlaku di Indonesia selanjutnya dilakukan analisis normatif dengan menggunakan sumber data berupa peraturan perundang-undangan keputusan pengadilan, pendapat para ahli hukum, beserta konsep hukum yang ada. Penelitian ini nantinya akan memfokuskan pada perlindungan hukum bagi pihak ketiga sebagai pemilik jaminan berdasarkan peraturan yang berlaku dan penyelesaian hukum bila pihak ketiga merasa dirugikan atas objek jaminan hak tanggungan yang dimiliki. Dari hasil penelitian tersebut dapat disimpulkan bahwa tidak ada larangan keterlibatan pihak ketiga sebagai penjamin hak atas tanah dalam proses perjanjian utang piutang, akan tetapi peraturan hukum mengenai peran pihak ketiga hanya dijelaskan secara tersirat dalam UU No.4/1996 sehingga mengakibatkan pihak ketiga rentan untuk dirugikan. Sebagai bentuk upaya perlindungan hukum terhadap pihak ketiga dapat dilakukan melalui proses preventif dengan penerbitan APHT dan SKMHT oleh pejabat yang berwenang, selain itu apabila pihak ketiga telah dirugikan haknya, dapat ditempuh secara ligitasi dan non ligitasi. Abstract

After the Covid-19 pandemic (New Normal Era) after the pandemic hit for two years almost all over the world, including Indonesia, there are still various social and legal problems that have not been resolved. Legal phenomena related to private interests as a result of Covid-19 arise in society because of conflicts of interest between parties so that disputes occur whose resolution requires another party (3rd party). At first, solutions can still be found by means of peace and deliberation, but in practice it is certainly not as easy as imagined because each party survives on the right side. The solution offered is by measiboth within the scope of the court (litigasi) and outside the court (non litigation). Along with the development of information technology in the digital era, the Indonesian government through the Supreme Court issued PERMA Number 3/2022 concerning Electronic Mediation in Court to resolve disputes quickly, fairly and evenly (win-win solution). The method in this research uses a legislative and conceptual approach to examine and analyze the regulation of the judicial field in the digital era related to mediation. The results of the analysis show that electronic (online) mediation regulated in PERMA Number 3/2022 was born legal because the manufacturing process is in accordance with the law and appropriate because it has adjusted to the current era of technology and information. Mediation is one of the appropriate, fast, effective and cost-effective ways to resolve disputes peacefully without interacting directly between the parties to the dispute. With PERMA, simple, fast and cost-effective judicial legal principles can be achieved and this rule will be needed in the future if the country faces another pandemic again. Keywords: electronic; mediation; new normal Abstrak Pasca pandemi Covid-19 (Era New Normal) setelah pandemi melanda selama dua tahun hampir di seluruh dunia termasuk Indonesia, masih menyisakan berbagai permasalahan baik sosial maupun hukum yang belum tuntas terselesaikan. Fenomena hukum yang berkaitan dengan kepentingan privat sebagai dampak Covid-19 muncul di masyarakat karena benturan kepentingan antar para pihak sehingga terjadilah persengketaan yang penyelesaiannya memerlukan pihak lain (pihak ke 3). Pada mulanya masih dapat dicari solusi dengan cara perdamaian dan musyawarah, namun dalam prakteknya tentu tidak semudah yang dibayangkan karena masing-masing pihak bertahan di pihak yang benar. Solusi penyelesaian yang ditawarkan adalah dengan mediasi baik yang dilakukan dalam lingkup pengadilan (litigasi) maupun luar pengadilan (non litigasi). Seiring dengan perkembangan teknologi informasi di era digital, pemerintah Indonesia melalui MA mengeluarkan PERMA No.3/2022 secara elektronik untuk menyelesaikan sengketa secara cepat, adil dan berimbang (win-win solution). Metode dalam penelitian ini menggunakan pendekatan perundang-undangan dan konseptual untuk mengkaji serta menganalisis pengaturan bidang peradilan di era digital yang berkaitan dengan mediasi. Hasil analisis menunjukkan bahwa mediasi elektronik (online) yang diatur dalam PERMA No.3/2022 dilahirkan sudah sah karena proses pembuatannya sudah sesuai undang-undang dan tepat karena telah menyesuaikan dengan era teknologi dan informasi yang berkembang sekarang ini. Mediasi adalah salah satu cara yang tepat, cepat, efektif dan hemat biaya untuk menyelesaikan sengketa secara damai tanpa berinteraksi secara langsung antara pihak-pihakbersengketa. Dengan PERMA dapat dicapai prinsip hukum peradilan sederhana, cepat dan biaya hemat serta aturan ini akan dibutuhkan untuk ke depannya jika negara menghadapi pandemi lainnya lagi. Abstract

The purpose of this research is to find out about medical waste management under the precautionary principle. This study uses a normative research method based on a review of literature and regulations or public policies to discuss issues. The novelty of the research is the application of the precautionary principle in the management of medical waste as environmental protection from disease transmission and environmental pollution. The results of this study are that medical waste contains odorous, dangerous, and toxic substances, so it must be managed carefully so that the results of medical waste management do not harm the surrounding environment. The precautionary principle is one of the principles used in managing hazardous waste so as not to have an adverse impact on life and the surrounding environment for a sustainable community life. Therefore, it is necessary to enforce the law against the perpetrators who pollute the environment by disposing of medical waste without first managing it in the form of administrative sanctions, fines, and criminal sanctions. The conclusion from this study is that the precautionary principle is a principle that aims to provide protection for the environment in society. Keywords: health services; management; medical waste Abstrak Tujuan penelitian ini menemukan tentang pengelolaan limbah medis dengan prinsip kehati-hatian. Penelitian ini menggunakan metode penelitian normatif yang berlandas pada kajian terhadap kepustakaan dan regulasi atau kebijakan publik untuk membahas permasalahan. Kebaruan penelitian yaitu penerapan prinsip kehati-hatian dalam pengelolaan limbah medis sebagai perlindungan lingkungan hidup dari penularan penyakit dan pencemaran lingkungan. Hasil penelitian ini bahwa limbah medis mengandung zat B3 sehingga harus dikelola secara hati-hati agar hasil dari pengelolaan limbah medis tidak membahayakan lingkungan disekitarnya, prinsip kehati-hatian merupakan salah satu prinsip yang digunakan dalam mengelolah limbah berbahaya agar tidak memberikan dampak buruk kepada kehidupan serta lingkungan sekitarnya untuk kehidupan masyarakat yang berkelanjutan. Oleh karena itu diperlukan penegakan hukum terhadap para pelaku yang melakukan pencemaran lingkungan dengan membuang limbah medis tanpa dikelola terlebih dahulu yang berupa pemberlakuan sanksi secara administrasi, denda, serta sanksi pidana. Kesimpulan dari penelitian ini bahwa prinsip kehati-hatian adalah prinsip yang bertujuan untuk memberikan perlindungan terhadap lingkungan hidup di masyarakat. Abstract

The regulation concerning political party coalitions of the presidential election has been implemented since the enactment of Article 6A paragraph (2) of the 1945 Constitution of the Republic of Indonesia. It has been known that in the practice of coalitions formed is relatively short-term and unstable. This study aims to analyze the existence of a pre-election coalition in the presidential election and to examine the concept of formed coalition continuation from the pre-election to become the government steady coalition. Conceptual, comparative, and statute approach are used in this study as a normative legal method research. The research result showed that the continuity of the pre-election coalition in government administration is in line with the purpose of Article 8 paragraph (3) of the 1945 Constitution of the Republic of Indonesia. In addition, to strengthen the binding power of the coalition, it is necessary to set regulations in the forthcoming election law by adding an agreement clause to transform the pre-election coalition into a government coalition. Praktik koalisi partai politik yang terbentuk masih bersifat jangka pendek dan tidak stabil. Penelitian ini bertujuan menganalisis eksistensi pre-election coalition pada pemilihan presiden serta mengkaji konsep pengaturan kontinuitas koalisi partai politik dari pre-election coalition ke government coalition. Penelitian ini menggunakan metode penelitian hukum normatif melalui pendekatan konseptual, pendekatan perbandingan dan pendekatan perundang-undangan. Hasil penelitian menerangkan pertama, kontinuitas pre-election coalition dalam penyelenggaraan pemerintahan selaras dengan ketentuan Pasal 8 ayat (3) UUD NRI 1945. Kedua, penguatan daya ikat antar koalisi partai politik membutuhkan pengaturan dalam undang-undang pemilu di masa mendatang melalui penambahan klausul kesepakatan transformasi pre-election coalition menjadi government coalition. Abstract

The demand for an extension of the village head's term of office becomes a dilemma, according to regulations the authority for extending the term of office of the village head is an open legal policy that forms political laws, but on the other hand, in democratic principles, we want restrictions on power. The research method used in this study is normative legal research using statutory and conceptual approaches. The results of the study show that the terms of office for village heads are not explicitly regulated in the 1945 Constitution of the Republic of Indonesia, such as the terms of office for the president and vice president and the term of office for regional heads. One of the reasons for the difference in arrangement is inseparable from the peculiarities of village governance in the Indonesian constitutional structure. According to the democratic principle that requires a limitation of power, an extension of the term of office for the village head will have the potential for abuse of power, such as corruption cases at the village level which occupy the top rank as the sector with the most corruption cases being prosecuted by law enforcement officials. Keyword: democracy; length of service; village head Abstrak Tuntutan perpanjangan masa jabatan kepala desa menjadi problematik, secara aturan kewenangan perpanjangan masa jabatan kepala desa merupakan kebijakan hukum terbuka (open legal policy) pembentuk undang-undang yang bersifat politis, namun di sisi lain dalam prinsip demokrasi menginginkan adanya pembatasan kekuasaan. Metode penelitian yang digunakan pada penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan aturan mengenai masa jabatan kepala desa tidak diatur secara eksplisit dalam UUD NRI 1945 seperti halnya masa jabatan presiden dan wakil presiden serta masa jabatan kepala daerah. Salah satu alasan pembedaan pengaturan itu tidak terlepas dari kekhasan pemerintahan desa dalam struktur ketatanegaraan Indonesia. Menurut prinsip demokrasi yang menginginkan adanya pembatasan kekuasaan, perpanjangan masa jabatan kepala desa akan berpotensi terhadap penyalahgunaan kekuasaan (abuse ofpower) seperti kasus korupsi di tingkat desa yang menempati urutan teratas sebagai sektor kasus korupsinya paling banyak ditindak oleh aparat penegak hukum. Abstract

The Criminal Justice System in Indonesia has explained related to the authority of each law enforcement apparatus, including the authority to defend suspects or defendants. However, deviations occurred in 2022 where the police acted as defenders in trials (legal advisors) for other members of the police who were accused in the Kanjuruhan tragedy, this is of course vulnerable to conflicts of interest and is not in line with the criminal justice system. The research method used is empirical juridical, which is related to the implementation of laws and regulations in cases that occur in society, in this case, the question of the authority to defend in the trial of the Kanjuruhan case. In principle, the authority to defend in the context of criminal justice is regulated in the Law No.18/2003, in cases where a police officer is acting as a legal representative for other police officers in criminal cases it is a deviation from the process of the criminal justice system in Indonesia, this also contradicts Article 16 in the Law No.2/2002, which explains that the police do not have the authority to provide legal assistance in criminal trials. Abstract

The purpose of this study is to analyze the authority of the Regional Government in establishing the Regional Public Service Agency. This research is normative legal research with statutory and conceptual approaches. The results of this study found that based on Article 346 of Law No.23/2014 in conjunction with Article 205 paragraph (1) PP No.12/2019 Regional Government has attribution authority to form BLUDs with the aim of improving public services. The authority of the Regional Government to form a BLUD is a discretionary authority that gives the choice to the Regional Government whether or not to form a BLUD based on consideration and an assessment of regional needs to improve public services. In forming a BLUD, Regional Governments must meet the requirements as stipulated in Article 29 Permendagri No.79/2018, namely substantive, technical and administrative requirements. Keyword: authority; public service, regional government; regional public service agency Abstrak Tujuan penelitian ini adalah menganalisis kewenangan Pemda dalam pembentukan BLUD. Penelitian ini adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian ini menemukan bahwa berdasarkan Pasal 346 UU No.23/2014 jo Pasal 205 ayat (1) PP No.12/2019 Pemda memiliki kewenangan atribusi untuk membentuk BLUD dengan tujuan untuk meningkatkan pelayanan publik. Kewenangan Pemda untuk membentuk BLUD merupakan kewenangan diskresi yang memberikan pilihan kepada Pemda untuk membentuk BLUD atau tidak berdasarkan pertimbangan dan penilaian kebutuhan daerah untuk meningkatkan pelayanan publik. Dalam pembentukan BLUD, Pemda harus memenuhi persyaratan sebagaimana ditentukan dalam Pasal 29 Permendagri No.79/2018 yakni persyaratan substantif, teknis, dan administratif. Abstract

In UMKM activities in Minggirsari Village, Blitar Regency, the contract is the basic framework used as a frame of relationship for economic actors. The contract can give rise to rights and obligations for the parties who make the contract. This the contract plays an important role in doing business in Indonesia. This condition is the background of this research in order to find out how the stages of designing a business contract and how to make a business contract structure. This research uses normative legal research with a concept and law approach. The analysis of legal materials was carried out by descriptive, interpretative, evaluative and argumentative analysis. The results showed that the contract design stages consisted of the pre-contract stage, the contract signing stage and the post-contract stage. The parties to an agreement must look at the principles that form the basis of the contract made. The principles in question, such as understanding the elements of the agreement, the principle of the agreement and the legal terms of an agreement, need to be careful and thorough by the parties who make a contract/agreement in designing a good and correct business contract structure. In addition, it must meet procedural requirements, namely fulfilling subjective and objective requirements. A good contract must be clear and detailed, regarding the subject, object and obligations of the parties along with the sanctions imposed on the parties, as well as the clarity of the ways and procedures for implementing sanctions, and not contradicting all legal norms related to the contract. Abstrak Dalam kegiatan UMKM di Desa Minggirsari Kabupaten Blitar, kontrak merupakan kerangka dasar yang digunakan sebagai bingkai dari hubungan bagi para pelaku ekonomi. Kontrak dapat menimbulkan hak dan kewajiban bagi para pihak yang membuat kontrak tersebut. Dengan demikian kontrak sangat berperan penting dalam berbisnis di Indonesia. Kondisi ini melatar belakangi penelitian ini dalam rangka mengetahui bagaimana tahapan perancangan kontrak bisnis dan bagaimana pembuatan struktur kontrak bisnis. Penelitian ini mempergunakan jenis penelitian hukum normatif dengan pendekatan konsep dan undang-undang. Analisis bahan hukum dilakukan secara deskriptif, interpretatif, evaluatif dan argumentatif analisis. Hasil penelitian menunjukkan tahapan perancangan kontrak terdiri dari tahap prakontrak, tahap penandatangan kontrak dan tahap pasca kontrak. Pihak-pihak yang melakukan suatu perjanjian harus melihat prinsip yang menjadi dasar pada kontrak yang dibuat. Prinsip yang dimaksud seperti paham akan unsur dari perjanjian, asas dari perjanjian serta syarat sahnya suatu perjanjian, perlu cermat dan teliti oleh pihak-pihak yang melakukan suatu kontrak/perjanjian dalam merancang pembuatan struktur kontrak bisnis yang baik dan benar. Selain itu harus memenuhi syarat prosedural yaitu memenuhi syarat subjektif dan objektif. Sebuah kontrak yang baik harus jelas dan terperinci, menyangkut subjeknya, objeknya serta kewajiban para pihak beserta sanksi yang dibebankan terhadap para pihak, serta kejelasan cara dan prosedur pelaksanaan sanksi, serta tidak bertentangan dengan seluruh norma hukum yang terkait dengan kontrak. Abstract

Securities crowdfunding is a financial service activity in the capital market sector. In the Financial Services Authority Regulation No. 16/POJK.04/2021 concerning changes to Financial Services Authority Regulation No. 57/POJK.04/2020 concerning Securities Offering Through Information Technology-Based Crowdfunding Services (POJK Crowdfunding Securities) The Financial Services Authority (OJK) regulates the imposition of user losses on operators of securities crowdfunding. The formulation of the issues are, first, about the position of OJK in granting authority to operators of securities crowdfunding and second, the law protection that OJK should provide to operators of securities crowdfunding. Analysis of the data in this study is a qualitative analysis with the type of normative research using secondary data. The results of the study show that the authority of the OJK in supervising and regulating all financial service activities including the capital market is given attribution as special agencies through in Article 7 the Law of the Republic of Indonesia Number 21 of 2011 concerning the Financial Services Authority (OJK Law/UU OJK). This is a form of government intervention as a welfare state. In addition, OJK has the authority to grant the permits and revoke the legitimacy of permits granted to the operators. Legitimacy should also be given to the issuers and securities to measure the eligibility and capacity of issuers to issue securities. Furthermore, as an effort to protect investors and prevent market failures. For example, the Financial Services Authority has granted a business license for a Securities Offering Operator through Information Technology-based Crowdfunding Services to PT. LBS Crowdfunding with Business License Decision Number KEP-22/D.04/2022 on March 18, 2022. The operator as the permit holder has the duties and responsibilities to provide, manage, and operate activities securities crowdfunding. In order to support the duties and responsibilities of the operators, OJK allows the operators to cooperate with third parties. As a consequence of cooperation with third parties, if the user suffers loss, the operator must be responsible for the user's loss under strict liability. To conclude, this is considered unfair considering that user losses can also be caused by the risk of the investment fund. In order to avoid the burden of compensation on the operators for errors/and or mistakes of other parties, legal protection measures are needed, both preventively and repressively. Suggestions are intended, first to OJK through legitimacy and on-site examination, and second to users, especially investors, to better understand risks before investing. Keywords: scurities crowdfunding; law protection; OJK Abstrak Securities crowdfunding merupakan kegiatan jasa keuangan di sektor pasar modal. Pada Peraturan Otoritas Jasa Keuangan No. 16/POJK.04.2021 tentang Perubahan atas Peraturan Otoritas Jasa Keuangan No. 57/POJK.04/2020 tentang Penawaran Efek Melalui Layanan Urun Dana Berbasis Teknologi Informasi (POJK Securities Crowdfunding). Otoritas Jasa Keuangan (OJK) mengatur mengenai pembebanan atas kerugian pengguna terhadap penyelenggara securities crowdfunding. Rumusan masalah yang diangkat pada penelitian ini adalah mengenai pengaturan hukum terhadap penyelenggara securities crowdfunding berdasarkan POJK. No. 16/POJK.04/2021 dan bentuk perlindungan hukum yang seharusnya diberikan pemerintah terhadap penyelenggara securities crowdfunding. Analisa data pada penelitian ini adalah analisa kualitatif dengan jenis penelitian normatif menggunakan data sekunder. Hasil penelitian menunjukan bahwa kewenangan OJK dalam mengawasi dan mengatur seluruh kegiatan jasa keuangan termasuk pasar modal diberikan secara atribusi sebagai special agencies sebagaimana tertuang dalam Pasal 7 Undang Republik Indonesia Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan (UU No. 21/2011). OJK berwenang untuk memberikan izin dan mencabut legitimasi yang diberikan izinkepada penyelenggara. Legitimasi seharusnya juga diberikan terhadap penerbit dan efek untuk mengukur kelayakan penerbit dalam menerbitkan efek. Sebagai contoh, Otoritas Jasa Keuangan telah memberikan izin usaha Penyelenggara Penawaran Efek melalui Layanan Urun Dana berbasis Teknologi Informasi kepada PT. LBS Urun Dana dengan Nomor Keputusan Izin Usaha KEP-22/D.04/2022 pada tanggal 18 Maret 2022. Hal ini sebagai upaya dalam melindungi pemodal serta mencegah terjadinya kegagalan pasar. Penyelenggara sebagai pelaksana izin memiliki tugas dan tanggung jawab untuk menyediakan, mengelola, dan mengoperasikan kegiatan securities crowdfunding. Agar dapat mendukung tugas dan tanggung jawab penyelenggara, OJK memperkenankan penyelenggara untuk melakukan kerja sama dengan pihak ketiga. Adapun sebagai konsekuensi dari kerja sama dengan pihak ketiga, apabila pengguna mengalami kerugian maka penyelenggara wajib bertanggung jawab atas kerugian pengguna secara strict liability. Hal ini dinilai tidak adil mengingat kerugian pengguna juga dapat disebabkan oleh risiko dari investasi yang dilakukan. Agar menghindari pembebanan ganti rugi terhadap penyelenggara atas kesalahan/dan atau kelalaian pihak lain maka diperlukan upaya perlindungan hukum, baik secara preventif maupun represif. Saran ditujukan, pertama bagi OJK melalui kewenangan dan on-site examination. Tradisi Lewa Di Lembata Dalam Prespektif Kebijakan Konservasi Dan Ancamannya Terhadap Ekosistem Laut

Abstract

Indonesia is an archipelagic country that includes at least 17,000 islands.. Of the various islands, Indonesia has an island called Lembata which belongs to East Nusa Tenggara Province. In Lembata itself precisely in Lamalera known as the culture or tradition of Leva Nuang or Lewa, which is the tradition of hunting whales, rays, sharks, or those included in cetaceans or marine mammals. Departing from this, the author tried to see how the implications of Lewa's activities in the community, especially in Lamalera and how the law saw the tradition in the realm of conservation and the impact of such activities. This journal was written using qualitative research with a constructivist paradigm approach to frame the Lewa Tradition in Lembata in its conservation policy perspective and threat to marine ecosystems. From this research it was obtained that Lewa or Leva Nuang activities are cultural diversity and traditions that have been running and developed for quite a long time, and in carrying out Lewa activities despite experiencing dynamics and contradictions in conservation policies in Indonesia, there is a principle of legal exclusion in it, because these activities are the heritage of ancestors and for the sake of preserving customs and culture of course with strict fishing rules. Keywords: conservation; lamalera; leva; marine live Abstrak Indonesia merupakan negara kepulauan yang mencakup setidaknya 17.000 pulau. Dari beragam pulau tersebut Indonesia memiliki pulau yang bernama Lembata yang termasuk kedalam Provinsi Nusa Tenggara Timur. Di Lembata sendiri tepatnya di Lamalera dikenal dengan budaya atau tradisi Leva Nuang atau Lewa, yaitu tradisi perburuan paus, pari, hiu, atau yang termasuk ke dalam cetacea atau mamalia laut. Berangkat dari hal tersebut penulis mencoba melihat bagaimana implikasi dari kegiatan Lewa di masyarakat khususnya di Lamalera dan bagaimana hukum melihat tradisi tersebut dalam ranah konservasi serta dampak dari kegiatan tersebut. Jurnal ini ditulis menggunakan metode penelitian normatif yuridis dengan penelitian kualitatif dengan pendekatan paradigma konstruktivis untuk membingkai Tradisi Lewa di Lembata dalam prespektif kebijakan konservasi dan ancamannya terhadap ekosistem laut. Dari penelitian ini didapat bahwa kegiatan Lewa atau Leva Nuang merupakan keberagaman budaya serta tradisi yang telah berjalan dan berkembang cukup lama, serta di dalam melakukan kegiatan lewa meski mengalami dinamika serta kontradiksi dalam kebijakan tentang konservasi di Indonesia, namun terdapat asas pengecualian hukum didalamnya, dikarenakan kegiatan tersebut adalah warisan nenek moyang serta demi melestarikan adat dan budaya tentunya dengan aturan tangkap yang ketat.
