Abstract

This paper discusses the problem of inter-marriage between customary law and Islamic law by referring to the laws of Panji Selaten and Beraji Niti as a case in point. These are the laws of Kutai Kertanegara Sultanate in Kalimantan. The paper particularly asks to what extent does customary law in Kutai Kertanegara absorbs Islamic law and vice versa. We argue that this case is a perfect example of not only the ability of Islam to adapt to a local scenario but also the genius of early Muslims in this particular region to understand the universal message of Islam. That Islam is universal means that it is applicable in different settings and contexts. We also discuss the history of the two laws, their characteristics and systems in order to present a clear idea of how they connote to the Islamic values. Further, through this study we try to show that in one way or another, the Dutch colonizing power at the time was aware that to keep the resistance at bay, it has to apply the policy of what Van Den Berg calls receptio in complexu, that is recognizing and applying Islamic law for the Muslims.

Abstract

This paper takes into account the very fact that Syariah has been a subject of controversy over centuries. Its interpretation in the form of fiqh (Islamic jurisprudence) is a strong indication that Syariah is not immune from personal subjectivization. Fiqh is quite personal whereby a jurist would read the message of Syariah and attempt to give his personal and subjective interpretation of it. Nonetheless, the paper is also of the argument that this controversy is in itself a source of the dynamics of Syariah. It is due to this controversy?otherwise known as the legal dispute- that fiqh is capable of being developed overtimes. Some substances of fiqh are responses to the opposing views on some issues. Not less important than this is to delve into the factors that triggered such controversy and dispute. The paper speaks of three factors, namely the nature of subject matter, the way the jurists interpret it, and the social circumstances that surround the jurists and help shape their way of thinking. The first is epistemological, the second methodological, whereas the third to sociological. The three factors are inter-related and form as it were the comprehensive legal products that the Muslims currently inherited. The Tarjih in the meantime is a form of a legal product, which serves both as a social and intellectual modality for the Muslims in their daily lives.

Abstract

Jih?d is one of the Islamic teachings which has been extensively discussed since the last few decades due to the increasing acts of violence perpetrated by some Muslims. This article tries to join this discussion by presenting Muh ammad ?Abd al-Sal?m Faraj?s concept of jih?d and his ideas of Islamic state and Caliphate by referring to his al-Far?d ah al-Gh??ibah (the Neglected Duty). We argue that Faraj?s basic perception of the Egyptian politics and society at the time shaped his whole concept of state and Caliphate. We hence contend that his proposal of jih?d is born out of his disappointment of the Egyptian government and even society as far as applying Islamic law is concerned. He uncompromisingly believed that the government and society are hypocrite and apostate for distancing themselves from the divine law of God. This belief prompted four members of Jih?d Organization to which Faraj belongs, to assassinate President Sadat in October 1981. By jihad, Faraj means fighting and confrontation against enemies even through bloodshed. And by enemies he means anyone who is not willing to apply God?s law on earth. The most controversial idea that Faraj has tried to pose is that jih?d is considered to the sixth pillar of Islam, which has to be carried out by each and every member of Muslim ummah.

Abstract

This paper understands that the Sharah Economics is a serious contender for the modern global capitalistic economic system. Capitalism has been responsible for the collapse of not only the global economic system but also the moral deterioration of human being. Injustice is the main mark of capitalism. Hence, in a capitalistic society, no law of the game is upheld economically speaking. The strong and the rich rule. The weak is always a victim. This is the main concern of this paper, vis-?-vis which it introduces the Sharah perspective as providing a good alternative. The paper first speaks of the sources of this ?Islamic? system -namely the Quran, the Sunna, Ijma and Qiyas- and then delves into its heart, namely justice. The study holds that the main imprint ot Syari? ah economic system is justice. Being divinely revealed, this system is always in line with the very nature of man as a social being whose responsibility it is to do something beneficial for his fellow human being. Man is not created solely to accumulate wealth, but to serve God, his religion, his community by using wealth among others. Hence, wealth is not the goal, but the means. The goal that every man wants to acquire is happiness. Shariah Economics?the paper argues- is ordained to provide a practical guideline toward happiness.

Abstract

In the past decade or so, Islamism as a political concept and perhaps as an ideology has gained strong momentum in Indonesia. The fall of Soeharto after more than three decades in power has helped this ideology to emerge and exert itself particularly in the form of religion oriented political party. This paper is interested in exploring the expression and actualization of Islamism by scrutinizing the political behavior of Justice and Welfare Party (Partai Keadilan Sejahtera / PKS) during the 2009 presidential election. We are particularly interested in looking at the use of religious symbols and rites by the party for clear political purposes. We argue that Islamism has been manipulated by PKS during that election as a vehicle to gain power. Hence, the main problem that this paper deals with is actually the idea of the politization of religion by a political party claiming to have represented Islam and its noble teaching.

Abstract

Many have been done to study the problem of Shariah and other related issues. But little has been done to investigate the notion of the application of Shar??ah in Indonesia in the form of regional law, otherwise known as Perda Shariah. Apart from its importance and sensitivity, the Perda Shariah is quite ignored by the academic circle in this country. It is toward filling this gap that this paper is written. It is interested first in discussing the nature of Syariah, its values, history, and sources. Then it moves to the currents of thought and modes of interpretation as far as Shariah is concerned. It finally discusses the ways Shariah is applied in daily live and how a country like Indonesia ?or rather certain districts in it- are involved in formalizing Shariah as their regional law. The main argument of this paper is that, Islam is not solely about law. Islam is a religion of ethics, morality, belief, and spirituality. Islam is also a way of life, the consequence of which being that it should be comprehended universally as comprehensive system of living. Hence, we argue, that the application of Islam in the form of regional law would mean a simplification of the more universal form of Islam, and a reduction of the more holistic message of the religion.

Abstract

This paper discusses the views of Muslims on the nature and legitimacy of bank interest as far as Syari?ah law is concerned. Three views are presented here. First is the view of the neo-revivalists who argue that bank interest is legally illegitimate and that it is a form of riba. Second is the view of?among others?Fazlur Rahman who believes that bank interest is not riba. And third is the view that bank interest is in the state of legal doubtfulness (shubhat). We do not support particular view in this paper. But in principle it seems particularly legitimate to argue that Islam is a religion of social wellbeing in which any transaction should be free from such illegitimate practices as riba, gharar (cheating), and financial speculation. However, we also argue that bank interest is too complicated to be equated with riba. There are no accepted standards and qualifications by which the two can be said as the same. To this complex issue we dedicate our paper as a contribution to the issue at hand.

Abstract

Hadith, a prophetic saying has been a living tradition for the Muslims. In their plea to live a better live, Muslims would turn to either the Quran or the hadith. It has in other words served as a source for all aspects of the lives of Muslims. As an object of academic study, hadith has also been subjected into a serious investigation both to prove its authenticity in its narration and message, and to elaborate certain points of importance. Critical studies of hadith have been common in academic circles in the Muslim world and in the Western universities, one of which focuses on the contextual meaning of it. It is toward this end that this paper is aimed at. It is an attempt to make a contribution in the contextual analysis of hadith. By contextual analysis we mean a study that puts a lot of stressing on the meaning of a hadith by looking at the context from which it was said or reported. This way of studying hadith would help to understand it better in line with the dynamic nature of Islam. The paper argues that a hadith cannot be understood in isolation from its context. It also maintains that understanding its context would mean that one would be able to unveil and even reconstruct the hadith epistemology. Since the epistemology of a hadith lies in its meaning, the re-interpretation of a hadith according to its context would mean rediscovering the new dimension of the epistemology.

Abstract

This paper is aimed at articulating the Sufi concept of tawhid, God unity. Tawhid has always been an intriguing issue to tackle within the premises of tasawuf considering that it is this notion that has triggered controversies over centuries. The Sufis have often been accused of betraying Islam by presenting a distorted version of tawhid. This paper will neutralize this accusation and contend that the Sufistic concept of tawhid is categorically Islamic, Qur?anic and prophetic. Against all odds, tasawuf has survived from all sorts of onslaught. This means that tasawuf is just in line with the prophetic Islam, or else with the pure of Islam brought about the prophet Muhammad. The paper will consult the views of many leading Sufis to support its basic contention. The strength of this paper does not indeed lie in its basic premises, but in its data, line of argument and in its analysis. The paper will leave aside for the time being the views of the Sufis that belong to the periphery.

Abstract

The object of this paper is man in the modern Islamic literature. The man that it deals with is a modern man, a man overwhelmed by psychological deceases ranging from loneliness, sadness, depression, and the likes. The paper maintains first and foremost that modernity has brought about a serious challenge for modern man. The high standard of living, the demands of life, and the competition among individuals have all been a source for the deepening malaises of the modern man. All this, the paper argues has been reflected in the contemporary Islamic literature whose vibrant expression of modern life has stood a strong indication of the plight of modern man. Contemporary Islamic literature in other words, is the medium through which we can understand the dilemma of modern man as well as the medium through which modern men can resort to express their feeling and live-experience. By Islamic literature we mean any literature that has an ontic and epistemic relationship with the authoritative sources of Islam.
