Abstract

This paper tries to trace and analyze the roots of?Islamic transnationalism? or ?transnational Islam? in Indonesia through the lens of the three theoretical frameworks that I borrowed from Mandaville as follows: (1) travelling theory; (2) hibridity theory, and; (3) diasphora theory. The paper focuses its analysis on an Islamic movement who carries the ideology of ?Islamic transnationalism? (khil? fah Isl?miyah), namely Hizbut Tahrir Indonesia (HTI). Before delving into the details of HTI?s ideological roots of transnational Islam, however, a conceptual definition of ?transnational Islam? will be elucidated in advance.

Abstract

The Islamic law in Indonesia has evolved from time to time in line with the demands of the changing history. Recently, and during the era of reformasi?it is commonly known so?the Islamic law has been progressively positivised. By this we mean the dynamics within which the Islamic law has the ability to respond to the new situation that requires the re-thinking of some of its dictums. The role of the government has equally been good; it is completely supportive of this process. This shift in direction taken by Islamic law is due to the fact that the colonial law in the country has become rotten. It is no longer able to deal with the ever-changing situations of this Muslim-majority country. This paper discusses this historic turn, and embarks on the debate concerning the advantages of the Islamic law for a Muslim country like Indonesia. The paper also links this development with the democratic system that the country has adopted. It argues that democracy does serve as a pre-condition in which a revealed law like Syari?ah can prevail.

Abstract

Model construction of curriculum and integrated learning between the Islamic Religious Education (PAI) and Civic Education (PKn) in elementary schools oriented to synergize the PAI and Civics teachers in designing integrated learning a more comprehensive and effective while improving the personality of students for the future be able to reflect the intellectual potential and the potential for in attitude. Basically, in the process of education and learning , teachers are required to conduct a comprehensive innovations and effective to prevent saturation, both teachers and students. Concerned it, this research produces research that has been tested in three elementary schools (SD) in Surabaya in the form of construction of an integrated curriculum in a way to bring some basic competence of these two subjects, then packaged in an integrated learning syllabus equipped, Learning Implementation Plan, Instructional Materials / Module Simple, and the Learning Guide.

Abstract

This research is interested in exploring the seeds of the Sunni political thought during the era of Islamic kingdom in Indonesia. Many have argued that the Islam that has finally prevailed in the country is a Sunni Islam. Accepting this proposition would mean that the political ideals that the early Muslim kings in the land adopted are necessarily Sunni. The forms and contents of these ideals will be the task of this paper to discover. The paper however argues that whatever form the ideals have taken, the Indonesian version of Sunni politics has most likely been developed around power. In other words, the ulama and the princes are two sides of the same coin. While the ulama need the support of the princes to disseminate the Sunni doctrine, the later needs the support of the former for the legitimacy of his authority. The paper hence maintains that there has been no any form of separation between religion and politics in the early history of Indonesian Islam.

Abstract

A professional teacher not only serves as a teacher, but also as a coach, counselor, facilitators, and managers. In order to perform all these functions, teachers are required to have certain qualifications and competence. One of the competences is competent to apply the various approaches, strategies, methods, and techniques that teach creative learning in subjects taught. This paper attempts to offer an alternative approach that is independently developed by the author and has been tested in its application of PAI learning, which is reflective learning. Reflective learning can help learners improve their understanding and awareness of Islamic values learned through learning activities which involve the process of reflection. Application of reflective learning approach has been proven to improve the success of PAI learning in schools characterized by increased religiosity of students, both in terms of effectiveness, efficiency, and attractiveness.

Abstract

The kind of Islamic sciences being taught in many higher education institutes in Indonesia is that which tends to make students isolated from their world. These Islamic sciences in themselves are kind of separation from the religious and worldly, Islamic and secular. This dichotomous character had inflicted upon the students mentality, who in turn become equally dichotomous in their attitude, and way of thinking. This paper tries to explore this, and attempts to seek the best way in which the dichotomous curriculum can be replaced with the integrative one. It argues that, like the nature of Islam, religious sciences cannot be separated from the non-religious ones. The one must work hand in hand with the other so that. The paper addresses specifically the dilemmas intrinsic within the text book used by many higher religious institutes in the country called ?Reorientasi Pendidikan Islam: Menuju Pengembangan Kepribadian Insan Kamil?. The book?we argue?directs the students to adopt a single identity, disregarding therefore the multi and diverse racial, religious and even cultural background of the students. The paper is simply about a warning of the danger of the implication that the book can come up.

Abstract

Islamic thought has conventionally distinguished between what it calls the People of Hadith (ahlu al-had?s) and the People of Opinion (ahl ar-ra?y). These two segments have improved into a countless current of thought in the modern world, making it impossible to refer to a certain type of thinking as this or that. Nonetheless, the basic characters of the modern Muslim thinking are not quite distinctive from that of the classical-dualistic dichotomy. Hence, the clash of discourse that we witnessed recently in various Muslim worlds is reflective of the intellectual tension between the People of Hadith and the People of Opinion. The clash of discourse that we have just referred to even took the form of physical conflict such as that which happened in Egypt and Algeria. In these two Muslim countries the clash of discourse has turned into the clash of politics, where religious radicalism and absolutism are the dominant features. This paper seeks to provide a critique of this negative development, offering in the process a kind of discourse that can serve as an alternative, namely the discourse of a moderate Islam.

Abstract

Many contemporary Muslim scholars argue that Islamic jurisprudence (fiqh) is not ready to face the demands of the modern era. Modernity is so powerful that it weakens the foundation of fiqh on the one hand, and opens up new opportunities that cannot be reached by fiqh on the other. The method that fiqh has introduced is in itself incapable of adapting to new situation and also incapable of addressing new issues such as the issue of human right, constitusionalism, and the like. It is in this context that contemporary Muslim scholars speak out for reform in the methodology of fiqh as well the application of this methodology in addressing new issues. This paper is concerned with discussing this problem by referring to the thought of some leading authority in this regard such as Abdullahi Ahmed an-Naim, Aboe el-Fadl, and Nasr Hamid Abū Zayd. The paper argues that for these scholars, fiqh has lost its role and power in the modern society because of its discriminative trait. Fiqh must therefore deal with this negative image if it is to restore its influence in the modern civilization.

Abstract

There are two conceptual terms that this paper will try to expose. The first is analogy (qiyās) and the second is istiḥsān, an analogy?like method of extrapolating jurisprudential rules. The paper will try to speak of their relationship in the light of al-Sarakhsī's rationality. In the field of Islamic jurisprudence, the two concepts are often seen as contradicting to one another. The Shafiite jurists are even of belief that using istiḥsān is legally forbidden for that would contradict the general rules of Islamic law. The paper assumes that despite general view of the jurists that istiḥsān is an equivocal method it can nonetheless be fitted into qiyâs. To show that however, the paper would inevitably re-define both qiyās and istiḥsān as proposed by al-Sarakhs?. By exploiting the ideas of al-al-Sarakhsī, the paper hopes that new lights may be shed as far as the richness of Islamic method in jurisprudence is concerned.

Abstract

Corruption has become a kind of endemic in a country like Indonesia. It becomes our serious challenge therefore to deal with it properly and appropriately. This paper argues first and foremost that combating corruption through law enforcement is not enough. It proposes instead, that preventing corruption can only be effective and affective through education. By education we mean that which sharpens and softens the mindset, attitudes, and behavior of the educated. Our schools have hitherto been focusing on the cognitive aspect of education only ignoring in that process its spiritual and affective aspects. What is needed?this paper further argues?is value inculcation in the mind and heart of the students in such a way that when they grow up they can look after themselves as far as avoiding vices is concerned. Value inculcation in turn can only work when a religious education and instruction is involved. Hence, good education is what which incorporates religious teaching and doctrine into the system of education. It is to this point that this paper is destined.
