Abstract

Support in a marital relationship is an obligation for a husband towards his wife and children.Fulfilling the wife's wishes when she has cravings is categorized as a husband's maintenanceaccording to Sheikh Athiyah Saqr, which is also legally obligatory. However, seeing the phenomenonof excessive coveting from wives that often occurs nowadays, it is necessary to classify wives' desires,which the husband must fulfill by law. This research aims to analyze Sheikh Athiyah Saqr's method ofijtihad in his fatwa on the obligation for husbands to fulfill their wives' desires when they desire themand to relate the relevance to current phenomena. This research uses the library research method. Thedata collection technique used is library research. The data analysis technique used in this research isthe descriptive method. The result of this research is that Sheikh Athiyar Saqr in determining thisfatwa used the qiyas and maslahah murlah methods. According to Sheikh Athiyah Saqr, the obligationof a husband to fulfill his wife's wishes when she desires is translated into the obligation of thehusband to provide his wife with daily living. Apart from that, fulfilling the wife's wishes by thehusband is considered to bring benefits to the wife and the fetus. However, it is necessary to limit thewife's wishes which must be fulfilled by the husband, namely wishes that do not violate the Shari'a, donot bring harm, and are still within the limits of the husband's capabilities

Abstract

The burgeoning Muslim population in Indonesia has led to the construction of numerous mosques, yet their proliferation hasn’t significantly impacted community welfare as expected. Dewan Masjid Indonesia, established to foster mosques as centers for worship, community development, and unity, seeks to revitalize their role in modern society. This research delves into the strategies employed by Dewan Masjid Indonesia of DKI Jakarta to achieve this objective. Employing a qualitative descriptive approach, the study utilizes primary data collection methods such as observation, interviews, and documentation, supplemented by a review of existing literature. Data analysis follows Miles and Huberman’s model, involving data reduction, presentation, and conclusion drawing. Findings reveal the implementation of various programs aimed at mosque revitalization, though significant impact remains elusive due to the nascent stage of these initiatives. Recommendations include the recruitment of competent, young members to strategic positions within the council and prioritizing budget allocation towards digital data management and security. By addressing these areas, the council can enhance its effectiveness in revitalizing mosque functions and better meet the evolving needs of the Muslim community in Jakarta. This research contributes to the understanding of mosque management strategies in contemporary Indonesia and provides insights for enhancing the role of mosques in societal development

Abstract

The trauma experienced by women after childbirth often leads to baby blues syndrome, which shows that the shock after childbirth can affect the physical and psychological changes of a woman. This paper aims to examine and analyse the phenomenon of baby blues syndrome experienced by postpartum women, which can affect family harmony and resilience, especially in the concept of Islamic family law. The study in this paper is descriptive qualitative. The data is collected through a library research approach and through the process of reading and searching on the Google search engine with the keywords "baby blues syndrome". This paper shows that baby blues syndrome experienced by postpartum women can be present in the form of trauma and acts of violence both to themselves and to children and even affect household harmony, even in the concept of Islamic Family Law, it is important to remember that a loving, understanding, and supportive attitude towards wives who experience baby blues syndrome is part of the responsibility of husbands and families in carrying out their respective roles. This is evidence that mental readiness before having a child is needed by a wife. This study shows that the baby blues condition is the cause of the breakdown of a family so that a comprehensive study of the phenomenon of baby blues syndrome is needed, which is expected to minimise the occurrence of baby blues syndrome in the household, so that family resilience can be maintained.

Abstract

This study aims to examine the baganyi tradition from the perspective of fikih munakahat, with an emphasis on social and legal dynamics in Minangkabau culture. The initial aim is to understand how baganyi affects the position of wives and children and how Minangkabau customs apply customary values with Islamic legal principles to resolve disputes within the family. This research uses a qualitative descriptive methodology by interviewing family members and looking at how Minangkabau families resolve conflicts. The results show that the baganyi tradition is a form of peaceful effort made by the women of the wife's family to return the husband who left home. This process involves several stages, starting from individual problem solving between husband and wife, then solving between two families with the help of ninik mamak and bundo kanduang. This research also found that the manjapuik sumando yang baganyi custom has a philosophy behind picking up the husband, which is to perfect or repair the rift in the husband-wife relationship. The implication of this research is the importance of integration between customary values and the principles of Islamic law in resolving husband-wife conflicts. Minangkabau custom with the baganyi tradition shows that the intervention of ninik mamak and bundo kanduang can help restore harmony in the household. It also shows that the status of the wife and children must be prioritized in the process of resolving husband-wife problems, so as to reduce the divorce rate and improve family welfare. Thus, this research contributes to a deeper understanding of the baganyi tradition and the importance of Minangkabau customs in overcoming marital problems, as well as its legal implications in the context of fiqh munakahat.

In Indonesial, the position of children in falmily lalw caln be caltegorized into two types, viz legitimalte children alnd illegitimalte children. The definition of al legitimalte child is regulalted in Alrticle 42 of Lalw Number 1 of 1974 concerning Malrrialge which realds: "Al legitimalte child is al child born in or als al result of al vallid malrrialge". This is explalined in Alrticle 99 Compilaltion of Islalmic Lalw which realds: "Legitimalte children alre: (al) born children in or als al result of al vallid malrrialge (b) the result of the legall alcts of al husbalnd alnd wife outside the womb alnd born by the wife". Mealnwhile, in the opinion of Albid, et all., which stalted thalt Whalt is mealnt by al child out of wedlock is al child who is fertilized alnd born out of wedlock vallid. Resealrchers use quallitaltive resealrch, with al libralry resealrch alpproalch. Literalture study is al series of alctivities relalted to daltal collection methods libralry, realding alnd talking notes alnd processing resealrch malterialls. The realsons resealrchers use This resealrch method is to strengthen the philosophicall foundaltion of religious literalcy. This alrticle is strengthened in the Compilaltion of Islalmic Lalw which staltes thalt children born out of wedlock only halve falmily relaltions with his mother alnd his mother's falmily, the consideraltion of such aluthority becomes unfounded becaluse the alrticles thalt were driven by the palnel of judges did not tallk albout aluthority issues judicialry, but tallking albout the issue of children's rights. The legall staltus of children outside of malrrialge alnd the outcome of Sirri's malrrialge is it is obvious thalt the child only hals al civil relaltionship with his mother. Implementaltion of the Constitutionall Court Decision Number 46 of 2010 regalrding the Staltus alnd Legall Position of Children Out of Wedlock alnd the Results of Sirri's Malrrialge in Court Religion caln be alpplied in two walys: First, through the aluthority of the Religious Courts Outside the Lalw on Religious Courts. Abstract

The purpose of this research is to look at how the rights and obligations of husband and wife are applied in the kinship system in Indonesia from the perspective of positive law. This research will also evaluate the extent to which positive law can ensure this equality and find obstacles that hinder it. The research in this article uses normative legal research methodology, it aims to find legal rules, principles, and theories to solve legal problems. The research approach of this article uses a statutory approach. The results show that in forming a fair and harmonious family, couples must have equal rights and obligations. Gender equality in the family sphere can be achieved with a strong commitment from the community, government, and law enforcement agencies. This will greatly benefit all Indonesian people. As a country that is rich in diversity and has various kinship systems such as patrilineal, matrilineal, and parental, the implementation of equal rights and obligations between married couples is what is aimed for in positive law. While each system has its own characteristics, the goal of Indonesian law is to ensure that both husbands and wives can lead equal and fair lives. This is part of a larger effort to create a society that respects and protects the rights of everyone regardless of gender, but it also shows how important it is for the understanding between adat and positive law to achieve the goal of equal rights and obligations between spouses by understanding and applying the principle in various contexts. The implications of this show that equal rights and obligations of husband and wife in the kinship system in Indonesia need an important role from the community, government, and law enforcers in harmony between adat and positive law

Abstract

           Penelitian ini bertujuan untuk memberikan jawaban tentang polemik atau bagaimanakah ketentuan hukum tabattul (membujang) dan juga analisa dampak tabattul dari segi sosial, agama, kejiwaan, dan lainnya. Penelitian ini termasuk jenis penelitian pustaka (library research), dengan metode kualitatif. Analisis data melalui pendekatan analisis kritis deskriptif untuk menghasilkan sebuah kesimpulan. Hasil penelitian ini menyimpulkan bahwa Tabattul (membujang) dalam pandangan hukum Islam itu dikembalikan kepada asas atau pokok hukum dalam menikah, sebagaimana hukum menikah merupakan sunnah Rasul dalam bentuk ibadah kepada Allah, adapun hukum menikah itu wajib kepada seseorang yang sudah membutuhkan serta hasrat untuk menikah dengan catatan mampu, namun apabila seseorang tidak ada hasrat untuk menikah maka hukum yang berlaku atasnya adalah sunnah, dalam arti tidak diwajibkan atasnya untuk menikah. ataupun haram bagi seseorang dilihat dari alasan dan latar belakang seseorang yang akan menjalaninya. Terlepas dari itu menolak menikah dengan alasan ekonomi juga tidak dibenarkan, hal ini karena Allah SWT dalam firmannya telah menjamin kemampuan ekonomi bagi seseorang yang menikah. Seseorang yang tidak mau menikah dengan alasan yang  jelas  adalah sangat merugikan dirinya sendiri dan lingkungannya seperti dari segi kesehatan, sosial, agama, dan lain sebagainya.

Abstract

This study analyzes the aspects of family law in Islam related to parenting in Islamic boarding schools as a form of protection of children's rights, with a case study at Al-Ikhlas Islamic Boarding School, Taliwang District, West Sumbawa Regency. This research focuses on two main aspects, namely how the parenting style in the Al-Ikhlas Islamic Boarding School is applied and how the Islamic family law analyzes the parenting style. Using a qualitative research approach with empirical methods, data were collected through interviews, observations, and documentation. The results of the study show that the parenting style at the Al-Ikhlas Islamic Boarding School involves 24-hour parenting as a means of education and the implementation of the "Demerit Point" system which functions as a step to protect children's rights by replacing physical punishment with educational punishment. This parenting style is considered to be in accordance with Islamic teachings that prohibit acts of violence, although there are still cases of violence that are still handled seriously.

Abstract

Family is the society life cells which are the main foundation for generations’ development and continuity.  Umar Bin Abdul Aziz's leadership model, a famous caliph during the Umayyad caliphate, emphasizing the leadership based on Islamic principles which aimed to build family resilience in society.  Umar bin Abdul Aziz's leadership pattern certainly brought values and messages for ideal family education.  This research aimed at analyzing Umar bin Abdul Aziz's leadership model in the context of building family resilience on the perspective of Islamic family law.  This research used a qualitative approach with analyzing historical documents and literature about the life and policies of Umar bin Abdul Aziz related to family and society. The research findings showed that Umar bin Abdul Aziz's policy in building family tenacity was reflected in his leadership style example, achievements and services which were often referred to as the fifth of Khulafaur Rasyidin. Umar bin Abdul Aziz's policy analysis in building family resilience during his reign as caliph played an important role in strengthening family institutions in Islamic society.  These policies reflected to Islamic principles that promoted justice, protection and empowerment of families. Among these were such as providing assistance to poor families, empowering the family economy and eliminating the tax burden, and protecting the rights of women and children. By understanding Umar bin Abdul Aziz's method for building family resilience, it is hoped that we can draw inspiration and valuable lessons that can be applied in the context of modern family life.
