Abstract

This study aims to see the legal status of the game meat trade in Islamic law. This type of research is field research, using observation and interviews with hunters and players who buy and sell game meat. Trading in-game meat must not violate religious and state regulations. This paper finds that hunting and trading animal meat in the field against protected animals is prohibited by Islamic law. Hunting needs to be supervised by those who care so that the ecosystem is well preserved.

Abstract

The revitalization of religion function —that some people think— is an effective instrument to fight the cancer of corruption and also the implementation of democratization and liberalization of the market. Value systems, moral teachings and spirituality in religion are considered to be opposite of the corruption characters growing in the contemporary society. The more religiosity of a society leads to the expectation for the lower corruption. However, according to the Corruption Perception Index (CPI) data, we will exactly find a tendency of paradoxical phenomena. For example, in the context of Islamic countries, the high of influence for the Muslims belief to their religion is not directly proportional to the commitment of the corruption eradication in the Muslim populized countries mostly. This phenomenon deserves to be shared reflection, to find the answers of classic questions; why does corruption tend becoming habit of Muslim community who are uphold moral principles and integrity in social life and state? It causes this article to discuss the relationship between religion and corruption in general, and also to elaborate it by dealing with the experience of Islamic countries

Abstract

This article aims at describing ḥifẓ al-dīn concept in Dermolo Village Jepara and its philosophical basis. Religion upholding (maintenance) as maqāṣid al-sharī’ah in Dermolo villagers is constructed through noble/ultimate value systematization from cultural hero. Religion is placed as a way of life and is not framed as unorganized religion. This is the form of religion upholding sourced from social text, in which their religiosity motivation are influenced by academic and economic level factors of the society. This form then metamorphs/change into organized religion sourced from written text of holy book as the result of ideological and cultural migration of migrants. The difference of these two types of religions has religiosity paradigm impicitation to its adherents; the first one is accommodative and the other oneis justificative. This article serves the implementation of ḥifẓ al-dīn concept as a result of maqāṣid al-sharī’ah transformation from orthodoxy to contemporary practuced by the society in Dermolo Village..[]Artikel ini bertujuan menggambarkan konsep ḥifẓ al-dīn pada Desa Dermolo Jepara dan landasan filosofisnya. Pemeliharaan Agama (ḥifẓ al-dīn) sebagai maqāṣid al-sharī’ah pada masyarakat Desa Dermolo dikonstruksi melalui sistematisasi nilai-nilai luhur yang diwarisi secara turun-temurun (ultimate value) dari cultural hero. Agama ditempatkan sebagai way of life dan tak terbingkai dalam wadah organisasi (unorganized religion). Inilah bentuk pemeliharaan agama yang bersumber dari teks sosial (social text), dimana motivasi keberagamaannya dipengaruhi oleh faktor tingkat pendidikan dan ekonomi masyarakatnya. Bentuk ini lalu bermetamorfosa menjadi agama organisatoris (organized religion) yang bersumber pada teks kitab suci (written text) sebagai hasil migrasi ideologis dan kultural masyarakat pendatang. Perbedaan kedua jenis agama ini berimplikasi pada paradigma keberagamaan pemeluknya, yang pertama bercorak akomodatif, sementara yang kedua bercorak justifikatif. Artikel ini akan menyajikan implementasi konsep ḥifẓ al-dīn sebagai hasil transformasi maqāṣid al-sharī’ah dari ortodoksi ke ortopraksis yang dilakukan oleh masyarakat Desa Dermolo.

Abstract

Tixl (TXL) is a crypto money project that uses Initial Coin Offering (ICO) to fund its development phase. Various problems underlying the existence of Tixl (TXL) and the proposed solutions are closely related to the condition of society in the information technology era. This study aims to determine the various factors underlying the use of ICO as a way to raise funds, examine Tixl (TXL) as a crypto money project and its position in public life which is reviewed in the perspective of the maṣlaḥa mursala, and token sales transactions in ICO organized by Tixl gmmbH in the perspective of Islamic treaty law. This research is a library research using a conceptual approach and qualitative analysis techniques. This paper shows that there are three factors underlying the use of ICOs as a way to raise funds, namely a change in orientation in the business model, tokenization, and characteristics of business activities. As a crypto money project, Tixl (TXL) cannot provide benefits that are comprehensive or kully, even the harm caused is greater than the benefits. Transaction of token sales in ICO held by Tixl (TXL) is a transaction that is damaged because it is contrary to maqāṣid al-sharī'ah.

Abstract

Nanggroe  Aceh  Darussalam  (NAD)  in  the  reform  era  is authorized  returned  to implement  Sharīah (Islamic law). Its authority is justified by the l egal basis: Law No. 44 of 1999 on Privileges of Aceh, Law No. 18 of 2001 on Special Autonomy for the Province of Aceh as Nanggroe Aceh Darussalam, and Law No. 11 of2006 regarding the Government of Aceh. From this legal basis, then followed by the formulation of regulations ( Qānūn) at the  provincial  level.  But  legislation  of  implementi ng  shari'ah  law  in  NAD  contains problematic juridical. For instance: determining ofsanctions, in the form of whipping and one or two years imprisonment, considered against legislation in higher level. Another problem is that Syar'iyyah Court positions still below on the Supreme Court (MA) as the highest court. The efforts to open “special room” of Supreme Court in NAD is seen as a solution not to take it below on the Supreme Court, seen a contrary to the laws and regulations  are  higher.  Likewise,  the  competence  of  Syar'iyyah  Court  particularly  in handling a criminal cases is still obscure and there is a clash with the competence of the District Court.***Provinsi  Nanggroe  Aceh  Darussalam  (NAD)  pada  era  reformasi  diberi  kewenangan kembali untuk melaksanakan syariat Islam. Kewenangan ini dilandaskan pada payung hukum berupa UU No. 44 Tahun 1999 tentang Keistimewaan Aceh, UU No. 18 Tahun 2001 tentang Otonomi Khusus bagi Provinsi Daerah Istimewa Aceh sebagai Provinsi Nanggroe Aceh Darussalam, dan UU No. 11 Tahun 2006 tentang Pemerintahan Aceh. Payung hukum tersebut kemudian ditindaklanjuti dengan pembuatan Perda atau Qānūnpada tingkat Provinsi NAD. Namun legislasi pelaksanaan syariat Islam di Provinsi NAD mengandung problematika yuridis. Penentuan bentuk sanksi berupa cambuk dan kadar sanksi  berupa  penjara  1  (satu)  atau  2  (dua)  tahun  b ertentangan  dengan  peraturan perundang-undangan  yang  lebih  tinggi.  Problem  lain  adalah  masih  bertumpunya peradilan  Mahkamah  Syar‘iyyah  pada  Mahkamah  Agung  (MA)  sebagai  puncak  peradilan. Upaya pembukaan “kamar khusus” MA di Provin si NAD yang dipandang sebagai solusi agar tidak bertumpu pada MA, justru bertenta ngan dengan peraturan perundangundangan  yang  lebih  tinggi.  Demikian  juga,  kompetensi  Mahkamah  Syar‘iyyah khususnya dalam menangani perkara pidana masih kabur dan terjadi benturan dengan kompetensi Pengadilan Negeri.***Keyword: syariat Islam, Provinsi NAD, Mahkamah Syar’iyyah, yuridis

Abstract

In the 13th century BC Heliocentric concept presented by the Greek philosopher: Aristarchus. But the theory is still a hypothesis, and contrary to the opinion of Aristoteles. Heliocentric theory has not been able to replace Geocentric one, especially with the emergence of Ptolemy (140 AD), known as a pioneer of the Geocentric theory, who wrote a big book titled Almagest which astronomers have refered for centuries. But after Nicolaus Copernicus wrote a book with the title De Revolutionibus Orbium Coelestium, his published heliocentric theory, and finally It was able to undermine Geocentric theory that has long been established. Qur'an which was revealed long ago before this theory has been presented, has explained the astronomical concept such us motion of earth, that aligned with the Heliocentric theory. In the Qur'an there are some verses of earth, moon and sun, among others: Surat Yūnus: 5, al-Naml: 88, Yāsīn: 38, dan 40, al-Anbiyā’: 33, Āli ‘Imrān: 190. According to the exegete such Aḥmad Musṭafā al-Marāghī in his book Tafsir al-Marāghī, that the Heliocentric theory was the one that inline with the Qur'an,and that the Heliocentric theory is a part of the miracle of the Qur'an.

Abstract

This article describes Imam al-Shāfi'i thought in building istinbath Islamic law method and its decition's which evolved from qawl qadīm to qawl jadīd. He is known as the founder of uṣūl al-fiqh science which is arranged systematically-logically and critically. He tried to combine the two schools of thought, those are: Maliki, known as ahl al-ḥadīth that thrives in the Hijaz, and the Hanafi, known as ahl al-ra'y that is entrenched in Iraq. He managed to combine the two schools by taking method good ahl al-ḥadīth and leaving the less ones successfully. Reciprocally, he took the good ahl al-ra’y method and left the poor. It was done for the reason that he had studied with Imam Malik and Muḥammad ibn Ḥasan al-Shaibani, the adherents of the Hanafi schools. The fatwa which he formulated at his living in Iraq is known as qawl qadīm. After he reviewed the fatwa built in Iraq and found the fragility of the arguments as a fundamental, finally, he triggered a new law, namely qawl jadīd which was based on the strong arguments.

Abstract

Khuruj for preach by leaving the family is a must for every member of Jama’ah Tabligh (JT). When khuruj time, JT members cannot conduct their duty as head of the interested household especially to fulfill family economic needs. It is often, they khuruj without leaving enough provision of needs for their family. It is understandable why JT members are often accused as a group that neglects their family not even caring for the family. This research objective is to analyze survival strategy and tactics of the JT family by using a qualitative method. The researcher will conduct an in-depth interview with JT members and their family. Through this field research is found that 1) JT family has a strong belief that their sustenance is the gift of God. 2) Provision of needs that is left by the husband is enough to be utilized as long as being managed with sincerity. 3) JT family has a special survival strategy. So, khuruj is a method of da’wah that does not disturb family economic resilience.

Abstract

This paper describes the prayer problem for Muslim astronauts in space and provides solutions using the al-ḥīlah al-shar'iyyah method. This paper is qualitative with descriptive-analytic research methods with data sourced from the literature. This paper finds that with the al-ḥīlah al-shar'iyyah method, Muslim astronauts can still carry out their obligations as a mukallaf. They get rukhṣah (dispensation), both related to the direction of the qibla and the determination of prayer times. Rukhṣah, as a result of the al-ḥīlah al-shar'iyyah method, helps Muslim astronauts in two conditions at once, first, in their position as scientists who carry out scientific missions. Second, in his position as a Muslim with his obligations to carry out the sharī'ah.

Abstract

Data from the Ministry of ATR/BPN shows that most waqf lands have legal certainty problems. This article wants to look at the case of delaying the certification of waqf land for the Baitussalam Mosque in Semarang City due to the unclear toll road expansion project. The discussion is related to Gustav Radbruch's theory of three fundamental legal values. This paper uses an empirical juridical approach with a qualitative descriptive-analytical research specification. Data were obtained through interviews with several key informants and supported by legal materials obtained from literature studies. The results showed that the delay in certifying the waqf land of Baitussalam Mosque at the Semarang City Land Office was due to legal concerns by residents if the land was affected by the expansion of the toll road project. This article proves that Gustav Radbruch's standard priority teachings, which prioritize justice over expediency and legal certainty, are irrelevant and not ideal. The case of Baitussalam Mosque places legal certainty through waqf land certification as a top priority that must be carried out. Thus, this study confirms the teaching of casuistic priority in the theory of modern legal goals.
