Abstract

As of current, polygamy in terms of polygyny in Islamic law remains to be a debated topic. One of the reasons for the debate is that polygyny is viewed through the lens of men. Research on polygyny viewed from the male sexual perspective is still extremely rare. The research data were gathered through in-depth interviews with four polygyny practitioners to discover the most subtle, private, confidential, and exclusive aspects of polygyny's sexual practice. The study found that the sexual lust on the part of the male (husband) is a form of sexual sublimation and subtle sexuality in the practice of polygyny. Additionally, the findings indicate that the sexual lust is practice for recreational purposes. The research findings may have implications on the emergence of new understandings on the practice of polygyny. Nevertheless, the study raises an intriguing question for future research: why are women willing to be sexually objectified by polygynist men?

Abstract

Abstract: Fiqh for Minorities: a Theoretical Study. Fiqh for Minorities—which in Arabic is called Fiqh al-Aqaliyyât— is a fiqh model that maintains legal association of sharia and the dimensions of a particular community, namely minority Muslim communities in western countries. Fiqh for Minorities is a product of reinterpretation of the existing arguments on the basis of the benefit whichis the spirit of sharia. The designers of this fiqh are Taha Jabir al-’Alwani in his book, Toward a Fiqh for Minorities: Some Basic Reflection, and Yûsuf al-Qarâdawî in his book, Fî Fiqh al-Aqalliyât al- Muslimah. Fiqh for Minorities originated from the accumulation of the concerns of Muslim minority communities in western countries when it should be doing something related to their religion. This fiqh is designed to provide guidance and a handle on the things that are prohibited and permissible for Muslim minorities living in western countries to carry out their obligations as a Muslim. Keywords: fiqh, minority, shariaAbstrak: Fikih Minoritas: Suatu Kajian Teoretis. Abstract

Abstract: The implementation of worship in the time of the COVID-19 pandemic, especially congregational worship, has led to a debatable problem among Muslims, including Muslims in Indonesia. Various Islamic groups in Indonesia share different opinions and views on the practice of worship during the pandemic. On the one hand, some groups reinforce that the COVID-19 pandemic should not become a barrier or hinder the religious practices. On the other hand, some others insisted that the practice of worship during the COVID-19 period must comply with predetermined health protocols. If necessary, it must be temporarily stopped to avoid the spread of the COVID-19 cases. In this regard, the Indonesian Ulama Council (MUI) issued fatwa number 14/2020 concerning the implementation of worship in the COVID-19 outbreak situation. This article examines and explores the basis and considerations of the MUI in establishing a fatwa regarding the implementation of worship during the COVID-19 pandemic. Using qualitative analysis methods and the theory of maqāsīd al-sharīa, this research concludes that restrictions on the implementation of worship during the pandemic - or even prohibiting the practice of congregational worship for prone areas COVID-19 transmission - are based on considerations of benefit,. which is the essence of maqāsīd al-sharīa. The aim is to ensure five primary things (faith, soul,  mind,  offspring, and wealth). Hence, anything that can interfere with or threaten the existence of these five things must be avoided.

Abstract

The current Covid-19 pandemic has resulted in economic problems, but on the other hand, learning must still be carried out using computer or laptop technology that has software in it. The problem discussed in this article was how the law used pirated software during the Covid-19 pandemic. This research used a qualitative approach by interviewing students at the State Islamic University of North Sumatra. According to the results of the author’s research, it showed that this pandemic condition has changed the learning system from offline to online which had a huge impact on all levels of society. Copyright regulation and software requirements were needs that have reached the dharuri level and were included in the maqashid Sharia which aimed to maintain reason and protect human property so that they were not trapped and were not left in ignorance. Therefore, the result of this research was that the use of pirated software during the COVID-19 pandemic was permissible due to the pandemic period that has greatly changed the economic system of human beings, and will return to the original law, which was haram (forbidden) when this pandemic period ended, and the economy was back on its feet.
