Abstract

This research was conducted to examine the DSN MUI fatwa related to sanctions on fines and compensation for customers due to delaying payments, the sanctions given to capable customers who delay payments and to find out the application of the DSN-MUI Fatwa. This research was a qualitative research with primary data sources from interviews with the marketing coordinator and the service coordinator and documentation. The analysis in this discussion was descriptive qualitative data analysis. The results of this study indicate that the application of sanctions for fines and compensation for customers by banks based on the MUI DSN fatwa there were still some scholars who do not agree with this because the fatwa does not include specific criteria, thus the analysis of all Islamic banks taking mortgages in Islamic banking are capable people, but on the way there are those who are constrained by payment, such as traders whose income is uncertain. In this study it was also found that this was enforced by Islamic banking due to disciplining customers and company losses.

Abstract

Several previous studies on Islamic capital market screening have not conducted an in-depth exploration of Sharia screening on a country's index over different periods. This study aims to examine sharia screening performed on entities registered in the Jakarta Islamic (JII) Index 2015–2019. The study uses a descriptive quantitative approach by analyzing and describing Sharia screening in entities registered in JII. The research results show that the Financial Services Authority has properly screened Sharia law in registered entities according to the established criteria, as evidenced by looking at the qualitative aspects of entities that do not carry out activities that contain elements of usury, gharar, and maysir. Meanwhile, in the quantitative aspect, the entity has tracked the appropriateness between the percentage of interest-based debt of no more than 45 percent and non-halal income of no more than 10 percent. However, the OJK and MUI criteria still show some weaknesses compared to the screening criteria that apply in other countries

Abstract

Agricultural land has a large area and is useful for farmers, but not all villagers work as farmers due to limited funds and need money, so they prefer to rent it. This study aimed to determine the application of the ijarah contract and its impact on the agricultural sector. This study uses a qualitative method by applying a case study approach to obtain information directly from informants based on current cases. This study indicates that the application of agricultural land leases in Garung Village is following Islamic law. Several informants differ in explanations regarding the nominal fee of ujrah, year, and the expiration of agricultural land lease agreements. At the same time, the impact on landowners cannot improve welfare from religious indicators and souls. Still, it can improve welfare from indicators of religion, life, mind, descent, and property in terms of land tenants.

Abstract

The National Sharia Council-Indonesian Ulema Council has issued a fatwa regarding sukuk, namely Fatwa Number 72 of 2008 concerning SBSN Ijarah Sale and Lease Back. The concept of sukuk in the DSN-MUI Fatwa uses the concept of hyrid contracts. The research method used is normative juridical. While the type of this research is descriptive analysis and the data collection technique is literature study. The data analysis method is qualitative. The results showed that; first, takyif fiqh in the SBSN scheme uses the al-bai 'wa al-isti'jar contract, which is a combination of the bai' contract and the ijârah contract; second, the hybrid contract concept in the DSN-MUI Fatwa No. 72 regarding SBSN Ijarah Salse and Lease Back is a hybrid contract agreement that does not violate the rules and boundaries of the hybrid contract theory that have been formulated by the scholars.
