Abstract

Artikel ini mendiskusikan reaktualiasi hukum Islam di Indonesia, gagasan, posisi, dan peran sosial politik Munawir Sjadzali dalam perpolitikan Orde Baru, serta pengaruhnya terhadap bentuk dan isi hukum Islam. Setelah deskripsi tentang latar belakang kehidupan, karier serta pencarian intelektual Munawir, didiskusikan gagasan reaktualisasi dan polemik yang menyertainya. Penulis berargumen bahwa persoalan metodologilah yang sesungguhnya menyulut perdebatan. Keberatan banyak pihak tertuju pada lemahnya dasar metodologis gagasan reaktualisasi yang ingin melampaui batasan tafsir teks tradisional. Di samping itu, debat publik ini juga menggambarkan adanya perubahan dan penyebaran otoritas keagamaan dalam hukum Islam. Sebagai akibatnya, hukum Islam tidak lagi menjadi monopoli kaum agamawan yang secara tradisional disebut ulama. Kini, ia direformulasi oleh organ-organ negara melalui legislasi aturan-aturan Islam, para hakim dan institusi peradilannya.

Abstract

Beberapa sarjana Muslim pada periode Islam awal telah mencurahkan perhatian yang cukup besar dalam pengklasifikasian ilmu pengetahuan dengan tujuan mengorganisasikan pengetahuan yang dapat ditransmisikan dengan cara sistemik kepada generasi berikutnya. Upaya pengklasifikasian pengetahuan ini semestinya memberikan kontribusi yang cukup signifikan dalam lingkungan perpustakaan atau pusat informasi Islam, terutama untuk menempatkan disiplin pengetahuan tertentu atas sebuah dokumen dari seluruh organisasi pengetahuan yang ada. Di sisi lain, skema klasifikasi pengetahuan yang dihasilkan sarjana-sarjana Barat seperti DDC, LCC, dan UDC telah mendominasi lembaga-lembaga informasi di seluruh dunia termasuk negara-negara Islam. Bagaimanapun, akhirnya disadari bahwa skema-skema klasifikasi tersebut tidak memuaskan institusi-institusi informasi Islam karena mempunyai beberapa kelemahan dan perlakuan yang kurang memadai untuk mengorganisasikan dokumen-dokumen dalam bidang studi keislaman. Berkaitan dengan hal tersebut, tulisan ini berusaha mengkaji berbagai upaya yang telah dilakukan perpustakaan-perpustakaan beberapa negara Islam seperti Arab Saudi, Iran, Pakistan, Indonesia, dan Malaysia dalam mengembangkan skema klasifikasi pengetahuan Islam. Di samping itu, berbagai problem dan tantangan ke depan yang dihadapi perpustakaan-perpustakaan tersebut sebagai akibat sistem klasifikasi Islam yang diterapkan secara berbeda antara satu negara dengan lainnya juga dibahas dalam artikel ini.

Abstract

This paper looks at the Hizbut Tahrir of Malaysia and places it in the context of the wider and deeper development of Muslim politics and mass mobilisation across Asia and the world at large. While much has been written about the Hizbut Tahrir of Indonesia (HTI), little is known about the HTM. This paper traces the initial arrival of the HT to Malaysia, via the network of Malaysian students and activists who were educated abroad and who have managed to build their own inter-personal networks and relationships outside the parameters of mainstream political Islam and the state apparatus in the country. Furthermore it is interesting to note that HTM in Malaysia takes its own unique stand on Islamic issues with relation to the mainstream Islamic party PAS and the Malay-Muslim UMNO party. The paper therefore attempts to locate the ideological positioning of the HTM in the wider context of Islamist politics in contemporary Malaysia and to analyse its relationship to the wider currents of ethno-communal as well as religious politics in the country as a whole.

Abstract

Dalam artikel ini, penulis mendiskusikan perkembangan studi tentang dunia Arab secara khusus dan studi ketimuran secara umum di kalangan intelektual Rusia hingga awal abad ke-20. Lebih jauh, dibahas juga peran akademik orang-orang Arab-Rusia yang telah membuat dunia Timur semakin dikenal di kalangan orang-orang Rusia. Salah satu tokoh utama yang ikut merintis hubungan bagi universitas-universitas di Rusia dengan dunia Arab adalah Shaykh Muḥammad Ayyād al-Ṭanṭawy, seorang ulama al-Azhar yang kemudian pindah dan menetap di Rusia pada tahun 1840. Karir Ṭanṭawy sebagai profesor studi ketimuran dan kehidupan serta peranannya dalam memperkenalkan Arab-Islam kepada kalangan Rusia lewat berbagai kerja dan tulisannya banyak dibahas dalam artikel ini. Selain Ṭanṭawy, tokoh yang tak kalah pentingnya adalah Georgi Murkos, seorang Arab-Kristen dari Damaskus, yang melanjutkan pendidikannya di Universitas Petersburg, kemudian menjadi professor di universitas yang sama dan menjadi salah satu tokoh Arab-Kristen.

Abstract

Nigeria is a country with a centuries’ long tradition of Islamic revivalism and activism. It was the impact of the activities of the 17th century scholars of Nigeria that culminated in the success of the 19th century tajdeed movement that brought about the emergence of the muslim caliphate of Sokoto. British imperialism brought an end to the caliphate in the beginning of the 20th century, the circumstances of which have been consistently challenged mainly by the ulama and their followers ever since. Some contemporary scholars such as Shaikh Abubakar Mahmud Gummi, former Grand Qadi of Northern Nigeria, contributed significantly in the new dimension to the roles of muslim scholars in the government. Since 1999 muslim scholars have taken on new roles in the administration of states, serving as commissioners for newly established ministries for Religious Affairs, as special advisers, or directors of commissions like Hisbah, Hajj, Masjid, Moon Sighting, and other related government bodies, with full salaries and other benefits unlike ever before in the Nigerian system. This new role of ulama and its impacts in the governance of the contemporary Nigeria is what this paper intends to investigate and expound.[Nigeria merupakan sebuah negara dengan tradisi revivalisme dan aktivisme Islam selama berabad-abad. Hal itu terkait dengan upaya para ulama Nigeria abad ke-17 yang berpuncak pada keberhasilan gerakan tajdid pada abad 19 dengan munculnya kekhalifahan muslim dari Sokoto. Imperialisme Inggris mengakhiri kekhalifahan ini pada awal abad ke-20, yang terus dilawan oleh terutama para ulama secara konsisten. Beberapa ulama kontemporer seperti Syaikh Abubakar Mahmud Gummi, mantan Grand Qadi Nigeria Utara, memberikan kontribusi signifikan dalam membentuk dimensi baru peran ulama dalam pemerintahan Nigeria modern. Abstract

The following article is analyzing both Fuat Sezgin’s approach to Western scholarship of hadith and the views of some non-muslim scholars, which give either support or criticism against him. Some questions have been discussed; to what extent is Fuat Sezgin influenced by Western methods of hadith research and to what extent does he argue against the methods of non-Muslims? To what extent does he persist on arguing the reliability of hadith literature? To what extent does he base his argument on muslim hadith literature? To what extent does he digress from the classical methodology of hadith research? The following pages show that Sezgin has been familiar with non-Muslim scholarship of hadith research. Yet instead of following Western scholars’ approaches and premises on the early hadith literature, he severely criticized them and decided to follow the mainstream of Muslim scholars’ belief in the historicity of hadith transmission and collection. Fuat Sezgin focused his criticism on Goldziher’s historical claims. If one classifies Western discourse of hadith literature, Sezgin and Azmi can be located in the same line for their similar approach and way of handling the early literature of Islam. Both Sezgin and Azmi have been involved in the discussion on the reliability of early Islamic transmission. However, in contrast to Muslim scholars, who generally believe that the process of hadith transmission during the first century was mainly oral, they insist on arguing that many hadiths were, in fact, recorded in writing from the earliest times.

Abstract

Wacana tentang slametan dalam masyarakat Muslim Surinam keturunan Jawa di Belanda sesungguhnya, di satu sisi, merepresentasikan sebuah pertarungan identitas kultural keagamaan di antara mereka dan, di sisi lain, menunjukkan sebuah hubungan yang kompleks antara Islam ‘resmi’ dengan tradisi Jawa. Tulisan ini membuktikan bahwa praktek slametan dalam masyarakat Muslim Surinam keturunan Jawa di Belanda ternyata hampir tidak mengalami perubahan. Perubahan yang ada hanya berkaitan dengan aksesoris upacara sebagai akibat dari penyesuaian terhadap kondisi geografis dan iklim setempat. Hal ini tidak ada artinya dibandingkan dengan antusiasme yang sangat besar --khususnya bagi kelompok masyarakat Muslim Kejawen untuk melestarikan semua warisan budaya dari pendahulu mereka yang adalah orang Jawa. Tulisan ini pada akhirnya menunjukkan adanya pertarungan identitas antara kelompok Muslim Kejawen yang bangga dengan “agama jawa”-nya dan kelompok moderat dan reformis yang ingin menjadi Muslim yang sebenarnya.

Abstract

It is often argued that Islam is not compatible with modernity. This can be seen for instance in the fact of the problem that Islam faces to the challenge of universal values of human rights. Built on this supposition, the present article discusses on the great extent the question of religious freedom in Islam. As freedom of religion in the framework of universal declaration of human rights can mean as freedom to change religion, this contradicts to Islamic prohibition of apostasy, punishable with death penalty. The author argues that Islam in fact guarantees religious freedom. This is clear from the Quranic injunctions assuring the freedom of choice whether to embrace Islam or not. Such a freedom is however often contradicted to one prophetic tradition sanctioning death penalty for apostasy. In her view, the author believes that the hadith more in attunes to the political strategy of the prophet to safe Muslim community from any acts of treason or sedition. Death penalty for apostasy is thus not related to the mere personal crime of changing religion but more that of public law related to war or crimes against state. More relying on the modern interpretation of the Quranic verses as well as the prophetic traditions, the author concludes that Islam is in conjunction with the modern values of religious freedom in which personal choice of religion or belief is the backbone of human rights.

Abstract

One impact of globalization is that contemporary issues will rapidly come to fore. In fact, they frequently do not derive from Islamic knowledge or Islamic ethics. They even often do not go with Islamic identities. In sum, such issues will become a challenge for Islamic studies. Due to the challenges, it is notable to pose a question: whether viewpoints having been exercised by scholars in Islamic studies are workable for strong globalization stream or vice versa? Seemingly, if the perspectives do not stand for new global phenomenon, Islamic studies will be marginalized or put aside by both muslims and others. Accordingly, this is because of worldly affairs demand. Given this, efforts leading to the invention of new perspectives are urgent. Scholars will become wiser in facing and handling challenges of the globalization. This come true since they will pose them as inspiration for inventing perspectives called for. This is reasonable due to the fact that they will get an opportunity to explore new perspectives in dealing their subjects. Subsequently, they will be able to make more contribution for social life because of their workable perspective. This seems to be a guarantee to draw attention of a society or community.

Abstract

At present, several tarekats surfaced in the urban centers of Indonesia and continued to perform as a vehicle of social and cultural cohesion. The emergence of these so-called neo-tarekats (neo-sufi mystical orders) introduced rational reference to the sacred texts and Islamic law and rejected the close association between tarekats and the veneration of saints and holy places as generally known as silsilah in the old version of tarekats. This article depicts a close look at of Tarekat Kadisiyyah, an example of the neo-tarekats, located in central Bandung city of West Java. Most of the followers of this tarekat come from young and educated among urban people in Bandung. mursyid (Ar: murshid) of this tarekat refers to a person named Suprapto Kadis, who experienced the absence of an outward mursyid (lahiriah), but received direct guidance from Allah. There is no chain of transmission of mystical knowledge from a special mursyid to him. This kind of mursyid reminds us the concept of uwaysiyah in classical Islamic literature. Uways is the person who knew the prophet Muhammad but never met him in person. Another concept can be used to analyzes this phenomena is the notions of khidr functioning as an invisible guide for the mursyid. Tarekat Kadisiyyah trained its students that one should become his own self in order to know Allah. In doing this, Tarekat Kadisiyyah concluded that shari>‘ah is important as it is the vehicle to gain closeness to Allah.
