Abstract

The research question were whether or not the criminal disparity in rape cases, already complied with a basic legal value. Accordingly, the objective of the research was to identity the compliance between criminal disparity in rape cases and the basic legal value, and the causes of criminal disparity in rape cases. The research was juridical normative adopting descriptive qualitative method and deductive conclusion. The criminal disparity in rape cases has failed to optimally deliver a basic legal value. Different punishments in the sentences in general has contained a fair justice since the punishment tended to be proportional, in the sense that it complied with the qualification of the alleged crime. However, it lacked of legal certainty and benefits, as the punishment failed to compensate the sorrow of the victim and the embarrassment of her family.

Abstract

The purposes of this study are: 1) to determine the growth of operational expenditure, capital expenditure, and funds equity on govermental working units in Sigi; 2) to determine and analyze simultaneous influence of operational expenditure and capital expenditure of fund’s equity on govermental working units in Sigi; 3) to determine and analyze the influence of operational expenditure on fund’s equity; 4) to determine and analyze the influence of capital expenditure on funds equity in govemental working units of Sigi. The results shows that the R2 value of 0,968 or 96,8% means that operational expenditure and capital expenditure have influence on fund’s equity of 96,8% in govermental working units of Sigi. While 3,2% influenced by variable that are not studied.

Abstract

This research intends to: determine and analyze simultaneous and partial influence of transformational leadership style, work motivation and organizational culture on officials’ performance in The Department of Transportation Central Sulawesi province. Sample in this research consists of 93 officials in The Department of Transportation Central Sulawesi Province. The results show that: transformational leadership, work motivation and organizational culture simultaneously and partially have significant influence on officials’ perfomance in The Department of Transportation Centar Sulawesi Province.

Abstract

This study reviews How Legal Protection for debtors in financial contracts Consumers in Palu? And How do legal settlement in the event of default by the parties to the consumer finance ?. The purpose of this study was to determine and assess the legal protection for debtors in consumer financing contracts in the city of Palu, as well as about the legal settlement to do in the event of default by the parties to the consumer financing. Research using this type of juridical empirical research using descriptive analysis method with approach Regulations Act and sociological approach which aims to describe a systematic, factual and accurate information about the implementation of consumer financing agreement with the Fiduciary. The data used in this research is primary data obtained by means of an inventory of documents through library and field study that is by interview , made ​​questionnaires filled by the respondents .        The study concluded that in protecting consumers in the financing contract is by banning the inclusion of standard clause in every contract of consumer financing in accordance with the rules of Article 18 of Law No. 8 of 1999 on Consumer Protection. Regarding defaults that occurred in consumer financing agreement between the consumer with Financing Company is the delay in arrears monthly installments are not in accordance with the contract. The sanction of debtor default is the withdrawal of fiduciary security object, but the execution must comply with regulations that register objects fiduciary Online at the Directorate General Law Administration of the Ministry of Justice and Human Rights of the Republic of Indonesia. Researchers suggest that the need for oversight and review of the government regarding the standard contract made by the finance company. The Government should further reinforce the regulation of consumer financing agreement where the latter for the perpetrators of violations of consumer financing given strict sanctions.

Abstract

The purposes of this research were 1) to describe the leadership of the Head of Lariang District, North Mamuju Regency; 2) to determine the roles of Lariang District Head Leadership to achieve maximum productivity of employee performance. The method used was qualitative and informants were sampled using accidental sampling technique amounting to 6 (six) people. The results showed that the leadership weakness at Lariang District Office was caused by 1) the leader’s inability to show a character strength or a positive identity to draw admiration, respect, and trust in his/her advantages from the subordinates; 2) the internal motivation weakness of the leader to inspire the subordinates to work to fulfill the whole purposes of the organization; 3) the lack of the leader’s capacity in terms of knowledge and skills; 4) the lack of the leader’s attention to the subordinates’ needs for education and career development. Therefore, the researcher predicted that the transformational leadership theory initiated by Bass was considered to be suitable to be applied by the leader of Lariang District Office, comprising four dimensions, namely Attributed charisma, Inspirational motivation, Intellectual stimulation, and Individualized consideration.

Abstract

This study aimed: to determine and to analyze the implementation of Village Fund Policy at Karave Village Bulutaba District North Mamuju Regency. This study used the theory of van Metter and van Horn, stating six indicators of policy implementation, namely (1) Policy standards and targets, (2) Resources, (3) Interagency relationship, (4) Characteristics of implementing agencies, (5) Disposition, and (6) Conditions of social, political, and economical environment. The research method used was qualitative, and the informants were determined purposively deemed to understand the problems studied, they were Head of Village Governance Division of North Mamuju Board for Community and Village Governance Empowerment, Head of Karave Village, Secretary of Karave Village, Speaker of Karave Village Consultative Body, and Public Figures of Karave Village. Types of data used were primary and secondary data. Data were collected through observation, interviews, and documentation. The results showed that (1) the Policy standards and targets could be concluded that it had been fulfilled marked by the of priority determination process of public needs before conducting Village Fund Policy. (2) Resources: the implementing staff were critically incompetent and lacking ability and skill in the implementation of Village Fund Policy resulting in unoptimal management of Village Fund. (3) Communication and implementing activities: uncommitted implementers in communication and coordination with related parties resulted in unoptimal implementation of Village Fund Policy. (4) Characteristics: the implementing agencies were not cooperative in the program implementation, resulting in unoptimal implementation of Village Fund Policy. (6) The indicator of economical, social, and political environmental conditions was unmet due to the existence of actors or community and community groups who rejected Village Fund Policy because they considered that the implementers did not favor local communities.

Abstract

This study aims to: (1) determine and analyze the participation of the community in terms of aspects of planning, implementation, and oversight in the transmigration program in UPT. Umpanga village, West of Bungku district, Morowali regency; and (2) determine the factors that support and obstacles in the public participation in transmigration program in UPT. Umpanga village, West of Bungku district, Morowali regency. The population of this study is all the community migrants who live in UPT. Umpanga village, West of Bungku district of Morowali regency as many as 125 families. These families consist of 70 families of TPS (Transmigration of Indigenous Peoples) and 55 families of TPA (Transmigration of Original People). As the relatively large number of population in this research, the researchers set a sample of 56 households using simple random sampling technique. Data were analyzed using qualitative descriptive analysis with frequency tables and triangulation. The results of this study indicate that community participation in terms of aspects of planning, implementation, and control have properly managed in the transmigration program in Unit of Transmigration Settlement (UPT) Village Umpanga District of Bungku West Morowali and factors that support community participation in the transmigration program in UPT. Umpanga village, including the motivation of citizens to involve in the transmigration program and the new jobs vacacies after the program has been implemented in the village. Meanwhile, the factors that impact the public to participate in the resettlement program in UPT. Umpanga village, include the  understanding of community regards to the transmigration program and the limited opportunities to participate because people are focused on to earn more money in order to fulfill their basic needs.

Abstract

The purpose of this study are: (1) To determine and analyze the projection of population growth and waste generation in the city of Palu in the period 2015-2025; (2) To determine the requirement of the waste facility in the city of Palu in the period 2015-2025. (3) To acknowledge the waste management in the city of Palu. According to the data survey in the year of 2000 and 2010 and it is analysed by exponential method, the population of Palu city have increased on average by 1.69% per year. The population of Palu city in 2015 has accounted by 366.134 inhabitants with waste generation ammounted to 1.007m3 per day. Meanwhile, the population of Palu city is projected to increase by 2025 with waste generation amount of 1.192m3 per day. Therefore, The number of garbage trucks facility in 2025 are estimated by 74 units while the number of waste trucks have operated in 2015 by 63 units. In addition,  the number of garbage containers in Palu city have operated by 126 units in 2015 and it is estimated to increased by 149 units in 2025. There are several strategies to improve the quality and quantity of solid waste management in the city of Palu;1)waste management should be equipped with sufficient and reliable management; 2)the local government should extend the dissemination to the public with the aim to build a mind-set that public participation in reducing the amount of waste is more important than providing handling facilities.  So, this strategies will improve the awareness and dicipline of citizens to apply 3R (Reuse, Reduce, Recycle) and composting; 3)strengthening cooperation and coordination with the relevant stakeholder with the aim to find alternative source of funding as well as improving the quantity and quality of waste management facilities in the Palu city.

Abstract

The objective of this research was to analyze the implementation of village fund allocationpolicy in Mpanau Village Sigi Biromaru Subdistrict Sigi Regency and the factors that influencing the implementation of the policy. The research used of theory implementation   Edward III. The techniques of data collection were observation, interview and documentation. The data were analyzed qualitative descriptively. The research results showed that the implementation of village fund allocation policy in Mpanau Village Sigi Biromaru Subdistrict Sigi regency was not effective. It was seen from the four indicators of implementation policy such as Communication, Resources, Disposition and Bureaucratic Structure. Have not run well and the factors that influencing the implementation of policy Mpanau Village Sigi Biromaru Subsdistrict Sigi Regency which were society participation, working environment and regional condition.

Abstract

This research intends to define and analyze the simultaneous and partial influence of motivation, commitment, work environment, and job stress on civil servants’ performance in Madani Hospital of Central Sulawesi Province. It involves 218 officials as respondents and uses descriptive approach with multiple regressions analysis. The results find that motivation, commitment, work environment, and job stress simultaneously and partially have significant influences on civil servants’ performance in Madani Hosptila of Central Sulawesi Province.
