Advances in technology has a big contribution in the spread of pornography, even it has a considerable advantage for the business of pornography. On the other hand, emerging social restless and the government will also impact negatively on pornography especially with regards to the mentality of the young generation. Nowadays, pornography can be enjoyed by all people start from children to the elders by the help of technology it makes easier for people to access this site.The offenses of pornography set in Law Number 44 of 2008 was full of controversy even after have been set, it still reap the rejection of the society. The Government considers that it is time for pornography to regulate specifically so it will not cause restless in the community even though it's been many laws offering pornography. Dangers of pornography take a big part in the mental damage of the young generation it becomes a specific reason why this case needs to be set firmly.In the politics of criminal law view, it is necessary to study in-depth whether the govern-ment's action to regulate pornography in a special law by imposing criminal sanctions are appropriate with the prospects of the people. Regulation of pornography needs to be completed perfectly or it will be better if the regulation be eliminated completely. Conclusions taking technique of this study is using deductive analysis.

Permasalahan penelitian ini: Pertama, bagaimanakah pelaksanaan kewajiban PT Arara Abadi wilayah operasional Desa Kota Garo Kecamatan Tapung Hilir Kabupaten Kampar sebagai investor bidang usaha HTI? Kedua, bagaimana upaya Pemerintah Provinsi Riau mengawasi pelaksanaan kewajiban investor bidang usaha HTI khususnya terhadap PT Arara Abadi? Tujuan penelitian: Pertama, untuk menganalisis pelaksanaan kewajiban PT Arara Abadi wilayah operasional Desa Kota Garo Kecamatan Tapung Hilir Kabupaten Kampar sebagai investor bidang usaha HTI. Kedua, untuk menjelaskan upaya Pemerintah Provinsi Riau mengawasi pelaksanaan kewajiban investor bidang usaha HTI khususnya terhadap PT Arara Abadi.  Hasil penelitian diketahui bahwa dari beberapa kewajiban yang menjadi fenomena dikaitkan dengan keadaan di PT Arara Abadi ternyata hanyalah kewajiban mematuhi semua ketentuan peraturan perundang-undangan yang masih terkendala. Implementasi SK Menteri Kehutanan tentang pemberian izin kepada PT Arara Abadi tentunya sebagai pemegang izin PT Arara Abadi haruslah mentaati seluruh aturan.  Desa Kota Garo juga ada konflik lahan antara PT Arara Abadi dengan masyarakat tempatan, baik perorangan maupun dengan kelompok tani. Hal itu, disebabkan persoalan tidak dilaksanakannya kewajiban enclave terhadap lahan yang belum tuntas. Ketetapan diktum keempat SK Menhut No. 743/kpts-II/1996 salah satunya tidak dilaksanakannya kewajiban inclaving. Upaya Pemerintah Provinsi Riau mengawasi pelaksanaan kewajiban investor bidang usaha HTI khususnya terhadap PT Arara Abadi dikaitkan dengan persoalan konflik lahan antara PT Arara Abadi dengan masyarakat, hanyalah dengan melakukan mediasi. Kemudian agar tidak memperlebar konflik Dinas Kehutanan mengupayakan terbangun kemitraan antara Perusahaan dengan masyarakat. Untuk menjalin kemitraan sudah ada dasar hukumnya yang mana diatur tanaman pokok sebesar 70%, tanaman kehidupan sebesar 20%, dan tanaman lainnya 10 %. Dalam tanaman kehidupan tersebutlah masyarakat bisa bermitra dengan perusahaan. Kemudian untuk mengawasi kewajiban pelaksanaan HTI upaya yang dilakukan Pemerintah Provinsi Riau adalah melaksanakan monitoring dan pengawasan, tetapi tidak dapat dilaksanakan secara keseluruhan, karena keterbatasan dana.

The rising population has the potential to increase the need for land, on the other hand faced with the fact that the land is not increased. The most accessible target is forest area. This is what opens up opportunities for forest encroachment. The TWA Holiday Resort Forest area initially includes production forests. Part of the area has been converted into plantation area. To save some of it again, the Minister of Forestry issued Decree No. 695/Kpts-II/1990 which establishes its transition function to TWA (Holiday Resort). The condition of TWA Holiday Resort area is now very worrying. The purpose of this study is to examine, analyze the implementation of forest protection principles in the case of the TWA Holiday Ressort Expansion Area in Labuhan Batu Selatan Regency and to mnyusun Concept of Settlement of TWA Holiday Resort in Labuhan Batu Selatan Regency. The type of research used is empirical juridical consisting of primary data and secondary data. Primary data was conducted with field research at TWA Labuhan Batu Selatan. The result of the research shows that Implementation of forest protection in Labuhan Batu Selatan Regency has not run well because of the lack of firmness of local government apparatus and law enforcement officers in overcoming the encroachment of TWA forest area, so there are still many activities of encroachment done by society even there which established private elementary and junior high schools, village head offices and other buildings. The concept of completing the encroachment of TWA Holiday Resort in the future is to renew the law by improving Law No. 41 of 1999 on forestry, because in article 78 of the Forestry Law the criminal offense starts from letter d, article 78 a, b, and c not mentioned sanctions, In addition to legal reforms, which need to be improved such as law enforcers, the parties that form and apply the law must be good, facilities or facilities that support law enforcement must also be good, the community or the environment in which the law is applied must support, this is so that efforts in tackling the encroachment of TWA area can be more effective.

Notary and Land Registrar (i.e. Pejabat Pembuat Akta Tanah [PPAT]) are general officials authorized to make authentic deeds. If someone is serving as a notary as well as being able to carry out his position, then he must be replaced by someone else temporarily. During the leave period, the land certificate they make is not authentic. The certificate sourced from and made by Notary or PPAT Deed is an authentic one that has perfect verification power. Therefore, every Notary or PPAT in carrying out the position should always be careful and aware of the consequences that can be caused on each deed he makes.

Introduction to The Problem: The use of information technology innovations in banking today through digital platforms or online or known as financial technology (commonly abbreviated as fintech) can indeed provide financial services to the public at a lower cost than traditional banking methods. But behind the sophistication of technology as well as an increase in banking risk, especially if the regulations that govern it have not been comprehensive.Purpose/Objective Study: This paper examines the development of various regulatory regulations in the field of fintech in Indonesia.Design/Methodology/Approach: The research method used in this study is qualitative through normative legal research. The obtained data analyzed by statutory approach to interpret the existing legal rules on Indonesian Banking.Findings: The results obtained are that the existence of fintech which is considered as disruptive innovation (disruptive innovation) has changed the old market and revolutionized the workings of traditional financial institutions. Therefore, the government through the financial authority that is authorized to respond to the development of fintech in the Indonesian banking system by making various regulations. In addition, the development of fintech business integration with banking institutions must also be a concern for both parties so that the development of fintech is not only a disruption but can also be a safe innovation for customers to use.Paper Type: Research Article

Perlindungan hukum masyarakat hukum adat atas hutan adat merupakan kewajiban pemerintah yang harus dipenuhi sebagaimana yang diatur dalam Pasal 18B UUD 1945. Fokus permasalahan yang dibahas dalam penelitian ini adalah bagaimana prinsip-prinsip pengaturan Hutan Adat berdasarkan Putusan Mahkamah Konstitusi No. 35/PUU-IX/2011 dan Bagaimana peran pemerintah daerah dalam mewujudkan Perlindungan Hukum Masyarakat Hukum Adat pasca Putusan Mahkamah Konstitusi No. 35/PUU-IX/2011.Hasil penelitian menunjukan bahwa Prinsip-Prinsip Pengaturan Hutan Adat dalam Putusan Mahkamah Konstitusi No. 35/PUU-IX/2011 adalah: a) Hutan adat terpisah dari Hutan Negara; b) Hutan adat merupakan hutan hak; c) Definisi Hutan adat adalah hutan yang berada dalam wilayah masyarakat hukum adat, dan; d) hutan adat merupakan hak yang dimiliki oleh masyarakat hukum adat. Sedangkan peran pemerintah daerah dalam mewujudkan perlindungan hukum masyarakat hukum adat atas hutan adat pasca Putusan Mahkamah Konstitusi No. 35/PUU-IX/2011 adalah dengan menerbitkan surat keputusan kepala daerah tentang pengakuan, perlindungan masyarakat hukum adat dan wilayahnya termasuk didalamnya hutan adat

Principally, the responsibility of shareholders based on positive law is limited to the amount of capital deposited. In accordance to Article 3 (1) of Company law number 40 year 2007, it confirms that company shareholder is not subjected to any personal liability for commitments made on behalf of company and shall not be liable for any loss exceeding its shares. The aim of this research is to figure out whether the subjective requirements of limited liability company establishment is absolute or not, and also to figure out how is the legal sanction of sole proprietorsip of a limited company. This research is a juridical normative research. The subjective requirement of limited company establishment is absolute. Limited company may be established by 2 (two) or more shareholders under the notarial deed. The legal sanction of sole proprietorship of a limited company is that the shareholder is personally liable of all company commitments and loss. The shareholders in maximally 6 (six) months after the company is legal under the notarial deed, is obliged to share part of it stock to other shareholders or the company issues a new stock to other. The shareholders are personally responsible if the shareholder is less than 2 (two) persons after 2 (two) months period given by the law.

The advancement of information technology affects the crime related to consumer protection. This impact is no longer confined to certain regions or country, but it is tranversing jurisdictional boundaries (transnational). Thus, the variety modes of the crime increase, not only used by individual, but also carried out by corporations. Criminalizing corporation is difficult, especially when related to consumer protection.  That is because there are no legal provisions about corporate’s position and its responsibility in Criminal Law in Indonesia. Consequently, this condition leads to multi interpretations and thoughts between law enforcement officers. Therefore, it is necessary to have guidelines in handling crime cases done by companies. This study employs normative juridical research method. This research concludes that after the issuance of Indonesia’s Supreme Court Regulation Number 13 of 2016 About Procedures for Handling Criminal cases done by corporations, the law enforcement officers are no longer confused on how to handle the crime.Kata Kunci: Pertanggungjawaban Korporasi, Perlindungan Konsumen.Â

Introduction to The Problem: A trustee agreement is an exclusive agreement in banking gives the bank the right and authority to manage the customer's assets as stated to the agreement The assets of trust assets are the property of the customer, the management of the assets must be separately carried out to implement the Prudential Principle and Pacta Sunt Servanda in banking contract.Purpose/Objective Study: Research and analyze the legal consequences of the trustee agreement and analyze the bank liability towards the insolvency status to the trustee agreement.Methodology/Approach: This Legal Research used normative positivism with the using of the Statute and Conceptual Approach. The Legal Research Sources divided into primary to the tertiary source.Findings: The research shows that the Bank is only as the manager of the asset; therefore, every legal conduct shall have approval from the Settlor under the trustee agreement. It means, if the assets are included as insolvency assets, it is a violation of contract as well as law where the dispute settlement shall be taken into account.Paper Type: This Research is Reseach Article completed by rules and regulations.

Rakyat di dalam tatanan demokrasi memiliki posisi yang sangat penting dan strategis, rakyat atau penduduk dalam hukum internasional pun merupakan suatu bagian yang tidak terpisahkan dari suatu negara hal ini tertuang di dalam Konvensi Montevideo 1933 tentang hak dan kewajiban. Esensi hadirnya rakyat atau penduduk di suatu negara mengharuskan suatu kewajiban sebuah negara untuk memberikan pelayanan serta melayani mereka untuk membuka ruang yang sudah seharusnya diterima oleh rakyat tersebut, tanpa harus mengurangi hak-hak mereka sebab kewa-jiban itu mutlak milik negara. Para pendahulu kita memberikan warisan yang ter-dapat dan terkandung di negara ini bukan untuk kalangan atau golongan tertentu akan tetapi untuk seluruh kesejahteraan rakyat Indonesia sebab itu merupakan hak setiap rakyat Indonesia, sejak Indonesia merdeka seluruh yang terdapat wilayah In-donesia termasuk yang terkandung di dalamnya yaitu sumber daya alamnya menjadi bagian yang tidak terpisah dan diperuntukkan untuk kemakmuran seluruh rakyat In-donesia. Sumber daya alam yang terdapat di Indonesia seperti batu bara serta minyak dan gas bumi (migas) sepenuhnya dimiliki dan dikuasai oleh negara yang digunakan untuk kemakmuran dan kesejahteraan rakyat Indonesia akan tetapi jika kita melihat situasi dan kondisi sekarang apakah bangsa ini telah melaksanakan amanat yang telah tertuang di dalam Undang-Undang Dasar 1945? buku tentang minyak dan gas bumi (migas) untuk rakyat catatan seorang praktisi yang ditulis oleh saudara Junaidi Albab Setiawan ingin mengembalikan dan mengingatkan pada pemegang kekuasaan untuk selalu tunduk pada konstitusi yang bertujuan untuk memaksimalkan sumber daya alam yang dimiliki oleh bangsa ini hanya untuk kepentingan rakyat Indonesia bukan untuk segelintir orang atau penguasa saja.
