Abstract

The 2018 International Student Assessment data puts Indonesia at 72nd and Turkey at 40th in the world, but that’s not all, the Times Higher Education World University Rankings Research puts 49 universities in Turkey on the list of the best university in the world, while Indonesia has left behind with only 9 campuses. In 2020, the literacy rate in Indonesia is 98.28% while Turkey is at 99.07%. However, how exactly is the fulfillment of the right to education for women in both countries? This article aims to explore the education system, budget allocation and education delivery based on the principle of equality. The results of the study show that although the law has guaranteed equal access to education, there is still discrimination in access to education for women in Indonesia, especially for coastal women and pregnant women. This study uses a qualitative method with a deductive approach, while the benefits of this article are to provide an overview of the education system and the fulfillment of education rights for women in both countries that can be used as lessons to build a better education system based on the principle of equality.Bahasa Indonesia Abstrak: Data Internasional Student Assessment tahun 2018 menempatkan Indonesia di peringkat 72 dan Turki di peringkat 40 dunia, tak hanya itu, Penelitian Times Higher Education World University Rankings menempatkan 49 Universitas di Turki masuk dalam daftar kampus terbaik didunia, sedangkan Indonesia jauh tertinggal dengan hanya 9 kampus. Tahun 2020, angka melek huruf di Indonesia adalah 98,28% sedangkan Turki berada di angka 99,07%. Namun, bagaimana sebenarnya pemenuhan hak atas pendidikan bagi perempuan dikedua negara? Artikel ini hendak mengupas sistem pendidikan, alokasi anggaran dan penyelenggaran pendidikan yang berdasarkan pada prinsip kesetaraan. Hasil penelitian menunjukan meskipun Undang-undang sudah menjamin kesetaraan akses atas pendidikan namun masih terdapat diskriminasi akses pendidikan bagi perempuan di Indonesia, khususnya bagi perempuan pesisir dan perempuan hamil. Penelitian ini menggunakan metode Kualitatif dengan pendekatan deduktif, adapun manfaat artikel ini untuk memberikan gambaran sistem pendidikan dan pemenuhan hak pendidikan bagi perempuan di kedua negara yang dapat dijadikan pelajaran untuk membangun sistem pendidikan yang lebih baik berlandaskan pada prinsip kesetaraan.

Abstract

The use of Peer to Peer Lending (P2P Lending) has been increasing rapidly since the Covid-19 pandemic in Indonesia, online loan has become a financing option for individuals and business entities. However, the facts showed that some P2P Lending providers operate without proper licenses from the Financial Services Authority (OJK), resulting in huge disadvantages for the borrowers as a result of illegal P2P Lending. This paper will analyze the legal aspects of P2P Lending in terms of risks, from its legality to supervision, and the role of associations in building a sustainable fintech ecosystem. Legal risks should be differentiated from investment risks in which from the user side, especially the borrowers, it is important to act proactively to check whether P2P Lending providers are legal and registered with OJK for risk management. This paper uses normative research by referring to some P2P Lending prevailing laws and regulations in Indonesia as well as factual facts. There are two types of approaches used, namely the statute and conceptual approach, to obtain the desired research results.Bahasa Indonesia Abstrak: Penggunaan Peer to Peer Lending (P2P Lending) sangat berkembang pesat sejak pandemi Covid-19 di Indonesia, pinjaman online menjadi salah satu opsi pembiayaan baik bagi individu sampai dengan badan usaha. Akan tetapi, fakta menunjukan bahwa cukup banyak penyelenggara P2P Lending yang beroperasi namun tidak memiliki izin resmi dari Otoritas Jasa Keuangan (OJK), yang pada akhirnya mengakibatkan banyak pengguna yang merasa dirugikan akibat P2P Lending ilegal. Tulisan ini akan menganalisis aspek hukum dari P2P Lending dari segi risiko, legalitas sampai dengan pengawasan, serta peranan asosiasi dalam membangun ekosistem fintech yang berkelanjutan. Risiko hukum harus dibedakan dari risiko investasi dari sisi pengguna terutama peminjam, sangatlah penting untuk berperan proaktif mencari tahu penyelenggara P2P Lending legal dan terdaftar di OJK dalam rangka manajemen risiko. Jurnal ini menggunakan penelitian normatif dengan mengacu pada ketentuan hukum dan peraturan P2P Lending yang berlaku di Indonesia. Ada dua jenis pendekatan yang digunakan yaitu pendekatan undang-undang dan konseptual, guna mendapatkan hasil penelitian yang diinginkan.

Abstract

A person or legal-person who utilises state land or customary land needs a title to be able to apply for land rights. The form and type of the title used is only accepted if it is in accordance with the regulation of UUPA juncto PP No. 24 of 1997. That norm regulated basis of land rights has changed after enactment of PP No. 18 on the year 2021. Whoever utilise of the land as be a title to apply for land rights could be proofed by a statement letter. How a legal force of statement letter to apply for land rights in land law as a legal issue of this research. Aim of the research is juridical-analysis concerning statement letter as proof of land utilisation for land rights basis. The research was conducted using normative juridical research methods, and the conclusion that the statement letter regulated by PP No. 18 of 2021 actually has a little bit of legal force, because it has a unilateral ownership claim and it is unauthentic letter.Bahasa Indonesia Abstrak: Orang yang menguasai tanah negara atau tanah adat memerlukan alas hak untuk dapat mengajukan permohonan hak atas tanah. Bentuk dan jenis alas hak yang digunakan hanya diakui jika sesuai dengan yang diatur UUPA juncto PP No. 24 Tahun 1997. Ketentuan baru soal alas hak berubah bersamaan dengan diundangkannya PP No. 18 Tahun 2021. Disebutkan bahwa penguasaan fisik atas tanah adalah alas hak untuk permohonan hak yang dibuktikan dengan surat pernyataan penguasaan fisik (SPPF). Bagaimana kekuatan hukum SPPF sebagai alas hak untuk permohonan hak ditinjau dari hukum pertanahan menjadi masalah hukum di penelitian ini. Tujuan peneltian untuk menganalisis SPPF sebagai alas hak permohonan hak atas tanah. Penelitian dilakukan dengan menggunakan metode penelitian yuridis normatif, dan kesimpulannya bahwa SPPF yang diatur PP No. 18 Tahun 2021 sejatinya mempunyai kekuatan hukum pembuktian yang tidak kuat, karena bermaterikan pengakuan sepihak dan berkualifikasi di bawah tangan.

Abstract

The Indonesian government initiated a law called Job Creation which aims to facilitate the flow of licensing bureaucracy to increase investment in Indonesia. However, there are problems that have come to the attention of the author regarding the regulation of forestry matters in this regulation, namely the centralization of authority to issue permits in the central government, the role of local governments in the formation and assessment of environmental impact analysis (AMDAL) and Environmental Management Efforts-Environmental Monitoring Efforts (UKL-UPL), and regarding the features of the National Strategic Project (PSN). These problems are the main discussion of the authors in this study. By using normative juridical research through a statutory approach as well as descriptive analytical concepts, the authors conclude that forestry regulations in these laws tend to restore the dignity of centralization of authority in the context of forest management authority, particularly with regard to forest use. This is not in line with the constitutional design regulated in the constitution regarding the division of authority for forest use between the central and regional governments which must be carried out based on the spirit of autonomy as wide as possible in a fair and harmonious manner.Bahasa Indonesia Abstrak: Pemerintah Indonesia menginisiasi sebuah Undang-Undang dengan nama Cipta Kerja yang bertujuan untuk mempermudah alur birokrasi perizinan untuk meningkatkan investasi di Indonesia. Namun, terdapat permasalahan yang menjadi perhatian penulis terkait pengaturan soal kehutanan dalam regulasi ini, yaitu pemusatan kewenangan pemberian izin di pemerintah pusat, peran pemerintah daerah dalam pembentukan dan penilaian analisis mengenai dampak lingkungan (AMDAL) dan Upaya Pengelolaan Lingkungan Hidup-Upaya Pemantauan Lingkungan Hidup (UKL-UPL), dan perihal keistimewaan Proyek Strategis Nasional (PSN). Permasalahan tersebut menjadi bahasan utama penulis pada penelitian ini. Dengan menggunakan penelitian yuridis normatif melalui pendekatan perundang-undangan serta konsep yang bersifat deskriptif analitis, penulis berkesimpulan bahwa pengaturan kehutanan dalam undang-undang tersebut cenderung mengembalikan marwah sentralisasi kewenangan dalam konteks kewenangan pengelolaan hutan, khususnya berkaitan dengan pemanfaatan hutan. Hal ini tidak selaras dengan desain konstitusional yang diatur dalam konstitusi mengenai pembagian kewenangan pemanfaatan hutan antara pemerintah pusat dan daerah yang harus diselenggarakan berdasarkan semangat otonomi seluas-luasnya yang adil dan selaras.

Abstract

According to article 68 of the Capital Market Law (CM Law) states that accountants registered with the Financial Services Authority (FSA) who examine the financial statements of issuers and other parties carrying out activities in the capital market are required to submit a confidential notification to the FSA within three days at the latest. The things that may be reported are violations committed against the provisions of the CM Law or its implementing regulations; or things that could endanger the financial condition of the institution or the interests of its customers. When performing audit actions, the auditor that supports the stock market faces a conundrum. the conflict between society’s interests and the company’s objectives. This study aims to examine how accountants can report financial reports that are suspected of violating applicable laws and regulations and the accountant’s dilemma between regulators or the public interest and issuers as the party paying accountants according to the agency theory. This research uses normative juridical method. This study concludes that accountants can report to regulators after obtaining written explanations from the directors so that reporting cannot be done as soon as possible. Accountants in providing an opinion have a dilemma. The originality of this study highlights the need for professionalism and independence in those who support the capital market. In the event of a violation, capital market support specialists, including auditors, are required to notify the authorities. The appropriate authorities should be informed of the audit’s preliminary findings.

Abstract

This article is to analyze and examine the dynamics of investment law politics that can provide legal certainty for investors, both domestic and foreign investors. Legal politics is an integral part in making a statutory regulation. The existence of such legal politics will bring the substance of a regulation into the initial purpose and spirit of the formation of legislation. This research was conducted normatively using secondary data. Secondary data used in the form of primary legal materials and secondary legal materials. After the data was obtained in the literature, the data were then analyzed descriptively qualitatively to produce conclusions in this study. The conclusion in this study is that the investment law politics in each era of the old order, new order era, and reform era has its own characteristics according to the developments and demands of the times. In the old order era, the focus was more on finding capital for development and national interests, while in the reform era investment became an additional element in national development. The Job Creation Act brings the spirit of ease in investing.

Abstract

Land cases in Indonesia are one of the most common types of cases in Indonesia. The forms of land cases that often arise are related to land grabbing, namely illegal taking of land belonging to other party. An example of a land grabbing case can be seen in the Supreme Court Decision Number 1071 K/PDT/2020 where the Plaintiff is the rightful owner of a piece of land with property rights in Tanjung Jabung Barat Regency, Jambi Province as proven by the Certificate of Ownership, but then Defendant I came to take the land belonging to the Plaintiff by constructing a building on the land without a permit and refusing to move even though it has been given a warning, so that the Plaintiff feels aggrieved. Therefore, the author intends to find out how an act can be classified as against the law and what kind of compensation arrangements are in accordance with applicable regulations. The research method used is normative legal research method and the approach used is law approach and case approach. The results showed that land grabbing done by Defendant I could be classified as an act against the law because all the elements had been fulfilled; while related to losses due to unlawful acts in the form of land grabbing, the most appropriate compensation is the return of the Plaintiff’s condition to its original state.

Abstract

Having advantages of consensus mechanism in decentralizing data transaction which potentially eliminates the need for third-party intermediaries, blockchain has the potential to revolutionize markets industry to decrease the showcase control of today’s centralized stages by utilizing the internet. Blockchain has been rising innovation in Indonesia, demonstrated by establishment of Indonesia Blockchain Association. Though its application in Indonesia is still restricted to cryptocurrency sector, no question that blockchains will be connected broadly in near future, and unquestionably will influence business competition. Law and technology ought to be thought of as allies-not enemies-as they feature complementary strengths, yet it might also have their curses. Some intriguing articles has even questioned how blockchain would cause the death of anti-trust, the so-called competition law. Meanwhile this article would focus on elaborating consequences of blockchain technology both positive and negative sides in Indonesia Competition Law Perspective, both in substantial and procedural law, using library research, statute, comparative, and conceptual approach.

Abstract

This article is to demonstrate that the principle of good faith (iktikad baik) manifests in the principles of trust and confidentiality. Not only is good faith one of the key causes of the emergence of a dispute, it also indeed has a great influence on the success of resolving that dispute. Despite its importance, we have found that many disputing parties do not apply this principle to resolve their disputes. Even though, this principle plays a huge part on maintaining trust and confidentiality at the same time. The purpose of this paper is to increase awareness on the application of the good faith principle, noting that there are still realities where this principle is not applied. In this paper, we first elaborate on the descriptive comprehension of all these three principles. Afterwards, we observe how good faith connects with the other two principles. Through the manifestations of good faith, we have concluded that the a quo principle acts as a key basis for the application of the other two principles. In trust, applying good faith means making the arbitration trustworthy, whereas in confidentiality, maintaining good faith keeps the information confidential to irrelevant parties. In the conclusion, we have pointed a few concrete resolutions on maintaining the principle of good faith, trust, and confidentiality. This is found by observing the two factors that cause the realities when the principle of good faith is not applied, which consists of the normative and human factor.

Abstract

So far, technological advances have encouraged the formation of new patterns of life, with creative and innovative ideas, concepts, and thoughts. In the music industry, for example, various digital media and virtual concert venues have developed as a form of breakthrough in dealing with various obstacles due to the Covid-19 pandemic. Virtual concerts are interesting to study because they allow the Author to announce his creation for the first time as the basis for the existence of a Copyright and perform musical performances, including choreographed works. However, on the other hand, it eases other people to fix or record the virtual concert without permission, then distribute it for commercial purposes. In this regard, normatively, the Copyright Law has norms to prohibit such illegal acts. Having said this, this research is addressed to examine how the regulation and implementation of the Copyright Law is for the choreographic works performed in Virtual Music Concerts. The type of research utilizes normative juridical with empirical juridical support. In the perspective of legal certainty, the results of the study conclude that choreographic works do not include works that are managed by the National Collective Management Organization’s potential royalty revenue, as is the case with song and/or musical creations. Therefore, to achieve legal certainty in copyright protection, the authority of the National Collective Management Organization needs to be broadened to include the management of royalties for the use of choreographic works for commercial purposes which has implications for the revision of the Copyright Law and Government Regulation No. 56/2021.
