Al-Ihkam: Jurnal Hukum dan Pranata Sosial Al-Ihkam: Jurnal Hukum dan Pranata Sosial is a high-quality open- access peer-reviewed research journal published by the Faculty of Sharia, Institut Agama Islam Negeri Madura, Pamekasan, East Java, Indonesia. The focus is to provide readers with a better understanding of Islamic Jurisprudence and Law concerning plurality and living values in Indonesian and Southeast Asian society by publishing articles and research reports. Al-Ihkam specializes in Islamic Jurisprudence and Indonesian and Southeast Asian Islamic Law and aims to communicate original research and relevant current issues. This journal warmly welcomes contributions from scholars of related disciplines. It aims primarily to facilitate scholarly and professional discussion over current developments on Islamic Jurisprudence and Law concerning Indonesian and Southeast Asian plurality and living values. Publishing articles exclusively in English or Arabic since 2018, the journal seeks to expand boundaries of Indonesian Islamic Law discourses to access broader English or Arabic speaking contributors and readers worldwide. Hence, it welcomes contributions from international legal scholars, professionals, representatives of the courts, executive authorities, researchers, and students. Al-Ihkam basically contains topics concerning Jurisprudence and Indonesian and Southeast Asian Islamic Law society. Novelty and recency of issues, however, are the priority in publishing. The range of contents covers established Jurisprudence, Indonesian and Southeast Asian Islamic Law society, local culture, to various approaches on legal studies such as comparative Islamic law, political Islamic Law, and sociology of Islamic law and the likes.

Abstract

The purposes of Islamic law (Maqâshid syarî`ah) have become principal instruments for Muslim intellectual on producing or reproducing Islamic jurisprudence, to deal with everyday life of Muslim society. The purposes of Islamic law do not only enhance Islamic jurisprudence as a tool but also a spirit. In today’s globalization, maqâshid signify itself as practical necessity of Islamic jurisprudence for responding or challenging realities: from the text to the context. This paper attempts to describe istidlâl (extracting process of Islamic jurisprudence) on answering complexities of social issues and scrutinizing the classification of Maqâshid syarî`ah. This research found that maqâshid-based approach, that is, ingrained in the narrative of revelation, implicitly or explicitly, is needed to answer social problems. This approach could be classified as the necessary for expressing the illat (the underlying reason), explaining the wisdom and the purposes of syarî`ah: partially or communally, generally or specifically. This approach aims to introduce new perspectives of Maqâshid syarî`ah, such as hifz al-bi’ah (environmental preservation), hifz al-‘alm (cosmic protection), tolerance, human rights, and freedom, which are based on contextual relevance. (Maqâshid syarî`ah merupakan instrumen yang sangat penting bagi seorang mujtahid untuk memproduksi hukum Islam sebagai solusi persoalan kehidupan sehari-hari. Tanpa memahami fikih maqâshid, maka ajaran Islam hanya akan terkesan sebagai piranti tanpa ruh. Maqâshid mengindikasikan urgensi pembentukan hukum Islam sebagai tantangan dan jawaban bagi era globalisasi. Karenanya penting untuk merevitalisasi peran maqâshid dalam kajian istidlâl hukum dari teks ke konteks. Tulisan ini akan  menggali istidlâl atau proses untuk menyimpulkan dalil dari teks hukum Islam (al-Quran dan al-Sunnah) untuk menjawab persoalan-persoalan kehidupan, dan mengetahui klasifikasi dan dimensi maqâshid syari`ah dalam kerangka revitalisasi hukum Islam. Temuan penelitian menunjukkan bahwa, persoalan dan tantangan kehidupan yang semakin kompleks dan berkembang, mesti bisa dijawab secara eksplisit maupun implisit melalui teks atau narasi wahyu dengan pendekatan berbasis maqâshid. Ia dapat diklasifikasikan dalam cakupan kepentingan yang sangat mendesak untuk  menampakkan illat,  menjelaskan hikmah dan tujuan syariah, baik secara parsial ataupun komunal, baik secara umum ataupun khusus, dalam segala sendi kehidupan dalam berbagai tema dalam hukum Islam. Abstract

Aceh Province as an Islamic Sharia Regional has culture and customs based on the values of the Quran and Hadith. For the Acehnese people, customs and laws cannot be totally separated that Acehnese customary law continues to grow until the birth of Acehnese Qanun Number 9 of 2008 concerning the Development of Indigenous and Customary Life. In the implementation, the customary sanctions experience some obstacles due to their unwritten characteristic that made them slightly shifted by the presence of national law. As what happens nowadays in Central Aceh District which is famous with its traditional values, there found legal issues for the customary instrument (Sarak Opat) when the customary sanctions considered discriminatory and arbitrary. Therefore, the settlement of customary disputes must be in accordance with humanitarian principles prioritizing the principle of deliberation and peace although many obstacles still exist at the level of implementation because of lack of understanding by both community and customary instruments related to the implementation of customary itself.

Abstract

Menghadap kiblat merupakan salah satu rukun shalat. Bagi orang-orang yang tinggal di daerah kota Mekah persoalan menghadap kiblat tentulah tidak sulit, karena mereka bisa menyaksikan secara lagsung posisi Ka’bah. Namun bagi umat Islam yang tinggal jauh dari kota Mekah serta tidak mampu melihat ke arah Ka’bah secara langsung maka perlu melakukan ijtihad menentukan arah kiblat.Ilmu falak merupakan salah satu tema yang banyak mengkaji tentang arah kiblat, mulai dari cara pengukuran, proses pengukuran dan alat yang digunakan. Berkaitan dengan hal tersebut ada tiga permasalahan yang menjadi kajian pokok dalam penelitian ini. Pertama, tentang alat apa yang digunakan untuk mengukur arah kiblat masjid  di wilayah Kecamatan Pademawu Kabupaten Pamekasan. Kedua, tentang proses pengukuran dan penetapan arah kiblat masjid di wilayah Kecamatan Pademawu Kabupaten Pamekasan. Dan ketiga, tentang akurasi arah kiblat masjid di wilayah Kecamatan Pademawu Kabupaten Pamekasan menurut metode Mizwala Qibla Finder (MQF). Penelitian ini berlokasi di sejumlah masjid di wilayah Kecamatan Pademawu Kabupaten Pamekasan. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan kualitatif dalam bentuk analisis deskriptif. Data-data dalam penelitian ini diperoleh melalui wawancara dengan menggunakan pedoman wawancara terstruktur, observasi non partisipan dan dokumentasi. Selanjutnya proses analisis data pada penelitian ini dilakukan melalui beberapa tahapan yaitu reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian ini menunjukkan bahwa; (1) terdapat beberapa alat pengukur arah kiblat yang digunakan di beberapa masjid di wilayah Kecamatan Pademawu Kabupaten Pamekasan. Yaitu; Rubu’ Mujayyab, kompas, bhencèt/tongkat istiwa’, meteran dan benang. (2) proses pengukuran arah kiblat masjid di wilayah Kecamatan Pademawu Kabupaten Pamekasan di lakukan dengan cara melibatkan beberapa elemen masyarakat mulai dari tokoh, aparat desa dan masyarakat yang ada di wilayah tersebut. Selanjutnya pengukuran dilakukan secara sederhana dengan menggunakan alat yang sudah disediakan. (3) akurasi arah kiblat masjid di wilayah Kecamatan Pademawu Kabupaten Pamekasan dengan menggunakan metode/alat Mizwala Qibla Finder (MQF) hanya 35% masjid dari jumlah sampel yang arahnya akurat.

Abstract

This article is to reveal the intrinsic objectives and values of Bull Race culture. Basically, every culture must contain a purpose forecasted by the first initiator. Therefore, it tries to analyze the culture through Islamic Law by using the theories of ‘urf and maqâshid al-syarîah as the approach. The historical data shows that the intrinsic purpose of the culture is to create prosperity by increasing people’s income, especially in crop production. Besides, this culture also gives additional income to the cow’s livestock. As the result, Bull Race culture really gives great benefit to the society. The dry field becomes fertile and the crop production gets much more successfull. Furthermore, the income of cow also increases significantly because the local cows are healthy and fat with high quality meat. Meanwhile, the noble values from the Bull Race culture are: a. hard working, b. cooperative, c. competitive, d. discipline, e. sportive. Considering the intrinsic objectives and cultural values, it concludes that the culture of Bull Race is not contradictory with the Islamic rules. In fact, it is relevant with the maqasidh al-syari’ah providing that it neither hurts the animals (cows) nor contains gambling and any other immoralities. (Artikel ini adalah untuk mengungkap tujuan dan nilai intrinsik budaya kerapan sapi. Pada dasarnya, tiap budaya harus mengandung tujuan yang diramalkan oleh perintis pertama. Artikel ini mencoba menganalisis budaya kerapan sapi dalam Hukum Islam dengan menggunakan pendekatan teori ‘urf dan maqâshid al-syarîah. Data historis menunjukkan bahwa tujuan intrinsik budaya kerapan sapi adalah untuk menciptakan kemakmuran dengan meningkatkan pendapatan masyarakat, terutama dalam produksi tanaman. Selain itu, budaya ini juga memberikan penghasilan tambahan untuk ternak sapi. Hasilnya, budaya kerapan sapi telah memberi manfaat besar bagi masyarakat. Lahan kering menjadi subur dan produksi tanaman menjadi jauh lebih sukses. Selain itu, pendapatan dari ternak sapi juga meningkat secara signifikan karena sapi lokal sehat dan gemuk dengan daging berkualitas tinggi. Sementara itu, nilai-nilai luhur dari budaya kerapan sapi adalah: a. kerja keras, b. koperasi, c. kompetitif, d. disiplin, e. sportif. Dengan mempertimbangkan tujuan intrinsik dan nilai-nilai budaya, disimpulkan bahwa budaya kerapan sapi tidak bertentangan dengan aturan Islam. Bahkan, relevan dengan maqashid al-syari'ah asalkan tidak menyakiti binatang (sapi) atau mengandung perjudian dan amoralitas lainnya)

Abstract

The motion of earth, moon and sun result in natural phenomena which people can directly see and tangibly experience. They occur globally yet are experienced locally, such as the phenomenon of solar and lunar eclipses. In Islamic studies discussion, this leads to specific consequence relating to taklif (compulsion) of worship to perform eclipse prayers. Therefore, this study aims to elaborate whether the local eclipse phenomenon could apply the taklif globally. Another question is on when the obligation is urged to Moslem.Using the approach of fiqh and science through descriptive-analytic method, this study finds that in scientific perspective, both solar and lunar eclipses are sunnatullah or natural phenomenon relating to rotation of earth, moon and sun. From the earth, this phenomenon comes in two types of condition. First, it could be both computed and witnessed, while second, it could only computed but not everyone could eye-nakedly witness it. In fact, solar eclipse, for instance, although globally accessible through digital instruments, could be only manually seen in any local and limited area. Therefore, in the fiqh based perspective, the taklif of eclipse prayers only applies based on matlak wilayatul hukm. It is based on the strong belief that hisab indicates the occurrence of eclipse on any certain area in Indonesia and is empirically proved. The taklif, therefore, only applies for those who see the phenomenon, (Pergerakan bumi, bulan dan matahari mengakibatkan terjadi fenomena alam yang dapat dilihat dan dirasakan secara nyata. Fenomena ini bersifat glabal, akan tetapi dirasakannya secara local seperti fenomena gerhana matahari dan bulan. Dalam kajian keislaman, fenomena ini memunculkan akibat khusus yang berkaitan dengan taklif ibadah, yakni salat gerhana matahari dan bulan. Apakah fenomena gerhana yang bersifat lokal tersebut dapat berlaku secara global, dan kapan taklif tersebut terbebankan pada setiap umat muslim? Dengan pendekatan fiqh dan sains secara deskripstif analitis, artikel ini menemukan bahwa dalan perspektif sains, fenomena gerhana matahari dan bulan adalah sunnatullah yang berkaitan dengan rotasi bumi, bulan dan matahari. Bagi penduduk bumi, fenomena ini dapat dialami dalam dua kondisi, yaitu pertama, dikomputasi sekaligus disaksikan, dan kedua dikomputasi, akan tetapi tidak semua semua orang bisa menyaksikan. Karena itu, fenomena gerhana matahari walaupun dapat dikomputasi secara global, akan tetapi hanya dapat disanksikan secara lokal. Dengan demikian, dalam prsepektrif fiqh, taklif ibadah salat gerhana diberlakukan berdasarkan matlak wilayatul hukm, yaitu apabila diyakinkan bahwa secara hisab menunjukkan terjadi gerhana dalam kawasan tertentu di Indonesia dan dapat dibuktikan dengan fenomena empiriknya, maka taklif salat gerhana tersebut hanya berlaku bagi mereka yang menyaksikan fenomena gerhana tersebut.)

Abstract

The spreading Islamic content through Whatsapp as one of popular social media platforms which no longer reflects moderate (wasatiyyah) Islamic teaching has began to appear. It ranges from the content of Islamic teaching, the pattern of movement, response on contemporary life, to discussion on political system and discourses on nation-state. In responding to the Islamic contents implying radicalism, terrorism and ambition to change the form of state from republic into khilafah based system, most of Maduresse urban people reject it. However, they still rely on the content spreaded through social media in understanding Islam. This dynamics could possibly influence people and lead them to either right or left extreme points out of the frame of moderate Islam taught by Rasulullah pbuh and classically recognized scholars (ulama’ salaf al-salih). Therefore, it is urgent to formulate a preaching strategy with the good content to provide people access on balanced information so they could be selective in understanding Islamic teaching. (Penyebaran konten keislaman melalui media sosial (WhatsApp) yang tidak lagi mencerminkan wasathiyyat al-Islm (moderasi ajaran Islam) mulai bermunculan baik materi keislaman, pola gerakan, penyikapan terhadap kondisi kekinian, bahkan perbincangan system politik dan kehidupan bernegara. Dalam menyikapi konten keislaman yang mengarah pada paham radikalisme, terorisme, dan gagasan mengubah system bernegara NKRI dengan konsep khilafah, mayoritas masyarakat perkotaan di Madura menolaknya. Namun demikian terhadap konten materi keislaman yang disebarkan melalui media sosial, sejumlah kalangan sudah menjadikannya sebagai pijakan dalam memahami Islam. Dinamika ini dapat mempengaruhi masyarakat pada sikap ektrem kanan atau ekstrem kiri, yang keluar dari bingkai Islm wasathiyyat sebagaimana yang diajarkan oleh Rasulullah Saw. dan Para Ulama Salafus Shlih. Oleh karena itu perlu strategi dakwah dengan materi yang tepat agar masyarakat mendapatkan informasi yang berimbang sehingga bisa selektif dalam memahami ajaran Islam)

Abstract

The formulation of hudûd law has been more synonymous with criminal and punishment forms. Such formulations and construct are recognized to distort the true concept of hudûd. It also implicates on the theoretical debate in Islamic penal law. The main goal of this paper is to explore and elaborate the hudûd discourse in the study of Islamic law. This paper is a library research with a hermeneutical approach. The data collection technique used in this research is a documentary study (historical) which is elective-eliminative historic in nature. The analysis methods used in the research are the general methodical elements such as interpretation and deductive-inductive also personal reflection. This paper produces several conclusions: (1) The discourse of hudûd penal in the Islamic criminal law studies has experienced a paradigm shift as a dynamic entity from time to time. And the stipulation of hudûd penal is an Islamic Juristic formulation (fuqahā’) and (2) As a product of ijtihad, stipulation of hudûd or its existence is open with criticism using contemporary epistemology. (Rumusan hudûd yang selama ini ada lebih identik dengan bentuk pidana dan hukuman. Rumusan dan konstruksi yang demikian diakui telah mendistorsikan konsep sebenarnya tentang konsepsi hudûd. Paper ini bertujuan mengupas serta mengelaborasi diskursus hudûd dalam studi hukum Islam. Disamping itu, tulisan ini juga melacak pergeseran- paradigma terkait konsepsi dan rumusan hudûd yang muncul sepanjang sejarah. Tulisan ini menggunakan pendekatan hermeneutika-tematis melalui studi dokumenter bersifat historis elektif-eliminatif.  Data akan dibandingkan, dianalisis serta disaring hingga tersisa satu teori yang paling relevan. Paper ini menyimpulkan bahwa diskursus hudûd dalam hukum Islam telah mengalami pergeseran paradigma (paradigm shift) dari waktu ke waktu. Dan, rumusan hudûd yang identik dengan bentuk-bentuk pidana (al-ꞌuqûbât al-muqaddarah) merupakan ijtihad para fuqahâ’ atas tradisi kenabian (Sunnah). Abstract

Islamic banking and religious courts have a very close-knit network. Both Islamic banking serving as Islamic financial intermediation institution and religious courts as special courts with authority to resolve the dispute of  Islamic banking similarly stressed on applying the sharia principles in the operation. They are expected to sinergically rely on sharia principles. The philosophical basic of religious courts’ authority  in dispute settlement of shariah banking  is to create a harmony between the execution of contract and material law based on the principles of sharia with religious courts as an institutiton for Moslem justice-seekers so that the disputes can be resolved wholly (kafa’ah) and consistently (istiqomah) through court rulings upholding the culture of law. The meeting of values of sharia and culture living in society produces harmony in terms of Islamic banking dispute settlement. (Keberadaan Perbankan Syariah dan Peradilan Agama memiliki keterkaitan yang sangat erat. Perbankan Syariah sebagai lembaga intermediasi keuangan syariah dan Peradilan Agama sebagai lembaga peradilan khusus yang mempunyai kewenangan ablosut menyelesaikan sengketa perbankan syariah sama-sama menekankan menerapkan prinsip-prinsip syariah dalam operasionalnya. Perbankan Syariah dan peradilan agama diharapkan dapat bersinergis dengan berpegang pada prinsip syariah. Dasar filosofis Kewenangan Peradilan Agama dalam Penyelesaian sengketa perbankan syari’ah adalah agar terciptanya keselarasan antara pelaksanaan akad dan hukum materiil yang berlandaskan prinsip-prinsip syariah dengan lembaga peradilan agama yang memang merupakan wadah bagi pencari keadilan yang beragama islam sehingga sengketa perbankan syariah dapat diselesaikan secara kafaah dan istiqomah melalui putusan pengadilan yang mengedepankan budaya hukum. Abstract

Ijârah begins from the concept of classical fiqh as a transaction that sustains the development of Islamic banking. The wide range of banking products produced from the concept of ijarah is the basis for developing the concept of jurisprudence from classical fiqh contact to banking products in the form of financing. These developments can be seen from a large number of banking products that use ijârah contracts, especially those related to services. This development lies in the merger of ijârah contracts with several other contracts such as wakalah. Another development that exists in the path to ijarah financing is seen from the foundation. In classical fiqh concept, ijârah is a product of fiqh ijtihad which is ẓanni or not binding. Every Muslim may practice the concept of jurisprudence from many scholars as ijtihad. However, in the financing of the surcharge, it is a combination of several contracts and is based on the DSN-MUI fatwa which is more binding for Islamic financial institutions on the recommendation of the Islamic banking law. (Ijârah yang berawal dari konsep fikih klasik merupakan salah satu transaksi yang menopang perkembangan perbankan syariah. Luasnya cakupan produk perbankan yang dihasilkan dari konsep ijarah menjadi dasar bagi pengembagan konsep ijârah dari kontak fikih klasik menuju produk perbankan dalam bentuk pembiayaan. Perkembangan tersebut dapat dilihat dari banyaknya produk perbankan yang menggunkaan akad ijârah terutama yang berkaitan dengan jasa. Perkembangan tersebut terletak dari penggabungan kontrak ijârah dengan beberapa kontrak yang lain seperti wakalah. Perkembangan lain yang ada pada ijârah ke pembiayaan ijarah adalah dilihat dari dasar pijakan. Dalam kensep fikih klasik, ijârah merupakan produk ijtihad fikih yang bersifat dzanni tidak mengikat. Setiap orang Islam boleh mengamalkan konsep ijârah dari ulama manapun yang bersifat ijtihad. Namun dalam pembiayaan ijârah selaian merupakan gabungan dari beberapa akad dan berpijak pada fatwa DSN-MUI yang lebih mengikat bagi lembaga keuangan syariah atas anjuran dari undang-undang perbankan syariah.

Abstract

The perspective of Islamic constitutional law, The Unitary State of the Republic of Indonesia is in harmony with the principles of Islamic state administration, because the system of government implemented has embraced the principles of Islamic constitution such as; al-Musâwah (equality), al-‘Adâlah (justice), al-Syûrâ (democration), al-Hurriyyah (freedom). The principle is contained in the five precepts of the Panacaila. HTI's efforts to establish a khilafah government according to its version in the Unitary Republic of Indonesia can disrupt the system, basis and philosophy of the State, can result in national disintegration, can eliminate religious tolerance which is substantially the principle in Islamic state administration. The birth of Perppu Number 2 of 2107 has implications for the closure of opportunities (Sadd al-Dzarîah) Community Organizations that have teachings or understandings contrary to Pancasila grow within the Unitary State of the Republic of Indonesia and HTI becomes a prohibited organization living in Indonesia. According to the consequentialist approach, the existence of HTI threatens the sovereignty of the State, so that being included in the category of levels of sadd al-dzarîah which has the effect of causing harm and danger therefore, to avoid alternative declarations dissolving HTI is the right choice that must be put forward.
