Abstract

AbstractThe discourse on Islamic law has always been the public attention, both from the standpoint of fiqh, as well as other legal side (civil/ common law, customary or feminism). Ijtihad as part of legal reform, is an important part of the dynamics of inheritance law from the time of as-shahabh (the companions) to this day. This paper attempts to describe the development of inheritance law in Indonesia. Some thoughts on equality in inheritance law are part of ijtihad object of legal experts as well as developments in Court decisions.Key words:Fiqh, Ijtihad, Iquality, Renewal, InheritanceAbstrakDiskursus tentang hukum waris Islam selalu menjadi perhatian publik, baik dari sudut pandang fikih, maupun sisi hukum lainnya (hukum Barat, adat atau feminisme). Abstract

AbstractWaqf is a form of worship by separating some of our belongings to be used as common property, for the benefit of Muslims or people in general. In order to make waqf’s benefits more applicable and accessible for all, the management must be maximally monitored. With innovative management and intensive supervision, waqf is expected to become productive and empower the mauquf ‘alaih (waqf eligible receiver) and make them independent economically, health and education. With the library research method and content analysis on the interpretation of related al-Quran verses, none explicitly mentions the word waqf. But the Islamic scholars have agreed that infaq and shadaqah jariyah is the essence of waqf. Waqf are long-lasting infaq and shadaqah jariyah, as long as the asset is still used then the reward still flows to `wakif even though he has passed away.Keywords:waqf, productive waqf, Indonesian Waqf Board AbstrakWakaf merupakan satu bentuk ibadah dengan cara memisahkan sebagian harta benda yang kita miliki untuk dijadikan harta milik umum, yang akan diambil manfaatnya bagi kepentingan umat islam atau manusia pada umumnya. Agar keberadaan wakaf dan hasil­nya dapat dirasakan oleh semua lapisan masyarakat, maka pengelolaan dan pengawasannya harus diberdayakan dan diawasi secara maksimal. Dengan cara-cara pengelolaan yang bersifat inovatif dan pengawasan/ monitoring secara intensif yang kemudian wakaf tersebut menjadi produktif sehingga berdaya guna dan menjadikan para mauquf ‘alaih menjadi mandiri secara ekonomi, kesehatan dan pendidikannya.   Dengan metode library research dan content analysis terhadap penafsiran beberapa ayat Al-Quran yang terkait, tidak satupun secara eksplisit menyebutkan kata wakaf. Tetapi para ulama fiqih sudah sepakat bahwa infaq dan shadaqah jariyah yang dimaksud intinya adalah wakaf, karena wakaf adalah infaq dan shadaqah jariyah yang bertahan lama, selama harta tersebut masih digunakan maka pahalanya tetap mengalir kepada`si wakif sekalipun ia sudah meninggal dunia.Kata Kunci:wakaf, wakaf produktif, Badan Wakaf Indonesia

Abstract

AbstractSince Law Number 21 of 2008 concerning Sharia Banking was ratified and promulgated on July 16, 2008, the existence of Islamic Banking in Indonesia has a very strong formal juridical basis so that the institutions, business activities and operations of Islamic banking in Indonesia are required to apply sharia principles. This paper aims to explain the principles of sharia economic law which are adopted and become the foundation of the Islamic banking law. The methodology used in this study is to use analytical descriptive method with a normative juridical approach with qualitative analysis. Based on the results of the discussion, the following research is produced, namely that sharia principles in the Sharia Banking Act can be found in Article 1 paragraph (13), (20), (21), (22), (23), (24), (25), and (28); Explanation of Article 3; Article 5 paragraph (4); Article 19 paragraph (1) letters a, b, c, d, e, f, g, and i; Article 19 paragraph (2) letters a, b, c, d, e, f, g, and i; Article 21; consideration of letter (a); and the phrase "With the Grace of God Almighty" at the beginning of the Sharia Banking Act. While the principles of Islamic economic law can be found in Article 1 paragraph (2), (8), (16), (21), (22), (23), (24), (25), (26), ( 27); Section 2; Article 4; Article 19; Article 26; and Article 40 paragraph (1) Sharia Banking Law.Keywords : Sharia Economic Law, Sharia BankAbstrakSejak disahkan dan diundangkan Undang-undang Nomor 21 Tahun 2008 tentang Perbankan Syariah pada tanggal 16 Juli 2008, keberadaan Perbankan syariah di Indonesia memiliki landasan yuridis formal yang sangat kuat sehingga kelembagaan, kegiatan usaha dan operasional perbankan syariah di Indonesia wajib menerapkan prinsip-prinsip syariah.  Tulisan ini bertujuan untuk memaparkan prinsip-prinsip hukum ekonomi syariah yang diangkat dan menjadi landasan undang-undang perbankan syariah tersebut.  Metodologi yang digunakan dalam penelitian ini adalah menggunakan metode deskriptif analitis dengan pendekatan yuridis normatif dengan analisis kualitatif. Abstract

AbstractThere is a custom in Cibadak Sub-District, Sukabumi Regency, that a prospective spouse candidate and the wedding date are determined through a particular date calculation. The community members believe this calculation will give them a good day to carry out the ceremony and the newly wed will have harmonious marriage. This study aimed to describe the custom practice through the perpective of Islamic law. The applied method of this study is descriptive analysis upon with qualitative data, collected through desk study, interviews, and observation. This study shows that most of marriage conducted in the district applied the calculation, since they believe this custom will bring happiness to the couple. This intention is correspond to the aims of marriage based on the the Republic of Indonesia Compilation of Islamic Law 1991 which are to realize a sakinah, mawaddah and warahmah domestic life.This custom is permissible since it is merely part of effort to achieve the marriage goals.Keywords: Marriage, customary law, Islamic lawAbstrakMasyarakat Kelurahan Cibadak Kecamatan Cibadak Kabupaten Sukabumi, memiliki kebiasaan untuk melakukan hitungan tanggal dalam menentukan pasangan dan hari baik untuk menikah. Hal itu dipercaya akan mencapai tujuan dalam perkawinan yakni keharmonisan dalam keluarga. Tulisan ini bertujuan untuk memaparkan kebiasaan tersebut dihubungkan dengan perspektif hukum Islam. Penelitian ini menggunakan metode deskriptif analitis dengan jenis data kualitatif. Hasil penelitian menunjukkan bahwa sebagian besar perkawinan yang dilakukan di kelurahan ini menggunakan adat hitungan sebelum akad perkawinan. Hal tersebut dilakukan karena masyarakat setempat percaya bahwa ia akan mendatangkan kebaikan dalam kehidupan rumah tangga yang akan mereka lalui. Kepercayaan tersebut searah dengan tujuan perkawinan yang diangkat antara lain dalam Kompilasi Hukum Islam yaitu untuk mewujudkan kehidupan rumah tangga yang sakinah, mawaddah dan warahmah”. Kebiasaan tersebut dapat diterima mengingat ia hanya sekedar wasilah atau ikhtiar semata.  Kata Kunci:Perkawinan, hukum adat, Hukum Islam

Abstract

Abstract Interpretation of al-Quran is a human effort to understand the meaning and purpose of God’s words based on their ability level. Various methods of interpretation have been born along with the development of religion and science. The method used in this study is Descriptive-Analysis by describing the method of interpretation. The verses of al-Quran in the field of Law have become a particular study, called as Tafsir Ahkam. In Islamic law, this study broadly branched out into rationalist schools of fiqh (ahl al-Ra'y) and textual Hijaz schools (ahl al-hadis). But these divisions are getting thinner as law development (instibath) requires reasoning gained from qiyas and istihsan or maslahat.  Therefore, the tafsir ahkam method developed with the growth of the school of fiqh, and the emergence of a rational approach in tafsir ahkam is a logical consequence of a dynamic of ijtihad fiqh method development. Keywords: Tafsir, Ahl ra’yi, Fiqh.   Abstrak Tafsir Al-Quran merupakan upaya manusia untuk memahami makna dan maksud firman Allah sesuai dengan kadar kemampuannya. Berbagai metode Tafsir telah lahir seiring dengan perkembangan ilmu agama dan sains. Ayat-ayat al-Quran di bidang Hukum telah menjadi bidang kajian tafsir tersendiri dan melahirkan tafsir ahkam. Metode yang dipergunakan dalam penelitian ini adalah Deskriptif-Analisis dengan menguraikan tentang metode penafsiran. Di bidang hukum Islam telah berkembang pula mazhab fiqh yang secara garis besar terbagi atas mazhab fiqh irak yang rasionalis (ahl al-Ra’y) dan mazhab Hijaz yang tekstual (ahl al-hadis). Namun ciri tersebut semakin tipis seiring berkembang istinbath hukum yang memerlukan penalaran baik dengan qiyas, istihsan atau maslahat. Karena itu, corak tafsir ahkam berkembang dengan tumbuhnya mazhab fiqh, dan lahirnya pendekatan rasional dalam tafsir ahkam sebagai konsekuensi logis dari pertumuhan metode ijtihad fiqh yang dinamis. Abstract

AbstractNowadays, adultery is no longer an individual act, but becomes an industry with its localization both legal and illegal. In this case, many actors are involved in it, such as the presence of pimps, sex brokers, place providers, delivery agents, and so on. They can be referred to as facilitators of adultery, in addition to the adulterer itself. The purpose of this study was to determine the view of fiqh jinayah towards facilitators of adultery acts and its sanctions. By using the content analysis method as well as the juridical-normative approach to various qualitative data in form of rules and theories related to the object of research, this study shows that facilitators of the acts are categorized as jarimah and jarimah ta'zir to be specific. Judging from the concept of participation, the facilitator of obscene acts are participating directly or indirectly depending on his case, Sanctions for facilitators of this obscene act are ta'zir sanctions. The severity of the punishment becomes the state rights in order to achieve public benefits.Keywords: fiqh jinayah, facilitator, immoral act AbstrakSeks bebas sekarang bukan sekedar perbuatan perseorangan lagi, tapi sudah menjadi “industri” dengan adanya lokalisasi baik legal maupun ilegal. Dalam hal ini banyak pelaku terlibat didalamnya seperti adanya germo, calo seks, penyedia tempat, tukang antar, dan lain sebagainya. Mereka dapat disebut sebagai fasilitator perbuatan zina/cabul, di samping pelaku zina itu sendiri. Tujuan penelitian ini adalah untuk mengetahui pandangan fiqh jinayah terhadap fasilitator perbuatan asusila serta sanksi bagi mereka. Dengan menggunakan metode content analisys serta pendekatan yuridis-normatif terhadap berbagai data kualitatif berupa peraturan dan teori yang terkait dengan objek penelitian, penelitian ini menunjukkan bahwa para fasilitator perbuatan asusila merupakan perbuatan jarimah dan termasuk pada bagian jarimah ta’zir. Dilihat dari konsep turut serta, fasilitator perbuatan cabul ini termasuk pada turut serta secara tidak langsung dan bergantung pada kasusnya, bisa dengan jalan persepakatan, menghasut (menyuruh), atau memberi bantuan. Sanksi bagi fasilitator perbuatan cabul ini adalah sanksi ta’zir, berat ringannya menjadi hak negara sesuai dengan tuntutan kemaslahatan.Kata kunci: fiqih jinayah, fasilitator, asusila.

Abstract

AbstractYusuf al-Qaradawi with his various opinions has placed him as a contemporary fiqh expert, among others in the field of zakat. His opinions include the analogy of various business activities such as bonds and stocks into trade zakat. This paper aims to explain the implementation of the trade zakat at KPRI Sabilulungan, particularly regarding the legal basis used in determining mustahiq, the istinbath method, and how to channel it. The method used in this study is descriptive analytical, which qualitatively examines the opinions of Yusuf al-Qaradawi and observations at KPRI Sabilulungan obtained by observation and interviews. The results of the study indicate that KPRI Sabilulungan uses the same legal basis as that used by Yusuf al-Qaradawi with the istinbath intiqa'i / tarjih method, especially in applying the goal of distribution of mustahik. The implementation of zakat distribution is given to amil zakat and then distributed to mustahik.Keywords:Yusuf al-Qaradhawi, zakat trade, mustahik, cooperative AbstrakYusuf al-Qaradhawi dengan berbagai pendapatnya telah menempatkannya sebagai ahli fiqh kontemporer, antara lain di bidang zakat. Pendapatnya antara lain hasil analogi berbagai kegiatan usaha seperti obligasi dan saham ke dalam zakat perdagangan. Tulisan ini bertujuan untuk memaparkan pelaksanaan zakat perdagangan tersebut di KPRI Sabilulungan, khususnya mengenai landasan hukum yang digunakan dalam penentuan mustahiq, metrode istinbath, serta cara penyalurannya. Metode yang digunakan dalam kajian ini adalah deskriptif analistis, yang secara kualitatif mengkaji pendapat Yusuf al-Qaradhawi dan hasil pengamatan di KPRI Sabilulungan yang didapat dengan cara observasi dan wawancara. Hasil kajian menunjukkan bahwa KPRI Sabilulungan menggunakan dasar hukum yang sama dengan yang digunakan oleh Yusuf al-Qaradhawi dengan metode istinbath intiqa’i/tarjih, khususnya dalam penerapan sasaran pendistribusian mustahik. Adapun pelaksanaan penyaluran zakat diberikan kepada amil zakat untuk kemudian dibagikan kepada para mustahik.Kata Kunci: Yusuf al-Qaradhawi, zakat perdagangan, mustahik, koperasi

Abstract

AbstractReparation is an integral part of state responsibility for the past of gross human rights violations committed in any country and it is also legal obligation under international law. Those violations have ever committed in Argentina (1976-1983) and Chile (1973-1990) during the military dictatorship regime. The applied method in this study is descriptive-analytic with historical approach to the reparation efforts for the victims of the past gross human rights violations in those countries. The author concludes that the characteristic of the gross human rights violations committed in Argentina and Chile can be categorized as crime against humanity based on the Rome Statute 1998. Reparations programs by fullfiling economic and social rights of the victims of gross human rights violations have been done by both countries as well.  Keywords: Reparation, Victim, Violation AbstrakPemulihan adalah bagian integral dari tanggung jawab negara atas pelanggaran berat HAM masa lalu yang terjadi di dalam suatu negara dan hal itu juga merupakan kewajiban hukum menurut hukum internasional. Pelanggaran-pelanggaran tersebut pernah terjadi di Argentina (1976-1983) dan Chile (1973-1990) selama rezim diktator militer berkuasa. Metode yang digunakan dalam kajian ini adalah deskriptif analitis dengan pendekatan historis terhadap upaya upaya-upaya pemulihan terhadap para korban pelanggaran berat HAM masa lalu di kedua negara tersebut. Penulis menyimpulkan bahwa karakteristik pelanggaran berat HAM yang terjadi di Argentina dan Cile dapat dikategorikan sebagai kejahatan terhadap kemanusiaan berdasarkan Statuta Roma 1998. Program-program pemulihan dengan memenuhi hak-hak ekonomi dan sosial dari para korban pelanggaran juga telah dilakukan oleh kedua negara itu. Kata Kunci: Pemulihan, Korban, Pelanggaran

Abstract

Fairness in inheritance distribution between men and women in Indonesia is still an exciting topic to discuss. It is proven that classical Islamic thought says that men's and women's portions in inheritance distribution are final, as stated in the Qur'an Surat an-Nisa verse 11. However, contemporary Islamic thought sees it as a rule that needs to be contextualized to current situations. This progressive thinking about inheritance distribution was pioneered by gender activists who saw that Fiqh Mawaris has a gender bias and discrimination. Therefore, the application of the "gender-friendly justice" concept in the inheritance distribution in Indonesia needs to be put forward. This research analyses the "gender-friendly justice" concept in inheritance law and its application in Indonesia. This study uses Sigmund Freud's gender theory, with an analytic descriptive method focusing on the problem of inheritance distribution in Indonesia. The research results prove that the concept of "gender-friendly justice" in the inheritance distribution refers to the agreement principle and the gender equity principle, where the application is carried out based on the fairness principle. The gender equality principle is implemented by prioritizing the concept of rahmatan lil'alamin, namely equality as servants and caliph of Allah, equality in receiving primordial agreements and cosmic drama events, and reaching achievements.

Abstract

The Sharīʿah is of fundamental importance for all Muslims. No Muslim is exempted from following the Sharīʿah. However, the understanding of Islamic law is often too narrow and problematic for several reasons. Further, this situation is more critical in the Muslim minority context since it paves the ways to misunderstand and misinterpret the nature and purpose of the Sharīʿah. Therefore, applying Sharīʿah  has become a contro­versial  matter that harms people’s interests rather than serves them. Further, during the last few decades, there has been significant interest among the scholars of Sharī’ah in producing the Maqāsid al-Sharī’ah as a new methodology to interpret the texts of Sharīʿah.  They propose Maqāsid al-Sharī’ah as general principles that open expansive rooms for applying Sharīʿah under its broad perspective. Acknowledging this background, the researcher examined the views of Sri Lankan Muslim scholars about applying Sharīʿah based on Maqāsid al-Sharī’ah’s viewpoint. Hence, the perceptions about the application of Sharīʿah are collected from selected Muslim scholars by conducting the interview. This study follows the qualitative method of data collection and content analysis method to reach the results and findings. Accordingly, the study reveals that the prevailing narrow perspective about Sharīʿah serves as an obstacle for the correct and beneficial application of the Sharīʿah and causes negative perceptions among the public. Consequently, the study concludes that the broad perspective of Sharī’ah opens a more expansive space for the application of Sharī’ah and largely helps cooperate and collaborate with other religious communities.
