Jurnal Studi Agama dan Masyarakat (JSAM) is an academic journal, publishing two issues per year (June and December). JSAM is published by Lembaga Penelitian dan Pengabdian kepada Masyarakat of Institut Agama Islam Negeri (IAIN) Palangka Raya, Indonesia. This journal seeks to provide a venue for sharing new empirical research and theoretical analysis of intersections between religion and societies. JSAM publishes original works that contribute to scientific discussion of the relationship between Islam and societies. The journal’s primary focus is on contemporary issues of Islam and culture, politics, economics, law, communication, and history within Indonesian contexts such as local wisdom, multiculturalism and pluralism. However, works on the issues of world religions and global societies are welcome.

Abstract

The background of the tradition of the muslim community in dividing the inheritance amicably was due to advice from one or more of the heirs which the most dominant in the division of inheritance,  because inheritance heir of inadequate if distributed with the way faraid, in addition there are also which based on the message of  inheritor before died to the heirs to share of inheritance the amicably. The purpose of this research was the tradition of the muslim community in dividing. This research uses descriptive qualitative approximation is collect and describe the data and facts matching in with situation which to exist at field and that obtained from the result of observation, interview and documentation. The result of this research demonstrate that The practice of implementation of the division of inheritance traditions amicably, there are two i.e. ways the division which done with the way agreement the family and the based to testament of the inheritor in moment still living, whereas the impact of the division of inheritance with the way amicably which done based on the message of inheritor before died to the heirs to divide of inheritance with the way amicably it is the positively impact.

Abstract

Lack of good nutrition for pregnant and lactating mothers cause reduced productivity smoothly for all mothers breastfeeding postpartum. Various problems that arise then in this study focuses on the obligations How can the mother in delivering the first food intake according to QS. Al-Baqarah [2]: 233. The type this study is a library research, where the data analysis method is double movement that popularized by Fazlur Rahman. Results  of  the  study  are:  Giving  exclusive  ASI  as  step  as  the commandement of Allah SWT.: “...and for mothers must do breastfeeding to their children as long as two years, its for the one who wan to give breastfeeding completely...” (QS. al Baqarah [2]:233). The recommendation of breastfeeding by giving ASI exclusively is being children‟s rightness. So, the porpose of maqasid syariah in order to life protection (ḥifẓ an nafs) and descent (ḥifẓ an nasl) can be realized. Formula milk (SUFOR) in order of its development has done some improvement of nutrition, still and all, the composition of SUFOR nutrition cannot compete the complete nutrition of exclusive ASI. The writer considers that the use of formula milk as the last way (mubah), is is if exclusive ASI cannot be gained by the baby.

Abstract

Abbasiyah empire is which one empire in Islam. In History, Abbasiyah empire is top empire, so we called it as “The Golden Age of Islam”. This empire exist when Umayyah empire had fallen in Damaskus. Umayyah’s generation (Abdu al-Rahman al-Dakhil) escape from Abbasiyah empire and went to Andalusia. And automatically Abbasiyah empire exist in Damaskus. After Abbasiyah could controlled moslems in Damaskus, they changed governance center to Baghdad. In Baghdad, they developed sciences. They translated manuscript foreign languages to Arabic. Beside it, Abu Ja’far al-Manshur was building Baitul Hikmah as a library and center of sciences development.

Abstract

The purpose of this study to describe the entry of Islam to Indonesia and the process of Islamization in Indonesia. The results show that, A). There are three theories about the coming of Islam to Indonesia: 1) The theory of Gujarat by Snouck, said the entry of Islam comes from Gujarat, based on: a) the lack of facts that explain the role of Arabs in spreading Islam to the archipelago. b) Indonesia-India trade relations have been established long time ago. c) The oldest inscription of Islam in Sumatra illustrate the relationship between Sumatra with Gujarat. 2) Theory of Makkah, Hamka declare the entry of Islam to Indonesia first century H / 7 M, 3) The theory of its review to the Persian culture among Indonesian Islamic community have similarities with the Persians, among others: a) the 10th anniversary of Ashura Muharram or as a memorial day for the deaths of Shiite martyrdom of Husain. b) their clear affinity between Shaikh Siti jenar with Iranian Sufi Al-Hallaj. c) use of the term Iranian language in Arabic letters spelling system. d) a headstone on the grave Malikus Saleh (1297) and the tomb of Malik Ibrahim (1419) in Gresik booked from Gujarat.

Abstract

 Monokotomic education is the educational system construction of the plenary which is capable of integration educational value of domain-oriented humanitarian and religious by a nature.The education system also implies an attitude of valuing differences in values, norms, culture and tradition (Multiculturalism) as well as of the religious aspect of pluralism as a consequence of the Muslims. Therefore, there needs to be a paradigm in education it is necessary to elaborate on the elements of cultural pluriformity become construction between the wisdom or community – read the culture. It is intended as an attempt to construct a more civilized society structure, harmonious, and prosperous with cache while respecting cultural differences. Konstruks education is believed to be supporting the formation of communities of multiculturalism and pluralism in this modern era; where the whole community with all the elemental sued for bear's fate and interdependence together for the creation of a lasting peace. Therefore, education (Islamic) multiculturalism with the paradigm of monokotomic need to be constructed which will later put forward positional egalitarian culture system at all, so it's able to eliminate the superiority-inferiority between one culture and other cultures.

Abstract

This study took place in the cit y of. This research is a custom object off the ground for Javanese  conducted   by  the  public  in  Palangkaraya.   The  approach  used  is descripive qualitative data collection techniques such as interviews, observation, and documentation. Validation data using triangulation techniques and to analyze the data through several stages, namely:  data collection  (Data  Collettion),  data reduction (Data Reduction), data presebtation (Data Display), and then the new conclusion (Conclusions Data) by looking back at the data that has been collected. The results showed that the customary land down since time immemorial have been made of their ancestors and continue to this day, they are considered custom picture off the ground known as the child’s talents or interests that relate man to God Almighty to always tangible safety, protection, peace, and prosperity in life. Furthermore, the results of the analysis of the study stated that the customs off the ground in the city of Palangkaraya nothing that violates the Islamic law. So if there  are  irregularities  in the  implementation  of  the  Islamic  law,  then  the y should not be implemented custom not to be involved in the case shirk.

Abstract

                Research conducted by the researchers focused on three things. First, how the background of the idea of the circuit court of the Religious Courts Sampit. Second, what is the basic provisions that allow a circuit court Sampit Religious Court. Third, how the effectiveness of the implementation of the circuit court Sampit Religious Court.               This research is the study of law (legal research) is research that uses the type of sociology of law studies with persefektif EMIC. Using descriptive qualitative approach and a sociological approach to examine perceptions and behaviors that occur in the field of law. The data used in this study of primary data and secondary data. Subjects in this study there are 8 (eight) that three judges Religious Court Sampit, clerks replacement Religious Court Sampit, bailiff Religious Court Sampit, cashier/administration Religious Court Sampit, head of the Religious Affairs Office District of Seruyan Hilir Seruyan, head of the Religious Affairs Office Subdistrict Katingan Katingan Hilir district and subdistrict head of the Religious Affairs Office of the Middle Katingan Katingan. Collecting data through interviews, observation, documentation and to pengabsahannya through source triangulation techniques. Meanwhile, the data analysis through three stages, namely data reduction, display data, and Conclusion.               These results indicate that the background for the circuit court in the Religious Sampit three factors. First, the distance is quite far away. Second, geographical location or terrain traveled not only by land but there are also passing through the waterway. Third, to facilitate justice seekers get justice in the legal field. The legal basis that allows the circuit court Sampit Religious Court that the Supreme Court Circular (SEMA) No. 10 Year 2010 on Guidelines for Providing Legal Aid, gave an order from the High Court of Religion and Government Contracting Palangkaraya East Kotawaringin with DIPA funds given to the implementation of circuit courts Operational costs. While the effectiveness of the implementation circuit court conducted Religious Courts Sampit runs well and is very effective for society. The procedural law is used also law applicable in ordinary proceedings (litigation regular), which differ only in their implementation outside the Religious Court Sampit, namely in the Religious Affairs Office (KUA) local.

Abstract

Nationalism is a crucial issue in this republic, where nationalism does not have function as unity tool, because of less carrying to Indonesia itself and there are a few people or groups who underline the nationalism for their own importance, and also because of the pancasila fading spirit which then breinging this nation into separation and all of others issues. A moslem literate Aguk Irawan MN, spent his idea about nationalism phenomenon through novel entitled Penakluk Badai the novel took a setting at rising and base of the nation of Indonesia on pre-independence period and telling about how were the national movement started by the Islamic leader. The method of this study was discourse analisys method based on Halliday model, where this model involved three units of study such as discourse site, discourseinvolvement, and discourse mode. So hten the result of the writer’s study to three analysis unit of Halliday model were the discourse site related to the natives’ education an the fight to colonialism.

Abstract

The problems of the study in this research were 1) the students’ difficulty in learning about the course of Kemuhammadiyahan I and 2) the internal and external factors that caused the students’ difficulty in learning for non-Muslim students for Therefore, the purpose of this study was 1) to describe the difficulty in learning that was faced by non-Muslim students in attending Kemuhammadiyahan I at PGSD Study Program, UMP, and 2) to describe the internal and external factors that caused the non-Muslim students’ difficulty in attending Kemuhammadiyahan I at PGSD Study Program, UMP. The result of the study showed that (a) there was no difficulty in learning found from non-Muslim students in Kemuhammadiyahan I, this result was based on the score of Kemuhammadiyahan I from the total of 5 students who became the subject of the study. (b) Having reviewed from the internal and external factors, from 16 non-Muslim students who took Kemuhammadiyahan I, there were 5 students who were chosen as the subjects. Concerning the internal factor, it was due to the students’ lack of motivation, interest, and also attention to the course.  The results showed  it does not occur non-Muslim students' learning difficulties in the course Kemuhammadiyahan I

Abstract

One of the major contributions of Ibn Qayyim is about wali mujbir guardian in marriage. He expressed a parent or guardian should not be married off forcibly if it is not accompanied with the consent and approval of the child. This perspective is different from the scholarly (the majority of scholars) that states a parent or guardian may be married off forcibly although without the consent and approval of the child. This study is a literature study (library research) using a contextual approach presented in descriptive and deductive. Data were analyzed through content analysis and hermeneutic methods and study uṣul fiqh. Results from this study: (1) Especially girls (as well as boys) should not be forced to marry and must not be married except with his/her agreement. (2) The Method used legal istinbāt. (3) Relevance thought Ibn Qayyim Al-Jawziyya about mujbir guardian in marriage (a child’s right perspective) in accordance with the spirit of child rights and relevant to contemporary conditions. Thought Ibn Qayyim are considered able to accommodate the growing problems of law in society in order to avoid forcing the parents to their children to marry without first requested permission and consent of the child.
