Abstract

Government Authority in the implementation of land acquisition for the constructionof a public interest in the Government authorities to provide land for the construction of thepublic interest . The problem that arises then is unclear rules governing the authority of theGovernment in the implementation of land acquisition for the construction of the publicinterest as well as legal protection for land rights holders affected by the land acquisition bythe government. This journal normative method to approach the study of literature. In Article6 of Law No. 12 The year 2012 is mentioned land acquisition for public interests held by theGovernment. Section 8 of Presidential Decree. 71 The year 2012 also mentioned that theGovernor carry out a preparatory stage of land acquisition after receiving the land acquisitionplanning documents. Law No. 2 In 2012 and Presidential Decree. 71 The year 2012 is set onthe deliberations, awarding damages, and filing a lawsuit for land rights holders. It can beconcluded authority for the implementation of land acquisition for the construction of publicinterest under the authority of the Governor and the Provincial Government as the legalprotection of the rights of the owner of the land is reflected through the regulation ofdeliberation, of compensation, and the provision of opportunity to file a lawsuit to theAdministrative Court and to District Court.

Abstract

Implementation of tourism accommodation activities pertaining to non-star hotelbusiness at first have been regulated by office of tourism Denpasar city, but as the emergence ofoffice of licensing, and occurring transition to the monitoring task of non-star hotel business.Where all the implementation of and supervision over non-star hotel business now governed byoffice of licensing local regulations number of 24/2001 on non-star hotel business. It is causingthe occurrence of problem where there are many non-starhotel business who commits anoffense against business permit such as : many non-star hotel business who no license, andmany non-star hotel business which is not extend the license, and many non-star hotel businessthat has changed ownership, but not registered it and there is also a non-star hotel businesswhich have previously been registered in tourism agency, but after it has occurred transition theeffort is not registered back. This article uses empirical legal research. From the descriptionabove then can be concluded that the implementation of and supervision over non-star hotelbusiness in the city of denpasar still not fit with local regulation number of 24 / 2001 on nonstarbusiness.

Abstract

This paper is motivated by the existence of governance based on the principle of legality (the written law) which in practice is inadequate. This is because the law is written always contain weaknesses. Although the principle of legality has weaknesses, he remains a key principle in any law of the State. As with any policy of mini markets trading business needs to be organized with a strong legal basis. In regard to controlling Trading License (License), Local Government Klungkung No. 9 of 2004 on Trade Permit (License).The formulation of the problem in this study: 1) whether the required permissions Klungkung regency governments in controlling the establishment of a mini market in the region. 2) what legal action by the government against the violation of the district Klungkung mini market business license.Results of this study concluded that 1) efforts to establish a market in Klungkung regency min required to have a Business License with the form requirements must be signed by the owner of the company with a complete document specified. 2) The sanctions provided in the form of a written warning to revoking SIUP.The method applied in this study is the juridical-empirical approach. Data were analyzed qualitatively that emphasized on understanding and then compared with the data obtained in the field through interview techniques.

Abstract

In the development or construction of a city would be based on planning, spatial planning is the first step in determining how the spatial patterns that would be implemented, the use of space control is an attempt to ensure the achievement of the goals and objectives of spatial plans. Spatial control guided by the directives set out in the regional spatial structure plans and land-use planning at the provincial and city levels. Control land use permitting is done also through the use of space, the provision of incentives and disincentives, as well as the imposition of sanctions. Permitting the use of space is intended as an effort to curb use of space so that any use of space must be made in accordance with the layout plan.

Abstract

This research entitled “contribution of market retribution in improving own source revenue of Tabanan district” which becomes problem of the research is the own source revenue of Tabanan district comes from retribution which one of them is market. Based on the background, the author raises the problems of the research, such as: how does the discharge in collecting of market of retribution in Tabanan district and also how do the relation between market retribution with own source revenue of Tabanan district. This research uses empirical method and obtain the conclusion that market retribution has worked well and directly proportional with the own source revenue of Tabanan district.

Abstract

This research, entitled "Implementation of the Regulation of Bali Province No. 10 Year2011 about No Smoking Area Protection in the Context of Passive Smokers". Thebackground of the problems in this research that there are many smokers who smokefreely in any place in terms of not only detrimental to the health of smokers themselve ,but also harms the people around him as a result of exposure to cigarette smoke.Normatively since 2001 Government of Bali Province has rules about No Smoking Areathrough the Regulation of Bali Province No. 10 Year 2011. Based on this background,the problems in this research include: the authority of the Government of Bali Provincein No Smoking Area arrangements and the implementation of the Regulation of BaliProvince No. 10 Year 2011 about No Smoking Area in order to protect againstsecondhand smoke. This research is an empirical legal research, which emphasizes theeffectiveness of the law, which is based on sources of primary legal materials andsecondary legal materials. Based on the discussion of this research, its obtainedresearch results that the Government of Bali Province authorities for the organizationof Smoking Area, but has not been effective, because they found smokers who smokecigarettes even though the region has been performed with prosecution.

Abstract

Property rights of the ownership over the land unit of flats, which is built up on land of building rights over the management rights, where the terms of the extension of ownership rights over the land have to obtain approval of the extension by the holder of management rights. The problem is how the status of ownership of property rights over units if flats, if doesn’t have obtain approval of the extension. This legal research is a normative research through the study of legislation the act No. 16 of 1985 jo. The act No. 20 of 2011 and government regulation No. 4 of 1988 about the flats. The conclusion of this research is not explained about the status of ownership the property rights over the units of flats, if doesn’t have approval of the extension which cause nullification of a building rights over the land of management rights.

Abstract

Regional Water Company (PDAM) of Badung Regency has the authority andresponsibility for water resource management, including regulating, deciding andproviding licenses for provision of supply, use and cultivating of water resources. Theauthority of Regional Water Company (PDAM) of Badung in providing generalservice creates an opportunity which possibly causes disputes to occur betweenRegional Water Company (PDAM) as the party having authority to water resourceand community as the customers. In relation to such matter, this paper discusses twoproblems: 1. The authority of Regional Water Company of Badung Regency fordrinking water management in Badung Regency; 2. The legal liability of RegionalWater Company (PDAM) of Badung Regency, in the event of disputes arise with service users of Regional Water Company. The method applied is normative researchmethods.The conclusions obtained are: 1. The Regional Water Company (PDAM) of BadungRegency in implementing its authority on water supply management requiresagreement or power of attorney from the chief of the region through supervisingboard especially in determining rate; 2. In the event of a dispute arises, the settlementis prioritized through non litigation procedures, litigation action through district court.
