Abstract

Judicial independence is best understood as a two dimensional relationship. Firstly, in terms of the sources of dependency, external controls and influences must be distinguished from internal controls and influences. Secondly, in terms of the targets of influence or control, the individual judges must be distinguished from the judiciary as a collective whole or institution. Judicial independence is a pre-requisite to the rule of law and a fundamental guarantee of a fair trial.

Abstract

This research rises the problems as follows: First, which factors contribute to the ineffective implementation of border area development policy. Second, whether Cross Border Approach model as relevant policy alternative will be implemented in the border area development and what pre-requisites are needed. This research used field survey method with interview, observation, and literature study techniques. The analysis model was conducted interactively. The findings conclude: First, the factors used in the development policy model by the government is less relevant with the area characteristics, including bureaucracy culture which is still sectoral, weak authority of border management board, inconsistency between technical policy and the border development paradigm, and isolated geographical condition which needs extra-ordinary treatment. Second, cross border approach is quite strategic to be policy model alternative for border development with some of its strength, among many, the program discussed is beneficial for both parties, the program is interest-based and the implementation is responded quickly by the government without undergoing complicated sectoral level.

Abstract

The problems studied in this research are: First, the role of State-Owned Enterprises (SOEs) in producing high quality goods/service through the SOE management and control based on the GCG principles; second, the role of SOEs in promoting the small scale industries/cooperatives development through Corporate Social Responsibility (CSR). The method used in this research is normative juridical. This research finds and concludes that: First, in any aspects, the implementation of SOE roles is still far from ideal as stipulated in the Article 33 of Constitution 1945, which should be beneficial for the prosperity and welfare of the community. In fact, the SOEs have already implemented the GCG principles in their management and control as the effort to optimize the role of SOEs. Second, the role of SOEs to promote the development of the farmers’ small scale industries/cooperatives through the implementation of CSR can at least help create the independence economic of the farmers as long as the implementation is sustainable and involve the participation of all farmer community.

Abstract

Evaluations on local regulation by government and private institutions show that many local regulations are pointed out to be in disagreement with Acts No. 10 of 2004. It impacts public attention on the legislation process for those acts and local regulation. The legislation of those regulations has caused hesitation among local and foreign investors to invest their money there. The lack of investment has a significant impact on the local economy because the Regional Income Rate depends on the investment.Key words: correlation, local regulation, local investment

Abstract

Legal aid and protection for disabled people are still difficult to get. Worse, there are not any legal institutions which protect them. The problems discussed in this research are: first, how is the issue of legal aid to disabled people as criminal victims and its challenges? Second, what kinds of legal aid that should be given to disabled people as criminal victims in order to bring access to justice? This was an empirical and normative legal research. The research findings show that: first, the advocacy of disabled people as the victims of violence has been handled by several LSM (Non-Governmental Organizations) in the field of legal aid. Most of the handled cases are discontinued in the middle of the process due to some issues regarding the legal aids, such as issues related to legal aid agencies, disabled victims, victims, and law enforcement apparatus. Second, the ideas suggested to legal aid agencies are to provide supervision from psychologists, translators, and special advocates to handle disabled victims. The ideas suggested to the police are to provide special investigating officers for disabled people, such as assigning police woman for rape and violence cases involving disabled woman victims; and in the judicial proceedings i.e. by one time investigation system in the investigation step in which judges review the victims’ testimony based on police investigation report in the investigation step.

Abstract

Islamic financial transactions, particularly in Islamic banking business, is a new mode of financial transaction in the nomenclature of the law of contracts. Different from conventional financial transactions which have been established for a long time, Islamic financial transaction is a newly introduced and is still evolving to find out its ideal form. Having said this, dispute settlement for cases arising from the Islamic financial transactions certainly need sufficient attention from the judicial authority in Indonesia. If for about fiveteen years dispute settlement in this matter was under the authority of the Shariah Arbitration Panel (Basyarnas), today, this dispute settlement can be brought to the court of juctice. It is made possible by virtue of the issuance of the Act no. 3 of 2006 on Religious Court and also the approval of the bill of Shariah Banking Act by the members of parliament. This fact suggests that for Indonesia necessary preparations pertinent to the court sistems to be rady in hadling the cases are strongly demanded. In this situation, Malaysia’s experiences in matters pertinent to dispute settlement of Islamic financial business through the court is a good case to be learned.

Abstract

This research focuses on method of dispute resolution using online arbitration as online dispute resolution. This research character is analytical descriptive. Analysis method used in this research is qualitative method. The result of this research shows: First, online arbitration as one of the method of dispute resolution using online dispute resolution considered by e-commerce business actors as the best solution in resolving dispute in cyber world; Second, online arbitration in the practice faces juridical obstacle in some matters as follow: (1) agreement to perform arbitration; (2) choice of arbiter (3) fulfillment of fundamental procedures; (4) character and execution of arbitration binding decision.Key words : Online arbitration, dispute, and e-commerce

Abstract

This research discusses the legal arrangement and enforcement of remuneration law in Employment Law (UUK) as an effort to realize the social welfare of workers. The method of this research was juridical empirical which regards law as a fact to observe and value-free. The research finding concludes that, first, UUD NRI (Indonesian Constitution) of 1945 has been weakened by UUK with its practice of labour market system and termination of employment. In addition, UUK has provided an opportunity for businessman to neglect his duty to respect the rights of Labour Union. Second, the enforcement of remuneration law is ineffective. Supevision from the Ministry of Manpower and Transmigration is hampered by the insufficient number of civil servant investigators (PPNS) compared to the number of companies.

Abstract

Company law will be an important policy for both the Indonesian Government and New Zealand Government in the future. This is because that law has proven to be extremely effective in developing companies’ performance and improving the economic situation in these countries. This paper examines the similarities and differences of company laws in Indonesia and New Zealand. There are two reasons why Indonesia and New Zealand have been chosen for this paper. The first reason is that Indonesia and New Zealand reformed their company laws in the 90s. The second one is due to the similarity of the main source of company law in Indonesian and New Zealand, namely from the common law jurisdiction Finally, this paper suggests that Indonesia should learn from New Zealand’s experience which has a more comprehensive system of company law.

Abstract

This research is focused on the issue of supervision of Qanun as a realization of Central Government authorithy over special autonomy in Nangroe Aceh Darussalam. This research uses analytic descriptive method which gives illustration on scope and opinion of the Central Government supervision over Qanun in Nangroe Aceh Darussalam. This research used juridical normative method as well through legislation approach. This research concludes that for the purpose of supervisory, Central Government may suspend or annul Qanun in the event of contradiction to the related legislation. Preventive supervision is performed on the Regional Government policy which regulates revenue budget and regional expenditure, regional tax, and other regulation that may cause high economical cost.
