This research is focused on the competency of Constitutional Court to review Perpu. The analyzed problem is judicial review by Constitutional Court over Perpu. This research is a normative research. The characteristic of this research is prescriptive research, which is a research purposed to obtain suggestions on how to solve the problem. The research approach applied in this research includes statute approach and case approach. The data used in the research is secondary data. The result of this research is that Constitutional Court has competency to perform judicial review over Perpu, although Constitution does not clearly grant authority to Constitutional Court. Consideration used by Constitutional Court judges to review Perpu is teleological and sociological factor due to developing society needs.Key words : Competency, examination, vacuum of law

This research discusses, first, whether there has been any regulatory compliance related to purchase and sale transactions of Flats/Apartments in Special Region of Yogyakarta? Second, how is the role of Land Title Registrar in such legal relationship? This was a normative legal research whose data analysis was descriptive qualitative. The conclusions are: first, there has not been any Local Regulation regarding Flats/Apartments until the present time so that Regent/Mayor Regulations (Mayor Regulation Number 7 of 2015 regarding the Certificate of Proper Function of Flat, Mayor Regulation Number 8 of 2015 regarding the Legalization of Title of Flat Separation, Mayor Regulation Number 9 of 2015 regarding the Union of Owners and Occupants of Flats and Regent Regulation of Sleman Number 40 of 2015 regarding the Legalization of Report and Title of Flat Separation are still in the form of a guideline which should have become an implementation regulation from the Local Regulation regarding purchase and sale transactions of Flats/Apartments. Second, Land Title Registrars should play their roles professionally by mastering all regulations related to Flats/Apartments so that any land titles they issue related to purchase and sale transactions of Flats/Apartments will have authenticity as a proof.

Reformation in 2008 has changed the state paradigm of Indonesia from centralistic into decentralized government by widely implementing the autonomy concept. This change has also brought the influence in establishment and analysis of Local Regulation based on the concepts of Rocippi, Fish Bone, or RIA that are representative of the old paradigm to the new one that is the concept of SDER (Sustainable, Development, and Engineering Regulation). This research applies the judicial-normative method through a regulation approach. Meanwhile, the analysis method used to solve the existing legal issues is the qualitative-judicial method. The result of the research on two PERDA (the Local Regulations) - which is about Public Service and Openness of Public Information – concludes that by implementing the concept of SDER, the paradigm in establishment of both the State Oriented Local Regulation and civilized oriented Local Regulation could be turned into the Integrated Local Regulation; namely State and Civilized Integrated Oriented Local Regulation. The legal implication of this concept is that the Program of Local Legislation must be oriented to the struggle of the local regulation reform that can prosper the people.

This research analyzes whether the sole proprietorship policy can support national banking monitoring andhow this policy is implemented in the banking globalization, legal protection for national banking and concept of national banking development in globalization era in relation to the objectives of welfare state. The research uses normative juridical method with descriptive analysis. The findings are: first, the sole proprietorship policy does not apply to under 25% shareholding of a bank or share acquisitions in several banks. Second, the nature of sole proprietorship policy is futuristic, so it can reduce the discretion for national banking shareholding by foreign/global investors. Third, legal protections for national banking towards domination of national banking shareholding have been ineffective because the sole proprietorship policy only incorporates the same proprietorship of several banks. Fourth, in globalization era, the concept of national banking regulation independency for capital is adjusted to the business segment of each bank. In addition, an integrative monitoring should be applied to national banking activities, particularly to foreign parties who hold shares in several national banks without highly influenced by global banking regulation recommendation.

In Hans Kelsen opinion, one of the essences of democracy is the possibility for compromising various aspirations with regard to the foundation of a state. The principle of compromise is the settlement of a conflict via certain procedure which is not fully in favor of a party and ignoring the rests. By this compromise, democracy performs as an approach in the process of achieving the hope perfectly.Keywords: the theory of democracy, aspiration of the majority, aspiration of the minority, compromise.

This research was to study and find an attempt to recover the authority of Constitutional Court after the apprehension of Akil Mochtar. The method used in this research was normatif legal research which was descriptive qualitative with statute approach. The secondary data were primary and secondary legal materials which were collected by literature study and analyzed normatively and qualitatively. The research result showed that the recovery of the authority of Constitutional Court must be conducted in a correct way, namely by using 1945 Constitution of Republic Indonesia as the guideline in order to ensure the implementation of the norms contained in 1945 Constitution as the standard. This was in accordance with the principle of constitution supremacy applied in Indonesia.

This research discusses about some rules related with the law’s establishment which is not only related with the body of law but also related with the nation’s institution, such as the compiling process to make a law’s constitution in Legislative institution and the protection for the public interest by the Executive institution. This research will excavate the good concept of law enforcement as the direct derivation of good governance concept. This research uses the concept of academic thinking and applies a good rule as has said in the frame of law’s comprehensibility. This is a theoretical explorative research. It uses the combination of normative method as well as theoretical method as the analysis method. The conclusion of this research is that good law enforcement needs an organized application in its process in order to gain the aimed goal which covers the actualization of value system that becomes the basis of attitude preference in the law enforcement, which is also aimed to the law’s intention.Key words : Legal moral, law enforcement, good governance

This study aims at analyzing the implementation of Law No. 40 of 2004 related to the Health Social Security after the Constitutional Court decision No. 07 / PUU-III / 2005. The reseacher uses library research method with content analysis approach. The research result highlights that: the implementation of Law No. 40 of 2004 related to the Health Social Security after the Constitutional Court decision No. 07 / PUU-III / 2005, whose implementation is entrusted to BPJS is still far from fairness for all. The application of Health Social Security BPJS is still problematic in many ways, among which since it implements a tiered service flow prior to the hospital, that is the participants must first check into the first-level health facilities (health centers) before being referred to the hospital. Another problem is regarding the complexity of the service flow of BPJS for implementing a tiered service flow.
