Abstract

This article seek to discuss the concept of the state’s properties which are included in the state enterprises (BUMN), especially those which are in the form limited liability companies  (Persero). From legal perspective, state’s properties which are placed  in a limited liability companies  are separated properties. The inclusion of such properties in a limited liability company brings about a legal consequence, namely, such properties are then legally belong to the company instead of the state. A limited liability company is an independent entity, and hence, physically, the said state’s properties are then deemed as the share. It suffices to conclude therefore, that the state can not in any way in possession of the company as a whole, but rather merely on the limited amount of share.Keywords: State Enterprise, Limited Liability Company,  separated state’s properties.

Abstract

Land acquisition for development especially development for public purpose is always a major problem in terms of the development of public interests. The issues are always centered on the location, compensation, and the definition of public interest itself. This research discusses land consolidation as a method of land acquisition which at the same time becomes the participative and integrated spatial planning instrument. Furthermore, it will discuss the legal aspects that may appear related to land consolidation as a land acquisition method and integrated and participative spatial planning instruments. The research result shows that land consolidation could become the method of participative land consolidation by involving private sector in providing utilities and infrastructure development in a consolidated area. Land consolidation does not only give economic advantages but also social and environmental advantages upon consolidated area.Key words : Land consolidation, land acquisition, spatial planning

Abstract

Trade remedies, i.e. Anti Dumping, Anti Subsidy and Safeguard Action, are instruments of international trade prolicy that are the most frequently used by importing Member Countries of the World Trade Organization (WTO) to ptotect their domestic industries. However, Indonesia has been categorized as a Member Country which is the least frequently in the use of the instrument. This article recomemends that Indonesia employ the instrument more proactively in order to protect domestic industries. Parallel to this, dtrengthening the legal system of trade remedis is also urgent, since a strong lehal system either its substances, structures, and cultures, will play a crucial role on the effectiveness of the protection of domestic industries.

Abstract

This research aims at disclosing empirically legislation practices of regional regulations (Perda) which are analyzed based on the basic principles of democracy. The problems in this research are formulated as follows: (1) Why does the legislation of Regional Regulations in East Java tend to be conducted in elitist way? (2) What factors do obstruct the institutionalization of the basic principles of democracy in the legislation of Regional Regulations in East Java? And, (3) How is the future conceptualization of legislation of Regional Regulations in democracy perspective? To answer the questions, this research uses socio-legal research approach. The result of the research shows that: first, (a) there is a reluctance of the regional elites to disseminate and give room to the community to continually participate in the legislation of Regional Regulations, (b) the process is time-consuming and circuitous, (c) the discussion in Raperda (Regional Regulations meeting) is not focused, (d) lack of budget for the legislation of Regional Regulations activities, (e) not all people understand the matters regulated in Raperda, and (f) regional elites consider that Raperda has already been discussed thoroughly between DPRD (Regional House of Representative) and Regional Government. Second, there are 5 (five) factors that impede the institutionalization of basic principles of democracy in the research area, namely: (a) legal substantial factor,(b) legal structural factor, (c) legal cultural factor, (d) time factor, and (e) budget factor. Third, elite expectation must meet and be harmonious with public expectation.

Abstract

The concept of production sharing contract in Indonesia has experienced various changes or amendments. However, the implementation of such concept in acts pertinent to petrol and natural gases remain unclear. The detailed regulation on this aspect do not deliver sufficient elucidation, including in some significant clauses. It is considered therefore that in the near future, the legal framework pertaining to this matter shall encompass clear and detailed provisions.Keywords: Production Sharing Contract, Act on Petroleum and Natural Gases

Abstract

“The fulfillment of local traditional obligation or obligation prevailing in the local community” as an additional crime in the Draft Plan of Criminal Code means that the law allows the regulation existing in the community (indigenous criminal law) which does not have an equivalent in the prevailing regulations of law to be a legal source”. In this matter, the law enforcers must be able to assess whether there is really a traditional crime reported by the victim. The difference between the criminal code and the indigenous criminal law principles must also be known and anticipated by the law enforcers. This research studies the additional criminal sanction from the perspective of restorative justice that is the indigenous law concept which requires the willingness and participation of the victim, perpetrator, and the community in order to find solution for the crime conducted. This research which uses the secondary data by literature study and the primary data using interview concludes that “the fulfillment of the local traditional obligation or obligation prevailing in the local community” meets the restorative justice principles. However, a comprehensive study is needed to include the restorative justice system into Draft Plan of Criminal Code and Draft Plan of Civil Code to create the synchronization and harmony between material criminal law and normative criminal law.

Abstract

This research discusses: first, the authority of government evaluation on Qanunof Aceh flag and symbol, and second, the urgency of preventive inspection to Qanun No. 3 of 2013. The method used in this study was normative juridical using regulations of law and conceptual approaches.The result of research shows that: first, the government is not authorized anymore to cancel Qanunof Aceh flag and symbol since the discussion period is outdated as stated in Article 145 of Law No. 32 of 2004 on the Regional Government. Second, the urgency of preventive inspection to Qanun No. 3 of 2014 on Aceh flag and symbol by the government is necessary to guarantee the legal supremacy and to maintain the unity of the Republic of Indonesia.

Abstract

Initially, the goal of bankruptcy law is the liquidation of debitor’s assets. Later, it becomes the means for reorganization of the company’s debitor, and protects the honest individual debitor by executing discharge. The goal is manifested in Acts Number 37 of 2004 which protects the debtor more as the condition of bankruptcy, however it is not easy to get the bankrupt status in reality. That fact was exploited by using the theory of creditor’s bargain and value-based account. This research used normative juridical method and law comparison. The research found that Indonesian Bankruptcy Acts have not so far protected the creditor, debitor and stakeholders; not based on the philosophy of protecting debitor solve; not differentiating the bankruptcy between individual and company though each goal is different. And the last, it has not introduced the discharge for individual bankruptcy.Key word : Bankruptcy law, creditor, debitor

Abstract

The issues to be examined in this research is how does the practice of simultaneous Local Election according to the valid legislation and which institution is authorized to settle the disputes of simultaneous local elections? This research is normative. The study found that Article 3 (1) regulation number 1 2014 About the Election of governors, regents and mayors passed into law No. 1 Year 2015 on the Election of governors, regents, and the Mayor state that, the local election is held every 5 (five) years simultaneously throughout the territory of the Republic of Indonesia.The Local Election schedule is implemented in several periods. Meanwhile the simultaneous national elections is held in 2027. Law No. 1 2015 mandates the Constitutional Court to resolve the dispute over the local elections, despite the fact that it is unlikely for one institution to examine and judge hundreds of cases of disputed local elections at the same time. Local Election dispute resolution processes also have a specified time limit. To that end, the institutions considered most appropriate to handle election disputes is the Supreme Court by delegating the High Court in each region. If litigants are not satisfied with the decision of the High Court then, they may appeal to the Supreme Court.

Abstract

Labor Law in Indonesia is one of specific law that has a main goal to protect the workers in front of entrepreneur’s power. This article uses normative method in analyzing the interrelation of Constitutional State, Democracy, and Administrative Law, in Labor Law aspect, especially on the government intervention to the worker and entrepreneur relationship. Based on a democratic and constitutional state, the government shall protect and respect human rights of citizen by using juridical instruments. Thus, in fulfilling his duties in labor aspect, the government has a responsibility in order to reach a social justice between the parties in working relationship. Also, the government has a responsibility to interfere the working relationship between parties by some limitations and regulations of the Indonesian Democratic and Constitutional State based on Pancasila.
