Abstract

This study focused on the assessment of public perception on fatwa of The Council of Indonesian ‘Ulama’ (MUI) about the religious cult in Indonesia who has become quite intense public debate. Various responses to that fatwa, on the one side create a religious life in Indonesia more dynamic, but on the other side, the public misunderstanding to the status of a fatwa making religious life became disturbed. This research included in the qualitative research tradition. The main characteristic of this research is the way of observation and data collection performed in the background or natural setting, Based on the results of research in the field, the public perception on fatwa of The Council of Indonesian‘Ulama’ (MUI) inferential into three views: First, exclusive category, those in support to the fatwa with all the consequences (taken for granted). Second, inclusive-moderate category, those in support to the fatwa with record does not affect to the civil rights who has been deceive. Third, inclusive-extreme category, those who refuse for any reason (apriori).Key words : Religious problems, public perception, fatwa authority

Abstract

Formally, Indonesia adopts bicameral system as there are the House of Representatives (DPR) and the Regional Representatives Council (DPD). However, structurally, it could be deemed ad tricameral, as there are three representative bodies available; People’s Consultative Assembly (MPR), House of Representatives (DPR) and the Regional Representatives Council (DPD). Thus, practically, Indonesian parliamentary system is unicameral since the authority for legislation lies in the hand of the members of  the House of Representatives (DPR).

Abstract

This article illustrates the relationship between the role of law, especially competition law and economic development. Competition law is prerequisite of free market which gives us some advantages, including competitive price, increasing the quality of life and the social mobility, as well as efficiency both allocative and productive. Those advantages, however, only established if there are five qualities in law which render it conducive to economic development, such as stability, predictability, fairness, education, and special development abilities of law enforcer.

Abstract

This research aims to analyze and observe the answer for several issues: first, finding out the legal protection for Intellectual Property Rights in traditional science in consideration to the absence of a particular regulation in Indonesia laws; second, to find out a concept of equitable management of the traditional science in order to support the economic development in Indonesia. The approach used in this research refers to both judicial-normative method and judicial-comparative method. The result of the research then reveals the following conclusions: first, the protection for Intellectual Property Rights towards traditional science using the regulations of Intellectual Property Rights, in fact, cannot give a total protection. In essence, the protection of Intellectual Property Rights is exclusive, monopolistic, andindividualistic making it to be privat domain. This is much different from the nature of traditional science more focused on collectivism. Second, the precise concept of traditional science management is by regulating the Sui Generis law that is by making prior art as a protection by accommodating the equitable concept of “benefit sharing”. The existing regulation of Intellectual Property Rights after Indonesia ratified TRIPs cannot give any justice for the protection towards traditional science for the existence of misappropriation.

Abstract

Gender Gender and corruption are the recent problems in the anti-graft issue. This research is aimed at understanding the profile and gender equality influence in the corruption eradication attempts in DPRD Kota Yogyakarta. The research uses the combination method between quantitative and qualitative data. The result of the research shows that: First, the aspects of values, state governance ethics, attitude guidance and accountability of women are better than those of men. Women have nine indicators of excellence, while male members of the legislatives only have seven indicators of excellence. However, there is a gender inequality in DPRD Kota Yogyakarta. The large gap of inequality occurs in the control of and benefit for the women in each activity they follow. Second, the superiority of woman in the corruption eradication attempt will not be meaningful without gender equality.

Abstract

Since the compliance towards shari’ah principles is mandatory in Islamic banking, the shari’ah advisory and supervision is another important aspect. It is also said that the shari’ah advisory and supervision is part and parcel of shari’ah compliance. In this regard, the regulation on shari’ah advisory or supervision, which also covers the role of shari’ah board, shall occupy the central part within the shari’ah compliance regulatory framework. In light of the abovementioned reasons, the research and discussion on shari’ah compliance, together with the role of the shari’ah board is very demanding and relevant to the current problems in the Islamic banking business. This paper will focus on the regulatory framework of the shari’ah compliance and its implementation in Islamic banking in Malaysia and Indonesia. Through the comparison between the two countries, some advantages will be identified.Particular reference should be made to the regulations and their implementation in the Islamic banking in Malaysia and Indonesia since there are few valuable considerations. Malaysia experienced the advanced development of Islamic banking compared to the rest of the Asian Muslim countries in the Southeast Asia region. The both countries are moslem dominated countries, and also, they share in the affiliation to Shafi’i Madhhab.Key word: compliance shari’ah, the Islamic banking

Abstract

Pancasila has not provided a great influence on the development of Indonesia. This is caused by the history of the implementation of Pancasila which is laden with irregularities committed by the authorities. The problem in this study is, first, how is the responsibility of the youth to the future of Pancasila? Second, what are the values contained in Pancasila. This research is doctrinal. Legal materials used in the form of primary and secondary legal materials. The method used the philosophical approach and historical approach. The finding of this study concluded that, first, youth personal responsibility is to continue the improvement of the character by studying and implementing the values of Pancasila. Secondly, Pancasila containing the noble values of divinity, humanity, unity, democracy, and justice must be instilled as early as possible within Indonesian society.

Abstract

Corruption eradication requires not mere technological hardware and good legal enforcement institutions, but this again, requires software instrument in the form of legal culture, which encompasses the ideology of law and the ideology which legal apparatus adopt. More importantly, in this globalization era, corruption prevention interconnects with politics, economics, culture, law, and international world. Two elements, namely social-political control, as well as penalization which is derived from the ideal concept of justice, are key elements in this regard.

Abstract

This research focused to dispute resolution through negotiation in “Adat” Law. This research operates in “adat” community of Banjar, Aceh, Ambon, North Lombok, and Lamaholot. The researched question is penal mediation as conflict resolution between perpetrator and victim of criminal conduct. Using normative, conceptual, and historical approach, this research reveals negotiation becomes the basis conflict dispute between perpetrator and victim. Negotiation inspired the development of criminal mediation which is known as traditional village or tribal moots.Key words : Criminal Mediation, “adat” penal law, “adat” community

Abstract

The amendment of UUD 1945 implicates on the establishment of Constitutional Court. One of the authorities of the institution whose authority is equal to Supreme Court is to resolve the dispute of general election. The success of Constitutional Court in resolving the 2004 general election dispute proved that the principles of court justice have been implemented in order to keep democracy and to establish the constitution.Keywords: the role of constitutional Court, Election Dispute Resolution
