Abstract

To utilize natural resources for the good of the people as mandated by the Constitution 1945 and to retrieve prosperity based on the Five Principles of Pancasila, a sustainable environmen preservation corresponding to the national growth is highly needed. Al-Quran is rich ofverses teaching mankind the necessity for them to preserve the nature as God has appointed mankind as the caliph of the earth. This research is a library research aimed at obtaining a vivid description on the implementation of Environmental Preservation and Management Constitution. Deductive and comparative method were implemented to analyze the data. The analysis pointed out that the authority for environmental management control lingered in deviation as it did not conform to the aims of the political law. Law enforcement faces barriers due to the difficulty to determine exact criteria and measurements of environmental damage. Therefore, dedication and professionalism from the law enforcers and the societal environmental awareness of the people were required to execute the laws governing the utilization of environment.

Abstract

The issuance of various shariah based ordinances in many provinces and residences across the country, such as those which have been issued in Solok Residence, namely ordinance no. 6 of 2002 on Moslem Attire, may lead to the violence against the rights of the religion’s adherents to be protected by the state in serving religious tenets. If such kind ordinances let to be issued more, may lead to the disintegrate of the country.

Abstract

This research was conducted to find out the sociological juridical reasons on the increase of crimes using firearm. This is a socio legal research. The research result showed that sociologically the increase of firearm ownership in the society has resulted in the increasing number of crimes using firearm in the society. One of the reasons is that the law permits firearm ownership through two gates, by the Minister or by the Police.

Abstract

The enforcement of constitutional law as stated in the authority of the Indonesian Constitutional Court may will run effectively in the form of equal horizontal-functional based on the doctrine of checks and balances in the separation of power, when the verdict issued by this constitutional court is accepted and implemented by the concerned parties. The Indonesian Constitutional Court may safeguard their verdicts in the form of Conditional Constitutionality and Grace Period in order to implement the verdict which states whether an act in unconstitutional, however this cannot guarantee that the constitutional law will run. All related aspects are actually subject to the political-will of the government (executives) and legislators (law makers).Keywords: the constitution court, law enforcement

Abstract

The problem formulations of this research are: first, how is the structure of state institutions in Indonesian constitutional system according to the 1945 Constitution of Indonesian Republic? Second, what are the issues in dealing with the conflicts related to state institutions’ authority in Constitutional Court of Indonesian Republic? This research is aimed at: first, analyzing the structure of state institutions in Indonesian constitutional system according to the 1945 Constitution of Indonesian Republic. Second, analyzing and identifying the issues in dealing with any conflicts related to state institutions’ authority in Constitutional Court of Indonesian Republic. This research was a normative legal research. The data analysis was done by using descriptive-qualitative approach. The findings show that: first, the structure of state institutions in Indonesian constitutional system after the amendment of the 1945 Constitution of Indonesian Republic has equal positions since the position of MPR (People’s Consultative Assembly) as the highest state institution has been abolished. After the amendment of the 1945 Constitution, Indonesian constitutional system no longer upholds the teaching of distribution of power, but separation of power. Second, the issues in dealing with the conflicts related to state institutions’ authority in Constitutional Court are the fact that there are differences in each decisions in SKLN, i.e. Decision No. 068/SKLN-III/2004, Constitutional Court Rejects the Petitions of Petitioners. Decision No. 3/SKLN-X/2012, Constitutional Court Grants. And Decision No. 2/SKLN-X/2012 Constitutional Court states Not Granted.

Abstract

The unresolved clash between the employees and employers may result a fire or resignation. Generally, it makes the unexpected condition worse for both. In the case of a fire, the employees will face a bad future without job. The research is focused on the arbitrary possibility as a solution for their need to solve the clash between employees and employers. It is done through normative and comparative approach, and secondary data analysis. The result shows that an arbitrary has three characteristics; they are simple, fast and cheap, which is suitable to maintain a good working relationship in Indonesia. Yet, it has some weaknesses that mainly relate to expense and fee for the arbitrary team paid by those parties. Thus, this arbitrary mechanism is unlikely to be used in majority.Key words : Arbitrage, employment relationship, and dispute resolution

Abstract

The problem of this research is: how high is the authority of Constitutional Court to amend the provisions of criminal procedure law (KUHAP) by stating that some articles in KUHAP are not constitutional and expanding the authority of judges in pretrial forum. Since 2015, pretrial judges have authority to investigate and decide whether the determination of a suspect is legitimate. The research method was normative juridical. The result shows that Constitutional Court judges have actually replaced the position of lawmakers (legislator) and violated the principles of nullum iudicium sine lege. In relation to that, if the need is to improve the supervision mechanism for the use of coercion in investigations, lawmakers should amend KUHAP or introduce better supervision mechanism for investigators..

Abstract

Local governments, though they may establish international collaboration, they can not be considered as a subject of law in the international law, but rather as an auxiliary instrument of the central government. From the perspective of international law, the responsibilities  raised by such international collaboration or international agreement  is not in the hand of local government. Another significant point with regards to the said collaboration is that this is also does not contradict with the principle of national unity (NKRI). Because, the local government is merely as an agent of the state which is a subject of international law. In case of any disputes that may the agreements cause shall also be emphasized to be settled within national legal system of Indonesia.Keywords: Authority, Local Government, Collaboration, MoU, Sister City, Foreign Private

Abstract

The role of Judicial Commission in enforcing law has not been optimal, especially in conducting its function and authority to conduct external supervision of judges. The problem addressed in this research is what effort should be done to strengthen the role of Judicial Commission for law enforcement in Indonesia. The approach used in this research is juridical normative, and data source in this research is secondary data, which are primary, secondary, tertiary law material. Furthermore, the law material is analyzed descriptively and qualitatively. The research result shows that Judicial Commission needs to strengthen its role in enforcing law through the effort in: a. accelerating the revision of responsive and visionary Law of Judicial Commission; b. strengthening the role of institutional; c. strengthening institution in conducting external supervision, both preventively and repressively; d. reforming regulation in the field of justice in order to harmonize and synchronize the laws of Judicial Power, Supreme Court, Constitutional Court and the Judicial Commission; and e. strengthening and arranging its organization and personnel.Key words : Judicial commission, law enforcement, supervision of judge
