Abstract

The main problems discussed are: First, how the realization of the Islamic positive law reinforcement is in the Religious Court to create justice in the division of marital property in KHI (Islamic Law Compilation); second, what the form of of progressive ijtihad is in the Islamic positive law reinforcement in the Religious Court to create justice in the division of marital property in KHI (Islamic Law Compilation). This research uses normative juridical, descriptive in nature, through the data in form of Religious Court decisions using constructivism paradigm with qualitative analysis. The result of the research is as follows: First, in the division of marital property, the wife gets 2/3 (two-thirds) which is more than the husband who gets 1/3 (a third). This decision seems contradicting Article 97 KHI. Second, using the method ijtihad tatbiqi, ijtihad used in implementing the law by observing the facts and events as the background of the case, the judges find the appropriate clauses for the case after observing the relations between the background facts and event.

Today, the Criminal Court Procedure is not the sole mechanism to put the responsibility for the serious violence against human rights. Abstract

The government policy to temporarily ‘postpone’ the voting right of the army and police after the reform has become an interesting topic of discussion among the people. This study discussed: first, what are the implications of the political and state administration reform 1998 on the national army dual function? This study was a normative research using primary and secondary research materials. This study employed statute and historical approaches. This study concluded that first, the implications of the political and state admisnistration reform 1998 on the national army dual function were the institutional separation between army and police, the abolishment of army membership in People’s Consultative Assembly, and the temporary postponement of voting right of national army and police until General Election of 2014. Second, national army and police were not allowed to use their rights to vote in the General Election after the reform due to the fact that the dual function of army during the New Order had weakened the democracy functions.

Abstract

The most common type of conflict involving indigenous people is the dispute  on the ownership of economic resources and cultural sites which are convicted  and is guaranteed as traditional indigenous rights. In this regard, indigenous people stand vis a vis with investors’ interest  which is usually safeguarded by state legal instruments. Indigenous people are shaky  in this kind of conflict, and in the factual cases, the process to weaken and destroy indigenous community has  been made through regulations, policies  as well as the real actions made by the government.

Abstract

The stipulation of the conversion in UUPA (Agrarian Basic Laws), on the one hand is meant to guarantee that there is a law of land ownership which was mostly unsure before, especially for those who individually own their land hereditarily without formal or legal document. Conversion, on the other hand can affect that some traditional land which is informally owned before can be owned by right. The next effect is that the communal and religious duties in the fo =rm of “ayahan” which is attached to the land before disappears and changes into secular, private ownership. Beside that, traditional land belonging to traditional villages becomes less and if this condition is not handled or taken care of, it can threaten the traditional village itself. It seems that the anxiety has just been newly realized so that it brings conflict for the land ownership in Bali and this problem continuous until now and even can be seen in the villages in the traditional villages in every regency in Bali.Key words : conversion, traditional land, land ownership conflict

Abstract

The formulations of ideal legislative drafting in the formation of environmental-based Regional Regulation is of highly essential matter to be done in a constitutional democracy. On this basis, the research problem in this research is how is the ideal formulation of legislative drafting in order to realize a democratic state of law, especially in the formation of environmental-based regional legal products? The method used in this research is a normative juridical method with qualitative analysis. As a result, this study highlights that in order to realize the ideal of a democratic state of law, the formulation of legislative drafting, especially in the formation of environmental-based regional legal products, should contain regionally-based materials of the specific condition of the area as well as further elaboration of higher legislation. The program establishment of regional regulation as instruments for program planning of Provincial Regulation or District / City Regulation arranged in a planned, integrated and systematic way, operationally lists the Regional Design Regulations which were organized based on certain method and parameters as an integral part of the national legislation system based on the Constitution of Indonesian Republic Year 1945 and the philosophy of the State.Formulation, legislative drafting, ideal, state of law, democratic.

Abstract

The change of transaction method in business, which was previously real in character but change into virtual transaction, causing some new legal problems in trade transaction, particularly for consumer protection. Protection for consumer is needed because the consumers have not strong bargaining position. The legal protection of consumer’s rights in global e-commerce not only regulated by one legal aspect, but needs set of legal system which able to give simultaneous and comprehensive protection. Therefore, legal protection for consumer must be performed by using international approach through legal harmonisation dan cooperation between law officer intitutions.

Abstract

The problem reviewed in the research was the procedure of compensation on tort in representation claim. This research was juridical normative research. The legal material used in this research was primary legal material in the form of legislation and court decisions, and secondary legal material. The legal material was analyzed qualitatively. This research concluded that if the compensation claim was granted, the judge had decided the amount of compensation in detail, group determination, the mechanism of compensation distribution and steps must be taken by the group representative as well as the obligation to conduct the notification.Key words : Group representation claim, compensation, tort

Abstract

Normatively the amendment of Indonesian Constitution 1945 implemented pure presidential system. However, the sytewm is not compatible with the multy parties system which is viasible based on the amendment. Thus, to maintain the presidential system, it needs further regulations in the form of Act  concerns to more simple  party system to support presidential system.

Abstract

This article seek to discuss the concept of the state’s properties which are included in the state enterprises (BUMN), especially those which are in the form limited liability companies (Persero). From legal perspective, state’s properties which are placed in a limited liability companies are separated properties. The inclusion of such properties in a limited liability company brings about a legal consequence, namely, such properties are then legally belong to the company instead of the state. A limited liability company is an independent entity, and hence, physically, the said state’s properties are then deemed as the share. It suffices to conclude therefore, that the statecan not in any way in possession of the company as a whole, but rather merely on the limited amount of share.
