Abstract

The government of Republic of Indonesia undertake pemajuan, penghormatan, protection, fulfillment, and enforcement effort of human rights to convicts who are in penitentiaries and correctional facilities through Correctional System as has been established in Law Number 12 Year 1995 on Correctional Institution. Based on this act, various regulation of execution related to Correctional process issued by the government as the form of correctional system operatinalization which is considered as effective implementation  and as realization of the government’ responsibility in respecting, protecting, enforcing and promoting human rights as stated in article 71-72 Law Number 39 Year 1999 on Human Rights. Besides the law, correctional institution becomes indicator of protection and fulfillment of human rights.  This method used in this research is qualitative method in which it is expected to result in deep analysis about utterance, writing and behaviours which can be observed from an individual, group, society and particular organization in particular context, which is analyzed from the whole, comprehensive, and holistic point of view. (Hadjr, 1996 in Basrowi and Sudikin, 2002:2)The findings of this research are the followings: (1) Right protection in performing the religion, namely the existence of mosque and church provided by the penitentiary supports the religious activity in Class IIB of Kuala Kapuas penitentiary, Central Kalimantan, (2) Legal protection on the right of getting health service, namely by the supervision or the convicts’ clothes maintenance done by penitentiary officers, and the health checking for the convicts in Class IIB of Kuala Kapuas Penitentiary is done by having cooperation with doctors and health centres, (3) Legal protection on the visit of convicts’ families, namely the visit is done in six days, Monday, Tuesday, Wednesday, Thursday, Friday, Saturday, from 08.00 to 13.00 WIB in visit lounge and the visit is limited for fifteen minutes (4) Factors which encourage and detain the law on the convicts’ rights should be revamped. In fact, the penitentiary officers has done maximum effort to give service in Class IIB of Kuala Kapuas Penitentiary Central Kalimantan.    Keywords: right, protection, convict

Abstract

Causes of low participation and learning outcomes of students in grade 4 RPL 2 SMKN Banjarmasin is due to the use of teaching methods that have not been optimized in the implementation of learning, mostly mitode lecture and question and answer are often used in the implementation of learning. The purpose of this research is: (1) Want to know the model Snowball rowing on track with the learning material cases of human rights violations in order to protect, promote and fulfill human rights in class XI RPL 2 SMKN 4 Banjarmasin. (2) Want to know students' participation in the learning track with cases of human rights violations in the context of the protection, promotion and fulfillment of human rights through the learning model Snowball rowing in class XI RPL 2 SMKN 4 Banjarmasin. (3) Want to know the results of students in the learning track with material cases of human rights violations in the context of the protection, promotion and fulfillment of human rights through the learning model Snowball rowing in class XI RPL 2 SMKN 4 Banjarmasin. To achieve these objectives, action research conducted in two cycles, and each cycle consisting of three meetings. Data collection was performed using the test and non-test. Tests conducted with a series of questionnaires to students and non tests done through observation, interviews, documentation and library.These results demonstrate the applicability of the model of rowing Snowball was in accordance with the planned management and learning is done by teachers, including the qualifications either. Participation of students and teachers in the learning civics model of learning rowing Snowball was in accordance with aspects of the cooperative and is included in both the qualification. Civics student learning outcomes after using the classical model of learning and increased Snowball rowing is good in qualifying.Teachers are expected to be able to make a model of Snowball rowing as an alternative in efforts to increase the participation and student learning outcomes, due to the implementation of the model Snowball Rowing good then learning will be more effective and efficient.Keywords : Participation, learning outcomes and learning Snowball rowing

Abstract

Pasal 1 Undang Undang No. 1 tahun 1974 tentang Perkawinan adalah untuk membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Meskipun demikian kebahagian dan kekekalan yang diinginkan kadangkala tidak berlangsung lama dan tidak menutup kemungkinan akan terjadinya perceraian. Dengan adanya perceraian, Pengadilan dapat mewajibkan kepada mantan suami untuk memberikan sesuatu kewajiban kepada mantan isteri dan anaknya. Kewajiban dari mantan suami yang berupa mut’ah, dan nafkah untuk anak-anak.Peneliti merasa tertarik untuk melakukan penelitian di Pengadilan Agama Banjarmasin karena merupakan wilayah hukum yang seharusnya dipatuhi dalam perkara hukum perdata. Masalah yang dibahas dalam penelitian ini adalah (1). Bagaimana pemberian mut’ah yang layak kepada mantan isteri (2). Bagaimana pemberian biaya hadhanah untuk anak yang belum mencapai umur 21.Metode yang digunakan dalam penelitian ini adalah dengan menggunakan metode kualitatif, karena pengumpulan data dipandu oleh fakta-fakta yang ditentukan pada saat penelitian.Sumber data penelitian ini dari hakim Pengadilan Agama Banjarmasin dan tiga orang isteri yang telah diceraikan oleh suaminya.Hasil penelitian ini menunjukan bahwa pemberian mut’ah yang layak kepada mantan isteri berbeda-beda, dikarenakan sesuai dengan kemampuan para suami mereka. Dalam menentukan besarnya pemberian mut’ah yang harus dibayar, selain mempertimbangkan aspek kemampuan dari suami, lama perkawinan juga menjadi salah satu pertimbangan bagi majelis hakim untuk menentukan besarnya pemberian mut’ah yang akan di bebankan kepada suami, dalam prakteknya pemberian mut’ah berupa pemberian uang. Mengenai pemberian biaya hadhanah untuk anak yang masih dibawah umur 21 tahun, Semua biaya hadhanah dan nafkah anak, wajib ditanggung oleh bapak/ayahnya.Berdasarkan hasil penelitian dapat disarankan apabila perkawinan tidak dapat dipertahankan lagi dan mengakibatkan perceraian, diharapkan para mejelis hakim memberikan pertimbangan yang seadil-adilnya agar pemberian mut’ah yang layak sesuai dengan kemampuan suami, sehingga isteri pun menerima haknya tersebut dengan kata lain sepakat. Dan bilamana seorang ayah tidak memberikan nafkah kepada anak sebagaimana telah diputus oleh pengadilan yang telah berkekuatan hukum tetap, maka pihak yang dirugikan dapat mengajukan gugatan perdata ke pengadilan untuk menuntut hak-hak keperdataan anak yang di abaikan. Kata kunci : Hak mut’ah, biaya hadhanah bagi anak dibawah umur 21

Abstract

Dalam perspektif PKn, pembelajaran yang memberikan kasus “dilema moral” akan menjadi wahana pendidikan yang memfasilitasi peserta diri untuk memberikan argumen moral sekaligus menunjukkan posisi perkembangan moralnya terhadap kasus “dilema moral” yang diajukan kepadanya, sehingga lambat laun mengembangkan dirinya menjadi warga negara yang cerdas, bertanggungjawab dan berkeadaban. Peserta didik kelas XII SMA Korpri Banjarmasin, secara keseluruhan berdasarkan rerata ‘judgment score” sebesar 14,7, maka tingkat perkembangan moral kognitif peserta didik kelas berada pada tahapan II (konvensional), yang berorientasi pada hukum dan ketertiban, yakni 70% peserta didik lelaki dengan rata-rata “judgment score” sebesar 13,6, dan 100% peserta didik perempuan dengan “judgment score” sebesar 15,8. Perbedaan gender pada pengukuran Kohlberg menampakkan hasil-hasil bermakna ganda, memperlihatkan pola-pola yang amat berbeda dari jenis kelamin, tetapi juga kontoversial, namun ditegaskan bahwa perempuan memang berkembang secara berbeda dari laki-laki, juga dalam hal berpikir moral.  Kata-kata kunci: pertimbangan moral, gender, peserta didik, PKn

Abstract

Abstrak: Anak cenderung tidak begitu tertarik dengan pelajaran PKn karena selama ini pelajaran PKn dianggap sebagai pelajaran yang hanya mementingkan hapalan, kurang menantang serta membosankan. Tujuan utama dilakukan penelitian ini adalah untuk meningkatkan aktivitas dan hasil belajar siswa menggunakan media pembelajaran Ko-Ruf-Si (Kotak Huruf Edukasi) berbasis word square pada materi Kedaulatan Rakyat dan Sistem Pemerintahan di Indonesia Kelas VIIIC SMPN 1 Lampihong Tahun Pelajaran 2014/2015. Aktivitas dan hasil belajar siswa dapat ditingkatkan melalui penggunaan media pembelajaran Ko-Ruf-Si (Kotak Huruf Edukasi) berbasis word square. Hal tersebut terlihat dari skor rata-rata aktivitas siswa yang relevan dengan pembelajaran mengalami peningkatan dari siklus pertama sampai siklus kedua. Pada siklus pertama skor rata-rata aktivitas siswa meningkat dari 63,60% menjadi 74,50% mengalami peningkatan sebesar 10,90%. Demikian juga tentang ketuntasan belajar pada siklus pertama 65% dan pada siklus kedua menjadi 85% mengalami peningkatan sebesar 20%. Sementara untuk respon siswa terhadap pembelajaran adalah dominan siswa setuju bahwa pembelajaran PKn dengan media pembelajaran Ko-Ruf-Si (Kotak Huruf Edukasi) berbasis word square dapat meningkatkan aktivitas dan hasil belajar siswa dengan persentase 95,6%.Kata kunci:    aktivitas dan hasil belajar, media pembelajaran Ko-Ruf-Si, model pembelajaran word square.

Abstract

Basically the acquisition of moral values is seen as the regeneration of the traits of a person. It can be said that the moral values as continuity of psychological processes such as perception, attitude, and belief in oneself. On the other hand, some are saying that the acquisition of moral values as the social interaction between the individual and his environment. Current perspective is more emphasis on the role of the outside world as a factor that facilitates value system. The role of parents, teachers, community and moral value system that is maintained in an environment in which he lives is an important factors for the possession of the moral values of the individual self. In the view of philosophy, moral values are often associated with the problem of goodness. Something is said to have a moral value if something is useful, true (truth value), beautiful (aesthetic value), good (moral values), religious (religious values), and so forth. Moral values and the ideal is something that is good. Hence the value is regarded as something abstract and can not be touched by the five senses. In connection with this, the Fraenkel (in Hamid Darmadi, 2007: 27) states that this nilaimoral presence in the "people's minds" (human chimera) as well as different other. The opinion similar to the view of this Fraenkel is Rokeah, stating that moral values is something valuable that is considered valuable, fair, good and beautiful as well as to guide or handle themselves. Keyword: the role of teacher, civics, develop, moral values, democracy matter.

Abstract

Consumer Dispute Settlement Board is a Board / Independent Institute, a public body which has the role, duties and responsibilities include implementing and penyelesaianan handling consumer disputes Conciliation, Mediation and Arbitration, provide consumer protection consultation, to supervise the inclusion of standard clauses, reported to general investigators, receive complaints both written and unwritten, calling businesses are alleged to have committed a violation, call and produce witnesses and administrativ sanctions against businesses that violate. The method used in this study is a qualitative approach, to determine the source of the data used purposive sampling technique. Data was collected through observation, semi-structured interviews, and dokomentasi. Data analysis was done by reducing the data, presentation of data, and draw conclusions.The results showed (1) the role of BPSK in resolving consumer disputes out of Court by using the method of settlement in mediation, conciliation and arbitration. Disputes that go on in 2012/2014 to BPSK Banjarmasin as many as 31 cases, mediation settlement form more among others, namely 11 cases. (2) Law BPSK decision against the perpetrators to the dispute in accordance with the result of collective deliberation or decision of the panel BPSK binding and ends, and can’t be contested or appealed.Based on these results, it can be suggested that the presence of BPSK terkaitt for this community Banjarmasin not too familiar with BPSK. BPSK should socialize more about where BPSK in Banjarmasin. Every community and consumers as connoisseurs, user and / users of goods and / services can complain and disappointment to the goods / services to BPSK, before the State to court.Keywords: role, consumer dispute resolution

Counselor (I) Zainul Akhyar, (II)Harpani Matnuh.In this study examines the Passed Cross In SMK Students of SMAN 7 and SMKN 5 Banjarmasin. The purpose of this study to determine the background of students' understanding of the requirements to be allowed to use motor vehicles, motor driving ordinance, penal sanctions for violations of traffic rules and the impact of violations of traffic rules on the road.The method used is a qualitative method of data capture techniques through observation , interviews, focus group discussions ( FGD ), and documentation of the data sources were selected purposively. Testing the validity of the data can improve through perseverance, triangulation, and using reference materials.The Results showed students' understanding of the requirements to be allowed to use motorized vehicles for knowledge of traffic laws still do not understand, the omission of a police presence, absence by the school, and the presence of omission by the parents. The procedure for motor drive system is the lack of understanding and knowledge of how to drive motorized traffic rules, patterns of behavior or attitude in driving a motorcycle, provide socialization and appeal to the public, held a routine patrol, raid gear motorcycle standards and prohibitions for junior high school students to use bicycles motors. Penal sanctions for violations of traffic rules by the bad behavior of motorists who often do, and exposed to legal sanctions traffic rules. The impact of traffic rules violation on the highway is not orderly traffic, and an increase in accidents involving students.Based on the results of research to realize a student who obey the law for orderly traffic, traffic cop Sat Banjarmasin So should conduct a more intensive dissemination of the laws of the Republic of Indonesia Number 22 of 2009 on traffic and highway transportation for students, should all the parties concerned work together to address the problems of traffic norms neighbors, and students are expected to provide instances neighbor traffic rules, especially students PPKn course in dealing with various problems faced by the students about traffic norms and regulations.Keywords: Elapsed Understanding Cross, Student.Keywords: Elapsed Understanding Cross, Student.

Abstract

Internalization of nationalism value is an effort of developing learning strategy which includes nationalism values in building students’ moral in MAN 2 Model Banjarmasin. This effort is done to develop the civic education learning as lesson material which is integrated with nationalism value in order to increase the students’ learning outcome and change the students’ attitude in learning in high school so that the self-awareness on nationalism can appear. Furthermore, this research aims to find out the program and the internalization strategy of nationalism value which are done by the civic education teachers to the students and the implementation of nationalism value done by the students of MAN 2 Model Banjarmasin.This method used in this research is qualitative method. The technique of collecting data is by using observation to observe directly the internalization process of nationalism value by the teachers, interview to get the information needed directly from the informants as the data source, and documentation to ease the researcher in collecting the data, both written document and pictures as the data source.The finding of this research indicates thatthe program and the internalization strategy of nationalism value by the civic education teachers have been run well which apply various methods and strategies. However, the implementation which is done by the students is still low because of the environment factor.Based on the finding of this research, it is suggested that the teachers should increase the effort to instill the nationalism value to the students by using various, effective, and interesting ways and methods in order to keep boosting the degree of students’ nationalism. It is also suggested the school should create school culture which has character to make the students not only smart academically, but also have moral, good behaviour and high nationalism spirit. Keywords: internalization of value, nationalism, civic education learning

Abstract

Tujuan penulisan artikel ini adalah untuk menjelaskan pentingnya nilai toleransi dan keberagaman yang dapat kembangkan dengan strategi pembelajaran dilakukan oleh guru. Strategi pembelajaran sebagai upaya yang dilakukan oleh guru dan siswa untuk mencapai tujuan pembelajaran. Strategi pembelajaran tematik storybook digunakan pada pembelajaran di sekolah dasar. Kajian yang digunakan pada artikel inii mengunakan kajian literature dengan mencari dan mengumpulkan data yang sesuai dengan tema artikel yang dipilih. Data atau informasi yang berkaitan dengan penanaman nilai toleransi dan keragaman dan strategi pembelajaran. Konsep yang ditawarkan dengan implementasi strategi pembelajaran tematik storybook dapat memberikan pemahaman siswa terkait keberagaman dan dapat memberikan pemahaman nilai toleransi yang berdampak pada pengetahuan, sikap, dan keterampilan siswa. Media storybook berisi cerita yang mengambarkan keberagaman dan toleransi, dengan media storybook dapat mendukung penanaman nilai toleransi dan keberagaman terdapat kesesuaian kompetensi dasar dari kelas satu sampai enam mata pelajaran PPKn sekolah dasar.
