Abstract

The criminal act that happens currently in the society is not done only by adult, even there is a trend that the person who did it was included in the children age. Legally, a call for a person who committed a crime that included in the children age is known as a child who has conflict with law. One of state’s efforts to protect the child who has conflict with law is by implementing the Diversion pattern, that is handling process to a child who has conflict with law is shifted from the formal to be a non-formal process. This research with the normative research type that is supported by the empirical data has purpose to investigate and study the Diversion ideas in the law protection to the child who has conflict with law, and further to find out the concrete implementation that is drafted in the Law of Children Jurisdiction System these days (Law No. 11 Year 2012) and the  application by all law enforcer component and  the related institutions that involves in the handling of the cases of child who has conflict with law in due process of law from the level of investigation, prosecution, court session and the development in the Prison for Children.

Abstract

The high percentage of non-performance loan (NPL) may bring adverse impact to creditor (banks), the banking sector in general, and also to the economic and financial of the country. To overcome these conditions, Bank of Indonesia issued a policy regarding restructuring. Restructuring is an effort undertaken in the activities of credit to borrowers who have difficulty to meet its obligations. Banks engaged in lending has a restructuring program has been set on the credit policy of each bank, but still there are banks that ignore and do not do this loan restructuring seek in accordance with the procedure. This study is an empirical study that examines the juridical on the implementation of the rules concerning the restructuring of the debtor defaults on bank loans as well as obstacles in implementing the debt restructuring. This research is a descriptive research. Data sourced from primary data and secondary data. Data collection techniques used is literature study and interview techniques. Analysis conducted qualitative and descriptive analysis presented. Implementation of the provisions of the rescue loan restructuring and settlement of non-performing loans on bank credit has not been optimally applied to all borrowers who are having trouble paying even though they have the opportunity to carry out the payment. Inhibiting factors, among others, the rules concerning debt restructuring are scattered in various policy rules, regulations often change with a relatively large number of rules, the lack of a comprehensive understanding of this policy, an independent financial consultant is often overlooked involvement in debt restructuring, which is not good faith to implement agreement, the lack of information and initiatives in the debtor filed debt restructuring, customers who do not cooperative and giving false information about the source of income.

Abstract

A mismatch between the administrative documents or the physical characteristics of a property offered in a contract and the actual conditions received by the client becomes an important problem in a property business. The property, which is the object of an agreement, should be in line with the legal aspects required by the legislation. The purpose of this study is to understand the legal condition of registering a property as the object of an agreement, by using consumer protection law in relation to property sales (i.e., Legislative Decree number 1 of 2011) as the perspectives. This study used normative legal framework based on Law and concept approaches as its research method. Several primary laws were collected and analyzed by a qualitative descriptive method. This study found that a property could be included as the object of an agreement if it fulfills the terms and conditions written in the Article 42 Clause 1 of Legislative Decree number 1 of 2011 on Real Estate and Residential Areas. Furthermore, a property can be an object of sales agreement if they meet several criteria written in the State Minister of Community Estate Decree’s number 09/KPTS/M/1995, with the date of issuance on 23 June 1995, about the sale and purchase of a property. It can be argued that the Legislative Decree number 1 of 2011 on Real Estate and Residential Areas might not offer a comprehensive protection to the consumer rights, and subsequently inflict physical and mental harm to the consumers.

Abstract

The enactment of Law No. 44 of 2008 on Pornography has caused widespread controversy among the people. Some regions refused enact the legislation as it is considered not reflect the spirit of culturally diverse,or The Bhinneka Tunggal Ika principle. Therefore, it should be a review of the legislation of the philosophical, juridical and sociological comprehensively in accordance with national character, openness, honesty, and tolerance based on the spirit of national unity.Diberlakukannya UU Nomor 44 Tahun 2008 tentang Pornografi telah menimbulkan kontroversi luas di kalangan masyarakat. Beberapa daerah menolak memberlakukan undang-undang tersebut karena dianggap tidak mencerminkan semangat beragam budaya, atau Prinsip Bhinneka Tunggal Ika. Oleh karena itu, harus review undang-undang yang filosofis, yuridis dan sosiologis secara komprehensif sesuai dengan karakter nasional, keterbukaan, kejujuran, dan toleransi berdasarkan semangat persatuan nasional.

Abstract

Sanctions stipulated in the Narcotics law adheres to double track system in the form of criminal sanctions and action sanctions. Rehabilitation is one form of action sanction, in accordance with the provisions of Article 54 of Law Number 35 Year 2009 on Narcotics. The purpose of this study is to analyze the judge's consideration in dropping criminal punishment against the soldier of Indonesian National Army as narcotics abusers. This study uses normative research methods with statute approach and case approach. The results of the study indicate that Narcotics addicts and narcotics abuse victims in the case of proven or proven as victims of narcotics abusers as regulated in Article 127 paragraph (3) of Narcotics Law shall undergo medical rehabilitation and social rehabilitation. Consideration of the judges of Military Court III-14 Denpasar through its decree Number: 33-K / PM. III-14 / AD / VIII / 2015, which states that the defendant has been proven legally and convincingly guilty of committing a criminal act of narcotics perpetrator to impose criminal sanctions, appears to be inconsistent with the provisions of the Narcotics Act because the judge does not consider the provisions of Article 127 paragraph (3) Law Number 35 Year 2009, namely compulsory rehabilitation in case it can be proven or proven as a victim of narcotics abuser, the abuser shall undergo medical rehabilitation and social rehabilitation. Therefore, the judge in deciding the perpetrators of narcotics abuse should be guided by the provisions set forth in Law Number 35 Year 2009 on Narcotics. Sanksi yang diatur dalam undang-undang Narkotika menganut double track system yaitu berupa sanksi pidana dan sanksi tindakan. Rehabilitasi merupakan salah satu bentuk sanksi tindakan, sesuai dengan ketentuan dalam Pasal 54 Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika. Tujuan dari penelitian ini adalah untuk menganalisis tentang pertimbangan Hakim dalam menjatuhkan pidana penjara terhadap prajurit TNI sebagai pelaku penyalah guna narkotika. Studi ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil studi menunjukkan bahwa Pecandu Narkotika dan korban penyalahgunaan narkotika dalam hal dapat dibuktikan atau terbukti sebagai korban penyalahguna narkotika sebagaimana diatur dalam Pasal 127 ayat (3) UU Narkotika wajib menjalani rehabilitasi medis dan rehabilitasi sosial. Pertimbangan hakim Pengadilan Militer III-14 Denpasar melalui putusanya Nomor :33-K/ PM. III-14/AD/ VIII /2015, yang menyatakan terdakwa telah terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana penyalahguna narkotika menjatuhkan sanksi pidana, tampak tidak sesuai dengan ketentuan dalam Undang- tentang Narkotika karena hakim tidak memperhatikan ketentuan Pasal 127 ayat (3) Undang-Undang Nomor 35 Tahun 2009, yaitu wajib rehabilitasi dalam hal dapat dibuktikan atau terbukti sebagai korban penyalahguna narkotika, penyalahguna tersebut wajib menjalani rehabilitasi medis dan rehabilitasi sosial. Oleh karena itu hakim dalam menjatuhkan putusan terhadap pelaku penyalah guna narkotika harus berpedoman pada ketentuan yang sudah diatur dalam Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika.

Abstract

Percentage provisions have a substantial part in the electoral law reform, especially for mathematical formulation. This research, that uses normative legal research method, showed that a legitimacy of percentage provision for candidacy requirement in President and Vice President Election is based on the legal authority of The House of Representatives. The 1945 Constitution of the Republic of Indonesia and most constitutions of other countries are not setting up a rigid formal requirement, like a minimum percentage, for presidential candidacy. A legal term has an important position in the making of law. A convention that uses “presidential threshold” as a term should be justified within a legal theoritical framework. Meanwhile, the perpetual discussion to create presidential system of government can works effectively, with a good support from the House of Representative, has always been a spirit but also a debatable material in every political acts in Indonesia. Legal formulation that used in Law No. 42-2008 must be viewed comprehensive so that justice and fairness in this political institutionalization process can be realized.

Abstract

Research in connection with the theme is “ Implementation of Good Corporate Governance(GCG) in Procurement at PLN Bali”. The problems are researched the translation of goodcorporate governace forms in the procurement of goods and services at PLN Bali and theform of the procurement of goods and services at PLN Bali.This research includes the category of empirical legal research, legal research is a empiricalmeans reviewing the practical reality in daily life - today. The nature of the research isdescriptive research that has a goal to paint a picture of something in the area and at acertain moment. Furthermore, the technique used is to study documents, interviews, Non-Probability Sampling, purposive sampling.Procurement of goods or services in PLN involves many parties, the employees who wereappointed to take care of such procurement and future providers of goods and services.In this relationship unfair business competition or the price is too high or low in supply.However, the existence of e-procurement and the correct procedures in the procurementof goods and services as well as the concept of GCG which also animates the principles ofprocurement of goods and services. Procedures in the procurement of goods and servicesas well as the principles of GCG, the procurement in PLN can be carried out transparently,responsibly, independently, fairly and equitably.

Abstract

This Study in the legal protection of the victims of narcotics abusers aims todecrypt and analyze aspects of issues related to the concepts that underlie theneed for justification of legal protection of the victims and supervision of theimplementation of the decisions of rehabilitation, as well as decrypt and analyzethe legal form of protection. This study is a normative one using law approachand legal concept analysis. The results of the study indicate the legal protection ofvictims of drug abusers can not be detached from the underlying idea of legalprotection of the victims of narcotics abusers in the form rehabilitasi. Legalprovisions governing the rehabilitation of drug addicts measures stipulated inArticle 54, 56.103, and was associated with article 127 of Law No. 35 of 2009,SEMA No. 4 of 2010 as The Guideline on the implementation of the rehabilitationof narcotics abusers, but monitoring of the rehabilitation measures notaccommodated in such provisions so that there are gaps in the law enforcementmechanism of action monitoring narotics rehabilitation.

Abstract

The discussion in this thesis raised regarding Legal Protection against Justice Collaborator in the handling of corruption in Indonesia. The objectives of this study are to be analyzed with both forms of regulation and identify the type of protection provided by the laws of the State of Indonesia justice collaborator and determine the accuracy of the strength of the evidential value of the testimony in the trial of a justice collaborator, by analyzing the legal provisions in the legislation other law relating to witnesses. This type of research is used in a scientific journal this is the kind of normative legal research, because there is disharmony norm based research in the form of a legal vacuum regarding the setting justice collaborator in formal laws and regulations in Indonesia, as well as the legal ambiguities in the text of the legislation on Article 10 paragraph (2) Law No.. 13 of 2006 on the Protection of Witnesses and Victims of the justice collaborator testimony that can be used as consideration to give the judge for leniency. Having regard to the development of the current law that requires courage and willingness of law enforcement in combating corruption as an extraordinary crime, it is necessary to break the law through the use of an instrument justice collaborator.

Abstract

The author of this journal aims to analyze the cooperation agreement between the tourism management Tanah Lot Tabanan District Government with Pakraman Beraban not provide the right balance for the parties to the agreement and a cooperation agreement tourism management Tanah Lot justice for Pakraman Beraban.jurnal was prepared using methods using a normative juridical research approaches legislation and approach to the concept. Based on the survey results revealed that the cooperation agreement tourism management Tanah Lot between the Regional Government of Tabanan regency with Pakraman Beraban not provide the right balance for the parties to the treaty because Tabanan regency has a higher position than Pakraman Beraban, so that the rights granted to the village pakraman not the same, the imbalance is also due Tabanan District Government want to manage the DTW Tanah Lot, in accordance with Article 12 Paragraph 3 of the Law of regional governments. Further, management cooperation agreement Tanah Lot tourism fair is to revise the substance of the agreements II in chapters 8 and 9 Paragraph (1), by applying the principle of legal equality and the principle of balance. Penulis jurnal ini bertujuan untuk menganalisis perjanjian kerjasama pengelolaan pariwisata Tanah Lot antara Pemerintah Daerah Kabupaten Tabanan dengan Desa Pakraman Beraban tidak memberikan keseimbangan hak bagi para pihak dalam perjanjian tersebut serta perjanjian kerjasama pengelolaan pariwisata Tanah Lot yang berkeadilan bagi Desa Pakraman Beraban.jurnal ini disusun menggunakan metode penelitian yuridis normatif dengan menggunakan pendekatan pendekatan perundang-undangan dan pendekatan konsep. Berdasarkan hasil penelitian diketahui bahwa Perjanjian kerjasama pengelolaan pariwisata Tanah Lot antara Pemerintah Daerah Kabupaten Tabanan dengan Desa Pakraman Beraban tidak memberikan keseimbangan hak bagi para pihak dalam perjanjian tersebut karena Kabupaten Tabanan memiliki kedudukan yang lebih tinggi dari Desa Pakraman Beraban, sehingga hak yang diberikan kepada Desa pakraman tidak sama, Ketidakseimbangan tersebut juga dikarenakan Pemerintah Daerah Kabupaten Tabanan ingin mengelola sendiri DTW Tanah Lot tersebut, yang sesuai dengan Pasal 12 Ayat 3 UU Pemerintah daerah. Selanjutnya, Perjanjian kerjasama pengelolaan pariwisata Tanah Lot yang berkeadilan adalah dengan melakukan revisi terhadap substansi perjanjian kerjasama II pada pasal 8 dan 9 Ayat (1), dengan menerapkan asas persamaan hukum dan asas keseimbangan.
