Abstract

Genealogy relationship to every aspect of life is a link for  a  generation  to  the  next  one.  The  continuity  of  generation needs the preparation and supply, materially or immaterially, in order to be able to exist and survive. Al-Qur‘an even suggested Moslem not to leave the weak generation. Therefore, genealogy relationship  was  believed  as  a  main  cause  of  inheritance transition from the dead to the heir. The problem appears when the Moslem has to bequeath to non Moslem. Al-Qur‘an does not explain  it,  even  the  tradition  forbade  the  interreligious inheritance,  whereas  the  social  context  demands  to  treat  the other way. The dialectic between law and social demand became a big problem to the Islamic law of inheritance.  The problem  of interreligious  inheritance  appeared  when  the  relationship between  Moslem  and  non  Moslem  was  re-discussed  by  some social groups. Moreover, it became attention of Moslem thinkers since its formation, such as Mua? bin Jabal. His decision to share the  inheritance  from  Moslem  to  non  Moslem  is  an  innovation that is needed to appreciate. He braves  to find another way  by ignoring  the  textual  law  towards  the  contextual  law  without leaving the essence of shariah. Besides it is for human benefit, it is also for implementing uptodate Islamic law.

Abstract

There  are  two  issues  that  always  actual  in  Islamic Marriage/Family Law (Munakahat), which until now  has always discussed by scholars, because no matter how much people need a  clear  legal  status,  ie  Marriage  Mut'ah  and  Sirri.  Such controversies are appropriately addressed with no preconceived notions, so that it can be studied with a critical attitude and well mannered  (no  blasphemy).  Marriage  mut'ah  a  variant  in  which marriage  is  governed  by  the  contested  legitimacy  of  Islam between  Sunnis  and  Shi'ites.  In  general,  the  Sunnis  consider mut'ah  marriage  is  a  type  of  marriage  is  not  legitimate  or illegitimate based on the testimony of hadith, Umar ibn Khattab fatwa and ijma 'Sunni clerics. As for the Shiites, particularly the Shiite  Istna  'Ash'arite,  consider  mut'ah  marriage  is  allowed  or lawful, although in practice  they  diffe r  on  some  of  the implementation.  This  paper  presents  the  analysis  about  the formulation of opinions about the scholars on the legal status of marriage mut'ah.

Abstract

Islamic jurisprudence see that sexual desire is a human base,  a  natural  power  that  is in a human.  So,  islamic jurisprudence regulate a human biological sexual desire channel by a marriage, and they don't  agree a sexual deviation, such as homosexual.  Homosexual is a bad behaviour that is prohibited in islamic jurisprudence based on al-Quran and hadis. Scribes of islamic jurisprudence agree to forbid homosexual, although there are so many opinion about law  sanction for them. Some of the scribes say that they have to be killed, have to be punished, such as a judgement for they commit an adultery, and even they say that homosexual will be punished in jail (ta'zir).

Abstract

Islamic law represent holy comands of Allah arranging all life aspect every Moslem, and cover items punish purely and also items of spiritual religious. He have the nature of elastic fixed hold on to its it's spirit that is and egaliter of monothoistik and also have  character  of  egaliter,  don't  rasial,  not  feodal  and  not patriarkhal.  Thereby,  education  of  Islam  which  dimiciling  it's equal  to  Islam  law  at  theoretical  framework  and  also  aplicative cannot discharge it his spirit that is and egaliter of monothoistik. Principal  of  education  of  Islam  which  this  egaliter  which  later have  to  be  developed  by  at  this  contemporary  education  era, backward  cause  of  moslem  after  glorious  so  much  year  in consequence of left behind his of education of woman.

Abstract

The  substance  of  issue  in  this  study  is  “how  many (degrees)  the  minimum  standardized  angle  still  be  considered feasible  and  how  the  application”  which  is  raised  in  the  title “The Minimum Standardized Angle  of the Kiblah Direction of Mosques in  Gorontalo  City”, with the aims on trying to find the minimum standardize referred to and to be used as guidelines by the  community  (Jama’ah)  whether  or  not  to  make  row adjustments  in  the  mosques  that  experienced  irregularities  of kiblah direction. Based on early studies showed that mostly the mosques of Gorontalo  city deviate from 1 to 15 degrees from the true  direction  of  Kiblah.  With  the  approach  of  science  and technology especially in the field of astronomy (falak), then what is desired by the provisions of Islamic law ( syar’i) above can be well  realized.  Deviations  of  Kiblah  direction  of  mosques  in Gorontalo  City today still can be find the solution to make rows improvements  /  adjustments  in  the  mosques  to  the  true direction of Kiblah or at least meet the minimum standardized angle which can be considered feasible in terms of the direction of kiblah in  the mosques has not been out of boundary areas of the city of Mecca.

Abstract

This  article  study  about  sukuk  is  known  as  sharia bonds with compare to obligation as the investment instrument in capital market.  Sukuk investment is  often regard as identical with obligation. There are number of basic differences between the  two  instrument,  that  is  the  use  of  sukuk  instruments  in investment  the  profit  of  which  is  divided  with  profit  sharing, sukuk  needs  to  have  an  underlying  transaction  in  the  form  of tangible assets and sukuk use religious advice that govern syariah bond.

Abstract

One of the Islamic fiscal instrument is waqf that have been played a significant role in economics.  Cash waqf is a new instrument  in  the  field  of  waqf  and  Islamic  economics as a facility for the purpose of worship and to achieve social welfare. The  development  of  the  waqf  field  through  cash  waqf, management  which  is  flexible  and  offers  many  choices.  Cash waqf have the multiplier effect in economic,  through this effect cash  waqf  can  be  used  as  instrument  to  poverty  alleviation program through community empowerment program.

Abstract

The  term  Maqasid  al-Syari’ah is closely linked to the Islamic Studies, especially in the field of the  study of Islamic law and Islamic jurisprudence. Some Muslim thinkers, like al-Syatibi (d. 766/1388) in his work al-Muwafaqat and al-Tufi (d.716/1316) in  his  Risalah  are  the  most  representative  of  them.  This  article will  introduce  the  development  and  the  enrichment  of  Maqasid al-Syari’ah theory in  contemporary era via Jasser Auda‘s thought. A difference from the previous theory of Maqasid al-Syari’ah, this contemporary theory of Maqasid al-Syari’ah can only be understood and developed, if and only if the Islamic law thinkers can and be able to integrate two different  type of scientific approaches,  namely  Historical  approach  and  Philosophical approach  in  the  same  time.  Historical  approach  very  keenly alerts the development and the movement of concept, meaning and interpretation in the understanding of Islamic law from the traditional,  modern  to  post-modern era.  While  philosophical approach utilizes the  systems theory – a theory which is commonly used  in  the  sciences – in the operationalization  of  those conceptual  entities. This  systems  theory  involves  six  features, namely  cognition,  wholeness,  openness,  interconnectedness, multidimensionality, and purposefulness. In the language  of scientific and institutional transformation of IAIN (State Islamic Institute) to UIN (State Islamic University) in the Islamic higher education  in  Indonesia  around  the  year 2000th, this changing scientific  outlook  is  patently  well  known as integration interconnection of scientific discourse.

Abstract

This article is aimed at examining how the study of Shari'ah sciences in  the higher  learning  institutions  in Indonesia  has  been  conceptually  developed  over  time,  and assessing whether or not such a development has responded to meet the dynamic demand of modern Muslim communities in the world. To achieve the objective, the article started with the examination  of  the  epistemological  concepts  that  have  been used so far to maintain certain departments of studies or create new  ones  by  employing  a  three-layer  concept  of  Islamic  law studies (philosophical, normative, and empirical). Further, the article  undertook  a  comparative  analysis  of  how  the  study  of the  Shari'ah  sciences  had  been  developed  in  three  most relevant  countries  to  Indonesia,  namely  Egypt,  Saudi  Arabia, and  Malaysia,  where  the  creation  of  new  departments  in  the Faculty  of  Shari'ah  had  been  responsive  to  their  respective local demands. The article concluded that the study of Shariah sciences  in  Indonesia  had  been characterized  by  the  lack  of attention to studies of Usul al-Fiqh as indicated by the absence of  the department of  Usul al-Fiqh at either undergraduate or graduate  studies,  and  the  lack  of  advanture  to  integrate  the study of Shari'ah sciences proper with such modern demands  -apart from Islamic economics  - as in the field of human rights, taxation, industrial law, land reform, etc

Abstract

The study of Islamic law requires a shifting paradigm from text to context and demands an inter-disciplinary approach involving  various  disciplines  in  social  sciences.  A  text-based legal-normative  approach  is  no  longer  adequate  to  ensure  the relevance of the study of Islamic law with the current changes as a  result  of  modernization  and  globalization.  Perspectives  of social sciences provides not only the lens to see Islamic law as a fact  social,  but  also  offers  the  analitical  frameworks  to  explain how  Islamic  law  engages  with  the  context  and  receives  new meanings  and  interpretations  in  its  complex  interaction  with other forms of social practices.  In  tandem  with  growing awareness  among  Muslim  intellectuals  of  the  importance  of actualizing Islamic law with the spirit of changes, the studies and researches  at  the  Faculty  of  Sharia  and  Law  at  Sunan  Kalijaga State Islamic University of Yogyakarta have thrived by utilizing and integrating social sciences into their paradigm, method and analytical  construct.  Within  this  context  the  so-called  "mazhab Yogya?  came  into  being.  This  new  trend  of  thought  pays  a special attention to the effort of reactualizing  fiqh  as knowledge about  the  basic  principles  used  as  a  reference  in  formulating Islamic law in accordance with local context.
