Abstract

Transformasi sistem perizinan usaha melalui implementasi Pendekatan Berbasis Risiko Pengajuan Tunggal Daring (OSS-RBA) telah menggeser paradigma perizinan dari pendekatan administratif konvensional ke pendekatan berbasis risiko. Transformasi ini telah memengaruhi penerapan peraturan daerah yang sebelumnya memberikan kewenangan perizinan kepada pejabat pemerintah daerah, termasuk kewenangan Mantri Pamong Praja dalam perizinan rumah kos di Kota Yogyakarta. Studi ini bertujuan untuk menganalisis kerangka peraturan yang mengatur kewenangan Mantri Pamong Praja setelah implementasi OSS-RBA dan untuk meneliti bentuk-bentuk ketidakharmonisan kewenangan yang dihasilkan serta implikasi hukumnya. Penelitian ini menggunakan metode yuridis normatif dengan menggunakan pendekatan hukum dan konseptual. Data dikumpulkan melalui penelitian kepustakaan dan dianalisis secara kualitatif melalui interpretasi sistematis, sinkronisasi hukum, dan harmonisasi peraturan. Temuan menunjukkan bahwa kewenangan Mantri Pamong Praja pada awalnya ditetapkan berdasarkan Peraturan Daerah Kota Yogyakarta Nomor 1 Tahun 2017, yang tetap berorientasi pada peraturan berbasis izin. Implementasi OSS-RBA berdasarkan UU Nomor 6 Tahun 2023, Peraturan Pemerintah Nomor 5 Tahun 2021, dan Peraturan Walikota Yogyakarta Nomor 51 Tahun 2023 telah menggeser mekanisme legalitas bisnis ke sistem elektronik nasional, menciptakan ketidakselarasan antara norma regional dan nasional. Ketidakselarasan tersebut tercermin dalam tumpang tindih kewenangan, mekanisme perizinan yang tidak konsisten, dan potensi ketidakpastian hukum. Kewenangan Mantri Pamong Praja telah diposisikan ulang dari penerbitan izin menuju fungsi pengawasan dan pengendalian regulasi. Studi ini merekomendasikan harmonisasi peraturan daerah dengan rezim OSS-RBA untuk memastikan kepastian hukum .

Abstract

Indonesia possesses an ambitious legal framework for environmental health and climate action, underpinned by its constitutional mandate and international commitments. Nevertheless, a significant implementation gap persists within the healthcare sector, a major contributor to national emissions. Employing a normative-empirical legal analysis, this study investigates the disconnect between national sustainability policies and their execution at the sub-national level. Our key contribution is to expose a critical legal blind spot: the healthcare sector is not explicitly regulated as a mitigation sector in Indonesia’s Enhanced NDC, despite its measurable emission footprint. Our findings indicate that the absence of sector-specific emission standards critically impedes progress, compounded by inadequate financial incentives for renewable energy and inconsistent enforcement of medical waste regulations. These regulatory failures not only jeopardize Indonesia’s climate commitments under the Paris Agreement but also compromise the constitutional right to a healthy environment. Consequently, this article goes beyond identifying the gap by proposing a novel sector-based legal framework: binding emission limits for health facilities combined with targeted green finance instruments. Such a framework is crucial to bridge the policy-implementation gap and to steer Indonesia’s healthcare sector toward a genuinely enforceable, constitutionally grounded, low-carbon future.

Abstract

The development of Artificial Intelligence (AI) technology has raised new legal issues in the field of copyright, particularly regarding the status and protection of works produced by artificial intelligence systems. AI is capable of producing works that appear original and complex, but its legal status as a creator remains a matter of debate because AI is not a legal subject with will and legal responsibility. Based on Law Number 28 of 2014 concerning Copyright, copyright can only arise from human creativity, feelings, and intentions that contain elements of creativity and originality. Therefore, works produced with the help of AI are still recognized as the property of humans who play a role in designing, directing, or controlling the creative process. Copyright principles such as the declarative, constitutive, originality, justice, moral rights, and economic rights are the main basis for maintaining a balance between protection for human creators and technological progress. The results of this study confirm that AI only functions as an aid in the creation process, while copyright recognition remains inherent in humans as the primary legal subject. Adaptive regulatory updates are needed so that copyright law in Indonesia can provide effective, fair, and aligned protection with the development of artificial intelligence-based digital technology.

Abstract

Penelitian ini bertujuan untuk menjelaskan urgensi pengintegrasian klausul Lingkungan, Sosial, dan Tata Kelola (ESG) ke dalam kontrak bisnis di Indonesia. Selain itu, penelitian ini juga berupaya untuk mengkaji upaya hukum yang tersedia bagi pihak-pihak yang mengalami kerugian akibat pelanggaran klausul ESG. Penelitian ini menggunakan metode yuridis normatif yang menganalisis norma hukum, prinsip, doktrin, dan peraturan perundang-undangan. Melalui pendekatan perundang-undangan, penelitian ini mengkaji peraturan-peraturan yang berkaitan dengan hukum kontrak, tanggung jawab perusahaan, dan keberlanjutan. Sementara itu, pendekatan konseptual mengeksplorasi teori, konsep, dan doktrin yang berkaitan dengan pelanggaran klausul ESG. Materi hukum primer yang digunakan dalam penelitian ini meliputi KUHP Indonesia (KUHP Perdata), Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas, dan peraturan-peraturan terkait lainnya. Materi hukum sekunder terdiri dari buku, jurnal ilmiah, laporan penelitian, dan artikel yang berkaitan dengan hukum kontrak dan ESG. Data dikumpulkan melalui riset pustaka. Temuan menunjukkan bahwa klausul ESG sangat penting dalam kontrak bisnis karena berfungsi untuk melindungi perusahaan dari berbagai risiko bisnis yang berkaitan dengan aspek lingkungan, sosial, dan tata kelola perusahaan sekaligus memastikan keberlanjutan bisnis. Penerapan klausul ESG dalam kontrak bisnis didasarkan pada prinsip kebebasan kontrak sebagaimana diatur dalam Pasal 1338 KUHP Indonesia dan persyaratan hukum untuk perjanjian yang sah berdasarkan Pasal 1320 KUHP Indonesia. Lebih lanjut, penelitian ini mengungkapkan bahwa pelanggaran klausul ESG dalam kontrak bisnis memberikan hak pilihan (keuzerecht) kepada pihak yang dirugikan untuk mengajukan klaim berdasarkan pelanggaran kontrak berdasarkan Pasal 1234 KUHP Indonesia atau klaim perbuatan melawan hukum berdasarkan Pasal 1365 KUHP Indonesia. Namun, klausul ESG harus dirancang dengan standar yang jelas dan terukur untuk memastikan keberlakuannya sebagai dasar tindakan hukum di pengadilan.

Abstract

Hospitals, as healthcare service providers, are legally obligated to deliver safe, high-quality, and lawful medical services. Nevertheless, the practice of employing medical and healthcare personnel without valid Registration Certificates (STR) and Practice Permits (SIP) remains prevalent, posing significant risks to patient safety and legal compliance. This study examines the civil and criminal liability of hospitals as corporate legal entities for employing unlicensed medical personnel. Using a normative legal research method with statutory and conceptual approaches, this study analyzes Indonesian health, hospital, and corporate liability regulations. The findings demonstrate that hospitals may be held civilly liable based on unlawful acts and the doctrine of vicarious liability for losses suffered by patients due to unauthorized medical practice. Moreover, hospitals may incur criminal liability as corporations where negligence, omission, or systemic management failures enable unlicensed personnel to provide healthcare services. These findings emphasize that ensuring the legality of medical personnel constitutes a core element of good hospital governance. Strengthening internal licensing controls and consistent law enforcement is essential to ensure legal certainty, patient protection, and healthcare quality.

Abstract

Agio represents capital contributions made by shareholders exceeding the nominal value of shares. Although economically significant, agio occupies an ambiguous position within Indonesian company law, as it is regulated only implicitly in the elucidation of Article 8 paragraph (2) letter c of Law Number 40 of 2007 on Limited Liability Companies. This normative placement creates legal uncertainty regarding the juridical consequences of agio, particularly whether such contributions affect fundamental shareholder rights. This article aims to analyze the legal status of agio in Indonesian company law and examine its implications for shareholder rights. Using a normative juridical approach through statutory and conceptual analysis, this study finds that agio does not automatically confer additional rights beyond those attached to shares, resulting in a disconnect between economic contribution and legal entitlement. This condition potentially generates disproportional outcomes and shareholder disputes. The article argues that clearer normative regulation is required to enhance legal certainty, fairness, and coherence in corporate capital arrangements.

Abstract

Indonesia and Australia have established the 1974 MoU Box, the 1981 MoU Concerning the Implementation of Provisional Fisheries Surveillance and Enforcement Arrangement, and the 1989 Agreed Minutes. These agreements aim to protect the traditional fishing rights of Indonesian fishermen within Australia's fishing zones, specifically around Ashmore Reef, Cartier Islet, Scott Reef, Seringapatam Reef, and Browse Islet. However, despite these agreements, Australia frequently arrests Indonesian fishermen who exercise their traditional fishing rights in these areas. This study utilizes a normative legal research method, focusing on document studies. The research findings indicate that Australian authorities arrest Indonesian traditional fishermen because Australia has re-designated these fishing zones as national marine parks, the definitions of fishing gear between Indonesia and Australia do not align with the needs of traditional fishermen, and there is a mutual interest between both nations in reducing Indonesian fishing activities in Australia’s fishing zones. The legal protection Indonesia should provide includes reinstating the traditional fishing rights of Indonesian fishermen in Australia’s fishing zones and clarifying the definition of traditional fishing gear to align with both fishermen's needs and scientific and technological developments.

Abstract

This paper discusses that Indonesia is currently experiencing a mental health emergency including in Special Region of Yogyakarta. From the data, it can be seen that there is an emergency in human mental health in the world, including for private workers and government employees. The results are there are no mental health services such as regular consultations with professionals in the field of mental health that are provided periodically to workers in PTN and PTS environments. The existence of these services is very important as reflected in the statements that have been filled in by respondents, both workers at PTN and PTS in Special Region of Yogyakarta.
