Abstract

Penelitian ini menganalisis pengaturan pelanggaran disiplin Aparatur Sipil Negara (ASN) pasca berlakunya Undang-Undang Nomor 20 Tahun 2023 serta menjaminnya terhadap kepastian hukum. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan-undangan dan konteks melalui kajian terhadap bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa terjadi pergeseran paradigma dari pendekatan sanksi yang represif menuju pembinaan yang bersifat rehabilitatif, dengan tetap mengacu pada Peraturan Pemerintah Nomor 94 Tahun 2021 sebagai dasar teknis. Namun dalam praktiknya masih terdapat permasalahan berupa ketidakkonsistenan hukuman, disparitas perlakuan terhadap pelanggaran serupa, serta potensi multitafsir norma yang berdampak pada lemahnya kepastian hukum. Oleh karena itu, diperlukan penegakan regulasi dan implementasi konsistensi untuk menjamin kepastian hukum serta meningkatkan profesionalitas ASN.

Abstract

Corruption in public administration is largely rooted in the abuse of authority by public officials in exercising governmental powers. In Indonesia, anti-corruption strategies have predominantly relied on criminal law enforcement, which tends to address corruption only at the symptomatic level rather than tackling its structural causes. This study argues that administrative law should function as a primary instrument (primum remedium) in combating corruption, given its central role in regulating the exercise of public authority and ensuring accountability in governance. This research employs a normative juridical method with an explanatory approach, using statutory, conceptual, and doctrinal analyses of legal materials derived from legislation, court decisions, and international anti-corruption instruments. The findings indicate that the limited effectiveness of corruption eradication in Indonesia is closely related to weak preventive administrative mechanisms, non-independent internal supervision, and ineffective enforcement of administrative sanctions against abuse of power. Strengthening administrative law enforcement through preventive, repressive, and restorative mechanisms can significantly enhance anti-corruption governance. Key reforms include merit-based recruitment of public officials, independent administrative oversight, stricter monitoring of officials’ assets, digitalization of public services, and the firm application of administrative sanctions without waiting for criminal conviction. These measures can improve institutional accountability and strengthen good governance as a structural strategy to prevent corruption.

Abstract

This study aims to analyze the provisions of part-time and full-time Government Employees with Employment Agreements (PPPK) in the Indonesian civil service legal system and examine the legal implications of the differences in rights and obligations between the two. The research method used is normative legal research with a statutory and conceptual approach, utilizing primary, secondary, and tertiary legal materials analyzed qualitatively. The results show that full-time PPPK have a clear regulatory basis in laws and regulations, specifically in Law Number 20 of 2023 concerning the State Civil Apparatus and Government Regulation Number 49 of 2018. Meanwhile, part-time PPPK do not have explicit normative regulations, resulting in legal uncertainty. This difference has implications for an imbalance in rights and obligations, particularly regarding salaries, benefits, job protection, and certainty of tenure. This condition has the potential to cause injustice and contradicts the principle of legal certainty and the merit system in ASN management. Therefore, regulatory harmonization is needed to ensure justice, legal certainty, and protection of the rights of all PPPK.
