Abstract

Penelitian ini bertujuan untuk memberikan gambaran perbandingan perlindungan hukum terkait perjanjian elektronik dalam transaksi E-Commerce, dan menentukan perbandingan mekanisme penyelesaian sengketa terkait perjanjian elektronik dalam transaksi E-Commerce. Penelitian ini menggunakan jenis penelitian hukum normatif dengan pendekatan studi literatur, jenis dan sumber bahan hukum menggunakan bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Penelitian ini juga menggunakan teori perjanjian kepercayaan, teori hukum perbandingan, dan teori perilaku terencana. Analisis data akan dipelajari secara kualitatif preskriptif. Hasil penelitian menunjukkan bahwa perbandingan perlindungan hukum terkait perjanjian elektronik dalam transaksi E-Commerce hanya tercantum secara lebih spesifik dalam Undang-Undang ITE dan perbandingan mekanisme penyelesaian sengketa terkait perjanjian elektronik dalam transaksi E-Commerce tercantum secara luas dan spesifik dalam KUHP dan Undang-Undang ITE.

Abstract

Vasektomi sebagai pilihan dalam layanan kesehatan reproduksi berhadapan dengan fatwa Majelis Ulama Indonesia (MUI) yang membatasi tindakan tersebut karena berpotensi mengakibatkan pemandulan permanen. Artikel ini menganalisis hubungan kedua kerangka norma dan menawarkan model akomodasi konstitusional. Penelitian hukum normatif ini menggunakan pendekatan perundang-undangan, konstitusional, konseptual, dan analitis dengan menelaah UUD NRI Tahun 1945, regulasi HAM, kependudukan, kesehatan, aturan pelaksana kesehatan reproduksi, serta Fatwa Ijtima Ulama MUI Tahun 2012. Kajian menemukan bahwa perbedaan tersebut bukan antinomi formal antarperaturan karena fatwa tidak berada dalam hierarki peraturan perundang-undangan. Persoalan yang muncul adalah ketegangan substantif antara layanan kesehatan berbasis hak dan norma agama yang berpengaruh secara sosial. Harmonisasi perlu menjamin pilihan sukarela, persetujuan tindakan tertulis, keselamatan klinis, informasi transparan mengenai sifat permanen dan rekanalisasi, perlindungan dari insentif yang memaksa, serta penghormatan terhadap keyakinan agama.

Abstract

This study aims to examine and analyze the implementation of civil case resolution via E-Court-based small claims procedures at the District Court, the factors hindering the implementation of electronic small claims at the Sidrap District Court, and the obstacles encountered in this process. The study employs a normative-empirical research design, utilizing both statutory and socio-legal approaches. Data sources include both primary and secondary data. Data analysis is conducted through observational-sensory and theoretical-rational methods, employing a reasoning model that proceeds from inductive logic to deductive logic. The study finds that the implementation of civil case resolution via E-Court-based small claims at the District Court is governed by Supreme Court Regulation No. 4 of 2019 (amending Supreme Court Regulation No. 2 of 2015 on Small Claims Resolution Procedures) and Supreme Court Regulation No. 7 of 2022 (on Electronic Case Administration and Court Proceedings). The process comprises the following stages: registration (E-Filing), payment (E-Payment), review of claim completeness, appointment of the presiding judge and substitute clerk, summoning of parties (E-Summons), conciliation, trial proceedings (E-Litigation), and the rendering of the judgment. In the E-Court system, judges upload official copies of rulings—electronically signed using digital certificates (e-sign) from the Electronic Certification Center (BSrE)—into the SIPP and E-Court systems. Factors hindering the implementation of electronic-based small claims lawsuits at the Sidrap District Court, as well as obstacles in resolving such civil cases, include: administrative factors (errors in uploading or transmitting files/documents, identity verification issues, problems with advance court fees, administrative errors in summoning parties, and delays in sending hearing documents); public factors (legal understanding and culture, where the public lacks knowledge regarding E-Court and still views face-to-face court services as necessary); and infrastructure factors (issues with internet networks and the E-Court system/application). Additionally, regulatory obstacles exist regarding Supreme Court rules on E-Court and small claims; these regulations address procedural aspects but fail to provide mechanisms for resolving issues that arise during the actual implementation of electronic-based small claims proceedings.

Abstract

This study aims to analyze the controversy surrounding song and music copyright royalties in Indonesia and identify the factors contributing to the suboptimal fulfillment of royalty rights for creators. The research method used is normative legal research with an analytical and comparative approach, comparing the royalty management systems in Indonesia with those in the United States. The results indicate that the main problems lie in the lack of transparency of the National Collective Management Institution (LMKN), a weak oversight system, and the suboptimal integrated song and music database. Furthermore, the Indonesian royalty management system still uses a collective approach, which is considered inefficient and does not provide fair legal certainty for creators. Meanwhile, the United States has implemented more transparent and flexible systems, such as direct licensing and technology-based management. This research contributes to providing recommendations for improving the royalty management system in Indonesia to make it more transparent, accountable, and equitable for all parties involved in the music industry.

Abstract

This study aims to determine and analyze the process of resolving disputes over the unlawful act of installing billboards and the legal consequences that occur if the billboard is installed incorrectly without rights. This study uses a normative research type with a legislative approach and an analytical approach. The types of legal sources use primary legal materials, secondary legal materials, and tertiary legal materials. Legal analysis will be studied in a qualitative prescriptive manner. The results of this study are the process of resolving disputes over the unlawful act of installing billboards, namely there are 2 paths or mechanisms, namely identifying or proving that the installation of billboards without rights meets the elements in Article 1364 of the Civil Code. In the settlement there are 2 efforts, namely Non-Litigation Efforts (Outside the Court) by seeking Negotiation, mediation, and Conciliation. However, if the Non-Litigation Effort is not successful and effective, then the Court Effort by filing a civil lawsuit in the Court can be carried out with the initial stage of filing a lawsuit (registration of the lawsuit, appointment of a panel of judges and determination of the trial date and mediation efforts), the examination stage (reading of the lawsuit, the defendant's response, replies and duplicates), the evidence stage (letters, witnesses, experts and others) and the final stage of the Conclusion and decision. After a court decision that has permanent legal force (completed or no legal efforts), then the execution will be carried out according to the wording of the decision and the legal consequences that occur if the error in installing a billboard without rights is the result of civil law related to the error in installing a billboard without rights, namely the perpetrator or installer is obliged to make compensation, stop the use of land without permission while dismantling the billboard without rights and returning the condition of the land or building to its original state.
