Abstract

A child of a indigenous faiths community is someone who has grown up in a community that holds certain traditional beliefs or faiths, which are often local and not tied to a major religion or official doctrine. They may follow or practice traditions such as the worship of nature, ancestral spirits, or rituals passed down through generations. In general, protection for minority groups. This research will examine the problematic fulfillment of children's rights of indigenous faiths in Indonesia. The approach method used in the research is normative juridical through legal principles, legal systematics, legal synchronization, and legal comparison. The data analysis method is qualitative juridical obtained through primary, secondary and tertiary data related to case studies of the fulfillment of children's rights of indigenous peoples in the region. The results of the research obtained from the problematic fulfillment of children's rights of indigenous faiths, first, the lack of legal recognition and identity/rejection of childbirth certificate registration for indigenous faiths couples. Second, the right of children to receive education in accordance with the curriculum and teachings of their beliefs. Third, protection from discrimination: Children from indigenous faith communities may be vulnerable to discrimination, and fourth, freedom of religion. The right of children to choose and practice their own religion or belief should be respected and protected.

Abstract

Perkembangan Fintech Lending memberikan kemudahan bagi masyarakat untuk memperoleh pendanaan. Namun demikian, keberadaan Fintech Lending seringkali menimbulkan permasalahan hukum yang merugikan konsumen. Pemahaman secara komprehensif aspek hukum Fintech Lending diharapkan dapat meminimalisir terjadinya kerugian konsumen. Metode yang digunakan dalam Pengabdian Pada Masyarakat ini dilaksanakan dengan penyuluhan hukum yang diawalai dengan pemberian materi dan diskusi. Hasil Pengabdian Masyarakat bahwa perlindungan hukum terhadap konsumen Fintech Lending dapat dikategorikan menjadi dua yaitu perlindungan hukum terhadap Fintech Lending Ilegal dan Fintech Lending yang terdaftar atau memiliki izin dari Otoritas Jasa Keuangan. Masyarakat dan konsumen Fintech Lending harus bijak memanfaatkan layanan Fintech Lending untuk menghindari adanya potensi kerugian yang dialami konsumen.

Abstract

The life of a person or company is inseparable from debt and credit transactions with the background of fulfilling a daily need. Business entities or people in conducting lending and borrowing activities that provide loan services, do not want the money loaned to just disappear without a reciprocal relationship between the borrower and the provider of funds. In fact, generally borrowers can pledge goods or assets owned as collateral if one day they cannot redeem or fulfil their obligations. Collateral that is sold without the consent of the owner can have legal consequences on the sale and ownership of the collateral. The purpose of this research is to examine and determine the legal status of ownership collateral objects sold by creditors to other parties without the consent of the debtor in a debt and credit agreement, as well as the creditor’s responsibility to the debtor who owns the collateral as the injured party from the sale of the collateral object without the debtor’s consent in terms of agreement law and collateral law. The research method used is using a normative juridical approach by using research result, works of legal experts, and library material that use secondary data in the form of primary legal materials, secondary legal materials, and tertiary legal materials. The results showed that the legal status of ownership of the object of collateral obtained by unlawful acts from the sale and purchase of collateral object that are being encumbered by debt and credit guarantees is declared legally invalid and ownership remains according to the Certificate of Title, namely the debtor in the debt and credit agreement as the owner of the land. The creditor’s responsibility towards the debtor as the injured party in the sale of the collateral object in the debt agreement is to provide immaterial compensation in the form of returning and surrendering land ownership by the land buyer to the land owner, namely the debtor in the debt and credit agreement as well as a statement from the judge’s decision that the creditor has committed an unlawful act by selling the land that is being encumbered by collateral.

Abstract

  Abstract This article examines the legal protection for vulnerable consumers, particularly women and children, within the framework of Indonesian consumer protection law. Using normative-juridical and case study methods, this study analyzes both the regulatory provisions and real-life case applications. One notable case involves the marketing of sugar-laden snacks to children via online influencers, while another explores the predatory lending practices targeting women through online loans. The study finds that existing consumer protection mechanisms are inadequate to respond to the specific vulnerabilities of these groups. It emphasizes the urgency of strengthening the legal framework through affirmative protection, institutional sensitivity, and a gender-and-child-friendly perspective in enforcement. The findings contribute to the discourse on consumer justice and propose regulatory reforms to ensure substantive equality in consumer protection. Keywords:, children, consumer protection law, indonesia, vulnerable consumers, women Abstrak Artikel ini membahas perlindungan hukum terhadap konsumen rentan, khususnya perempuan dan anak, dalam kerangka hukum perlindungan konsumen Indonesia. Dengan pendekatan yuridis-normatif dan studi kasus, penelitian ini menelaah ketentuan regulatif serta penerapannya dalam praktik. Kasus promosi makanan tinggi gula melalui influencer anak-anak dan praktik pinjaman online yang menjebak perempuan merupakan contoh nyata bagaimana kelompok rentan menjadi sasaran eksploitasi. Hasil kajian menunjukkan bahwa mekanisme perlindungan konsumen saat ini belum memadai untuk menjawab kebutuhan spesifik kelompok ini. Penelitian ini menekankan pentingnya afirmasi hukum, kepekaan kelembagaan, dan perspektif ramah gender dan anak dalam penegakan hukum. Temuan ini berkontribusi pada wacana keadilan konsumen dan merekomendasikan reformasi regulasi untuk menjamin kesetaraan substantif dalam perlindungan konsumen. Abstract

In 2019, the Indonesian government will target all products circulating in halal-certified Indonesia. While the readiness of the Halal Product Guarantee Agency (BPJPH) is still constrained by a Government Regulation that has not been approved by the President. The development of technology and information makes buying and selling transactions can be done online, there are many products sold online, some of which do not include halal labels in their products. Seeing the inequality between das sollen and das sein, this article formulates the problem of how to guarantee legal protection for the sale of non-halal labeled products sold online as well as any obstacles that must be anticipated by the JPH Law to protect Muslim consumers from obtaining halal products in electronic transactions using normative research method.

Abstract

Dispute resolution arrangements in the field of physical trading of crypto assets must comply with BAPPEBTI Regulation No. 8 of 2021 in order to be harmonized and have strong legal certainty. However, in practice there is a dispute resolution clause on the crypto asset exchange platform that is not in accordance with BAPPEBTI Regulation No. 8 of 2021. This study aims to determine the dispute resolution chosen based on the agreement in the user agreement on the cryptocurrency sales platform that is not based on BAPPEBTI Regulation No. 8 of 2021 and the legal force of the decision issued by the institution chosen based on the dispute resolution agreement in the user agreement in the field of physical trading of crypto assets. This research uses a research method with a normative juridical approach. The specification of the research conducted is descriptive analysis. The stages of this research focus on literature research and conduct field studies by conducting interviews. Based on the research results, two things can be concluded. First, the dispute resolution chosen based on the agreement in the crypto asset physical trading user agreement that is not based on BAPPEBTI Regulation No. 8 of 2021, the agreement remains binding on both parties as law for the parties. However, the crypto asset exchange platform is considered non-compliant with BAPPEBTI Regulation No. 8 of 2021 and may be subject to administrative sanctions. Second, the legal force related to the decision issued by the institution chosen based on the dispute resolution agreement in the user agreement in the field of physical trading of crypto assets and not in accordance with BAPPEBTI Regulation No. 8 of 2021 is final, binding, and has permanent legal force because the dispute resolution has been agreed by both parties in the user agreement before the dispute occurs (pactum de compromittedo).

Abstract

Perusahaan perkebunan wajib memfasilitasi kebun masyarakat sekitar, ketentuan memfasilitasi kebun masyarakat sekitar tersebut berdasarkan Undang-Undang Nomor 39 Tahun 2014 Tentang Perkebunan Jo. Undang-Undang Nomor 6 Tahun 2023 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja Menjadi Undang-Undang Pasal 58 yang berbunyi “(1) Perusahaan Perkebunan yang mendapatkan Perizinan Berusaha untuk budi daya yang seluruh atau sebagian lahannya berasal dari: a. area penggunaan lain yang berada di luar hak guna usaha; dan/atau b. areal yang berasal dari pelepasan kawasan hutan, wajib memfasilitasi pembangunan kebun masyarakat sekitar, seluas 20% (dua puluh persen) dari luas lahan tersebut”. Penelitian ini menggunakan yuridis normatif yaitu penelitian hukum yang bertumpu pada pelaksanaan kaidah-kaidah atau norma-norma hukum yang terdapat dalam hukum positif. Berdasarkan hasil dari penelitian bahwa Perlindungan Hukum yang diberikan yaitu Perusahaan perkebunan yang tidak melaksanakan kewajiban fasilitasi pembangunan kebun masyarakat sekitar dapat dikenakan sanksi administratif berupa denda, penghentian sementara dari kegiatan Usaha Perkebunan dan/atau pencabutan Perizinan Berusaha Perkebunan yang telah diatur dalam Peraturan Pemerintah Nomor 26 Tahun 2021 Tentang Penyelenggaraan Bidang Pertanian.

Abstract

Cybercrime covers a wide range of illegal acts carried out through the Internet or other digital devices, including fraud, identity theft, hacking, the spread of malware, to sexual exploitation of children. Girls are often the primary targets of these various forms of cybercrime. This is due to several factors, such as higher emotional vulnerability, still strong gender stereotypes, as well as a lack of education and awareness about cybersecurity among girls. Therefore, special protection that takes into account a gender perspective is essential to reduce the risk and impact of cybercrime against girls. In addition to the above cases, there are many more cases of cybercrime against girls in Indonesia that have not been or received public attention. Cybercrime is a serious threat that needs to be addressed seriously and urgently. So it is necessary to study further the impact of cybercrime on girls and to analyze gender perspectives in protecting girls' consumers as vulnerable consumers. Education on cybersecurity should start early, with a special focus on girls. Strict regulations and policies are needed to protect girls from sexual exploitation and other cybercrimes. Using protective technologies such as antivirus software and parental monitoring apps can help reduce the risk of girls becoming victims of cybercrime. Psychological and social support is crucial in helping girls who are victims to cope with the negative impact of cybercrime. Collaboration between various institutions and communities is essential to creating a secure and supportive digital environment for girls.
