Abstract

Traffic violations are committed not only on adults, even including the age of children also commit many traffic violations. Legal sanctions for violators will be imposed, both administrative criminal sanctions and imprisonment sanctions. Juridically, violators will be subject to imprisonment for a maximum of 1 (one) year and/or a maximum fine of IDR 2,000,000.00 (two million rupiah) in accordance with Article 229 paragraph (3) of Law Number 22 of 2009 concerning Road Traffic and Transportation. The law imposes imprisonment, confinement and fines for traffic violations in the Bangko police station. In addition, criminals and perpetrators of traffic violations can be sentenced to additional crimes in the form of revocation of driver's licenses or compensation for losses caused by criminal acts or traffic violations, but this enforcement is intended for traffic offenders who are adults. Meanwhile, criminal liability for perpetrators of traffic violations committed by school children in the jurisdiction of the Bangko Police Station, usually first looks at the elements, namely intentional or not or negligence that results in the occurrence of the violation, it will affect the legal action that will be taken by the Bangko Police Station for traffic violators. For criminal law liability for traffic violations committed by school children in the jurisdiction of Bangko Police Station, violators of the age category of school children are only given criminal sanctions in accordance with applicable legal provisions.

Abstract

This study discusses law enforcement against members of the National Police involved in drug abuse, with a review of the Chief of Police Regulation Number 14 of 2011 concerning the Code of Professional Ethics of the National Police and Government Regulation Number 1 of 2003 concerning the Dismissal of Police Members. The research method used is normative legal research. The results of the analysis show that law enforcement against members of the National Police who commit criminal acts of drug abuse refers to Law Number 35 of 2009 concerning Narcotics. In addition, violations of the National Police Professional Code of Ethics may result in ethical and administrative sanctions in accordance with the provisions stipulated in the regulation. Ethical sanctions are applied for minor violations, while administrative sanctions can include serious violations that can result in dishonorable dismissal of members of the National Police. The implication of this study is the importance of maintaining the integrity and professionalism of members of the National Police in carrying out their duties and complying with applicable legal rules in order to realize fair and effective law enforcement.

Abstract

This study aims to identify the factors that influence the occurrence of narcotics abuse in the Rokan Hilir Legal Area and analyze the efforts made by the Rokan Hilir Police and BNNK in preventing narcotics abuse in the region. The research method used is a combination of Normative and Empirical Legal research. The results showed that the factors influencing drug abuse in the Rokan Hilir jurisdiction include trial and error due to curiosity, lack of self-confidence, economic factors, lack of understanding of the dangers of drug abuse, and the influence of lifestyle. In addition, efforts made by the Rokan Hilir Police, together with BNNK, to prevent drug abuse in the region consist of promotive, preventive, and repressive efforts. The implication of this research is the importance of increasing public understanding of the dangers of narcotics abuse as well as expanding and increasing the effectiveness of preventive and repressive efforts carried out by the authorities in order to reduce the number of narcotics abuses in the Rokan Hilir jurisdiction.

Abstract

Traffic violations are a problem that continues to be faced by the Dumai Police jurisdiction. Applying criminal fines as sanctions for these violations is expected to reduce the number of violations and improve road safety. The purpose of this study is to explain the effectiveness of the application of criminal fines for traffic violations in the jurisdiction of the Dumai Police Station and to explain the factors that influence the occurrence of traffic violations in the jurisdiction of the Dumai Police Station. The method used in this research is a sociological juridical approach (sociolegal). The results showed that applying criminal fines for traffic violations at Dumai Police Station is still adequate. This can be seen from the number of offenders required to pay fines by the rules in Law Number 22 of 2009 concerning Road Traffic and Transportation. However, even though fines have been applied, they have yet to have a significant deterrent effect on violators. Violators often consider fines a redeemable punishment, making it possible for them to repeat the same offence in the future. Therefore, imprisonment should be considered in addition to fines to provide a more substantial deterrent effect. Factors that influence the occurrence of traffic violations in the jurisdiction of Dumai Police include human factors, vehicle factors, and road condition factors. This research implies the need to evaluate and review the policy of applying criminal fines for traffic violations. A combination of fines and imprisonment can increase the deterrent effect and reduce the number of traffic violations in the jurisdiction of Dumai District Police.
