Abstract

In accordance with Article 157 paragraph (3) of Law Number 10 Year 2016 About the Second Amendment to Law Number 1 Year 2015 On Government Regulation Stipulation in Lieu of Law Number 1 Year 2014 on the Governors Election, Regents and Mayors into Law, Disputes over the final election result shall be examined and tried by the Constitutional Court until the a special judicial body established. The time limit for the special judicial body formation is prior to the national elections implementation, if interpreted systematically with reference to Article 201 paragraph (9) of Law No. 10 of 2016, the implementation will be held in 2024. But it is possible that before the deadline the special judicial body to handle local election matters has been established, so that the transitional authority of the Constitutional Court shall be delegated to the real authority holder.This study aims to find answers to how the Constitutional Court authority during the transitional settlement of dispute over election results of regional heads; and to find alternatives to establishment concept of the Special Judicial Body for Dispute over the Regional Head Elections Results. With the achievement of the objectives of this study is expected to contribute or contribute to the development of legal science in general, Constitutional Law in particular; and can be useful other than as material information, literature, and for the development of legal science concerning dispute over disputes election results of regional heads. The method used in this research is a normative juridical approach that is an approach in legal research using secondary data as the main source. The data analysis used is normative qualitative, which aims to have existing data and then analyzed qualitatively based on existing laws and regulations as a positive legal norm so as not to use numbers and mathematical and statistical formulas. The results of data analysis are presented in the form of description. Concerning the position of the Constitutional Court in exercising its authority in deciding different electoral disputes with previous elections. If in judicial review, the Constitutional Court is 'above' the law, then the Constitutional Court's position in handling the election dispute is under the law and only in the position of executor. As the implementer of the Constitutional Court law must obey and follow the law, so that the authority is not exceeded. The Constitutional Court will provide a model for handling disputes over the results of this election at a special judicial body later. While the concept of a special judicial body dispute election results is a. The institutional model is a special election adhoc court, within the administrative court of the State; b. Scope: only administrative authority related to election result disputes; c. Decentralistic Nature; d. Number of Judges 5 persons, by filling 2 PTUN career judges, 3 adhoc judges; e. Pilkada implementation system: National Serentak starting in 2024; f. Application of Procedural Law The special session of election result disputes is regulated in a separate regulation by adapting the concept of procedural law prescribed by the Constitutional Court at this time, with some confirmation and adaptation of the Constitutional Court.

Abstract

Jumlah penduduk dari tahun ke tahun semakin meningkat, namun peningkatan jumlah ini bertolak dari belakang dengan dengan kondisi tanah karena luas tanah tidak mungkin mengalami peningkatan atau perluasan, kontradiksi ini sering memicu timbulnya gesekangesekan kepentingan yang berkaitan dengan penggunaan dan pemanfaatan tanah, yang berakibat timbulnya sengketa bidang pertanahan. Berdasarkan hal ini, maka permasalahan yangmenjadi pokok bahasan dalam penulisan ini adalah sebagai berikut: Sengketa pertanahan apakah yang objek sengketanya termasuk kewenangan Peradilan Umum berdasarkan Undang-Undang Peradilan Umum? dan bagaimanakah eksistensi kewenangan Peradilan Umum dalam menangani dan menyelesaikan sengketa pertanahan berdasarkan Undang-Undang Peradilan Umum?

Abstract

The purpose of the research is to find out law enforcement against children who abuse narcotics. The research method used is a normative juridical approach, namely research based on literature studies that examines primary materials, secondary materials and tertiary materials. Based on the results of the study, it can be concluded that first, law enforcement efforts against children who abuse narcotics or are related to narcotics crimes can be carried out in two ways, namely through a diversion mechanism using a restorative justice approach. The concrete form of the diversion effort and through the second court decision mechanism, Rehabilitation of Children Who Become Victims of Abuse of Narcotics, Spicotropics, and Other Addictive Substances, can be carried out in several stages including: medical rehabilitation, social rehabilitation, and non-medical rehabilitation.Penelitian ini bertujuan untuk mengetahui penegakan hukum terhadap anak yang melakukan penyalahgunaan narkotika dan untuk mengetahui merehabilitasi anak yang menjadi korban penyalahgunaan narkotika, spikotropika, dan zat adiktif lainnya. Metode penelitian yang digunakan adalah pendekatan yuridis normatif yaitu penelitian yang didasarkan kepada studi kepustakaan yang mengkaji bahan primer, bahan sekunder dan bahan tersier. Kesimpulan adalah pertama, upaya penegakan hukum terhadap anak yang melakukan penyalahgunaan narkotika atau terkait dengan tindak pidana narkotika dapat dilakukan melalui dua cara, yaitu melalui mekanisme diversi dengan menggunakan pendekatan keadilan restoratif. kedua, Merehabilitasi anak Yang Menjadi Korban Penyalahgunaan Narkotika, Spikotropika, dan Zat Adiktif Lainnya, dapat dilaksanakan dengan rehabilitasi secara medis, rehabilitasi secara sosial, dan rehabilitasi non-medis.

Abstract

This research is motivated by the increase in the crime rate in the Banjar Police jurisdiction in 2020, which was 27 (twenty seven) cases compared to the previous year which amounted to 14 (fourteen) cases. The data shows that the performance of the Banjar Police Sat Sabhara in carrying out patrol duties has experienced a decline. The method used in this study is a normative juridical approach, namely testing and reviewing secondary data. This research was conducted in two stages, namely library research and field research which is only supporting. The results of the study show that based on Article 55 paragraph (1) of the National Police Perkap No. 23 of 2010, Sat Sabhara has a position as an element of implementing the main tasks under the Chief of Police. As an implementing element for the main task, the Sat Sabhara has a role and function in terms of maintaining Kamtibmas through regulating, guarding, patrolling, escorting and community service activities and early-stage enforcement efforts. There are several obstacles faced by Sat Sabhara in carrying out patrol activities, namely the lack of good planning and the less than optimal implementation of patrols. The efforts that must be made are to evaluate planning and maximize patrol activities by increasing the number of human resources and adding facilities and infrastructure to support activities.Penelitian ini dilatarbelakangi oleh meningkatnya angka kriminalitas di wilayah hukum Polres Banjar pada tahun 2020 yaitu sebanyak 27 (dua puluh tujuh) kasus dibanding tahun sebelumnya yang berjumlah sebanyak 14 (empat belas) kasus. Data tersebut menunjukan kinerja Sat Sabhara Polres Banjar dalam melaksanakan tugas patroli mengalami kemunduran. Metode yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif, yaitu menguji dan mengkaji data sekunder. Penelitian ini dilakukan melalui dua tahap yaitu studi kepustakaan dan penelitian lapangan yang hanya bersifat penunjang. Hasil penelitian menunjukan bahwa berdasarkan Pasal 55 ayat (1) Perkap Polri No. 23 Tahun 2010, Sat Sabhara mempunyai kedudukan sebagai unsur pelaksana tugas pokok yang berada di bawah Kapolres. Sebagai unsur pelaksana tugas pokok, Sat Sabhara mempunyai peran dan fungsi dalam hal pemeliharaan Kamtibmas melalui kegiatan pengaturan, penjagaan, patroli, pengawalan serta pelayanan masyarakat dan upaya penindakan tahap awal. Ada beberapa hambatan yang dihadapi Sat Sabhara dalam melaksanakan kegiatan patroli yaitu kurangnya perencanaan yang baik dan kurang maksimalnya pelaksanaan patroli. Adapun upaya yang harus dilakukan adalah melakukan evaluasi perencanaan dan memaksimalkan kegiatan patroli dengan meningkatkan jumlah SDM dan menambah sarana dan prasarana penunjang kegiatan.

Abstract

Perselisihan hasil Pilkada merupakan perselisihan antara KPU Provinsi/ Kabupaten/ Kota sebagai Penyelenggara Pemilu dengan peserta pemilihan mengenai penetapan perolehan suara hasil pemilihan yang dapat mempengaruhi penetapan calon terpilih. Penyelesaian sengketa pilkada menjadi kewenangan Mahkamah Konstutusi. Sebagai pelaksana undang-undang MK harus taat dan mengikuti undang-undang, agar kewenangan tidak terlampaui. MK akan memberikan model penanganan sengketa hasil pilkada ini pada badan peradilan khusus. Konsep penyelesaian sengketa hasil pilkada yaitu Model Lembaga adalah pengadilan adhoc khusus pemilu yang berada dalam lingkungan peradilan tata usaha Negara, ruang lingkup sengketa hanya kewenangan administrasi terkait sengketa hasil pilkada, bersifat desentralistik.

Abstract

The process or stages of examining State Administrative disputes at the State Administrative Court, both based on statutory regulations, as well as in judicial practice, do not include a reconciliation process between the litigants through mediation. This is different from the examination of civil cases in both the general court and religious courts, in which there is mediation between the litigants. Based on these problems, the purpose of this study is to analyze the urgency of peaceful settlement of state administrative disputes through mediation at the State Administrative Court, as well as its legitimacy. The research method used in this research is normative juridical, which is a method in normative legal research that analyzes secondary data, which is then analyzed qualitatively. The results of this research are as follows: Settlement of state administrative disputes peacefully through mediation in the Administrative Court State Enterprises are very important (urgent) as instruments to be applied to the procedural law of the State Administrative Court, so that the Procedural Law of the State Administrative Court is more comprehensive, and can fulfill the administration of justice which is simple, fast and low cost and provides greater access to the parties. in obtaining a settlement of state administrative disputes that fulfills a sense of justice, and the legitimacy of peaceful settlement of state administrative disputes through mediation at the State Administrative Court, it is necessary to make changes to the amendments to the Republic of Indonesia Law Number 5 of 1986 concerning Judiciary. State Administration, or at least amendments are made to the Regulation of the Supreme Court Number 1 of 2016 concerning Mediation Procedures in Courts, which are adjusted to the procedural law of the State Administrative Court, so that with a formal acknowledgment (legitimacy) peaceful settlement of state administrative disputes through mediation at the State Administrative Court, so that the amicable settlement of state administrative disputes through mediation at the State Administrative Court is recognized as valid.

Abstract

lawsuit/dispute, because this concerns the authority of the judicial body, such as the authority of the State Administrative Court related to handling and resolving land disputes. Therefore, the purpose of this research is to analyze and find out about the authority of the Administrative Court in handling and resolving land cases. This research method is normative juridical. Normative juridical is a method in normative legal research that analyzes secondary data. The secondary data is then analyzed in a qualitative juridical manner. The result of this study are as follows: The authority of the State Administrative Court in handling and resolving land cases is more about the correctness of formal administrative procedures, not authorized to hear “cases of ownership of land rights”, which are civil in nature, even though the land has been certified.

Abstract

Angkeub Hamlet, located in Cimarias Village, Pamulihan Subdistrict, Sumedang Regency, has great UMKM potential in palm sugar production. However, Angkeub Hamlet has challenges in developing its economy, namely the lack of community understanding of digital business. This research aims to open the insights of training participants about product diversification from palm sugar. This activity was carried out with a qualitative method in the form of direct discussions with residents, namely palm sugar craftsmen. The results of this thematic KKN program are that the community gained a new understanding of palm sugar cultivation, bookkeeping, product legality, and the operation of platforms for digital marketing through social media and e-commerce, and became a fostered village of Universitas Islam Nusantara. The conclusion of this program has contributed to the livelihood of the community by providing them with new income opportunities. Increased added value of printed palm sugar products into ant sugar. After participating in this program, the craftsmen can technically know the process of making ant sugar and digital marketing, but assistance is still needed to escort them to the production scale and legality. Therefore, the prospect of long-term cooperation output is in the form of an Islamic Nusantara University Assisted Village.

Abstract

In medical procedures, doctors are required to obtain informed consent. However, in emergency situations, doctors are often faced with patients who are incompetent and the family is not present to ask for consent. This can lead to lawsuits. This study aims to analyze the implementation of informed consent in Indonesia based on Law No. 17 of 2023 and to determine the obstacles and solutions to these problems. The method used is a normative legal approach, namely a literature study as the main source of research with primary legal materials. The results of the analysis show that a doctor does not need to obtain informed consent in emergency cases as stated in Law No. 17 of 2023 concerning Health Article 293 paragraph (9) and the guarantee of legal protection for doctors from claims for compensation after providing first aid with the aim of saving lives and preventing disability as in Article 275 paragraphs (1) and (2). A doctor should not hesitate to give his best efforts in saving or preventing patient disability without prior consent for medical procedures. Because the doctor only provides an agreement of efforts (Inspaningverbintenis) and is exempt from claims for compensation if the doctor is in the process of helping the patient in an emergency case.

Abstract

Desa Girimulya adalah daerah penghasil kopi, sehingga setiap tahun memproduksi kopi dan mengakibatkan penumpukan limbah kopi. Limbah kopi di Desa Girimulya belum bisa dimanfaatkan secara optimal. Limbah tersebut menjadi tumpukan sampah di beberapa tempat, serta menimbulkan masalah serius di sekitar lingkungan Desa Girimulya. Salah satu aternatif untuk mengelola limbah kopi adalah dengan mengolahnya menjadi kompos. Pengabdian masyarakat untuk limbah kopi dilakukan dengan cara sosialisasi melalui pendekatan diskusi lesehan. Tujuannya adalah untuk meningkatkan pengetahuan dan keterampilan masyarakat dalam memanfaatkan limbah kopi. Pemberian materi disampaikan oleh narasumber/ahli di Bidang Pertanian bersama Tim PKM dan dilanjutkan dengan diskusi langsung pembuatan pupuk kompos dari limbah kopi. Kegiatan ini diikuti oleh masyarakat sekitar dan para pemilik pabrik kopi di Dusun 2 Desa Girimulya Kecamatan Pacet. Hasil yang diperoleh dari pengabdian masyarakat ini adalah masyarakat mampu memahami proses pembuatan limbah kopi menjadi kompos dibuktikan dengan cara mengikuti tahap-tahapan pembuatan kompos.
