Abstract

Mosque has a pivotal role in the process of Da’wah for Muslim, including  al-Barokah Mosqu, Guranteng, Tasikmalaya. This transformative research aims at transforming people's perception in understanding the substance of the role and function of mosques and optimizing the potential of the mosque to its fullest. This Participatory Action Research model links the social change process through three-area of empowerment : Community commitment, local leader, and institutional based needs. The results of the study gained action of change: Seeking the transformation of community paradigms on understanding the substance role of the mosque through several actions: FGD for restructuring DKM Management, strengthening DKM and DKM management training. Meanwhile, the second stage is to optimize the potential of the culture by implementing the mosque empowerment based on local culture, such as the training of Friday's cermon, corpes-handling management, Ziswaf Manager, reading Marhabaan, forming youth-mosque-managers, as well as assistance by other potential-based empowerment activities. Secara substansi masjid mempunyai peran sentral yang sangat penting terhadap laju perjalanan dakwah umat Islam. Peran sentral masjid kenyataannya tidak berbanding lurus dengan keberadaan masjid al-Barokah daerah ujung utara Kabupaten Tasikmalaya. Penelitian transformatif ini bertujuan untuk mentransformasi persepsi masyarakat dalam memahami substansi peran dan fungsi masjid dan mengoptimalisasikan potensi masjid secara maksimal. Penelitian ini menggunakan model participatory action research yang menghubungkan proses perubahan sosial melalui tiga pemberdayaan: komitmen masyarakat, local leader, dan institusi berdasarkan kebutuhan. Dari hasil penelitian diperoleh aksi perubahan:  mengupayakan transformasi paradigma masyarakat terhadap pemahaman substansi peranan fungsi masjid yang diupayakan melalui beberapa action: refleksi FGD merestrukturisasi pengurus DKM, pengukuhan pengurus DKM; dan pelatihan manajemen DKM.Sementara tahap kedua melakukan langkah optimalisasi terhadap potensi yang dimiliki dengan menerapkan pemberdayaan masjid berbasis lokalitas budaya, seperti pelatihan khutbah Jum’at, pengurusan jenazah, pengelola Ziswaf, membaca marhabaan, pembentukan pengurus remaja/pemuda masjid, serta dampingan kegiatan pemberdayaan lainnya berbasis potensi.

Abstract

Lately contradictory attitude toward a variety of social maturity often practiced in religious life, state and nation. Characterized by increasing the ideology of intolerance, claims of truth, apathy, radicalism, terrorism, and violence, racial background which would almost the stability of national unity of Indonesian. Efforts to push the level of socio-religious intolerance becomes the collective responsibility, one through the strengthening of research-based schools of religious moderation both theoretical and practical.The significance of this study is to track messages of religious moderation contained in the manuscript Tanbih TQN Boarding School Suryalaya Tasikmalaya. Type a descriptive qualitative research methodology to approach the content analysis study (content analysis) to the data source.The research found that the manuscript is a testament mursyid Tanbih Sheikh Abdullah Mubarak bin Nur Muhammad (Abah Sepuh) to all the brothers TQN Suryalaya. To obtain the inner and outer happiness and safety of life hereafter in accordance with the purpose bertarekat, then the text Tanbih true not only seen as sakralitas to be read and heard in every activity TQN Boarding School Suryalaya brothers, but also must be realized in the social life. Because the script Tanbih containing messages of religious moderation in the life of the nation which includes: (1) harmonization of the relationship between religion and state; (2) an attitude of respect and appreciate people who are older (seniority); (3) mutual compassion in the form of mentoring, guiding, and advising the kindness to younger (junioritas); (4) humility to an equal; (5) always put the collective interest above the interests of individual / group; (6) the attitude of generous, virtuous, and warm-hearted towards the poor; and (7) maintain the environment so maintained continuity.

Abstract

Divorce is one of the provisions contained inside constitution number 7 years 1989 article 65 about religious justice and compilation of islamic law article 115 and constitution number 1 years 1974 about marriage article 39 explain that divorce only can be done in front of the trial religious court after religious court trying and not succeeding reconcile the two sides. The main purpose divorce to be affairs authority religious court (see article 49) is to give discipline de jure for people who are Muslim in handling family matters. So that with various presence which mandates divorce done in front of the trial give taste satisfaction and comfort for seekers justice in search justice on environment of the religious court. Theory in writing this is used as basic analysis write in reviewing normatively and scientific  that is legal purpose theory, legal development, law enforcement and law enforcement in Indonesia. Normatively study write used legal basis which applies in the environment religious court in Indonesia. Between : 1) constitution number 1 years 1974 about is marriage. Constitusion number 7 years 1989. Constitution number 3 years 2006 Jo constitution number 50 years 2009 about is religious court, compilation of islamic law, and PP number 9 years 1975 about is implementation constitution number 1 years 1974 with the purpose of creating justice, benefit, discipline and peace of the community, and benefit for people who seek justice in the environment religious court in Indonesia. AbstrakPerceraian merupakan salah satu ketentuan yang terdapat di dalam Undang-undang No 7 Tahun 1989 Pasal 65 tentang Peradilan Agama dan Kompilasi Hukum Islam (KHI) Pasal 115 dan UU No. 1 Tahun 1974 tentang Perkawinan Pasal 39 menjelaskan bahwasannya perceraian hanya dapat dilakukan di depan sidang Pengadilan Agama setelah Pengadilan Agama  berusaha dan tidak berhasil mendamaikan kedua belah pihak. Tujuan utama perceraian menjadi urusan wewenang pengadilan agama (lihat Ps. 49) adalah untuk memberikan ketertiban secara hukum bagi orang-orang yang beragama Islam dalam menangani persoalan keluarga. Sehingga dengan hadirnya berbagai ketentuan yang mengamanatkan perceraian di lakukan di depan sidang pengadilan memberikan rasa kepuasan dan kenyamanan bagi para pencari keadilan dalam mencari keadilan di lingkungan badan peradilan agama. Teori dalam penulisan ini yang digunakan sebagai dasar analisis penulis dalam mengkaji secara normative dan ilmiah yaitu teori tujuan hukum, pembangunan hukum, penegkan hukum dan pemberlakuan hukum di Indonesia. Kajian secara normatif penulis menggunakan dasar hukum yang berlaku di lingkungan lembaga pengadilan agama di Indonesia. Diantaranya : 1) UU No. 1 Tahun 1974 tentang Perkawinan. UU No. 7 Tahun 1989 Jo UU No. 3 Tahun 2006 Jo UU No. 50 Tahun 2009 tentang Peradilan Agama, Kompilasi Hukum Islam (KHI), dan PP No. 9 Tahun 1975 tentang Pelaksanaan UU No. 1 Tahun 1974 dengan tujuan untuk menciptakan keadilan, kemanfaatan, ketertiban dan ketentraman masyarakat, dan kemaslahatan bagi orang-orang yang mencari keadilan di lingkungan badan peradilan agama di Indonesia.

Abstract

This paper discusses the role of women as witnesses in a court. This is one of debatable issues in Islamic law considering the provision stating that the value of two women’s testimony is equal to one man’s testimony. Based on a more comprehensive discussion and by revisiting the Islamic resources on this issue, this paper concludes that the provision in the hadith, historically, regards heavily on women’s capability and readiness to perform their duties as witnesses. It can be seen in the case of qadzaf where women can be witnesses for themselves (by stating four oaths in the name of Allah). Therefore, in the current development, women’s role as witnesses needs to be reconsidered so that women can appear in the judiciary to play a role in supporting justice. Penelitian literatur  (library research) ini bertujuan untuk menganalisa bagaimana pandangan kesaksian perempuan dalam Islam melalui pendekatan analitik terhadap ketentuan dalam fikih keadilan yang ditinjau melalui berbagai  berbagai corak diskusi dan referensi yang mendukung penelitian ini. Kesaksian merupakan proses menemukan dan membuktikan kebenaran dalam  perkara  perdata maupun  pidana. Dalam  hukum Islam, hal-hal yang membutuhkan kesaksian seperti itu adalah pernikahan dan perceraian yang menyangkut hudud dan qisha. Ada beberapa kriteria khusus dalam memberikan kesaksian. Dalam masalah-masalah spesifik, perempuan  tidak diizinkan memberikan kesaksian, diantaranya ialah wilayah hudud dan qisha. Ketentuan lainnya ialah  perempuan dapat  menjadi saksi di pengadilan, tetapi hanya dalam kasus perdata (transaksi keuangan), dan itupun bobot dua wanita sama dengan satu pria. Apabila  merujuk pada makna teks, maka jelas siapa pun dia (wanita) dan kualifikasinya tidak diperbolehkan untuk melayani sebagai saksi dalam kasus pidana. Meskipun secara historis,  terbukti banyak wanita cerdas, memiliki kedewasaan emosional, kredibilitas, dan berbagai kemampuan yang memenuhi syarat untuk tampil sebagai saksi dalam kasus-kasus, baik sipil maupun pidana. Masalah kesaksian seorang perempuan tersebut dinilai oleh sebagian orang sebagai salah satu perbedaan yang mensubordinasi perempuan.

Abstract

This article seeks to reveal the religious experiences of the members of the Tarekat Qadiriyah wa Naqsyabandiyah (TQN) in Suryalaya, Tasikmalaya, West Java. Using a phenomenological approach, this article finds that TQN followers exhibit religious awareness and obedience to legal norms, reflected in various ritual practices, such as dhikr (remembrance), khataman (completing the reading of the Qur’ān), manakiban (reciting the saint’s hagiography), riyāḍah (spiritual exercises), tawassul (mediating), and ḥajj (pilgrimage). The religious awareness is built upon the belief in achieving good morality as the attribute of a perfect man (insān kāmil). The socio-structural diversity of the TQN community in social life is manifested in the complexity of hierarchies involved in the tarekat system: murshid (spiritual leader); representatives of talqīn which include intellectuals/modernist, ulama/ traditionalist, scholar/neo-traditionalist; preachers from the realms of pesantren, university, and politics. This article argues that the relationship between different hierarchies of membership in the TQN with regard to religious awareness is based on the understanding of the tarekat teaching provided by the spiritual leader.

Abstract

Ulama sepakat bahwa seorang saksi harus beragama Islam. Syarat yang sama, khususnya pada akad nikah, juga diadopsi peraturan perundangan Indonesia. Tetapi, dalam kenyataannya, tak jarang seorang yang non-muslim jadi saksi pada perkawinan muslim dengan muslim, baik pada akad nikah, rujuk dan terutama sekali dalam penyelesaian perkara perceraian di Pengadilan. Hal itulah yang jadi masalah penelitian ini; bagaimana status non-muslim sebagai saksi dalam perkawinan menurut hukum Islam.Tujuan penelitian ini adalah untuk mengetahui kedudukan saksi non-muslim dalam perkawinan menurut hukum Islam. Untuk mencapai tujuan itu dipakai metode kualitatif dengan pendekatan studi kepustakaan (library riset). Sumber penelitian terdiri atas bahan-bahan hukum primer dan bahan-bahan hukum sekunder. Bahan sumber primer berupa kitab-kitab fikih dari empat mazhab Ahli Sunnah. Sementara bahan-bahan hukum penelitian ini adalah buku teks yang berisi prinsip-prinsip dasar ilmu hukum dan pandangan-pandangan sarjana dan ahli hukum Islam. Anlisa terhadap temuan penelitian dilakukan dengan mengggunakan metode berfikir deduktif dan induktif.Dari bahasan yang dilakukan dapat disimpulkan: berdasarkan surat al-Nisa' (4) ayat 141 dan sabda Nabi Saw bahwa “Tidak dibolehkan kesaksian pemeluk satu agama terhadap pemeluk agama lain, kecuali umat Islam”, maka hukum Islam tidak memandang sah akad nikah, talak dan rujuk dengan saksi non-muslim. Abstract

AbstrakPerkawinan merupakan ikatan suci antara laki-laki dan perempuan untuk membangun keluarga bahagia, harmonis, sejahtera, unggul, dan berkualitas yang turut berkontribusi dalam mewujudkan program pembangunan keluarga nasional seutuhnya. Namun temuan empirik menunjukan, masih terdapat institusi keluarga yang belum mengoptimalkan tujuan perkawinan. Hal itu disebabkan oleh faktor ketidaksiapan usia perkawinan baik dari aspek fisik, psikis, maupun spiritual. Penelitian ini menerapkan metode pengambilan hukum istihsan terhadap tradisi perkawinan usia dini yang langsung mengalami kehamilan. Jenis Penelitian ini termasuk yuridis kualitatif. Teknik pengumpulan data dilakukan melalui studi kepustakaan dan eksplorasi data primer-sekunder yang kemudian dianalisa. Para ulama berbeda pendapat mengenai hukum menunda kehamilan: mubah, mubah muqayad, makruh, dan haram. Secara normatif praktik menunda kehamilan masih belum sampai pada tahapan hukum yang mewajibkan. Dengan mengkaji data temuan, ternyata praktik kehamilan perkawinan usia dini berimplikasi negatif (madharat) baik bagi dirinya, keluarga, masyarakat, bahkan bangsa. Kehamilan tersebut dapat menghambat pembangunan keluarga berkualitas. Atas dasar analisa metode istihsan dengan mempertimbangkan prinsip al-mashlahatu al-khas dan al-mashlahatu al-am dan kaidah daf’ul mafaasid muqadamu ala jalbi al-mashaali, maka hukum menunda kehamilan pada perkawinan usia dini adalah wajib. Kata Kunci: Analisa, Hukum, Perkawinan, Istihsan, dan Keluarga. Abstract Marriage is holy bond between boy and girl to build a happy family, harmonious, prosperous, superior, and quality who participated contribute in realize the program full national family development. However findings a empirical shows, still there is a family institution which has not optimized the purpose of marriage. This is caused by factors unpreparedness of marriage age both from physical aspects, psychic, and spiritual. This research applies retrieval method istishan law towards early marriage traditions who immediately experience pregnancy. This type of research includes juridical qualitative. Data collection technique conducted through literature studies and secondary primary data exploration which is then analyzed. The theologian has a different opinion regarding the law of delay pregnancy: mubah, mubah muqayad, makruh, and forbidden. Normatively practice delaying pregnancy still not arrived at the stage obligatory law. By reviewing findings data, evidently practice of pregnancy marriage early age have negative implication (madharat) good for him, family, society, even the nation. The pregnancy can inhibit quality family development. On the basis of istishan method analysis taking into account the principle al-mashlahatu al-khas and almashlahatu al-am and kaidah daf’ul mafaasid muqadamu ala jalbi al-mashaali, then the law delays pregnancy in early marriage is mandatory.Keywords : Analysis, Law, Marriage, Istishan, and Family

Constitution number 3 years 2006 Jo constitution number 50 years 2009 about is religious court, compilation of islamic law, and PP number 9 years 1975 about is implementation constitution number 1 years 1974 with the purpose of creating justice, benefit, discipline and peace of the community, and benefit for people who seek justice in the environment religious court in Indonesia. AbstrakPerceraian merupakan salah satu ketentuan yang terdapat di dalam Undang-undang No 7 Tahun 1989 Pasal 65 tentang Peradilan Agama dan Kompilasi Hukum Islam (KHI) Pasal 115 dan UU No. 1 Tahun 1974 tentang Perkawinan Pasal 39 menjelaskan bahwasannya perceraian hanya dapat dilakukan di depan sidang Pengadilan Agama setelah Pengadilan Agama  berusaha dan tidak berhasil mendamaikan kedua belah pihak. Tujuan utama perceraian menjadi urusan wewenang pengadilan agama (lihat Ps. 49) adalah untuk memberikan ketertiban secara hukum bagi orang-orang yang beragama Islam dalam menangani persoalan keluarga. Sehingga dengan hadirnya berbagai ketentuan yang mengamanatkan perceraian di lakukan di depan sidang pengadilan memberikan rasa kepuasan dan kenyamanan bagi para pencari keadilan dalam mencari keadilan di lingkungan badan peradilan agama. Teori dalam penulisan ini yang digunakan sebagai dasar analisis penulis dalam mengkaji secara normative dan ilmiah yaitu teori tujuan hukum, pembangunan hukum, penegkan hukum dan pemberlakuan hukum di Indonesia. Kajian secara normatif penulis menggunakan dasar hukum yang berlaku di lingkungan lembaga pengadilan agama di Indonesia. Diantaranya : 1) UU No. 1 Tahun 1974 tentang Perkawinan. UU No. 7 Tahun 1989 Jo UU No. 3 Tahun 2006 Jo UU No. 50 Tahun 2009 tentang Peradilan Agama, Kompilasi Hukum Islam (KHI), dan PP No. 9 Tahun 1975 tentang Pelaksanaan UU No. 1 Tahun 1974 dengan tujuan untuk menciptakan keadilan, kemanfaatan, ketertiban dan ketentraman masyarakat, dan kemaslahatan bagi orang-orang yang mencari keadilan di lingkungan badan peradilan agama di Indonesia.
