Abstract

The series of land registration activities requires expenditures in the form of tariffs charged at each stage. The principle that we can associate with the provisions of Article 9 paragraph (4) of the UUPA is an affordable principle, in the government regulation, the costs related to land registration are regulated, provided that the people who are not able to be released are paid for the fees. we can also find it in Government Regulation Number 128 of 2015 concerning Types and Rates of Types of Non-Tax State Revenues that Apply to the Ministry of Agrarian and Spatial Planning / National Land Agency. How is the affordable principle of land registration with the land registration service in the form of the first land registration service for certain parties? This study uses a normative juridical approach. Affordable principles in land registration can be seen in Government Regulation No. 128 of 2015, Article 22 and Article 24, which will certainly ease the burden on certain designated parties, so that they can reach those who need, especially the poor. Keywords: Affordable Principle, Land Registration, First Time, Parties Abstrak Rangkaian kegiatan pendaftaran tanah memerlukan pengeluaran berupa tarif yang dikenakan pada masing-masing tahapannya. Asas yang dapat kita kaitkan dengan ketentuan Pasal 9 ayat (4) UUPA adalah asas terjangkau,dalam peraturan pemerintah diatur biaya-biaya yang bersangkutan dengan pendaftaran tanah, dengan ketentuan bahwa rakyat yang tidak mampu dibebaskan dari pembayaran biaya-biaya tersebut.Peraturan pemerintah yang dimaksud pun dapat kita jumpai pada Peraturan Pemerintah Nomor 128 Tahun 2015 tentang Jenis dan Tarif Atas Jenis Penerimaan Negara Bukan Pajak Yang Berlaku Pada Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional. Bagaimana keterkaitan asas terjangkau dari pendaftaran tanah dengan pelayanan pendaftaran tanah berupa pelayanan pendaftaran tanah untuk pertama kali terhadap pihak tertentu. Penelitian ini menggunakan pendekatan yuridis normatif. Asas terjangkau dalam pendaftaran tanah dapat dilihat penerapannya dalam Peraturan Pemerintah Nomor  128  Tahun  2015, Pasal 22 dan Pasal 24, tentu akan meringankan beban bagi pihak tertentu yang ditunjuk tersebut, sehingga dapat menjangkau pihak-pihak yang memerlukan, khususnya masyarakat tidak mampu. Kata Kunci: Asas Terjangkau, Pendaftaran Tanah, Pertama kali, Pihak Tertentu

Abstract

Pendaftaran tanah merupakan kegiatan administrasi di bidang pertanahan yang bertujuan untuk menjamin kepastian hukum. Namun dalam pelaksanaannya, terdapat permasalahan tumpang tindih alat bukti kepemilikan hak atas tanah, ketimpangan dalam kepemilikan tanah. Tulisan ini membahas bagaimana hambatan dalam penyelenggaraan tertib administrasi pertanahan melalui kegiatan pendaftaran tanah yang berkeadilan. Metode Penelitian yang digunakan yakni yuridis normatif dengan Analisa kualitatif. Hasil penelitian menunjukkan bahwa terdapat hambatan internal dalam penyelenggaraan tertib administrasi pertanahan melalui kegiatan pendaftaran tanah yang berkeadilan berupa sumber daya manusia yang terbatas, beban kerja dari pegawai di kantor pertanahan yang tidak sedikit, serta dalam pelaksanaannya harus melihat kondisi sosial masyarakat daerah yang mempunyai karakteristik berbeda yang mendasarkan pada kearifan lokal. Hambatan eksternal masih kurang optimalnya partisipasi masyarakat, adanya masyarakat yang masih enggan untuk mengikuti kegiatan pendaftaran tanah.

The granting of credit guarantees should be done directly by the grantor of the mortgage, for something because it can not be present itself, it must appoint the other party as its proxy, with SKMHT in the form of an authentic deed. Abstract

The establishment of Ibu Kota Nusantara (IKN), Indonesia’s future capital, introduces both challenges and opportunities for sustainable environmental management. Effective spatial planning is essential to balance developmental needs with ecological conservation. This study examines how spatial planning principles can be integrated within IKN’s environmental management framework, addressing key legal issues related to infrastructure development, environmental preservation, and the social and economic impacts of spatial policies. Through a normative legal research methodology, incorporating statutory and conceptual approaches, this paper assesses relevant laws, regulations, and environmental planning practices applicable to IKN. The findings highlight the importance of comprehensive spatial planning, robust legal enforcement, and continuous monitoring for long-term sustainability. The study argues that embedding spatial planning in policy-making is critical to mitigating environmental impacts, strengthening community resilience, and supporting sustainable development goals for Nusantara Capital City.

Abstract

Satu diantara program agrarian reform Indonesia yaitu landreform, obyeknya ada kaitannya dengan bagi hasil tanah pertanian. Penelitian ini bertujuan mengetahui bagaimana implementasi perjanjian bagi hasil tanah pertanian (bawang merah) di wilayah Brebes demi terwujudnya reforma agraria. Pendekatan yang digunakan yuridis empiris. UU Nomor 2 Tahun 1960 memberikan perlindungan pihak lemah, taraf hidup petani penggarap meningkat, sehingga mewujudkan reforma agraria. Ada kaitan antara pelaksanaan perjanjian bagi hasil dengan UU bagi hasil tersebut dengan terwujudnya reforma agraria. Kata kunci: UU Nomor 2 Tahun 1960, Bagi hasil tanah pertanian, reforma agraria

Abstract

This study is motivated by conflicts of authority in the management of natural resources, particularly Tanah Ulayat of indigenous communities, which are often inadequately protected in the course of development and resource exploitation, including illegal mining. The primary objective of this research is to examine the position and authority of the state in managing Tanah Ulayat, to identify the legal implications of illegal mining practices on Tanah Ulayat, and to formulate a legal framework that is both just and constitutional. The study employs a normative juridical method combined with a constitutional approach and an indigenous peoples’ rights perspective. The findings reveal a legal vacuum in the protection of Tanah Ulayat, particularly when mining activities are carried out with customary approval but without state authorization. In conclusion, there is an urgent need for a legal framework that is responsive, participatory, and grounded in the principles of simultaneous development and the recognition of communal rights.

Abstract

PPAIW has the main task of providing waqf administration and serving the needs of prospective wakif who will donate their assets by following per under the provisions of the legislation. The purpose of the PPAIW is so that the community gets authentic evidence that waqf has occurred. The existence of PPAIW makes waqf law change from a law that lives in the community to a written law that must be recorded by the state. However, that reality shows that PPAIW's performance in enforcing waqf law has not met the standards. The purpose of this study is to analyze the performance of PPAIW in enforcing the waqf law and formulate efforts that can be made in enforcing the waqf law. This research uses the empirical juridical method with qualitative analysis. PPAIW's performance in enforcing waqf law in Indonesia has not been by following per under good work indicators, because there are several legal problems in carrying out their obligations, so their performance is not up to standard. Efforts must be made to enforce waqf law, namely; increase PPAIW resources; realize a corruption-free government, and KKN; provide good service (good governance); guard nadzir in the land registration process; provide a decree for the appointment of nadzir; empowering nadzir and the community; mastering dispute resolution mechanisms and advocating for the community; comfortable office atmosphere and support PPAIW performance.

Abstract

Transnational bankruptcy resolution is still a legal problem in ASEAN. This problem arises because there is no harmonization of legal regulations regarding transnational bankruptcy in ASEAN. Several countries in ASEAN are taking other ways to overcome this problem. This is done by entering into bilateral agreements or by adopting the UNCITRAL Model Law. Indonesia still does not strictly regulate transnational bankruptcy. Looking at the problems above, in this journal a comparison will be made regarding the resolution of transnational bankruptcy in Singapore, Malaysia and Indonesia as well as the application of international law in Indonesia in resolving transnational bankruptcy. This research was prepared with the aim of knowing and analyzing the legal regulations regarding transnational bankruptcy in ASEAN as well as identifying and analyzing the roots of obstacles to transnational bankruptcy in Indonesia. normative and comparative juridical approach methods, namely research that is focused on reviewing and comparing library materials or secondary data such as statutory regulations, international regulations, legal works using analytical descriptive research specifications and studied using qualitative data analysis methods. Based on the results of research and discussions carried out by analyzing decision Number 138/Pdt.Sus-PKPU/2016/PN.Niaga.Jkt.Pst, it was found that Indonesia has not regulated the mechanism for resolving transnational bankruptcy, so it is necessary to apply international law in resolving it by resorting to petition efforts. recognition and implementation of the bankruptcy decision in the country concerned.
