Abstract

A notarial deed must be signed by the parties involved. In some cases, the parties involved cannot put their signatures. The purpose of this study was to find out whether thumbprints can replace signatures in making notarial deeds and their legal consequences. This study uses normative legal research with secondary data and library research. The results of this study according to Article 1874 of the Civil Code and Article 44 paragraphs (1) and (2) of the UUJN regulates the affixing of a thumbprint as a substitute for a signature in making notarial deeds to people who are sick or disabled to read and write. These articles state that affixing a thumbprint as a substitute for a signature can be done on condition that the affixing must be done before an authorized official (Notary) and the Notary is required to include information or reasons regarding the person not being able to sign. The legal consequences of a deed not being signed are replaced by using a thumbprint, which is still valid and legally binding as an authentic deed as long as the provisions contained in Article 1874 of the Civil Code and Article 44 paragraphs (1) and (2) UUJN are fulfilled.

Abstract

AbstractCircular decision-making has been stated in Article 91 of the Limited Liability Company Law with a statement that the party holding shares can make binding decisions outside the General Meeting of Shareholders. The decision is made by sending documents containing ideas to be determined by all shareholders and these ideas and obtaining approval from all shareholders, so that a binding decision is made. The purpose of this article is to find out the mechanism of the circular decision and the responsibility of the notary to the deed of circular decision statement. The research model is used, namely normative juridical, so that the result is a circular decision by sending a written proposal so that it is determined by all parties holding shares, then the proposal is to obtain written approval from all parties holding shares. In making a circular decision deed, the notary is not responsible for material truth because the notary makes the deed based on the formal correctness of the Circular Resolution submitted to him.Keywords: Circular Resolution; Notary; RUPS. AbstrakPengambilan putusan sirkuler telah tertuang dalam Pasal 91 Undang-Undang No. 40 Tahun 2007 tentang Perseroan dengan pernyataan bahwa pihak yang memegang saham dapat menetapan keputusan yang mengikat di luar Rapat Umum Pemegang Saham. Pengambilan keputusan tersebut melalui pengiriman dokumen yang berisikan gagasan yang hendak ditetapkan oleh seluruh pemegang saham dan gagasan tersebut dan mendapatkan persetujuan dari keseluruhan pemegang saham, sehingga memiliki keputusan mengikat. Penelitian ini bertujuan untuk mengetahui mekanisme dari keputusan sirkuler dan tanggung jawab notaris terhadap akta pernyataan keputusan sirkuler. Dipergunakan model penelitian yakni yuridis normatif sehingga diperoleh hasil bahwa keputusan sirkuler dengan mengirim usul tertulis sehingga ditetapkan oleh keseluruhan pihak yang memegang saham, kemudian usualan tersebut agar mendapatkan persetujuan tertulis oleh keseluruhan pihak yang memegang saham. Dalam pembuatan akta keputusan sirkuler notaris tidak bertanggung jawab atas kebenaran materiil karena notaris membuat akta tersebut berdasarkan kebenaran formil dari Circular Resolution yang diserahkan kepadanya. Abstract

Legal problems in the implementation of land waqf in the community are found in;  wakif, status of waqf land, nadzir, wakif heirs, nadzir heirs, and land waqf institutions. Therefore, it is very important to conduct a research on A Comparative Study on the Implementation of Land Waqf Law in Indonesia and Malaysia as a Stage to Land Waqf Law Reform in Indonesia to analyze land waqf practices in Indonesia and Malaysia, then to compare and identify their similarities and differences. This research can provide ideas for the government in updating the land waqf law. This study used a comparative approach.  The research data include primary and secondary data. The data were analyzed qualitatively. The results showed that there are some similarities of land waqf practices in Indonesia and Malaysia. These similarities are found in terms of ; its legal basis; forms of wakif and nadzir; as well as the position of the land waqf witness. Meanwhile, the difference lies in; land waqf management practices; government policy on waqf institutions; allotment, term, and settlement of land waqf disputes. By comparing Malaysian and Indonesia land waqf law practices, Indonesia can renew the land waqf law on the aspects of its legal rules and legal institutions.

Abstract

ABSTRACTAccurate land registration is essential to prevent ownership conflicts and to provide legal guarantees for the rightful land owner. The aim of this research is to find out the factors that cause land registration errors that are not in accordance with the location of land administration and efforts to resolve them. The research method uses empirical juridical. The results of the research concluded that with errors in measurements and land area, the certificate owner could face legal consequences such as cancellation of the certificate. The process of resolving land registration issues involves coordination meetings between the Village, District, Regency Government and Land Office, with facilitation from the Provincial government.Keywords: Registration Errors; Certificates; Legal ImpactABSTRAKRegistrasi tanah yang akurat sangat penting untuk mencegah konflik kepemilikan dan untuk memberikan jaminan hukum terhadap pemilik tanah yang sah. Tujuan penelitian ini untuk mengetahui faktor-faktor penyebab terjadinya kesalahan registrasi tanah yang tidak sesuai dengan letak administrasi tanah dan upaya penyelesaiannya. Metode penelitian dengan menggunakan yuridis empiris. Hasil penelitian disimpulkan bahwa kesalahan pengukuran dan luas tanah, pemilik sertifikat dapat menghadapi konsekuensi hukum seperti pembatalan sertifikat. Abstract

AbstractNotary must attach fingerprints on the Minutes of Deed. But until now, no one has issued a rule regarding the attachment of fingerprints on the Minutes of Deeds. The legal study in this case aims to determine the urgency placing the fingerprints of person who appears Notary on the Minutes of Deed, and to determine the legal force of the Minutes of Deed in the case of fingerprints not attached. This legal study uses normative juridical methodology. The research findings indicate that there is much thought about whether fingerprints should be listed on a separate sheet or on the Minutes of Deeds. The legal strength the Minutes of Deed as a valid deed is not affected by the absence of the fingerprints of the appearer.Keywords: notary public; fingerprints; minutes of deed AbstrakNotaris wajib melekatkan sidik jari penghadapnya pada Minuta Akta. Namun hingga sekarang, tidak ada yang mengeluarkan aturan terkait pelekatan sidik jari pada Minuta Akta. Studi hukum ini bertujuan untuk mengetahui urgensi pelekatan sidik jari dari orang yang menghadap ke Notaris pada Minuta Akta, serta untuk menentukan kekuatan hukum dari Minuta Akta dalam hal sidik jari penghadap tidak dilekatkan. Studi hukum ini menerapkan metodologi yuridis normatif. Temuan penelitian menunjukkan bahwa terdapat banyak pemikiran tentang apakah sidik jari harus dicantumkan pada lembaran tersendiri atau pada Minuta Akta. Abstract

ABSTRACT Legal protection for the profession of Land Deed Official (PPAT) is crucial to ensure integrity and sustainability in property transactions, encompassing legal certainty and rights protection. This study aims to analyze and elucidate the legal process of land deed creation and the implications of the urgency of deed legitimacy made by land deed officials based on applicable law. The research method employed is normative. The findings reveal that the process of land deed creation by PPATs must adhere to strict legal regulations, including the obligation to create authentic deeds confirming the transfer of land and buildings according to Law Number 2 of 2014, maintaining ethical standards and professionalism, and complying with applicable legal requirements and procedures to provide legal certainty in property transactions.Keywords: Legitimacy; Authentic Deed; PPATABSTRAKPerlindungan hukum terhadap profesi Pejabat Pembuat Akta Tanah (PPAT) penting untuk memastikan integritas dan keberlanjutan dalam transaksi properti, yang meliputi kepastian hukum, perlindungan hak. Abstract

ABSTRACTThe lack of knowledge and understanding of transmigration community members regarding the procedures for land transaction according to positive law is a contributing factor to the large number of illegal land transactions. The aim of this research is to determine the legal consequences of rights  transaction to transmigration land and forms of legal protection for buyers of property rights to land at transmigration locations obtained through private transactions. The method used in this research is empirical juridical. The results of this research are that there is no legal certainty regarding the subject and object of land rights that have been purchased and the form of legal protection applied by registering with the Court to obtain a decision that has permanent legal force.Keywords: Protection; Transactions; Land; TransmigrationABSTRAKKurangnya pengetahuan serta pemahaman warga masyarakat transmigrasi mengenai tata cara transaksi jual beli tanah menurut hukum positif menjadi faktor pendukung banyaknya terjadi jual beli tanah di bawah tangan. Abstract

This research investigates the legal implications and challenges of adapting ijab kabul (Islamic marriage contract) to the digital era in Indonesia. The rise of telecommunications technologies—especially video calls—has enabled remote marriages during the COVID-19 pandemic and in geographically separated contexts. While digital ijab kabul offers efficiency and broader access, questions persist regarding its legal validity, potential for fraud, and regulatory ambiguity. Currently, Indonesia’s Marriage Law No. 1 of 1974 requires physical presence for marriage to be legally valid. However, the Indonesian Ulema Council (MUI) has issued a fatwa allowing digital ijab kabul under specific conditions: real-time audiovisual communication, verified identities, and a shared session (ittihad al-majlis). These criteria demonstrate partial acceptance of digital presence under Islamic law, yet lack binding legal force. Using a normative juridical approach, this study analyzes statutory law, Islamic legal doctrines, and international comparisons with countries like Malaysia, Saudi Arabia, and the UAE. These nations have developed legal frameworks for digital marriage by enforcing identity verification (biometrics, e-signatures) and procedural integrity. The study proposes that Indonesia revise Article 26 of the Compilation of Islamic Law (KHI) to explicitly recognize digital ijab kabul, harmonizing it with Law No. 11/2008 on Electronic Information and Transactions (ITE Law). By formally acknowledging digital presence within ittihad al-majlis, Indonesia can ensure greater legal certainty and protect vulnerable parties. This legal reform supports Sustainable Development Goal (SDG) 16 by promoting access to justice, enhancing legal institutions, and fostering trust in digital innovations within religious and civil legal systems.

Abstract

Hukum Islam merupakan hukum yang menjadi dasar bagi umat Islam untuk menjalankan kehidupan di dunia. Indonesia sebagai negara dengan sebagian besar penduduknya beragama Islam, secara tidak langsung menjadikan hukum Islam sebagai salah satu hukum yang diadopsi ke dalam peraturan yang bersifat normatif di Indonesia. Tidak semua ketentuan dalam Hukum Islam di terapkan di Indonesia. Penelitian ini bertujuan untuk mengetahui dasar pemikiran bahwa norma-norma hukum Islam dapat diterapkan di Indonesia. Penelitian ini merupakan penelitian yuridis normatif dengan sifat penelitian deskriptif. Hasil dari penelitian ini adalah bahwa Hukum Islam bersifat normatif di Indonesia dapat dilihat dari ketentuan dalam UUD 1945 yang menyebutkan bahwa negara berlandaskan Ketuhanan Yang Maha Esa.Kata kunci : Hukum Islam, norma, normatif

Abstract

ABSTRACT  The Islamic economy is an economic system with the legal basis used is Islamic law. The Islamic economy though uses the basis of Islamic law but this does not deter non-Muslim communities from contributing to the Islamic economic system. Basically Islamic economics has a purpose to prosper, not only to seek profits, so that many countries that do not have the majority of the Muslim community or even liberal countries participate in applying Islamic economics on various sides. Islamic economics applied in various countries which are the prima donnas are Islamic banking or in Indonesia called Sharia Banking. This study aims to find out how the development of Islamic economics in several countries in the world.
