Abstract

The rise of cases of sexual violence today makes people become restless. This research is a normative legal research, where in this study the author analyzes various laws and regulations relating to sanctions for chemical castration in the perspective of criminal law. This study also uses various comparisons of theories to answer existing problems relating to criminal law policy in the case of applying chemical castration sanctions. The results show that The increasingly widespread cases of sexual crimes against children that can have a major impact on the child's psychic development. It deserves to be given a severe punishment and appropriate to the perpetrator. The imprisonment sanction that is deemed to be irrelevant and has no deterrent effect can be answered by the punishment of the last choice of child sex offender. Thus, the enforcement of the criminal law of nuisance is reasonable in the technical context of the sentence after a permanent legal court ruling stating the punishment of the left. It aims to create a comfortable environment where children grow and develop and guarantee the future of Indonesian children.

Abstract

Penelitian ini bertujuan untuk menganalisis ratio legis putusan Mahkamah Konstitusi tentang kewenangan pembatalan peraturan daerah. Realita pembatalan peraturan daerah kini dilema setelah Mahkamah Konstitusi seutuhnya melimpahkan kewenangan pembatalan Peraturan Daerah ke Mahkamah Agung yang menyebabkan pemerintah pusat tidak lagi dapat membatalkan peraturan daerah. Hasil penelitian ini menunjukkan bahwa Mahkamah cenderung menyamakan antara Pengujian dan Pembatalan. Kenyataannya sekarang, kewenangan pemerintah pusat untuk membatalkan Peraturan Daerah sudah tidak ada lagi mekanisme pembatalannya, yang ada hanya mekanisme pengujian.

Abstract

This study analyzed the legal position of presidential decrees in granting remissions to inmates and the meaning of giving remissions to lifelong criminal inmates. This study used normative juridical research with a statutory approach, a conceptual approach, and a comparative approach—sources of data obtained from primary and secondary legal materials. The data obtained were analyzed using descriptive methods. The results of the study showed that the legal position of the presidential decree in granting remissions that changed the type of punishment for inmates did not have juridical power. Changes in the type of crime should be carried out in the form of clemency as stipulated in the 1945 Constitution of the Republic of Indonesia. The meaning of giving life imprisonment to prisoners in prison in Indonesia was different from some countries in the world, which only reduced the criminal period and did not change the type of punishment because due to remission, it was excluded from crimes that were very dangerous to the general public.

Abstract

The granting of land rights is one way for legal subjects to be able to obtain a right to land in Indonesia. This study aims to determine the legal implications of the Decree on Granting Land Rights issued by the National Land Agency without implementing Article 7 of the Republic of Indonesia Government Regulation Number 34 of 2016 concerning Income Tax. This research is empirical legal research. The results of the research show that the Decree on the Granting of Rights to Land is still valid without implying that it is null and void, while Article 7 of the Republic of Indonesia Government Regulation Number 34 of 2016 is not in line with the principles in the theory of legal certainty and is not effective in its application or enforcement.

Abstract

This study examines the regulation of private funding sources for political parties, with the goal of developing a framework that ensures political equality for donors. Adopting a normative legal research approach, the study employs statutory, conceptual, and comparative methods. Data are analyzed descriptively and prescriptively to offer a comprehensive understanding of the current regulatory gaps and to propose a ius constituendum for the regulation of private political party funding. The findings reveal two key issues. First, while Indonesia has regulations governing private funding for political parties, these regulations do not comprehensively address all private funding sources, leaving certain sources unregulated or insufficiently restricted. Second, the existing regulatory framework fails to ensure political equality among donors. Based on these findings, the study recommends several reforms for more equitable regulation. Specifically, it advocates for a regulatory framework that prioritizes political equality, with detailed classifications of private funding sources—distinguishing between internal sources, such as party taxes from members holding political positions, and external sources, such as loans from individuals or legal entities. Additionally, the study proposes establishing clear limits on donor contributions, including maximum limits for both member contributions and party taxes. These reforms aim to create a more transparent and balanced system of political financing, ensuring fairer access to the political process for all donors.

Abstract

This study aims to analyze the enforcement of sanctions against perpetrators of the destruction of tourist objects in Ke'te' Kesu' North Toraja. This research uses empirical legal research methods with a statutory approach. The results of this study indicate that the enforcement of sanctions against the perpetrators of the destruction of tourist objects in Ke'te' Kesu' North Toraja is still less effective and the case has not been followed up, despite having a Regional Regulation of North Toraja Regency Number 7 of 2016. There are several obstacles faced in the application of sanctions in law enforcement against perpetrators of destruction of tourist objects due to, among others: (1) the civil service police unit can’t apply criminal sanctions because it does not have an agreement from the Police, Prosecutor's Office, and the Court; (2) the budget is slow or even non-existent so that the civil service police unit can’t move in guarding every tourist who enters North Toraja, and (3) the lack of personnel of the civil service police unit, so that it does not reach every violation of the destruction of Ke'te Kesu' Toraja Utara tourist objects.

Abstract

Penelitian ini bertujuan mengetahui dan menjelaskan perlindungan hukum terhadap mahasiswa magang di Indonesia. Untuk mengetahui dan menjelaskan implementasi hak jaminan sosial terhadap mahasiswa magang di Universitas Hasanuddin Makassar. Penelitian ini menggunakan jenis penelitian Normatif-Empiris, menggunakan pendekatan perundang-undangan dan pendekatan sosiologi hukum. Jenis serta sumber hukum yang digunakan dalam penelitian ini yaitu Data primer dan Data sekunder. Metode pengumpulan data melalui wawancara dan dokumentasi, keseluruhan dari data dianalisis secara kualitatif dan disajikan dalam bentuk deskriptif. Hasil penelitian menunjukkan 1. Perlindungan hukum terhadap mahasiswa magang di Indonesia yaitu, perlindungan hukum preventif telah dibuktikan dengan pertanggungjawaban pemerintah terhadap pembuatan aturan terkait jaminan sosial dalam UU No. 40 Tahun 2004 dan Peraturan Menteri Ketenagakerjaan Republik Indonesia Nomor 6 Tahun 2020. Sedangkan perlindungan hukum represif dibuktikan dengan penegakan sanksi administrasi bagi perusahaan yang tidak mendaftarkan kepesertaan BPJS ketenagakerjaan pekerja diatur berdasarkan Peraturan Pemerintah Republik Indonesia Nomor 86 Tahun 2013. 2. Implementasi hak jaminan sosial terhadap mahasiswa magang Universitas Hasanuddin Makassar telah berjalan sesuai peraturan perundang-undangan dengan mendaftarkan seluruh mahasiswa magang Universitas Hasanuddin di BPJS Ketenagakerjaan dengan memberikan perlindungan Jaminan kecelakaan kerja serta jaminan kematian.

Abstract

The provision of TPP is to improve employee welfare and satisfaction with the performance benefits of ASN employees. However, in Makassar there is an exception for the provision of TPP ASN for health workers which results in discrimination for health workers. Thus, the author is interested in studying the implementation of Perwali Number 58 of 2020, the mandate of the Minister of Home Affairs Number 061-5449 of 2019 concerning the Procedure for Approval of the Minister of Home Affairs on the TPP ASN in the scope of the Regional Government. This study used an empirical approach to legislation (Statute Approach) commonly known as the juridical-normative approach. This research also used a conceptual approach which is a type of legal research that provides an analytical point of view on solving a problem from the aspect of legal concepts. The results of the analysis from this study state that the implementation of Perwali Number 69 of 2020 accommodates the provision of TPP for Health workers and is in accordance with the laws and regulations as the legal basis for implementing PP Number 12 of 2019 concerning Regional Financial Management. However, it is still limited because it is only managed in certain agencies, namely only at the Health Office, not to the UPT Hospitals and Public Health Center due to several components, namely workload and work performance not being met, the existence of medical services, and regional financial capabilities. So that there is a need for coordination and optimization of increasing effectiveness regarding the elements of the tested criteria for providing TPP.

Abstract

The principle of deliberation and consensus is the spirit of the Pancasila industrial relations system in Indonesia, which aims to create a balance between workers' rights and the sustainability of employers' businesses. This study aims to analyze the legal transformation of the deliberation and consensus mechanism in resolving industrial relations disputes, starting from the era of Law Number 22 of 1957 to Law Number 2 of 2004 (the PPHI Law). The research method used is normative or doctrinal legal research with a statutory approach and library research. The results show that in the era of Law No. 22 of 1957, the dispute resolution mechanism was authoritative, where the state through P4D/P4P dominated the final decision and placed deliberation only as an administrative formality. In contrast, after the enactment of the PPHI Law, there was a paradigm shift towards an autonomous-participatory system that requires bipartite negotiations as an absolute requirement before litigation. However, this implementation still faces challenges in the form of unequal bargaining power and issues of good faith that often trigger "forced consensus." This study concludes the need for a reconstruction of norms that allow law enforcement to test substantive good faith in the bipartite process to realize harmonious social justice for the world of work in Indonesia.
