Abstract

AbstrakTaman Nasional Taka Bonerate (TNT) adalah taman laut dengan kawasan atol terbesar ketiga di dunia setelah Kwajifein di Kepulauan Marshall dan Suvadiva di Kepulauan Maladewa. Luas total dari atol ini 220.000 hektare dengan sebaran terumbu karang mencapai 500 km². Terdapat sekitar 295 jenis ikan karang dan berbagai jenis ikan bernilai ekonomis tinggi seperti Kerapu (Epinephelus spp.), Ikan Naopoleon (Cheilinus undulatus), dan Baronang (Siganus sp). Sebanyak 244 jenis moluska di antaranya Lola (Trochus niloticus), Kerang Kepala Kambing (Cassis cornuta), Triton (Charonia tritonis), Batulaga (Turbo spp.). Penelitian ini bertujuan memberikan perlindungan hukum terhadap ekosistem terumbu karang di TNT. Metode peneltian bersifat normatif-kuantitatif. Penelitian ini menunjukan bahwa status sebagai Taman Nasional belum memberikan perlindungan hukum yang kuat terhadap Taka Bonerate. Diperlukan payung hukum yang lebih konkrit untuk melindungi ekosistem terumbu karangnya. AbstractTaka Bonerate National Park is a marine park with the region’s third largest atoll in the world after Kwajifein Suvadiva in the Marshall Islands and the Maldives Islands. The total area of the atoll is 220,000 hectares with coral reefs spreading up to 500 km². There are about 295 species of reef fish and various types of high-value fish such as grouper (Epinephelus spp.), Napoleon fish (Cheilinus undulatus), and Baronang (Siganus sp). A total of 244 species of molluscs in between Lola (Trochus niloticus), Shells Goats Head (Cassis cornuta), Triton (Charonia tritonis), Batulaga (Turbo spp.). This study aims at providing legal protection for biodiversity in the National Park Takabonerate. Other research methods are normativequantitative. This study shows that the status as a national park not provide strong legal protection against Takabonerate. Required more concrete legal basis for protecting biodiversity.

Abstract

This study aims to determine the imposition of income tax on the transfer of rights to land and/or buildings on land registration for the first time. This research was conducted using empirical legal research methods with data collection techniques through observation, interviews, and literature. In addition, this research uses the descriptive analysis method. The results of this study indicate that the imposition of income tax on the transfer of rights to land and/or buildings on land registration for the first time is not a requirement for applicants for rights related to land registration for the first time. However, the Bone Regency Land Office requires proof of payment of income tax on the transfer of rights to land and/or buildings to the applicant during the land registration application for the first time. Thus, the imposition of income tax on the transfer of rights to land and/or buildings to the applicant regarding land registration for the first time at the Bone Regency Land Office is considered contrary to Article 4 section (1) of Law No. 36 of 2008 jo. Article 4 section (1) Government Regulations No. 34 of 2016. Therefore, it is hoped that the Head of the Bone Regency Land Office will abolish the requirement for the imposition of income tax on the transfer of rights to land and/or buildings to applicants for rights related to land registration for the first time. Apart from that, eliminating these requirements also avoids the imposition of inappropriate or on target taxes to uphold aspects of justice and legal certainty (the principle of certainty).

Abstract

Penelitian ini bertujuan mendeskripsikan dan menganalisis karakteristik Independensi KPK setelah Perubahan Undang-undang KPK. UU KPK perjalanannya mengalami perubahan secara substansi peraturannya Perubahan tersebut dinilai mengancam independensi KPK Penelitian ini merupakan penelitian hukum normatif. Hasil penelitian ini menunjukkan bahwa, (1) Pasca putusan MK No. 70/PUU-XVII/2019 mengembalikan Independensi Fungsional KPK, Membatalkan kewenangan Ijin Dewas, Dewas KPK bukan bagian dari aparat penegak hukum yang memiliki fungsi penegakan hukum (Pro Justitia).(2) Independensi administratif pemberhentian pegawai KPK, Mahkamah berpandangan alih status pegawai KPK menjadi ASN sudah sesuai aturan dan ketentuan yang berlaku. Padahal alih status pegawai KPK menjadi ASN akibat dari perubahan UU KPK mestinya alih status ditunaikan dahulu sebagai ketentuan perubahan UU KPK dan semangat Putusan MK terdahulu.

Abstract

This study aims to explain the legal effectiveness of BPIP's recommendations on statutory regulations that are contrary to Pancasila values and the main factors that are internal obstacles to BPIP institutions. This type of research uses normative-empirical research. This type of research uses secondary data (from the library) and is supported by primary data based on field research, such as observations, interviews and surveys. Using a normative/juridical approach and a philosophical/ideal values approach. The results of this study are that the implementation of the duties and functions of the BPIP in providing recommendations on regulations that conflict with Pancasila values or the institutionalization of Pancasila values in a product of current legislation is not fully effective due to various influencing factors, including the weak institutionalization of Pancasila values in political institutions. , economic, and socio-cultural, and lack of consistency in making Pancasila the source of all sources of state law in the formation of statutory regulations, BPIP with its duties and functions can provide recommendations on statutory regulations that are contrary to the values of Pancasila but need to be strengthened again the form of the recommendation so that it is final and binding, bearing in mind that the recommendation policy issued by BPIP is only in the form of written input on the contents of regulations or laws that are not in line with Pancasila values.

Abstract

Local wisdom as capital for sustainable water resource conservation is becoming increasingly important in the era of Society 5.0. It is characterized by technological transformation and extensive interconnection. In this context, implementing local wisdom values in the conservation of water resources is a significant challenge. This paper discusses the challenges faced in conserving sustainable local wisdom-based water resources in the era of Society 5.0, such as cultural and technological changes. This paper also examines legal regulations in water resource conservation based on local wisdom, such as how laws regulate water use and budget arrangements for water resource conservation. The method used is a literature study of several legal materials using concept and statutory approaches, then analyzed to answer the problems studied. The results show that it is necessary to strengthen the recognition and protection of local wisdom through the preparation or revision of laws and regulations that recognize the values of local wisdom in the conservation of water resources, a collaboration between stakeholders to build citizen communication and consultation; and regulatory adjustments to support the conservation of water resources in the era of society 5.0.

Abstract

Indonesia adopts the concept of a welfare state. However, there are many challenges, such as the sustainability of the national health insurance program, equal distribution of health facilities and subsidies for people who cannot afford it, so they have not achieved expectations. The Welfare State is an ideal idea of how the state carries out its duties in order to serve all citizens towards a harmonious and prosperous life order. The Indonesian state is one of the adherents of the concept of a material legal state which actually adopts the concepts of a welfare state which can be implicitly found in the general explanation of the 1945 Constitution of the Republic of Indonesia. However, there are many challenges such as the sustainability of the national health insurance program, equal distribution of health facilities and subsidies for people who cannot afford it so that it has not achieved what was expected.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaturan hukum Ombudsman Kota Makassar pasca Putusan Mahkamah Konstitusi Nomor 62/PUU-VIII/2010. Penelitian ini menggunakan jenis penelitian hukum normatif yaitu penelitian yang mengutamakan bahan hukum berupa peraturan perundang-undangan sebagai bahan acuan dasar. Selain itu, pengumpulan data dan informasi juga dilakukan di Kantor Ombudsman Kota Makassar dan Ombudsman RI Perwakilan Sulawesi Selatan. Penulis menggunakan sumber data melalui studi pustaka dan wawancara secara langsung disusun secara sistematis dan analisis dengan pendekatan Perundang-undangan (statute approach) dan pendekatan Konseptual (conceptual approach). Hasil analisis dari penelitian ini menunjukkan bahwa: 1) Ombudsman Kota Makassar merupakan lembaga independen Pemerintah Daerah, dikarenakan legitimasi Lembaga tersebut bersumber dari keputusan Walikota, yakni Peraturan Walikota No. 2 Tahun 2019 dan menggunakan sumber keungan daerah, sehingga harus bertanggungjawab kepada Walikota. Keberadaan Ombudsman Kota Makassar tetap penting, karena kelemahan utama UU No. 37 Tahun 2008 adalah menyentralisasi kewenangan pengawasan pelayanan publik di daerah kepada Komisi Ombudsman Republik Indonesia (ORI). ORI Perwakilan Sul-Sel bukan terdiri dari Komisioner, tetapi hanya Kepala kantor yang kewenangannya terbatas. Dengan demikian, perwakilan tidak bisa menyelesaiakan laporan masyarakat. Hal ini dapat dikatakan menghilangkan kemudahan akses bagi masyarakat untuk melaporkan masalah pelayanan publik di daerah.

Abstract

Makassar City as the largest city in Eastern Indonesia is known to have a high crime rate. On the other hand, the most common and often faced community dynamics in Makassar city is community mobility that triggers crowds. So as a preventive effort, the police have the authority to issue a crowd permit to regulate community activities. This research aims to analyze the regulations and mechanisms for granting crowd permits and to identify the methods of police supervision of crowd activities in the Makassar Port Police area. The type of research used is empirical juridical research. Data collection is done through interviews and observations. The technique of analyzing research data starts from data reduction, data presentation, to verification and conclusion drawing. The results showed that: (1) Regulations in granting crowd permits are regulated in Law of the Republic of Indonesia Number 2 of 2002 concerning the Indonesian National Police and several Field Guidelines of the National Police Chief. The mechanism for granting permits includes: First, the criteria for activities are given for activities with large masses. Second, the flow of services has been listed in the task guidelines with clear steps. (2) Supervision of crowd activities is carried out through open maintenance of public security and order by the Samapta Bhayangkara (Sabhara) unit and closed by the Intelligence and Security Unit and the Criminal Investigation Unit. Meanwhile, supervision of police members is carried out through control by police administrative staff, discipline enforcement by the Profession and Security Unit, and post-activity and periodic consolidation and evaluation once a year. Thus, the authority of the Police in granting crowd permits in the Makassar Port Police area has been running well, although there are still shortcomings in terms of supervision, especially time security and police availability to accompany crowd activities until completion.

Abstract

The resilience of coastal communities in the Global South, including in Southeast Asia, in facing the impacts of climate change requires a responsive and adaptive environmental legal framework. Local wisdom serves as a strategic element in safeguarding the rights of coastal communities and enhancing their capacity to withstand environmental threats. This study examines how integrating local wisdom into environmental law can contribute to strengthening coastal climate resilience, particularly within the context of Indonesia and comparable jurisdictions in Asia. Employing normative legal research, this study adopts conceptual, legislative, and comparative approaches to highlight best practices and theoretical reflections. The findings demonstrate that policies recognizing and incorporating local knowledge into environmental law hold significant potential to support effective adaptation and mitigation efforts in coastal areas. Comparative analysis of policies across different countries in the region shows that embracing local wisdom can foster a more context-sensitive and sustainable legal framework. Accordingly, this study proposes that legal frameworks in developing countries should integrate local wisdom as an integral element of environmental law reform to strengthen the resilience of vulnerable coastal communities. The implications suggest that such integration is not only relevant for climate change adaptation but also for building more responsive, participatory, and effective environmental governance in the developing world.
