Abstract

The law explanationis interpretation of norms contained in the body of the law. However, its existence as part of the law promulgatesthe unclear status of the lawexplanation as a mere interpretation or also as a binding legal norm. This has been further emphasized by the Constitutional Court Decision whichchanges its stance in judicial review to the law explanation. Therefore, issues regarding the legal status of the law explanationand the extent to which the Constitutional Court can judicial review tothe law explanationneed to be resolved. This research is a normative juridical research through literature study with historical, statutory, case, conceptual, and legal comparison approaches to secondary data in the form ofprimary and secondary legal materials which are analyzed descriptively qualitatively.

Abstract

The rapid expansion of e-commerce in ASEAN presents significant economic potential but also poses pressing challenges in integrating Sharia principles into regulatory frameworks. Regulatory fragmentation among member states, along with limited oversight, hampers the effective enforcement of core Sharia prohibitions such as riba (usury), gharar (uncertainty), and non-transparent transactions in digital commerce. This inconsistency risks undermining consumer trust and hindering the growth of Islamic digital markets across the region. This study explores the incorporation of Sharia principles into e-commerce regulations in Indonesia, Malaysia, Brunei, and Singapore through a qualitative comparative policy analysis, document review, and expert interviews. Findings indicate that Malaysia and Brunei have developed more mature regulatory frameworks that explicitly embed Sharia norms, whereas Indonesia and Singapore encounter structural and technical barriers to similar integration. Moreover, emerging technologies such as blockchain and smart contracts show promise in enhancing transparency and facilitating Sharia compliance. This article contributes to the discourse by recommending the establishment of an ASEAN-level coordinating body to harmonize Sharia-compliant e-commerce regulations and develop adaptable guidelines for member states. Such an institutional approach is vital for fostering regulatory coherence, enhancing market confidence, and supporting the sustainable development of Islamic digital finance. Future research should focus on leveraging advanced digital technologies to operationalize Sharia compliance across ASEAN’s digital economy. Perkembangan pesat e-commerce di ASEAN menawarkan potensi ekonomi yang besar namun juga menghadirkan tantangan mendesak dalam mengintegrasikan prinsip-prinsip Syariah ke dalam kerangka regulasi. Fragmentasi regulasi antarnegara anggota, disertai dengan pengawasan yang terbatas, menghambat penegakan efektif larangan-larangan utama Syariah seperti riba (bunga), gharar (ketidakpastian), dan transaksi yang tidak transparan dalam perdagangan digital. Ketidakkonsistenan regulasi ini berisiko merusak kepercayaan konsumen dan pertumbuhan pasar digital Islam di kawasan tersebut. Penelitian ini mengkaji sejauh mana prinsip Syariah telah diintegrasikan dalam regulasi e-commerce di Indonesia, Malaysia, Brunei, dan Singapura melalui analisis kebijakan komparatif kualitatif, tinjauan dokumen, dan wawancara ahli. Hasil menunjukkan bahwa Malaysia dan Brunei telah mengembangkan kerangka regulasi yang lebih matang dengan secara eksplisit memasukkan norma-norma Syariah, sementara Indonesia dan Singapura menghadapi hambatan struktural dan teknis dalam integrasi serupa. Selain itu, teknologi baru seperti blockchain dan smart contract menunjukkan potensi besar dalam meningkatkan transparansi dan memfasilitasi kepatuhan Syariah. Artikel ini memberikan kontribusi dengan merekomendasikan pembentukan lembaga koordinasi tingkat ASEAN untuk menyelaraskan regulasi e-commerce yang sesuai Syariah serta mengeluarkan pedoman yang dapat disesuaikan bagi negara anggota. Pendekatan kelembagaan ini sangat penting untuk mendorong konsistensi regulasi, meningkatkan kepercayaan pasar, dan mendukung pengembangan berkelanjutan keuangan digital Islam. Penelitian lanjutan disarankan fokus pada pemanfaatan teknologi digital maju untuk mengoperasionalkan kepatuhan Syariah di ekonomi digital ASEAN.

Abstract

The judicial review of constitutional amendments remains underexplored in Indonesia’s legal framework despite its recognition in global constitutional discourse. Several jurisdictions, including India, Germany, and Colombia, Turkey have established judicial safeguards to prevent amendments from undermining fundamental constitutional principles. This study aims to propose a judicial review model for constitutional amendments in Indonesia to ensure the protection of constitutional identity and democratic principles. Using a comparative legal approach, this study examines international judicial practices alongside a normative analysis of Indonesia’s constitutional framework. The findings highlight three key justifications for judicial review in Indonesia: historical, philosophical-juridical, and sociological. Historically, constitutional transitions have often violated procedural norms, as seen in the 1959 Presidential Decree, which reinstated the 1945 Constitution through executive action. Philosophically, Pancasila, as Indonesia’s foundational ideology, holds a supra-constitutional status and should serve as a benchmark for amendment review. Sociologically, the absence of review mechanisms exposes constitutional amendments to political manipulation, such as attempts to extend presidential term limits. This study advocates for an a posteriori judicial review model, granting the Constitutional Court the authority to assess amendments post-enactment. This model aligns with international practices and strengthens constitutional safeguards against politically motivated amendments. Implementing such a mechanism would uphold constitutional supremacy, democracy, and the rule of law in Indonesia.

Abstract

Abstract: Law No. 15 of 2019 provides an opportunity for a continuous process -which means an inter-period- in legislation making. Even though on the one hand it seems to solve the problem, but on the other hand, the conception of inter-period is still problematic in this concern. One of the occurring problems is the inappropriateness of the concept with the design of period of the legislation bodies as outlined by the constitution. This paper seeks to analyze how the design of the period of the legislation bodies in Indonesia is actually related to the concept of inter-period in legislation making. The study used juridical-normative method with descriptive-analytic techniques. This study revealed the three characteristics of the design of the period of the legislation bodies: fixed term, same period, and terminated-returned together. The analysis also disclosed that the legal political aspect in legislation making is periodic in nature, which does not match with the concept of inter-period legislation making.Abstrak: Undang-undang (UU) Nomor 15 Tahun 2019 memberikan peluang terjadinya proses pembentukan UU yang berkelanjutan dalam arti berlangsung antarperiode atau lintas periode masa jabatan. Kendati pada satu sisi tampak solutif, pada sisi yang lain konsepsi pembentukan UU lintas periode tersebut masih problematis. Salah satu di antara permasalahannya ialah konsep pembentukan UU lintas periode tersebut mungkin tidak cocok dengan desain masa jabatan lembaga pembentuk UU yang digariskan oleh konstitusi. Tulisan ini berusaha menganalisis bagaimanakah desain masa jabatan lembaga pembentuk UU di Indonesia berkaitan dengan ide pembentukan UU yang berkelanjutan dalam arti lintas periode. Metode penelitian yang digunakan ialah yuridis-normatif dengan teknik deskriptif-analitis. Studi ini menunjukkan bahwa desain masa jabatan pembentuk UU memiliki tiga karakter yakni fixed term, sama lamanya, serta diakhiri dan diawali kembali secara bersama-sama. Dengan desain tersebut politik legislasi bersifat periodik sehingga pada dasarnya tidak cocok dengan konsepsi pembentukan UU lintas periode.

Abstract

This article aims to evaluate the constitutional design of Indonesia's regulatory review system, which is administered by two institutions with judicial power. It also looks into the various obstacles that will arise when judicial review of constitutional amendments is put into practice in Indonesia. Statutory approaches are used in this article. The outcome demonstrates that the Indonesian constitution contains unchangeable provisions and that there is experience with both formal and informal, unusual constitutional amendments. These factors require the establishment of a judicial review mechanism to supervise constitutional amendments carried out in accordance with custom and as stipulated in the constitution, as well as to maintain and preserve the basic identity and structure of the constitution in order to prevent pragmatic constitutional amendments from damaging, eliminating, or undermining it. Challenges that the Constitutional Court will confront in its role as a judicial implementing actor in reviewing constitutional amendments when they are implemented in Indonesia in the future include resistance that will arise from the People's Consultative Assembly, intervention, and intimidation by other branches of power towards the Constitutional Court, as well as defiance of the decisions of the Constitutional Court, especially regarding the unconstitutionality of constitutional amendments.
