Abstract

Constitutional Court Decision No. 112/PUU-XX/2022, which extended the term of office of the Head of the Corruption Eradication Commission (KPK) from four to five years, has sparked public debate. On the one hand, the longer term is viewed as a means to ensure the effectiveness and continuity of anti-corruption efforts. On the other hand, many parties argue that this change opens the door to political interference, potentially compromising the independence of the institution and raising concerns regarding the principle of checks and balances. This research aims to analyze the decision from the perspective of Sulṭah al-Qaḍā’iyyah, the concept of judicial authority in Islamic law, which is grounded in the principles of justice (al-‘adālah), deliberation (shūrā), and public interest (al-maṣlaḥah al-‘āmmah). The study employs a normative juridical approach and qualitative methodology based on a literature review. The findings suggest that Constitutional Court Decision No. 112/PUU-XX/2022 has exceeded the Court’s role as a negative legislator, as it is seen to have created a new legal norm without following the formal legislative process. Although the decision is justified by the argument that a five-year term is needed to strengthen the independence, effectiveness, and stability of KPK leadership, from the perspective of Islamic law, such action may be ethically and substantively flawed if it disregards public participation and leads to social unrest. Therefore, this decision should be reconsidered not only from a constitutional standpoint but also in light of the substantive values of justice within the framework of maqāṣid al-sharī‘ah.

Abstract

Abstract This study aims to analyse the market mechanism of certified food crop seeds, particularly rice seeds, in Aceh Besar Regency. It also evaluates the pricing system through the concept of tsaman within the framework of Islamic economics and based on the Regulation of the Minister of Agriculture of the Republic of Indonesia Number 12 of 2018 concerning the production, certification, and distribution of seeds. The background of this study is motivated by the phenomenon of certified seed prices that tend to be high, yet lack transparency and a clear pricing basis, resulting in injustice for farmers, especially those from low-income groups. This research employs a descriptive qualitative approach, utilizing primary data collected through in-depth interviews with representatives from Aceh UPTD BPSBTPHP, farmers, and agricultural input suppliers, as well as secondary data from relevant literature and regulatory documents. The findings reveal that the absence of explicit pricing provisions in MOA No. 12/2018, along with limited dissemination, results in non-transparent pricing that is difficult for farmers to access. From the perspective of tsaman, this condition does not reflect the principles of fairness, openness, and price appropriateness. Consequently, some farmers prefer to use uncertified seeds obtained through mutual exchange among fellow farmers. This study recommends a pricing policy that is transparent, adaptive to market conditions, and aligned with Sharia principles to support the development of a healthy, fair, and sustainable seed market system.

Abstract

Salah satu lembaga adat yang berwenang mendamaikan (memediasikan) sengketa/perselisihan adat ini yaitu, Majelis Adat Aceh sebagaimana yang tertuang dalam Pasal 4 huruf g Qanun Aceh Nomor 10 Tahun 2008 tetang Lembaga Adat. Permasalahan dalam artikel ini melihat kewenangan Majelis Adat Aceh sebagai lembaga daerah dalam menjalankan kewenangan dalam penyelesaian sengketa adat. Metode penelitian yang digunakan yakni jenis yuridis normatif, dengan pendekatan perundang-undangan, dan konseptual yang dikumpulkan melalui data primer berupa telaah kepustakaan. Hasil penelitian menunjukan bahwa, kewenangan Majelis Adat Aceh dalam penyelesaian sengketa/perselisihan dapat sangat membantu permasalahan adat yang ada dimasyarakat untuk diselesaiakan dengan dengan prinsip kekeluargaan secara mediasi, tidak ada norma khusus bagi Majelis Adat Aceh dalam melakukan mediasi, akan tetapi dapat dipahami dalam Pasal 4 huruf g Qanun Aceh Nomor 10 Tahun 2008 lembaga adat dapat mendamaikan sengketa adat yang mana Majelis Adat Aceh sendiri adalah lembaga adat yang diatur dalam Pasal 2 ayat (2) huruf a Qanun Aceh Nomor 10 Tahun 2008.

Abstract

Pengelolaan sampah di Kabupaten Pidie Jaya tertuang dalam Qanun Kabupaten Pidie Jaya Nomor 2 Tahun 2017 tentang pengelolaan sampah, dimana pada pasal 26 ayat (1) mengamanatkan kepada Pemerintah Kabupaten untuk memfasilitasi pengelola kawasan untuk menyediakan TPS/TPST di kawasan permukiman. Namun fakta di lapagan menunjukkan tidak adanya TPS/TPST di kawasan permukiman Kuta Simpang Kacamatan Meurah Dua Kabupaten Pidie Jaya. Tujuan dalam penelitian ini pertama, untuk mengetahui tanggung jawab hukum Pemerintah Kabupaten Pidie Jaya dalam pengelolaan sampah. Kedua, untuk mengetahui perspektif fiqh siyāsah tanfiẓiyyah terhadap Pemerintah Kabupaten Pidie Jaya atas pengelolaan sampah. Metode penelitian yang digunakan merupakan metode penelitian kualitatif bersumber dari data primer dan skunder dan menggunakan analisis kualitatif deskriptif. Adapun hasil penelitian ini, pertama tanggung jawab Pemerintah Kabupaten Pidie Jaya yang dijalankan oleh Dinas Lingkungan Hidup (DLH) belum maksimal dalam menjalankan tanggung jawab pelaksanaan pengelolaan sampah. Tetapi tidak dapat diberikan sanksi administrasi dikarenakan DLH tidak mempunyai mitra kerja sesuai dengan pasal 72 Qanun Kabupaten Pidie Jaya Nomor 2 Tahun 2017. Kedua berdasarkan perspektif fiqh siyāsah tanfiẓiyyah, pemerintahan kabupaten disebut imāmah dan DLH sebagai wazῑr tanfiẓ yang bertujuan untuk membantu pemerintah Kabupaten dalam mewujudkan kesejahteraan umum seperti kemaslahatan rakyat dan pemerintahan yang baik sesuai dengan konsep hukum Islam.

Abstract

Civil servant lecturers are required to fulfil the Tri Dharma of Higher Education, including community engagement, which may take the form of providing legal assistance. In practice, this obligation encounters a legal barrier because Article 3 paragraph (1)(c) and Article 20 paragraph (2) of Law Number 18 of 2003 on Advocates prohibit civil servants from practising as advocates. This restriction has triggered debate over whether law lecturers, as civil servants, may exercise their constitutional rights to participate in advocacy work. This study seeks to examine the Constitutional Court’s legal reasoning in Decision Number 150/PUU-XXII/2024, which authorises civil servant lecturers to act as advocates within certain limits, and to assess the relevance of this decision through the lens of siyasah qadhaiyyah. Employing a qualitative research design supported by a statute approach and analytical approach, the study analyses pertinent primary and secondary legal sources. The findings reveal that the Constitutional Court issued a conditionally unconstitutional ruling on the contested provisions of the Advocate Law, clarifying that civil servant lecturers may undertake advocacy activities solely for pro bono services through university legal aid institutions. This ruling affirms the protection of constitutional rights guaranteed in Articles 28C and 28D of the 1945 Constitution and resonates with principles of substantive justice in siyasah qadhaiyyah, particularly the pursuit of the public good (maslahah ammah) through the involvement of legal scholars. The study concludes that constitutional justice and Islamic legal ethics can be synergised to balance individual rights with the professional responsibilities inherent to state officials.

Abstract

Trademark protection is an integral part of the intellectual property system that protects a product's reputation, economic value, and identity. According to Article 3 of Law Number 20 of 2016 concerning Trademarks and Geographical Indications, trademark protection is only granted to registered trademarks. However, in practice, trademark infringement has occurred, as in Supreme Court Decision Number 119 PK/Pdt.Sus-HKI/2017, between PT Gudang Garam as the owner of the well-known trademark "Gudang Garam" and the party using the trademark "Gudang Baru" on cigarette products. The method used was a normative legal approach, with a conceptual lens, examining case studies and literature as data collection techniques. The results of the survey show that PT Gudang Garam initially lost at the first level and in cassation because the judge considered the registration of the Gudang Baru trademark to be administratively valid. However, through a case review (PK), the Supreme Court found bad faith and similarity in essence, so that Gudang Garam ultimately won the case. This shows that the protection of well-known trademarks still faces challenges in terms of evidence in court. From the perspective of Haq al-Ibtikar, such actions constitute the unlawful taking of another person’s rights, which is prohibited under Sharia law, because trademarks are intellectual works with practical and economic value. It is recommended that trademark rights be protected preventively through official registration, market monitoring, and legal education for business actors, as well as strict law enforcement against trademark registrations made in bad faith.

Abstract

This study aims to analyse the performance appraisal system of religious instructors at the Ministry of Religious Affairs, Bener Meriah Regency, in relation to the realisation of performance allowances (tukin), viewed from the perspective of the ijārah ‘ala al-‘amal contract. The study was motivated by a tendency in performance assessment that previously emphasised administrative aspects, such as report completeness and attendance, rather than the effectiveness of guidance and the tangible impact of religious counselling in the community. This research employs a qualitative approach with a descriptive analytical method and an empirical juridical type of study. Primary data were obtained through interviews, while secondary data were derived from regulations, positive legal literature, and both classical and contemporary fiqh al-mu‘āmalah sources. The findings indicate that after the enactment of the Director General of Islamic Community Guidance Decree No. 794 of 2025, the performance assessment system shifted from an administrative orientation to a results-based model through the e-Kinerja. This shift encourages a more proportional evaluation that reflects actual work outcomes. Nevertheless, differences in assessment instruments among instructors persist due to social and geographical factors. Overall, the new system is more aligned with the principle of justice in the ijārah ‘ala al-‘amal contract, although further refinement is required to ensure that work benefits are measured fairly and contextually.
