Abstract

Pancasila as the state has to make sense of Pancasila as the basis for a set of governance. Aceh Qanun Laws and regulations are similar provincial regulations governing the administration of government and the Acehnese people. Aceh Qanun made based on laws and regulations that apply are compiled by the executive and legislature of Aceh. The position of Pancasila as the foundation of philosophy in Aceh Qanun is a legal norm in society aspired. Qanun can be used as the collective desire of the people of Aceh in carrying out day-to- day life, the Qanun expected through the implementation of the Acehnese people can feel the law is aspired for this. The implementation of Shari'a is a requirement of the Acehnese, and recognized by the State through Law No. 18 of 2001 on Special Autonomy and Law No. 11 Year 2006 on the Governing of Aceh. Applications of Shari’a in Aceh are in accordance with the first paragraph of the Pancasila as the practice of the precepts to five “justice for all Indonesian people" in this case of justice for the people of Aceh who want the implementation of Islamic Shari'ah in Aceh province.

Abstract

Negara merupakan tempat berkumpulnya orang-orang yang telah mengambil keputusan bersma untuk membentuk sebuah negara. Orang-orang yang tersebut boleh saja berasal dari suku yang sama, asal yang sama, agama yang sama dan warna kulit yang sama, atau bisa saja berasal dari suku yang berbeda, asal yang berbeda, agama yang berbeda, dan warna kulit yang berbeda. keragama merupakan keniscayaan yang harus dilakoni di Indonesia. sebagai neagra yang sangat besar, tentunya harus memilik filosofis bangsa yang sama. pancasila merupakan filosofis bangsa yang mampu menyatukan suku-suku yang berbeda, agama yang berbeda dan bahasa yang berbeda.

Abstract

Gampong adalah pemerintahan terendah dalam sistem pemerintahan di Indonesia. Beberapa tahun belakangan ini, gampong ataupun desa diberikan kewenangan yang besar dalam melakukan tatakelola pemerintahan desa terutama dalam mengelola keuangan gampong. Tuha peut diberikan kewenangan dalam melaksanakan fungsi pengawasan, terutama mengawasai kinerja pemerintahan gampong. Rumusan masalah pada penelitian ini dibatasi pada bagaimanakah peran tuha peut dalam melakukan pencegahan korupsi dana gampong? Penelitian ini termasuk penelitian kualitatif sebagai proses untuk memberikan pemahaman yang komplek yang terjadi pada interaksi manusia.

Abstract

Aceh is a unique area in Indonesia based on Law Number 11 of 2006 concerning the Government of Aceh. One of its features is the establishment of the Wali Nanggroe Institution which is the highest customary institution that aims to maintain peace in Aceh and participate in the world peace process. It is unique in the Indonesian constitutional system because its officers are former combatants of the Free Aceh Movement. This study would like to examine the opportunities and role of the Wali Nanggroe Institution in realizing peace domestically and globally. There are several opportunities for the Wali Nanggroe Institution in peace efforts in a conflicted country; among others, the Wali Nanggroe Institution can carry out the function of peace at the local, national and international levels. It can apply due to the legitimacy of laws and regulations, support from local political parties that dominate Aceh's parliament, and good relations with several foreign countries, such as the "Moro" separatist group from the Philippines had studied with Wali Nanggroe how the peace process from civil war can be realized

Abstract

Qanun Aceh Nomor 6 Tahun 2014 tentang Hukum Jinayah diantara mengatur tentang jarimahikhtilath yang terdapat dalam Pasal 25 (1) yang berbunyi “setiap orang yang dengan sengaja melakukan jarimah ikhtilath, diancam dengan ‘uqubat cambuk paling banyak 30 (tiga puluh) kali atau denda paling banyak 300 (tiga ratus) gram emas murni atau penjara paling lama 30 ( tiga puluh ) bulan. Sebagaimana dalam video-video Adi Bergek hampir sebahagian mengandung unsur ikhtilath. Tujuan penelitian ini untuk mengetahui bagaimana ikhtilath dalam video Adi Bergek dan tanggapan budayawan Aceh terhadap video klip yang memiliki unsur ikhtilath. Hasil penelitian menunjukan bahwa terpenuhi semua unsur-unsur ikhtilathyang terdapat dalam video klip Adi Bergek yaitu berpengang-pengangan tangan antara laki-laki dan perempuan, bersentuh-sentuhan dan bermesraan dengan yang bukan muhrimnya dengan kerelaan kedua belah pihak, selain mengandung unsur ikhtilath video klip Adi Bergek juga melanggar syariat Islam dan norma Agama yang sudah ada ketetapannya, hal ini dapat dilihat dari isi videonya yang menceritakan percintaan kisah remaja. Tidak hanya melanggar dari segi Agama, akan tetapi juga melanggar budaya yang sudah ada di Aceh, dikarenakan setiap penampilannya ataupun tutur lirik yang dinyanyikan juga tidak dapat memberikan manfaat kepada masyarakat luas yang mendengarkannya. Hal tersebut dapat membuat para generasi muda mencontohkan perbuatan-perbuatan terlarang yang melanggar syariat Islam, khususnya yang terdapat dalam Pasal 25 (1) Qanun Jinayah.

Abstract

Forests are an important element in the life dimensions of the Acehnese people. There are several important things about forests for the people of Aceh. Firstly, forests are the people of Aceh as a place to find protein needs for the family; secondly, as a place to fulfill family needs; and thirdly, as a place to find support for the household; therefore, forests in the past were protected. The people of Aceh knew that if the forest were not well protected, all household needs would be lost. Today, Aceh's forests are starting to lose their luxury because there are many interests in these forests, both those of business groups, ruling groups, and ordinary people. There is a contestation of every interest; for the sake of interests that seek profit, they may ignore other interests; in this case, it is ignoring the interests and sustainability of Aceh's forests. The question of this article is, how was the Livig law that existed in the Acehnese used to protect the forest. Therefore, it is interesting to study the experiences of the Acehnese people in protecting forests. The research uses qualitative research with a non-doctrinal approach. The research results show three interests of forests for the people of Aceh, namely forests as a place for hunting deer, a place for gardening, and a place for hunting fish in rivers. Acehnese people used cultural, legal, and religious approaches to protect forests. These three approaches are related to each other. Education regarding these three approaches is not through formal education but through social institutions that exist in society

Abstract

Dalam sejarah penyelenggaraan ketatanegeraan di Indonesia, provinsi Aceh merupakan salah satu provinsi yang pernah diberikan undang-undang keistimewaan sebanyak tiga kali. Tiga buah undang-undang keistimewaan tersebut mengatur mengenai keistimewaan di bidang penyelenggaraan adat di Aceh, hal ini kemudian diperkuat dengan adannya undang-undang tentang Pemerintahan Aceh pada tahun 2006. Tulisan ini akan menguraikan secara tekstual mengenai lembag-lembaga keistimewaan di Aceh yang memiliki kekuasaan teritorial di Aceh yang dibatasi pada beberapa lembaga saja yang dianggap memiliki keterkaitan dengan artikel ini. Penelitian ini menggunakan metode yuridis normatif, yang lebih mengutamakan sumber data pada aspek peraturan perundang-undangan. Penelitian ini menunjukan bahwasanya dari sekian banyak lembaga-lembaga keistimewaan di Aceh yang diatur dalam Undang-Undang Nomor 11 Tahun 2006 Tentang Pemerintahan Aceh didapatkan beberapa lembaga yang memiliki keterikatan dengan pemerintah pusat seperti Komisi Independen Pemilihan dan Panitian Pengawasan Pemilihan. Disisi lain lembaga-lembaga yang memiliki kekausaan teritorial di Aceh yang lebih dominan kepada mempertahakan nilai dan adat dari aspek kelembagaan lebih menampakkan kekhususan hanya terbatas pada teritorial di Aceh saja seperti Majelis Adat Aceh. demikian juga dengan Lembaga Wali Nanggroe meskipun Power yang dimiliki sangat berbasis teritorial akan tetapi dari aspek pengaruh politik masih menjadi pertimbangan ditingkat teritorial regional di Aceh.

Abstract

Elections are a democratic activity where every citizen has the right to directly elect leaders, people's representatives, and government officials for future leadership in a country. Apart from that, elections also become a stage for political contestation and become a democratic party in a democratic country. However, during the election, there were still many violations of the rules committed by several people. One of the rules that is often violated in organizing elections is during the campaign. This violation took the form of involvement of state officials in carrying out the campaign. In the 2024 Election, precisely during the campaign process, there are state officials who take part in the campaign, the state official who participates in the campaign is the Minister of Trade of the Republic of Indonesia. Basically, state officials are allowed to campaign but must fulfill several provisions, one of which is taking leave outside the state's responsibility and not being able to use state facilities other than accompanying the state official. However, the Minister of Trade of the Republic of Indonesia carried out a campaign outside the leave period that he had proposed. So his involvement in the campaign violated election administration. However, it is a shame that he did not receive strict sanctions from Bawaslu, as stipulated in the law, but the Minister of Trade of the Republic of Indonesia only received a strong warning from Bawaslu. This has also been prohibited in Siyasah dusturiyah, this is the same as not carrying out the mandate and abusing the authority that has been given.

Abstract

Regulation of the Minister of Home Affairs Number 86 of 2017 was ratified in 2017. The researcher is particularly interested in Article 178 of this regulation, which discusses the review of main ideas. The study examines whether the established rules are appropriate and whether their implementation is effective and efficient. The first issue the researcher seeks to investigate is the mechanism for implementing the Pokir (Main Thoughts) of the DPRD Banda Aceh City, as well as the effectiveness of these rules in promoting regional development in the Syiah Kuala District, Banda Aceh City. In writing this article, the author employs the Normative Juridical approach. This methodology in legal research focuses on analyzing applicable laws and regulations about the legal issues being studied, ultimately leading to problem resolution. The findings of this research indicate that the rules formulated by the legislative institution are appropriate, as they provide clear guidelines for implementing policies based on community aspirations. Furthermore, their implementation has been efficient and well-executed, demonstrating harmony between regulation and field application. This synergy between local governments and legislative institutions ensures that the main ideas generated genuinely contribute to planning that is more responsive to community needs. Thus, this regulation plays a significant role in fostering a more participatory and welfare-oriented regional development process.
