Abstract

Indonesia sebagai negara kepulauan yang memiliki garis pajang pantai sekitar 81.000 km memiliki potensi yang sangat besar untuk dikembangkan dan diberdayakan. Daerah sebagai wilayah yang berdasarkan Undang-undang memiliki kewenangan untuk mengelola sumber daya yang ada di wilayah masing-masing. Sesuai amanat dari Undang-undang Nomor 27 Tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-pulau Kecil, memberikan kepada daerah untuk dapat melakukan pengelolaan wilayah pesisir karena potensi yang sangat besar. Selain potensi sumber daya alam juga potensi sumber daya manusia yang terlibat langsung dalam pengelolaan sumber daya wilayah pesisir dan berperan sebagai subyek bukan sebagai obyek. Pemerintah Daerah juga perlu memperhatikan potensi konflik dan hukum adat yang berlaku di kalangan masyarakat pesisir tersbeut sebagai bentuk akomodasi dari respon sosial masyarakat atas peraturan daerah yang dibuat. Indonesia as an archipelagic country which has coastline about 81,000 km and has enormous potential to be developed and empowered.Locality as regions based on the Law have the authority to manage resources in their respective regions. In accordance with mandate of Law Number 27 Year 2007 concerning Management of Coastal Areas and Small Islands, giving regions to be able to carry out management of coastal areas because of its enormous potential. In addition to the natural resources potential, there is also the human resources potential  that directly involved in the coastal areas management and acting as subjects not as objects. Local governments also need to pay attention to the conflict potential and customary law that prevails in these coastal communities as accommodation from the community social response to the made local regulations.

Abstract

Kebijakan pemerintah kita dalam membuat aturan hukum yang didalamnya memasukkan sanksi pidana, seperti penyerobotan atas tanah yang diatur dalam KUHP masih terlalu sempit, khususnya pada penyerobotan. Lemahnya perlindungan hukum bagi pemilik tanah baik yang diakui berdasarkan hukum nasional berupa bukti surat-surat sampai pada seripikat hak atas tanah, termasuk pengakuan terhadap tanah adat. Sehingga konsep perbuatan pidana ?menduduki? atas lahan atau tanah yang kepemilikannya oleh masyarakat atau orang perseorangan belum diatur, karena penyerobotan difokuskan pada memasuki pekarangan. Istilah menduduki ini dianggap lebih tepat, karena tanah tersebut luas dan bukan dalam sekedar pekarangan sebagaimana dirumuskan dalam pasal 167 KUHP tentang penyerobotan tanah. Sedangkan Pasal 263, 264, 266,  KUHP yang berhubungan dengan pemalsuan surat-surat hak atas tanah, demikian juga pasal 385 KUHP yang mengandung unsur penggelapan  atas benda tak bergerak. Formulasi seharusnya mampu memberikan perlindungan hukum terhadap tanah bukan hanya dimiliki perorangan, badan hukum, melainkan juga tanah adat atau hak ulayat sepanjang hukumnya atau masyarakatnya masih memegang teguh hukum adat yang berlaku di lingkungannya. Tentunya hal ini didorongkan dari adanya amanat yang terdapat pada pasal 18 huruf B Undang-Undang  Dasar 1945.

Abstract

The traditional communal land is part of the rights of indigenous peoples are also the same is true with other rights. Only in the 1945 constitution has been no firmness to the Status of Communal Land as a value for the communal land, as well as a reflection of the existence of the Republic of Indonesia. In the plurality and diversity of society and their rights is a universal value and is considered a significant religious value, namely land. The existence of great importance that the State is dominating power in determining the allocation of land without making the communal land as one of the presence and diversity of law and its object in Indonesia. So that the rights of control by the State without clear boundaries.

Abstract

This study examines law enforcement against individuals who enter the Security Restricted Area without authorization at Sultan Aji Muhammad Sulaiman Sepinggan Airport in Balikpapan. The research identifies five contributing factors to the violations: the change in status of certain areas from Security Restricted Area to Controlled Area; substandard perimeter fencing conditions; inconsistent entry permit checks by aviation security personnel; low public awareness—with 79% of respondents unaware of the definition of a Security Restricted Area and 84% unaware of the penalties for violations; and the historical and economic background of fishermen who have inhabited the area since 1975. Although regulations stipulate penalties for violators, in practice law enforcement is has been well to verbal warnings without firm criminal sanctions. Barriers to enforcement include a lack of assertiveness from aviation security personnel who are still permissive, and insufficient public dissemination of regulations. The study recommends enhanced supervision, strengthened regulatory frameworks, and public education to improve the effectiveness of law enforcement in ensuring aviation security

Abstract

The Sovereignty Principle in the Plantations Law legalizes dynamics that disproportionately empower plantation companies while disenfranchising indigenous peoples. Under this principle, plantation permits are granted to companies, not indigenous communities, limiting the latter's involvement in mandatory deliberations set by the law. Consequently, indigenous peoples are coerced into relinquishing their lands in exchange for compensation, leading to the erosion of their collective land rights. This practice is at odds with the protections intended under Article 28D Paragraph (1) and Article 28H Paragraph (2) of the 1945 Constitution of Indonesia, which safeguard collective rights to property. The lack of political will to recognize and protect these rights suggests a troubling disregard for the existence and sovereignty of indigenous peoples.
