Abstract

This study is legal research aiming to find out the essence of Divine Principles in Indonesian Contract Law from the review of the Natural Law theory, the Sunt-Servanda theory, the Awareness and Legal Obedience Grundnorm theory, and Truth theory. This research reveals that the Divine Principle's essence is the most fundamental principle or guideline derived from God but exists in humans, aiming to find the truth and regulate the parties in making agreements. The application of the Divine Principle aims to find the truth and regulate the parties in the agreement's field.  Indonesian citizens could realize and practice the Precepts of Godhead in their agreement activities. In establishing the agreement, the parties are applying the teachings of their respective religions. This study reveals that the Divine principle needs to be incorporated into one of the upcoming National Agreement Laws principles, especially in the contract born because of the agreement. This study maintains that the divine principle can be applied comprehensively for Indonesian citizens who are parties to the agreement, not only limited to the Indonesian Muslim citizens.

Abstract

Regarding the transfer of agricultural land to housing, the reduction in the area of agricultural land in Blitar City is due to land conversion functions such as the construction of housing and other public facilities that are not in accordance with article 3 paragraph (1) letter g PERDA of the Blitar City Spatial Plan. In fact, regulations with reality that occur in the field are not in accordance with applicable regulations. The facts that occur on the ground are agricultural land being converted into housing that causing agricultural land to decrease. Based on this, the author made this study with the aim of analyzing the implementation of policies and accountability of the Blitar City Land Office for the conversion of agricultural land for housing in Blitar City.The research method used by the author is juridical empirical with a legal sociology approach. From the results of this study, it can be concluded that there is a lack of firmness in law enforcement towards the conversion of agricultural land which is still quite widely found in buildings in the form of housing and land converted to other non-agricultural land and not licensed. The results of the study show that there is a need for coordination between the City Government as a policy maker and agencies related to the conversion of agricultural land for housing, so that integrated supervision can be carried out so that changes in land use can be known earlier so that agricultural land does not decrease every year.

Abstract

 Masyarakat Pertuanan negeri leisela merupakan salah satu masyarakat adat di Kabupaten Buru, sebagian besar dari masyarakatnya memiliki mata pencaharian dalam bidang pertanian dan peternakan. Hal ini tentu saja menjadikan tanah sebagai hal yang begitu penting terhadap kelangsungan hidupnya khususnya dalam bidang ekonomi yang menyebabkan dalam hal pemanfaatannya sering mengalami benturan kepentingan antar pengguna tanah. Pada daerah petuanan tersebut sering terjadi sengketa tanah. Sengketa yang sering terjadi yakni sengketa perdata yang berkaitan dengan masalah-masalah tanah diantara masyarakat adat dalam hal pemilikan dan penguasaan tanah. Sengketa-sengketa tersebut berasal dari tanah-tanah hak ulayat seperti kasus sengketa hak ulayat yang terjadi antara masyarakat adat petuanan negeri leisela dengan pemerintah Kabupaten Buru dalam hal penyediaan tanah untuk penyelenggaraan program transmigrasi. Penelitian ini bertujuan untuk menganalisa terkait dengan penyebab sengketa hak atas tanah petuanan dalam hal penyediaan tanah untuk peyelenggaraan program transmigrasi dan penyelesaian sengketa hak atas tanah petuanan dalam hal penyediaan tanah untuk penyelenggaraan program transmigrasi di Desa Awilinan Kecamatan Air Buaya Kabupaten Buru. Metode penelitian ini adalah Yuridis Empiris dengan pendekatan yuridis antropologis. Berdasarkan hasil penelitian yang dilakukan, bahwa faktor-faktor yang menyebabkan timbulnya sengketa hak atas tanah petuanan dalam hal penyediaan tanah untuk penyelenggaraan program transmigrasi di desa awilinan kecamatan airbuaya adalah perbedaan kepentingan antara masyarakat adat petuanan negeri leisela dengan pemerintah daerah Kabupaten Buru. Dalam kasus ini, penyelesaian sengketa hak atas tanah petuanan dalam hal penyediaan tanah untuk  penyelenggaraan program transmigrasi di desa Awilinan kecamatan Air Buaya dilakukan melalui penyelesaian sengketa berdasarkan hukum adat setempat dengan cara kakawai.Kata-Kunci: Sengketa, hak atas tanah petuanan, transmigrasi The Leisela State Pertuanan Community is one of the indigenous peoples in Buru Regency, most of the people have a livelihood in agriculture and animal husbandry. This of course makes land a very important thing for its survival, especially in the economic field which causes conflicts of interest in terms of its use between land users. In the petuanan area, land disputes often occur. Disputes that often occur are civil disputes relating to land issues among indigenous peoples in terms of land ownership and control. These disputes originate from customary land rights, such as the case of customary rights disputes that occurred between the indigenous people of the land of Leisela and the government of Buru Regency in terms of providing land for the implementation of the transmigration program. This study aims to analyze the causes of disputes over petuanan land rights in terms of providing land for the implementation of the transmigration program and resolving disputes over petuanan land rights in terms of providing land for the implementation of the transmigration program in Awilinan Village, Air Buaya District, Buru Regency. This research method is Juridical Empirical with juridical anthropological approach. Based on the results of the research conducted, that the factors that cause disputes over petuanan land rights in terms of providing land for the implementation of the transmigration program in Awilinan village, Airbuaya sub-district are the differences in interests between the indigenous peoples of Petuanan Negeri Leisela and the local government of Buru Regency. In this case, the settlement of disputes over petuanan land rights in terms of providing land for  the implementation of the transmigration program in Awilinan village, Air Buaya sub-district, was carried out through dispute resolution based on local customary law by the kakawai method.Keywords: dispute, petuanan land rights, transmigration

Abstract

 Penulis akan membahas mengenai Perjanjian kerjasama antara Notaris dengan pengembang (developer) property. Perjanjian tersebut menimbulkan suatu hubungan hukum antara kedua belah pihak yakni pihak Notaris dengan pihak pengembang (developer) properti yang didalamya terdapat hak dan kewajiban masing-masing pihak. Secara mutatis mutandis notaris menjadi pihak dalam suatu perjanjian, hal ini tentunya bertentangan dengan Pasal 16 ayat (1) huruf a Undang-Undang Jabatan Notaris bahwa notaris dalam melaksanakan tugasnya sebgaai pejabat umum maupun sebagai profesi harus melaksanannya secara mandiri tanpa keberpihakan kepada salah satu pihak. Tujuan dari penelitian ini untuk menganalisis ratio legis perjanjian kerjasama antara notaris dengan pengembang yang bergerak di bidang properti yang dikualifikasi bermasalah terkait keberlakuan prinsip kemandirian notaris dan Akibat hukum apa yang timbul apabila terdapat perjanjian kerjasama antara notaris dengan pengembang yang bergerak di bidang properti yang dikualifikasikan bermasalah sebagaimana Pasal 16 ayat (1) huruf a Undang-Undang Jabatan Notaris. Jenis penelitian yang digunakan yaitu penelitian Yuridis Normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil dari Penelitian ini yaitu Ratio Legis dalam Perjanjian kerjasama antara notaris dan Pengembang (developer) Properti melanggar Pasal 16 ayat (1) huruf a Undang-Undang Jabatan Notaris tentang kemandirian serta ketidakberpihakan notaris menjalankan jabatannya, Sehingga berakibat terdegradasinya Akta Otentik yang dibuat Notaris menjadi Akta dibawah tangan sebagai konsekuensi atas dilanggarnya asas Proporsionalitas yang melekat pada jabatan Notaris. Bahwa Perjanjian Notaris dengan Developer Pengembang Properti hanya berlaku antara pihak-pihak yang membuatnya. Suatu perjanjian tidak dapat membawa rugi dan manfaat bagi pihak ketiga dengan tetap memperhatikan ketentuan 1365 KUHPerdata. Kesimpulan dari penelitian ini, Adanya perjanjian Kerjasama ini melanggar Pasal 16 ayat (1) huruf a UUJN, pelanggaran tersebut merupakan pelanggaran yang bersifat procedural yang berakibat terdegradasinya Akta Otentik menjadi Akta dibawah tangan.Kata Kunci: Ratio Legis, Perjanjian Kerjasama, Notaris, Pengembang Properti. The author discussed the cooperation agreement between a notary and a property developer (developer). The agreement creates a legal relationship between the two parties, namely the notary party and the property developer in which there are rights and obligations of each parties. Mutatis mutandis, a notary is a party to an agreement, of course, contrary to Article 16 paragraph (1) letter an of the Notary Position Law, that in carrying out his duties as a public official and as a profession, he must carry out his duties independently without taking sides with either party. The purpose of this study is to analyze the ratio legis for cooperation agreements between notaries and developers engaged in the qualifying property sector with problems related to the enforceability of the principle of notary independence and what legal consequences arise if there is a cooperation agreement between a notary and a developer engaged in the problematic qualifying property as Article 16 paragraph (1) letter a Law of Notary Position. The type of research used is juridical normative research with a statutory approach and a case approach. The results of this study are the Legis Ratio in the cooperation agreement between a notary and a property developer in violation of Article 16 paragraph (1) letter a of the Notary Position Law concerning the independence and impartiality of notaries in carrying out their positions, resulting in degradation of the Authentic Deed made by the Notary into the Deed. under the hands as a consequence of violating the principle of proportionality attached to the position of a notary public. That the Notary Agreement with Property Developer Developer is only valid between the parties who make it. An agreement cannot bring losses and benefits to a third party while still paying attention to the provisions of the 1365 Civil Code. This research concludes that the existence of this cooperation agreement violates Article 16 paragraph (1) letter a UUJN, this violation is a procedural violation that results in the degradation of the Authentic Deed into an Underhanded Deed.Keywords: Ratio Legis, Cooperation Agreement, Notary, Property Developer.

Abstract

 Sengketa pertanahan merupakan suatu permasalahan yang sudah banyak terjadi di berbagai daerah. Mengenai sengketa pertanahan, dapat dilihat dari adanya penyebab mendasar yakni ketimpangan kepemilikan dan penguasaan sumber-sumber agraria. Seperti halnya sengketa pertanahan antara PT. Sumber Sari Petung dengan masyarakat Kecamatan Ngancar, dimana tanah Hak Guna Usaha yang akan diperpanjang masa jangka waktu oleh PT. Sumber Sari Petung diduduki oleh masyarakat, sehingga masalah ini menjadi berlarut-larut diantara kedua belah pihak. PT. Sumber Sari Petung yang merasa dirugikan melakukan upaya untuk mencari kepastian hukum dan perlindungan hukum yakni dengan cara menggugat ke Pengadilan Tata Usaha Negara terkait dengan dikeluarkannya Surat Keputusan Kepala Badan Pertanahan Nasional Nomor 66/HGU/BPN/2000 yang berisi bahwa tanah Hak Guna Usaha yang diajukan permohonan perpanjangan oleh PT. Sumber Sari Petung dikurangi luas obyek tanahnya seluas 250 Ha dan selanjutnya akan di redistribusikan kepada masyarakat di Kecamatan Ngancar khususnya di desa Sugihwaras, desa Sempu dan desa Babadan sebagai obyek landreform. Metode penelitian dalam penelitian ini menggunakan penelitian hukum normatif dan menggunakan metode pendekatan kasus. Hasil dari penelitian ini dapat disimpulkan bahwa konsekuensi dari permohonan perpanjangan jangka waktu Hak Guna Usaha yakni dapat dikabulkan dan tidak dikabulkan, sehingga keputusan dari Pengadilan Tata Usaha Negara mengenai pembatalan Surat Keputusan Nomor: 66/HGU/BPN/2000 tentang Pemberian Hak Guna Usaha atas Tanah yang terletak di Kabupaten Kediri Propinsi Jawa Timur pada tanggal 18 Desember 2000 menjadi non executable.Kata Kunci: Sengketa HGU, Surat Keputusan BPN, PTUN. Land dispute is a problem that has occurred in many regions. Regarding land disputes, it can be seen from the fundamental cause, namely inequality in ownership and control of agrarian resources. Like the land dispute between PT. Sumber Sari Petung and the community of Ngancar District, where the land was land use rights that would be extended by PT. Sumber Sari Petung is occupied by the community, so that this problem becomed a protracted between the two parties. PT. Sumber sari Petung, who felt that he was aggrieved, made efforts to seek legal certainty and legal protection, namely by filing a lawsuit with the State Administrative Court regarding the issuance of the Decree of the Head of the National Land Agency Number 66/HGU/BPN/2000 which stated that the proposed land use rights were application for extension by PT. Sumber Sari Petung reduced the land object area of 250 hectares and then redistributed it to the community in Ngancar District, especially in Sugihwaras Village, Sempu Village and Babadan Village as landreform objects. The research method in this study uses normative legal research and uses a case approach. The results of this study can be concluded that the consequence of the application for extension of the term of land use rights is that it can be granted and not granted, so that the decision of the State Administrative Court regarding the cancellation of Decree Number: 66/HGU/BPN/2000 concerning the Granting of Business Use Rights over Land located in Kediri Regency, East Java Province on December 18, 2000 becomes non-executable.Keywords: Dispute the concession, Decree of the Head of the National Land Agency, State Administrative Court.

Abstract

Perlindungan Hukum bagi nasabah pialang perdagangan berjangka akan menjadifokus penelitian ini, terutama bila terjadi pelanggaran kontrak. Penulis akanmenganalisa peraturan perundang-undangan di bidang perdagangan berjangkayang terkandung dalam UU No.32 / 1997 sebagaimana telah diubah dengan UUNo.10 / 2011 tentang sejauh mana kedua undang-undang tersebut telahmemberikan mekanisme perlindungan hukum di bidang perdagangan masa depanketika pialang adalah melanggar perjanjian. Adanya mekanisme perlindunganhukum yang adil di bidang ini tentunya akan memberikan kepastian hukum bagiorang-orang yang terlibat dalam transaksi perdagangan berjangka.

Abstract

Setelah terbitnya Undang-Undang Nomor 20 Tahun 2011 tentang Rumah Susun, muncul permasalahan saat implementasi UU dimaksud yaitu perjanjian/akta apa yang dapat dipergunakan dalam hal syarat-syarat untuk melaksanakan PPJB sebagaimana di atur dalam Pasal 43 UU Rumah Susun belum terpenuhi. Pasal  43  UU Rumah  Susun  mengijinkan  pengembang   untuk   melakukan  penjualan  satuan    rumah  susun  yang  dibangunnya,  asalkan   memenuhi  persyaratan  -  persyaratan   yang  diatur  dalam  Pasal  43 UU ayat (2) tersebut. Selanjutnya, dengan menggunakan metode penelitian yuridis empiris, penulis mengkaji lebih lanjut apa yang menjadi rasio  legis pengaturan dari Pasal 43  UU Rumah Susun yang  wajib dipatuhi  oleh  pengembang. Kemudian dari hasil penelitian tersebut diketahui bahwa rasio legis pengaturan ketentuan tersebut adalah dalam rangka perlindungan konsumen.

Abstract

Undang-Undang No. 11 tertanggal 1 Juli 2016 tentang Pengampunan Pajak (Undang-Undang Pengampunan Pajak) mensyaratkan pengalihan harta tidak bergerak berupa tanah dan/atau bangunan milik Wajib Pajak selambat-lambatnya pada tanggal 31 Desember 2017, untuk memperoleh pembebasan Pajak Penghasilan. Namun, dalam faktanya tidak semua produk hukum Pejabat Pembuat Akta Tanah terkait pengalihan tanah dan bangunan tepat diaplikasikan untuk formalisasi transaksi wajib pajak dimaksud.  Melalui pendekatan yuridis normatif dengan metode penemuan hukum (rechtsvinding), Penulis menganalisis bentuk dokumen hukum Pejabat Pembuat Akta Tanah yang dapat mengakomodasi kebutuhan Wajib Pajak untuk memperoleh pembebasan pajak penghasilan berdasarkan Undang-Undang Pengampunan Pajak.

Abstract

To analyze and study the juridical implications of separate execution on the object/s of mortgage are the objectives to be achieved in this research and also to find out what are the obstacles faced by the Bank PT. Central Bank Asia Tbk. Kediri Branch in implementing para te execution with the object of the mortgage. The method used in this research is empirical legal research with interview data collection techniques, literature studies, and documentation. The results of the research with the method above show the obstacles that might occur is an obstacle that came from the debtor's side, for example, the existence of resistance from the debtor or third party and the emptying of the object of the liability right. The obstacle from the creditor's side is the difficulty in finding auction buyers for the object of the execution auction. The juridical implication of the execution parade with the object of collateral is to obtain creditor assurance regarding the repayment of his debt from the debtor, in addition to accelerating the repayment process of creditors when the debtor defaults by giving the creditor the right to sell the Collateral Right Object of his own power through a public auction.How to cite item: Rosari.
