Abstract

Abstrak Penelitian dalam rangka penulisan artikel, artikel ini membahas pokok-pokok masalah tersebut. Yang diuraikan ke dalam tiga sub masalah yaitu: pertama, bagaimana prosesi ritual Merau Assalamakang  yang dilakukan masyarakat Desa Palece Kecamatan Limboro Kabupaten Polewali Mandar, kedua, nilai-nilai apa yang terkandung dalam ritual merau assalamakang, Dan ketiga, bagaimana pandangan hukum Islam dan hukum Adat terhadap ritual merau assalamakang. Jenis penelitian ini bersifat kualitatif  dengan menggunakan pendekatan syar’i yang dimana pendekatan ini adalah pendekatan terhadap hukum Islam dan hukum Adat yang berhubungan dengan pendapat para ulama. Dalam mengumpulkan data melalui wawancara, penulis menggunakan studi kasus. Teknik yang digunakan adalah membaca literatur yang mempunyai ketertarikan dan relevansi dengan masalah pokok-pokok dan sub-sub masalah mengenai ritual ini. Dari hasil penelitian ini menunjukkan bahwa, ritual  Mandar seperti Merau Assalamakang oleh masyarakat Mandar memiliki maksud dan tujuan yaitu meminta keselamatan dan permohonan doa kesembuhan serta rasa syukur. Pelaksanaan ritual ini dapat berlangsung kapan saja tetapi waktu dan pelaksanaannya tetap memperhitungkan waktu dan hari yang dianggap baik.Kata Kunci: Ritual; Merau Assalamakeng; Hukum Islam; Hukum Adat.AbstractResearch in the context of thesis writing, this thesis discusses the main points of the problem. Described into three sub-problems, namely: first, how the Merau Assalamakang ritual procession is carried out by the people of Palece Village, Limboro Subdistrict, Polewali Mandar Regency, second, what values are contained in the merau assalamakang ritual, and third, how are the views of Islamic law and Customary law towards the ritual of merau assalamakang. This type of research is qualitative by using a shar'i approach where this approach is an approach to Islamic law and Customary law that relates to the opinions of the scholars. In collecting data through interviews, the authors use case studies. The technique used is reading literature that has an interest and relevance to the main issues and sub-problems regarding this ritual. From the results of this study indicate that, Mandar rituals such as Merau Assalamakang by the Mandar community have the intent and purpose of asking for safety and requests for healing prayers and gratitude. The implementation of this ritual can take place at any time but the time and implementation still take into account the time and day that is considered good.Keywords: Rituals; Merau Assalamakeng; Islamic Law; Customary Law.

Abstract

Pokok masalah penilitian ini adalah bagaimana perbandingan hukum islam dan hukum adat terhadap tradisi tolak bala mappande sasi yang ada di Lingkungan Tamo Kec. Banggae Timur Kab. Majene. Jenis penilitian tergolong kualitatif dengan pendekatan prime dan sekunder. Hasil penelitian ini menunjukkan bahwa: 1) Tradisi mappande sasi digelar setiah tahunnya dimana masyarakat nelayan tamo pulang dari perantauan setelah berbulan-bulan. Dalam Prosesnya, Prosesi acara mappande sasi diawali dengan pembacaan doa yang dipimpin oleh Imam untuk meminta keselamatan dan rezeki yang berlimpah. Pelaksanaan ritual pertama, yaitu mempersiapkan sesajen dan di bawah kelaut menggunakan perahu yg di persembahkan bagi mahluk goib; 2) Adapun beberapa pandangan dari masyarakat tamo memili pandangan yang berbeda beda dimana masyarakat berpendapat bahwa tradisi tersebut bertentangan dengan syariat islam namun, masih ada sebagian masyarakat mempercayai bahwa mereka tidak bisa meninggalkan kebiasan-kebiasaan yang ada sejak dari nenek moyang mereka; 3) Berdasarkan perbandingan hukum islam dan hukum adat bahwa tradisi tersebut sangat erat kaitannya dengan nenek moyang mereka.sedangkan dalalam hukum islam sebagai bentuk rasa syukur atas reski yang telah di berikan. Implikasi dari hasil penelitian ini adalah: 1. Agar masyarakat lingkungan Tamo Kecamatan Banggae Timur Kabupaten Majene yang masih menjaga nilai leluhur dan kesakralan dari tradisi mappande sasi agar kemudian dipertahankan atau dilestarikan yang positif dan berangsur-angsur mengganti yang negatif yang tidak menyimpang dari ajaran Islam 2. Tradisi Mappande Sasi yang dilaksanakan masyarakat daerah Tamo tidak patut dinilai musyrik karena sebagian besar masyarakat setempat berangsur-angsur telah mengubah tujuan dari tradisi tersebut sebagai bentuk rasa syukur atas rezeki yang telah diberikan oleh Allah Swt.

Abstract

The purpose of this study is to find out the views of the al-Shafi'i school and the Hanafi school about the phenomenon of fasakh nikah on the grounds that the husband is poor in the contemporary era. This research uses a qualitative type of research, with data collection using library research methods, the approach method used is normative by examining the Qur'an and Hadith as the basis of Islamic law, primary data sources in the form of the Qur'an and Hadith while secondary data sources in the form of books, journals, and other scientific papers. The results showed that marriage on the grounds of the husband in the contemporary era according to the views of the al-Shafi'i school and the Hanafi school is first according to the al-Shafi'i school saying that if the husband is in a state of incapacity or in a poor state that cannot provide for his wife in the form of food, clothing, and shelter then the wife can and is allowed to file for divorce through a judge (fasakh). Secondly, according to Hanafi, when a husband is unable to provide a living, the wife is not allowed to use the right of fasakh to sue her husband for divorce. A husband who is unable to provide for his wife may be due to two things, first: because he is reluctant or unwilling to take responsibility as a husband even though he is able, second: the condition of the husband is indeed in a poor state so that the husband has not been able to provide for his wife. Imam Hanafi reasoned that the wife was not allowed to claim her rights (fasakh) because the husband's obligation was only to provide according to his ability, the husband was still given the opportunity to earn a living so that he could return to meet his wife's bread.

Abstract

Kuli bangunan seringkali tetap bekerja meskipun pada bulan ramadan, namun yang menjadi masalah adalah apakah kuli bangunan mendapatkan dispensasi puasa (Rukhsah) pada bulan ramadan. Adapun yang menjadi masalah dalam penelitian ini adalah bagaimana hukum menjalankan puasa bagi kuli bangunan yang bekerja selama puasa Ramadan namun mendapatkan kesulitan selama menjalankan keduanya dalam Perpektif Ulama Madzhab. Jenis penelitian yang digunakan adalah library research atau kajian pustaka. Penelitian ini menggunakan metode penelitian kualitatif yang bersifat deskriptif, menggunakan dua sumber data yakni data primer dan data sekunder dimana data primer diambil dari kitab suci Al-Qur'an dan hadis. Dari hasil penelitian ini menunjukkan bahwa kuli bangunan yang dimaksud dalam penelitian ini harus tetap menajalankan ibada puasa Ramadan. Mengenai hukum rukhsah ibadah puasa Ramadan bagi kuli bangunan ada dua. Pertama, kuli bangunan tidak boleh (haram) mengambil rukhsah apabila tidak mendapatkan kesulitan selama melaksanakan pekerjaannya apabila tidak dirasakan masyaqqah (kesulitan). Kedua, para kuli bangunan dapat mengambil (mubah) rukhsah yang diberikan apabila ternyata selama melaksanakan pekerjaannya tiba pada waktu siang hari pekerja bangunan tidak dapat menahan lagi haus dan lapar yang bahkan saat itu sudah dikhawatirkan dapat mengancam jiwa dan kesehatannya apabila tidak membatalkan puasanya. Pelaksanaan rukhsah ini hanya dapat dilakukan jika memang telah sampai pada dikhawatirkannya jiwa dan keselamatan pekerja apabila masih melanjutkan puasa dalam bekerja bahkan hukumnya akan menjadi wajib dalam keadaan tertentu.

Abstract

Supaya manusia mampu melaksanakan tugas kekhalifahan di dunia, Allah membekali manusia dengan asma’(nama-nama) ilmu pengetahun. Pengetahuan itu sendiri tidak langsung terpatri tetapi melalui proses pengembaraan belajar, sehingga mencari ilmu menjadi kewjiban setiap pribadi muslim. Hanya saja ketika seseorang telah mengenal suatu ilmu pengetahuan kadang ia semakin merunduk, kadang biasa-biasa saja atau ia menjadi sombong karena merasa lebih tahu dari orang lain. Dalam kajian hadis ternyata ada aturan-aturan yang menjadi etika seorang Ilmuan ketika hendak menemukan ilmu dan sikapnya setelah memperoleh suatu ilmu pengetahuan. Hadis-hadis tersebut tentu akan dikritisi kualitasnya singkat yaitu cukup mengomentari para periwayat yang menjadi sumber rujukan hadis tersebut.

Abstract

This journal discusses Photographing People Without Permission in Street Photography Practices in Makassar City (Comparative Study of Positive Law and the School of Jurisprudence) which aims to provide deeper insight into controversial issues in street photography, explore the underlying ethical and legal values, and consider the social and cultural implications of this practice. The results of this research can also be useful for photographers, legal practitioners and the general public in respecting individual privacy and understanding the ethical boundaries of photographing people in public spaces. This type of research is qualitative research. This research was carried out in Makassar City. The population in this research are photographers, the general public, legal experts and jurisprudence experts. The sample in this research was 10 people using field research methods, where researchers collected data through interviews with street photographers, legal practitioners and Islamic jurisprudence scholars. The results of this research show that there are still many photographers who don't realize that permission is very important, they think that as long as it doesn't disturb or harm other people, it doesn't matter if they don't ask for permission, even though permission is important to create a sense of security for street photography practitioners because they can do it safely. utilize the results of their work as described in the provisions of article 12 paragraph (1) of Law of the Republic of Indonesia Number 28 of 2014 concerning Copyright) and the person who is the object of street photography feels safe because their privacy is protected. The implications of this research are to increase information and awareness for fellow photographers regarding the ethics of taking pictures of someone in the practice of street photography.

Abstract

The concept of qiyām al-lail in Islamic tradition is often narrowly interpreted as night prayers such as tahajjud or witir. However, numerous Prophetic traditions indicate that nighttime devotion includes not only prayer but also spiritually significant acts like remembrance (dhikr), Qur’anic recitation, consultation, education, and social service. This study aims to reinterpret the meaning of qiyām al-lail in the Prophet’s ḥadīths through a ma’ānī al-ḥadīth approach that emphasizes textual, intertextual, and contextual analysis. The method employed is qualitative library research with takhrīj al-ḥadīth and critical analysis of the chains of transmission (isnād) and content (matn) of ḥadīths found in the kutub al-tis’ah. The results show that the examined ḥadīths are authentic, free from ‘illah or shudhūdh, and provide a robust basis for reinterpretation. Through a meaning-based lens, qiyām al-lail encompasses not only ritual practices like prayer but also other nightly acts of devotion intended for seeking nearness to Allah. This reinterpretation affirms that spiritual excellence at night can manifest in various forms of contextualized religious and social engagement. Thus, this study expands the understanding of nighttime worship and brings the prophetic tradition closer to the lived realities of contemporary Muslims
