Abstract

The main objective of the research is to find out the risk of sexual harassment of persons with disabilities in Makassar City from the perspective of Islamic Law. This type of research is qualitative research (field research), with the research approach being theological-normative, sociological, and juridical. Primary data sources were eight subjects. The subjects were five women with disabilities, a psychologist, two social workers, and a religious figure. The secondary data is obtained through books, journal articles, government data, laws, fatwas, and research reports by utilizing libraries, online databases, and websites of related institutions. The data collection methods used are observation, interviews, documentation, and reference searches. Data processing and analysis techniques are carried out in three stages: data reduction, presentation/display, and conclusion drawing. The results of this study show, from an Islamic law perspective, that the protection of women with disabilities is supported by principles such as human dignity (al-Karāmah al-Insāniyah), equality (al-Musawah), justice (al-'Adalah), and freedom (al-Hurriyah). Islam underscores the importance of safeguarding and respecting the rights of all individuals, including those with disabilities. Islamic sanctions for sexual harassment can range from ta'zir (discretionary punishments) to had (prescribed punishments), depending on the severity of the offense. These Islamic principles align with human rights standards and provide a foundation for fostering a more equitable and secure environment for women with disabilities. The research implications include the development of an Islamic law-based protection system, raising social awareness, and establishing a support network to create a safe environment for women with disabilities.

Abstract

This article aims to overview some hadith[s] concerning justice and equality among wives in the practice of polygamy. This is literature-based research. In this study, documentation technique was employed in order to collect the data and used takhrij al-Hadith approach. Then, they were analysed by using descriptive analysis method. The result reveals that polygamy might be allowed in certain conditions, especially when a husband could be just and equal in a household among his wives. Practically, this requirement is somewhat challenging. Besides faith and obedience, justice and equality in a family can only be achieved if there is a high optimism, strong confidence, and good paradigm. Although some wives consider it as ‘ain al-sukhty (hatred paradigm), others percieve it as ‘ain al-ridha (pleased paradigm). Unfortunately, to overcome this problematic matter for polygamists in the recent day, justice and equality as the key points in a household should realistically be understood well as what the Prophet Muhammad Peace Be Upon Him (PBUH) had practiced. A positive atmosphere is likely possible to realize in a polygamous household.

Abstract

This study aims to analyze views on the use of the Sinovac vaccine based on the Fatwa of the Indonesian Ulema Council Number 2 of 2021 with the perspective approach of Maqasid Al-Syari'ah. Maqasid Al-Shari'ah is a conceptual framework in Islamic law that emphasizes the maintenance of fundamental goals, including religion, soul, reason, heredity, and property. In the context of the COVID-19 pandemic, vaccination has become a global debate, including the Sinovac vaccine. Through document analysis, the fatwa was analyzed in relation to the principles of Maqasid Al-Shari'ah in order to understand the extent to which the view supports the use of the Sinovac vaccine. In answering these problems and descriptive data analysis, the author uses a juridical normative approach. This research is classified as library research with a type of qualitative description research, where data is collected by quoting, adapting, and analyzing content (content analysis) of literature that is representative and has relevance to the problem discussed, then reviews and concludes it. Researchers found that vaccination has goals including stimulating the immune system, reducing the risk of transmission, reducing the severe impact of the virus and achieving herd immunity. In determining the halality of the COVID-19 vaccine, using the opinions of scholars who emphasize that treatment for illness and guarding against outbreaks is mandatory. Then use the concept of istihalah. And finally, the conclusion of jurisprudence related to vaccines is based on general rules of jurisprudence decision-making by authorities and experts in their fields. Maqasid al-Sharia against MUI fatwa number 2 of 2021, is the implementation of preserving the soul (hifz al-nafs). Vaccination efforts are part of achieving benefits by rejecting harm. Maqasid al-Sharia in this case is a special purpose where the desired ways of shari' protect the soul / self (Hifz al-nafs) from contracting covid-19. The fatwa also places emphasis on health care, life protection, and public benefit. Despite questions about the efficacy and halality of vaccines, the fatwa provides a foothold that in emergency situations, safeguarding public health and safety is a key principle. This research provides insight into how the interpretation of Maqasid Al-Shari'ah in fatwas can help formulate guidelines in dealing with contemporary issues such as the use of vaccines in a public health context

Abstract

The concept of qiyām al-lail in Islamic tradition is often narrowly interpreted as night prayers such as tahajjud or witir. However, numerous Prophetic traditions indicate that nighttime devotion includes not only prayer but also spiritually significant acts like remembrance (dhikr), Qur’anic recitation, consultation, education, and social service. This study aims to reinterpret the meaning of qiyām al-lail in the Prophet’s ḥadīths through a ma’ānī al-ḥadīth approach that emphasizes textual, intertextual, and contextual analysis. The method employed is qualitative library research with takhrīj al-ḥadīth and critical analysis of the chains of transmission (isnād) and content (matn) of ḥadīths found in the kutub al-tis’ah. The results show that the examined ḥadīths are authentic, free from ‘illah or shudhūdh, and provide a robust basis for reinterpretation. Through a meaning-based lens, qiyām al-lail encompasses not only ritual practices like prayer but also other nightly acts of devotion intended for seeking nearness to Allah. This reinterpretation affirms that spiritual excellence at night can manifest in various forms of contextualized religious and social engagement. Thus, this study expands the understanding of nighttime worship and brings the prophetic tradition closer to the lived realities of contemporary Muslims
