Abstract

Shariah banking operations have ignored the absurdity of applying the principles in the contract . In practice there is also a discrepancy between its practice and Islamic law. Shariah banking provides technical funding that is  considered only relatively easier  to  implement. At PT. Bank  Muamalat Indonesia  Tbk. Branch  Office of  Padang, for  multi-service  financing used contract ijarah. While  in  the  financing is required package services  and re- planting goods.  The focus of these studied research is implementation mul- tijasa ijarah financing for replanting of   oil   palm   plantations at   PT . Bank Muamalat Indonesia Tbk. Padang Branch Office has been according accord- ingly Fatwa of Sharia National Council . The purpose of this study is to analyze and disclose the review Fatwa of Sharia National Council on the implemen- tation  of multijasa ijarah financing for replanting of  oil  palm  plantations in PT. Bank Muamalat Indonesia Tbk. Branch Office of Padang. This research is in the form of qualitative deskriptif. The results of this study show that im- plementation of multijasa ijarah financing at PT. Bank Muamalat Indonesia Tbk. The Branch Offices of Padang for replanting the oil palm plantations as a whole have not been in accordance with the Fatwa of Sharia National Council. As for things that are not in accordance with the Fatwa of Sharia Na- tional Council is the writing of ujrah.  Ujrah at PT. Bank Muamalat Indonesia Tbk. Branch Office of Padang is still written in the percentage of 14% of year, although it is from the agreement between both parties, but in the Fatwa of Sharia National Council  Board fatwa on multijasa ujrah financing not in per- centage form but in nominal form.

Abstract

The Investment Gallery of the Indonesia Stock Exchange (IDX) serves as a means of introducing the Capital Market to the academic world. The IDX is a collaboration between universities and securities companies, aiming to introduce the Capital Market from both theoretical and practical perspectives. A common social phenomenon is where individuals are influenced to make decisions because others in their environment are doing so. This phenomenon frequently occurs in the investment world, where investors follow the actions of other investors despite having limited knowledge and information. The lack of interest in investing is due to two factors, namely knowledge and motivation to invest. This research is quantitative, utilizing a quantitative approach which is a method to test specific theories and can be conducted by examining the relationships between variables. The data collection techniques used include observation, questionnaires, and documentation. The sample size used in this study is 91 respondents. The data analysis techniques used are validity tests, reliability tests, classical assumption tests, and hypothesis testing. Firstly, the results of this study indicate that partially, the investment knowledge variable, with a significance level of 0.020 < 0.05 and a t-value of 2.371, compared to the t-table value of 1.661, shows that t-value 2.371 > t-table 1.661, has a positive and significant effect on the interest in investing among students of the Faculty of Sharia and Islamic Economics at the Indonesia Stock Exchange. Secondly, the motivation variable shows that partially, the motivation variable, with a significance level of 0.000 < 0.05 and a t-value of 6.028, compared to the t-table value of 1.661, shows that t-value 6.028 > t-table 1.661, has a positive and significant effect on the interest in investing among students of the Faculty of Sharia and Islamic Economics at the Indonesia Stock Exchange. Thirdly, simultaneously, the investment knowledge and motivation variables have a positive and significant effect with a significance level of 0.000 < 0.05 and an F-value of 96.812 > F-table 3.10. Therefore, it can be concluded that the investment knowledge and motivation variables have a positive and significant effect on students' interest in investing in the Indonesia Stock Exchange by 68.0%, while the remaining 32.0% is influenced by other variables not examined in this study.

Abstract

This research project was conducted to investigate the mathematical aspects, specifically focusing on two-dimensional geometry concepts found in the architectural design of the Tuatunu Grand Masjid, which aimed to integrate these research findings into the mathematics education curriculum. Utilizing a descriptive qualitative methodology from an ethnographic standpoint, information was collected through interviews with two takmir (masjid administrators), as well as through direct observation and documentation. The primary data collection method was direct interaction with participants, which could benefit from further explanation to clarify the specific types of interactions conducted. The analysis process followed Spradley"™s framework, encompassing domain analysis, taxonomy, componential analysis, and identification of cultural themes. The study"™s outcomes highlighted the presence of a variety of geometric shapes within the Tuatunu Grand Masjid, including triangles, quadrilaterals, pentagons, polygons, and circles. These findings suggest that the masjid can serve as a valuable resource for developing educational materials, including worksheets and textbooks, that are grounded in ethnomathematics. By incorporating the architectural features of the masjid into mathematics education, educators can offer students a tangible and practical context for learning two-dimensional geometry, enhancing their understanding and engagement with the subject matter.

Abstract

Penelitian ini bertujuan untuk meninjau pandanngan hukum Islam terhadap pengambilan keuntungan dalam transaki jual beli. Jenis penelitian ini adalah penelitian kualitatif dengan studi kepustakaan. Pengolahan data dilakukan dengan analisis deskriptif. Adapun hasil penelitian ini memberikan pandangan bahwasanya transaksi jual beli dalam Islam hukumnya diperbolehkan dilaksanakan selagi tidak ada dalil yang melarangnya. Di mana dalam transaksi jual beli ini juga diperbolehkan mengambil keuntungan atau laba, hal ini sejalan dengan penjelasan dalam al – Qur’an bahwasanya Allah SWT. telah menghalalkan jual beli dan melarang riba. Berdasarkan tinjaun hukum Islam berkenaan dengan pengambilan keuntungan dari transakis jual beli tidak ada nash al – Qur’an, hadis nabi, maupun ijma’ para ulama yang melarangnya. Adapun pendapat ulama tentang batasan pengambilan keuntungan ini terdapat perbedaan pendapat ulama. Menurut salah satu ulama (Yusuf Qardhawi) memberikan pendapat apabila keuntungan yang diperoleh terhindar dari sebab – sebab keharaman dan kezaliman maka penjual diperbolehkan mengambil 100% dari keuntungan yang diperoleh atau bahkan lebih. Hal ini dikarenakan tidak ada dalil yang menetapkan besaran keuntungan yang dapat diperoleh dari hasil transaksi jual beli.

Abstract

Pemilihan perangkat desa untuk posisi kepala dusun di Desa Aursati tahun 2022 telah menimbulkan konflik berkepanjangan antara pihak pemerintah desa dengan calon kepala dusun yang memperoleh nilai tertinggi. Tujuan tulisan ini untuk mengetahui cara penyelesaian konflik yang timbul dari hasil seleksi perangkat desa untuk jabatan kepala dusun di Desa Aursati Kecamatan Tambang. Metode penelitian yang digunakan adalah kualitatif deskriptif dengan pendekatan statue approach dan conceptual approach. Hasilnya: Pertama, dalam proses seleksi calon perangkat desa untuk kepala dusun di Desa Aursati telah menimbulkan konflik. Konflik ini muncul ketika Kepala Desa Aursati mengeluarkan SK dan menetapkan serta melantik kepala dusun yang nilainya lebih rendah. Hal ini mengakibatkan gugurnya calon kepala dusun yang memperoleh nilai tertinggi dari hasil tes dan seleksi. Peserta yang memperoleh nilai tertinggi merasa dirugikan karena haknya dirampas dengan alasan yang subjektif dan tidak dapat dibuktikan. Sehingga perkara ini dibawa ke jalur hukum dengan membuat pengaduan ke PTUN Pekanbaru. Kedua, pengangkatan dan pemberhentian perangkat desa sebenarnya telah diatur dalam Peraturan Daerah Kabupaten Kampar Nomor 12 Tahun 2017, akan tetapi masih memiliki kekurangan dan kelemahan karena di dalamnya belum dijelaskan tentang penyelesaian konflik yang muncul dari hasil pemilihan perangkat desa untuk jabatan kepala dusun.

Abstract

This research seeks to analyze the significance of brand protection for Micro, Small, and Medium Enterprises (MSMEs) in encouraging economic growth in Indonesia. Through a normative juridical approach, this research identifies brand protection as the key to strengthening the position of MSMEs in a competitive market. By providing adequate brand protection, MSMEs can build reputation, increase competitiveness, and expand access to markets and financial resources. However, challenges such as a lack of understanding about brand protection, the complexity of the registration process, and high costs need to be overcome through educational approaches, process simplification, and incentives for MSMEs. Thus, brand protection will not only provide direct benefits for MSMEs but will also contribute to inclusive and sustainable economic growth in Indonesia.
