Abstract

ABSTRAK Adanya kesamaan kewenangan atas sanksi yang diberikaan atas pelanggaran kode etik, dimana dalam Perubahan Kode Etik Notaris Kongres Luar Biasa Ikatan Notaris Indonesia Banten tahun 2015, Dewan Kehormatan Pusat berwenang untuk memberikan rekomendasi disertai usulan pemecatan sebagai Notaris kepada Menteri Hukum dan Hak Asasi Manusia Republik Indonesia. Pengusulan pemecatan yang sama juga dinyatakan dalam Undang-Undang Jabatan Notaris yang menyatakan bahwa Majelis Pengawas Pusat dapat mengusulkan pemberian sanksi berupa pemberhentian tidak hormat kepada Menteri Hukum dan Hak Asasi Manusia Republik Indonesia. Tesis ini membahas mengenai mekanisme pelaksanaan pengawasan dan pembinaan Notaris dan pemberian sanksi atas pelanggaran kode etik oleh Dewan Kehormatan Notaris dan Majelis Pengawas Notaris, dan sinergitas kedua lembaga tersebut dalam pemberian sanksi atas pelanggaran kode etik berkaitan dengan pengusulan pemecatan atau pemberhentian dengan tidak hormat sebagai Notaris kepada Menteri Hukum dan Hak Asasi Manusia.Penelitian ini merupakan penelitian yuridis normatif. Data yang digunakan untuk menjawab permasalahan dalam penelitian ini adalah data sekunder. Untuk memperoleh data sekunder, maka digunakan penelitian kepustakaan (library research), yang kemudian dilakukan wawancara dengan beberapa informan. Teori yang digunakan untuk penelitian ini adalah teori sistem hukum dan teori kewenangan.Hasil penelitian memberikan kesimpulan, sinergitas Dewan Kehormatan Notaris dan Majelis Pengawas Notaris hanya terlihat dalam hal pengawasan dan pembinaan, tetapi tidak dalam hal pemberian sanksi. Untuk itulah Dewan Kehormatan Notaris diharapkan dapat memeriksa terlebih dahulu pelanggaran kode etik, yang kemudian putusan Majelis Pengawas Notaris berisi melanggar kode etik berdasarkan Undang-Undang Jabatan Notaris, tetapi juga kode etik berdasarkan Kode Etik Notaris.Saran-saran yang dapat diberikan adalah dibuatnya suatu peraturan menteri yang mengatur mengenai pelaksanaan dari kedua kewenangan yang dimiliki oleh Dewan Kehormatan Notaris dan Majelis Pengawas Notaris, meningkatkan kerjasama dan koordinasi dalam hal pengawasan, pembinaan dan pemberian sanksi atas pelanggaran kode etik dan Majelis Pengawas Notaris dapat mempertimbangkan keikutsertaan Dewan Kehormatan Notaris dalam memeriksa pelanggaran kode etik yang diterima. Agar putusan yang diberikan tidak hanya melanggar kode etik berdasarkan Undang-Undang Jabatan Notaris, tetapi juga kode etik berdasarkan Kode Etik Notaris.

Abstract

Permasalahan tanah terlantar di indonesia masih krusial. Surat Keputusan Badan Pertanahan Nasional (BPN) dinilai tidak sesuai dengan prinsip pemerintahan yang baik. Penelitian ini mengkaji permasalahan status tanah terlantar di Pengadilan Tata Usaha Negara (PTUN), pembatalan keputusan BPN terkait tanah terlantar, dan perlindungan hukum pemegang hak atas tanah yang salah ditetapkan sebagai tanah terlantar. Penelitian ini menggunakan metode hukum normatif dengan analisis deskriptif dan data sekunder. Hasil penelitian menunjukkan bahwa PTUN membatalkan keputusan bpn karena kekeliruan dan ketidaksesuaian yang ditetapkan oleh Peraturan Perundang-Undangan, serta tanpa mempertimbangkan adanya lahan yang merupakan tanah High Conservation Value. Perlindungan hukum dapat bersifat preventif dan represif. Saran penelitian perlu adanya pengaturan status quo terkait penertiban tanah terlantar di PTUN, pengaturan terkait tanah High Conservation Value, dan keterlibatan instansi lain serta ahli dalam proses review keputusan tentang penetapan tanah terlantar.

Abstract

Phytoplankton are organisms that live floating in water. Its ability to move is limited, so the organism is always carried away. The waters of mangrove forests in Tapanuli Tengah Regency are directly adjacent to the shoreline, where phytoplankton always follow the current. At high tide, phytoplankton are carried by currents to mangrove forests; at low tide, phytoplankton can be carried by currents to free ocean waters. This study aims to determine the type of phytoplankton, phytoplankton abundance, and the level of phytoplankton diversity in the Mangrove Forest Waters of Aek Horsik Village, Tapanuli Tengah Regency. This research will be conducted from May to June 2023. Phytoplankton samples were taken using the purposive sampling method, and the research station was divided into 3. Station 1 is upstream of the mangrove forest, station 2 is in the middle of the mangrove forest, and station 3 is downstream. The results of this study showed that phytoplankton found in the waters of the Mangrove Forest, Aek Horsik Village, Tapanuli Tengah Regency consisted of 5 classes totaling 15 species, namely: Class Cyanophyceae (Synedra sp), Class Euglenophyceae (Euglena viridis sp, E.protista, and Euglena sp), Class Chlorophyceae (Ankistrodesmus sp, Scenedesmus sp, Tetraedron caudatum, Closterium acutum), Class Baciliarophyceae (Navicula sp, Nitzchia sp, Tabellaria sp, Nitzchia sigma), and Class Zygnematophyceae (Cosmarium sp, Staurastrum sp, S. curvacum). The highest phytoplankton abundance was 6100 Ind/L. Phytoplankton diversity is in the medium category, with the highest value being 2.671

Abstract

Abstract: Based on article 13 number 1 of Law Number 40 of 2004 concerning the National Social Security System, namely "Employers are required to gradually register themselves and their employees as participants with the social security organizing body, in accordance with the social security program followed". However, the fact in the field is that notaries as employers are still negligent in their obligations to register their employees in the BPJS Ketenagakerjaan program, one of the social security programs created by the government to improve the welfare of workers, which means that notaries do not comply with Law Number 30 of 2014 concerning the Regulation of Notary Positions Article 4 Number 1. The results of this study indicate that the reason notaries do not register their workers is due to the lack of knowledge about social security and the factor of administrative sanctions that are not firm and the lack of supervision of protection for workers who have been registered or have not been registered. then also notaries who do not care about the welfare of their workers. The suggestions in this study are as follows: Notaries are expected to submit to and comply with the SJSN Law which states that notaries are employers, and based on the SJSN Law and the BPJS Law, employers are required to register their employees in the BPJS Employment program, secondly, the sanctions for notaries who have not fulfilled social security for their employees are still too light so that they do not have a deterrent effect, thirdly, it is expected that notaries and their employees are active and continue to synergize in implementing applicable laws and regulations for the sake of mutual progress and prosperity. Keyword: Social Security, Notary Employees, BPJS Employment Abstrak: Berdasarkan pasal 13 angka 1 Undang-Undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional yaitu “Pemberi kerja secara bertahap wajib mendaftarkan dirinya dan pekerjanya sebagai peserta kepada badan penyelenggara jaminan sosial, sesuai dengan program jaminan sosial yang diikuti”. Namun fakta dilapangan notaris sebagai pemberi kerja masih lalai akan kewajibannya untuk mendaftarkan pegawainya pada program BPJS Ketenagakerjaan salah satu program jaminan sosial yang dibuat pemerintah untuk mensejahterakan pekerja yang berarti notaris tidak patuh terhadap Undang-Undang Nomor 30 Tahun 2014 Tentang Peraturan Jabatan Notaris Pasal 4 Angka 1. Hasil penelitian ini menunjukan penyebab notaris tidak mendaftarkan pekerjanya karena minimnya pengetahuan tentang jaminan sosial serta faktor tidak tegasnya sanksi administratif dan kurangnya pengawasan terhadap perlindungan pada tenaga kerja yang sudah didaftarkan ataupun yang belum didaftarkan. kemudian juga notaris yang kurang memperdulikan kesejahteraan pekerjanya. Saran dalam penelitian ini adalah sebagai berikut Notaris diharapkan tunduk dan mematuhi UU SJSN yang menyatakan bahwa notaris merupakan pemberi kerja, dan berdasarkan UU SJSN dan UU BPJS pemberi kerja wajib mendaftarkan karyawannya pada program BPJS Ketenagakerjaan, kedua sanksi bagi notaris yang belum memenuhi jaminan sosial untuk pegawainya masih terlalu ringan sehingga tidak menimbulkan efek jera, ketiga Diharapkan notaris dan karyawannya aktif dan terus bersinergi dalam penerapan peraturan perundangan-undangan yang berlaku demi kemajuan dan kesejahteraan bersama. Kata kunci: Jaminan Sosial, Kesejahteraan, BPJS Ketenagakerjaan

Abstract

This research examines the role of notaries in providing legal counseling and legal consultation as a manifestation of the social responsibility of the legal profession. Using normative juridical research methods with descriptive analytical approaches that rely on secondary data and literature study techniques, this research finds that notaries have a strategic role in creating legal awareness in society through legal counseling that is collective, preventive, and educative, as well as legal consultation that is individual and curative. However, the research results show that there is normative ambiguity regarding notaries' authority in providing legal consultation, where formally notaries are only authorized to provide legal counseling in the context of deed preparation, but in practice they often provide legal consultation free of charge as a form of social responsibility. This research concludes that clearer and more definitive regulations are needed to provide legal certainty regarding the limits of notaries' authority in providing legal consultation, so as to strengthen the position of notaries as public servants in the field of law without violating professional ethics.Keywords: Notary, legal consultation, notarial deed.

Abstract

The amount of revenue and expenditure realization of village government per year, which is quite significant, and the ongoing efforts of certain individuals to misuse village finances indicate the need for an effective and efficient legal concept of village financial accountability in Indonesia. This study yields two conclusions based on the normative juridical method using legal principles, legal systematics, vertical and horizontal synchronization levels, concrete legal regulations, the principle of subsidiarity recognition, and existing legal accountability models. First, the principle of subsidiarity recognition in the form of facilitation, emancipation, and consolidation should serve as the basis for village financial accountability in Indonesia. Second, the ideal concept of legal accountability in village financial management, which can foster sustainable development in Indonesian villages, is achieved through establishing and enforcing laws governing strict liability, vicarious liability, secondary liability, and collective liability, both administratively and criminally. It is recommended that there be a revision of the Village Law, which regulates the rights and obligations of each stakeholder in the village, to prevent potential incentives, pressures, motives, rationalizations, and opportunities in village finances, personal and/or joint responsibilities of each stakeholder in case of financial misconduct in the village, the principle of ultimum remedium in the event of financial misconduct in the village, and the imposition of administrative sanctions in the form of interest at the monthly interest rate in cases of financial misconduct in the village.

Abstract

Pajak Pertambahan Nilai (PPN) merupakan komponen penting dalam struktur penerimaan negara Indonesia, namun efektivitasnya dalam merespons pertumbuhan ekonomi masih dipertanyakan. Konsep tax buoyancy digunakan untuk mengukur sejauh mana penerimaan PPN meningkat seiring dengan pertumbuhan Produk Domestik Bruto (PDB), sebagai indikator efisiensi dan ketahanan sistem perpajakan. Studi ini bertujuan untuk menganalisis tingkat tax buoyancy PPN di Indonesia dari perspektif hukum dan kebijakan fiskal, dengan menggunakan pendekatan doktrinal dan interdisipliner. Penelitian ini mengevaluasi kinerja historis PPN Indonesia, membandingkannya dengan negara lain seperti Singapura, Malaysia, India, dan negara-negara OECD, serta menelaah pengaruh kebijakan pembebasan pajak, struktur ekonomi, dan reformasi administrasi terhadap elastisitas penerimaan PPN. Ditemukan bahwa tax buoyancy PPN Indonesia cenderung berada di bawah 1, menunjukkan ketidakmampuan sistem PPN untuk menangkap pertumbuhan ekonomi secara proporsional. Kondisi ini diperparah oleh kelemahan struktural seperti dominasi sektor informal, lemahnya kepatuhan wajib pajak, dan kebijakan pembebasan yang sempit. Implikasi hukumnya menunjukkan perlunya pembaruan regulasi perpajakan untuk meningkatkan kepastian hukum, perluasan basis pajak, dan reformasi kebijakan fiskal agar sistem PPN menjadi lebih responsif, adil, dan berkelanjutan. Studi ini menawarkan kontribusi baru melalui integrasi analisis hukum dan ekonomi fiskal dalam menilai daya apung pajak serta menyarankan strategi reformasi berbasis bukti untuk memperkuat posisi PPN sebagai pilar utama dalam pembangunan fiskal Indonesia.

Abstract

Legal protection for landowners holding land title certificates is a fundamental aspect of Indonesia's land system, which is normatively guaranteed through Law concerning Basic Regulations and Government Regulation, The research method employed is normative juridical approach conducted through literature study to obtain secondary data. certificates function as strong evidence. However, in practice, legal uncertainty still exists due to various factors such as land disputes, overlapping certificates, and weak supervision systems in the land registration process. Analysis of Supreme Court Decision Number 309 PK/Pdt/2021 shows that the Panel of Judges reinforces legal protection for certificate holders who registered legitimately and in good faith by applying the principle of registration time priority, where the party who registers first has stronger rights. This decision also affirms the rejection of overlapping certificates containing legal defects to strengthen legal certainty in the land system.

Abstract

The case of the loss of minutes of a notary's deed who died in Labuhanbatu Regency has raised serious legal problems related to the accountability and legal protection of the parties. Based on normative legal research with a descriptive analytical approach through literature studies and interviews with three Notaries in Labuhanbatu Regency, it was concluded that the responsibility is divided between the notary's heirs who are obliged to report the loss to the MPD, make a report, and submit the remaining protocol, and the notary receiving the protocol who is fully responsible for storing and managing the protocol based on Article 65 of the UUJN. Legal protection for the parties can be obtained through the creation of a replacement deed (Article 57 of the UUJN), court decisions, compensation claims, and assistance from the MPD in reconstructing the deed while maintaining the rights of the parties to obtain complete information about the handling of the loss case.
